richard who will give his legal analysis but first we go live to laura ingle, fox senior correspondent who is live in front of the courthouse in lower manhattan, laura, good morning. >> good morning to you guys. we have tight security here. we have a line of people that have been queued up here they started yesterday afternoon just to be in line to get a space inside of the courthouse for this historic arraignment this morning a former president donald trump. now, mr. trump arriving at trump tower yesterday and waving at his supporters. you see the tape. he is expected to arrive at manhattan court sometime around 1:00 this afternoon. we learned last night that trump's arraignment not be televised. only photos will be permitted to appear this after the defense argued it will create a circus light atmosphere with security concerns inconsistent with

hornbrook did a good job setting the table for us. do you anticipate surprises today? >> well there's a lot of rumors there is only one felony. but very quick proceeding to read them of his rights, and people answering they are ready for trial and the defense will weigh what we call former indictment. so not every trial will be read. the judge will do 1-2-5 this and that. how do you plead? and then a plea of not guilty. it will be a circus. i don't think we seen anything like this since o.j. simpson. it will be a combination of that. >> ashley: when you say a circus, lay it out for us. what do you mean? >> on all sides, first of all alvin bragg is the wrong person to be bringing the spirit he ran on a platform to get trump and

bragged no pun intended, he bragged about the cases aimed at the attorney general's office they brought one case against trump, attorney general james. in that case, let off holes in it. a lot of the text by motions. the circus atmosphere, i blame president trump for some of it, although people have a right to protest from a first amendment right. i think it sets a lot of individuals up for fail because they will show up to peacefully protest. if a few people start, then you could have a few people arrested to show up to support the president or oppose the president. and swept up in a rest. but nypd i'm sure he's taken all precautions. >> todd: let's drill down on the bragg thing you mention,

shane who represented trump in the impeachment, the trump needs to file three motions: one motion to dismiss, obviously you do that every single case in law. is the first issue take. a motion to recuse the judge and then three, motion to disqualify alvin bragg because, like you mentioned, he ran getting trump appear that literally was his campaign platform purity would agree with that strategy? >> what is excellent. what will happen for the set of motion schedule and trial date probably because of high profile case. and bragg, they have so many grounds to attack him on legally insane it is prosecution and he's got dirty hands going into it. listen, chuck schumer said something interesting in 2017 when trump laughter cia and fbi. chuck schumer's warned him publicly seven ways to sunday to get you. this is kind of what they have been investigating trump

nonstop. if you like trump rethink his policies are good, you will pose this and second its purity if you are a supporter of bragg or you believe he is the most eviln in the world, then you will rejoice in his indictment. but what will happen is there will be no change of venue. one thing they mentioned, they will not allow that to happen. trump making all the statements he makes and say, "i can't get a fair trial there." he's adding to the chaos so that's not a good strategy. they will not release in new york state city, also municipality state police are not allowed to release a booking photo and less on purpose. so this photo will be released by trump or it will be released unlawfully by somebody who leaks and out. we have already heard a number of