surrounding what was a legal non-disclosure agreement signed more than six years ago. but according to the media mob, while we're watching the crime of the century today, it was o.j. simpson and the white ford bronco all over again. it was john gotti finally being brought to justice. no man is above the law. they cheerfully exclaim in unison. now, of course, in less than twenty four hours, donald trump will be the first former president in history to be charged with a crime. but for what? allegations of a mislabeled document between two private citizens. one hundred and thirty thousand dollars. nondisclosure agreement, phony accusations of what a victimless infraction, a case that relies almost total. the testimony from a convicted admittedly liar, a felon by the name of michael cohn, a case that has never been tried before, using a new legal theory that is never applied to anyone else and a case that

looks to be well past a statute of limitations. now, the charges are so pathetically weak that the doj, the fec, bob mueller, the pariaman district attorney , all declined to bring a case. and former congressman, by the way, who voted to impeach donald trump. this is what he tweeted. we're going to indict a former president for essentially misdemeanor or falsification of business records. we are crossing the rubicon for that. that seems like effing weak sauce. anyway, make no mistake, what we are witnessing now, this is nothing but a blatant act of political persecution unfolding right before your eyes from a repoll left wing hack who had promised to take down donald trump on the campaign trail. now, as the former assistant us attorney for the southern district of new york and mccarthy pointed out, praag would have not brought these charges against any defendant not named donald trump. after all, bragge barely brings

charges against actual criminals, violent offenders,, robbers, more than half get off without any felony conviction. they get a free pass, an opportunity to terrorize more innocent new yorkers. crime keeps rising out of control. in recent days, there was a gas station stabbing in manhattan. a journalist jumped on the subway, a woman stabbed on the sidewalk and an off duty police officer beaten by a biker. these are all random high profile attacks, by the way, which happen every day, likely carried out by career criminals who will probably never see the inside of a prison, thanks to the policies of alvin bragg, who is too busy now going after donald trump. but again brags what watch it under under his watch. and this witch hunt against trump is not about keeping people in new york safe or secure. it's about keeping a campaign promise and appeasing his extreme left wing base and persecuting political opposition. donald trump and criminalizing

tonight since news of the indictment broke with over a million coming from first time donors. also, a report today that since the indictment, close to twenty thousand people have signed on to volunteer and help president trump and his 2020 four campaign. and that's not all. look at these brand new polls. look at trafalgar. that's robert haleys group. trump has gained 12 points, gone up 20% and the republican primary and is now well over 50%. a poll from yahoo! and yougov has him. 57%. matt torie's insider advantage also trump at 57%, 80% now believing that the government has been weaponized. now, trump is now running neck and neck with biden in a general election and beating outright kamala harris handily in a head to head matchup. bragg's insidious attempt to get donald trump might well catapult him right back to the white house. anyway. here with reaction is trump attorney joe tacopina. you know, my first question is , you know, considering, you

arrive. i assume others will be with the president at about 11:00 a.m. you'll be before a judge around 15 . we know that the president will get a mug shot. we know he will be fingerprinted. is he going to be perp walk? do we have any guarantee they won't do that? will be handcuffed? do we have any guarantee they won't do that any anything extraordinary that you expect tomorrow or is it all planned out? >> what's extraordinary is that tomorrow's actually happening. >> that's what's extraordinary. i just cannot believe on that point. i think we're on the eve of destruction. like, you know, it's just like surreal to me based on this charge, these allegations of a federal election committee and a federal election or rule that governs here. here's a state prosecutor, one federal the fec has turned this down. the federal prosecutors have turned down and went to looked at it has turned down, said there is no violation here. a state prosecutor is now going to bring a case based on a federal law violation that doesn't exist according to the federal authorities. it's surreal.

are infuriated and are now understanding that weaponizes of the justice system is a real thing. but, you know, attempting to gag a united states citizen who is a defendant, not a lawyer, not a litigant, but but a defendant in the case, you know, especially that's a first amendment violation, obviously, but has to be balanced against a right to a fair trial. >> but imagine putting a gag on donald trump when he's the front runner for the republican party, the presidential office . and imagine during the campaign he's told, i can't speak about the case. so when people ask him questions, he has to just say sorry, for a gag order. obviously, that's not going to happen. that would directly interfere with the election, as this prosecution has already done, that would further interfere with the election. there's no scenario where that's going to happen. i'm sure that i don't think that's even going to be requested. >> all right. let me let me ask this. i know the president said he doesn't believe he can get a fair trial. you've tried over one hundred cases in new york city over the course

of your career, very successfully in most instances. my question to you is , this is a city where democrat outnumber republicans nearly 10 to one . i mean, you've got a seat, a jury. the odds are the overwhelming number of potential jurors in this case are going to be registered democrats, democrats in this country. they seem a bubble in things like alka seltzer and water just at the very name donald trump on the face of donald trump. so i wonder i mean, you don't have to give away your strategy, but but i have doubts if he can get a fair trial here. i really do. and why not have a change of venue to make sure that it's in, you know, at least a 50 50 part of new york state. we're absolutely going to obviously consider all things we the legal team has been meeting and discussing and they'll be a host of motions are going to make concluding. i'm telling you right off the bat, a motion to dismiss based on selective prosecution ,prosecutorial misconduct.

there will be those other things considered like a venue change and other motions that wouldn't go right to get into. at this point. we first have to see this indictment. but, you know, look, at the end of the day, when if this gets to a jury and it really shouldn't get to a jury because this case should be dismissed on the law. but if it gets to a jury, you know, what i would do would would do with todd and susan would do is simply, look, you know, the jurors in the eyes and say this is you understand why you're not voting for political office. this is not a presidential campaign or a gubernatorial campaign. this is someone's life and liberty. and this is much more serious. and what side of the political spectrum you're on? this is someone's life in the brain, whether they're deemed a criminal for the life. and most people that that want to be able to look themselves in the mirror for the rest of their lives are going to follow the law and going to follow the facts if they follow the law. on the facts. in this case, if we get to a jury again, this should

be the quickest verdict in the history of the united states of america. >> so i look, we have to weigh all things and we do have to consider the bias against president trump in the city and we will weigh it. but but ultimately, people who are going to be sitting in judgment of him, if it gets that far , are going to really have to be so conscientious of their oath and their duty and the rule of law in this country, because if we just say it's donald trump, we don't to worry about it. like you said , there's a republican prosecutor in texas that's going to be gearing up for a democrat. now, and this is what we're going to use the justice system for, to to be a political tool in this country. and rule of law is dead. dead if that happens. john , you've said a number of times in this interview, if they get that far , are you not expecting it to get that far ? >> let me be very clear . the only reason it would not get that far is because the case would be dismissed on papers. okay, there zero zero chance where donald trump is pleading

they believe falls under the fec rules and regulations. the federal election committee's rules and regulations, and violates any of those laws. it does not by a long shot. and we've been with some terrific fec people. bradley smith and i have spoken and he's confirmed that. so it is i really just don't know where they think they're going to wind up here. if it was just to get the , you know, 15 minutes tomorrow to get him into a courtroom and whatnot, who knows? >> let me ask you a final question. considering we all know what bragg said . he ran a campaign to get donald trump one man, one company, the trump organization, one family, the trump family. >> do you believe that this is selective prosecution and prosecutorial abuse on his part? and is there any remedy for you on on that level? of course, that is why it is selective prosecution.

the judge issued a gag order. you will file an amicus brief and argue that we citizens of being denied the ability to hear the defendant, not only a defendant, professor, but he's also a presidential candidate. and they did this in the roger stone case. i think they might have done it in the manafort case. i don't fully remember. my question to you is , how do how does a judge get to take away the right of an american to speak out on their own behalf on a on a very public case like this? >> tragically, judges have done that. they've done it recently. i was glad to see joe be optimistic that they're not going to do it in this case. but if they did do it in this case, i would immediately put together some of the great first amendment lawyers in america as amicus because we would be the victims. >> there are two first amendment rights. the right of the speaker, but the right of the listener, according to justice thurgood marshall, is just as important. but i hope that won't happen because that would really mean

a body blow to the first amendment. and today you couldn't even count on the american civil liberties union to defend the first amendment on behalf of donald trump because they would lose all of their funding. the only disagreement i have with joe's great lawyer, i think he's too much of an optimist. i cannot imagine an elected judge in the borough of manhattan throwing out this case and having to go to his family and say, i'm the lawyer who freed donald trump or his friends or his business associates. all he has to do is remember what happened to me when i defended defended donald trump on the senate, lost all of my friends, clients, business associates and no judge is going to want to be, quote, dershowitz. so you're not going to have the opportunity to get a fair assessment of statute of limitations, change of venue. this is a fixed case. if it's tried in manhattan

the government has learned from this. >> but you've got a local prosecutor who now wants to put on trial the leading opponent of his bragg's political party . >> and i think in the end, this is going to backfire. tremendously. let me ask you, i want to look at this novel legal theory that they're using here had never been used before. would they take a state misdemeanor case where clearly the statute of limitations away over was, what, two years married to a federal election law whose statute limitations, i would argue, are also have passed, yet they put this together. this has never happened before, but they're doing this to him. now, keep in mind, this is a prosecutor that in 52% of felony cases reduces those felonies to misdemeanors. this is the only time he's taking a misdemeanor and trying to raise it to the level of a felony. that's why i'd like to see

the appellate court judges are elected. this is going to be a very hard case in which to get justice. look, the statute of limitations issue is so clear , they could have indicted him any time in the last six years. they say, no, he was out of the state. but when did the indictment they indicted him when he was out of the state in florida. what's the difference? the virtue of a statute limitations argument is that might be appealable right away, whereas these other arguments about selective prosecution, about whether or not the statute really covers this, you have to wait for a conviction to appeal, though. so there's some virtue in making change of venue, statute of limitations, arguments that are appealable. in terms of the basic case, there's no misdemeanor here. let me explain why this no misdemeanor. so there was a payment made. the payment was made to prevent information from coming out to his wife. and family and business associates about an alleged affair and bragging, saying once he paid the money to keep everything, he should

have listed it on his corporate form as hush money paid to a former porn star. never in the history of the world is anybody ever paid hush money and then put it on the public forum. >> it's always this guy's never in history. any disguise because legally nondisclosure agreement, you're not even allowed to talk about it publicly. >> but remember, this is the other aspect of it. the falsified business records is allegedly a fraud, according to , well, who is he defrauded his own business. so this is utter nonsense. and the predicate crime of the misdemeanor expired five years ago. i just don't see how you get there if you're all right. >> i got to leave here. i don't discuss this in this case. don't expect it's not going to happen. maybe when it gets to the supreme court, but not in the borough of manhattan. i love manhattan. i spend time in manhattan, but
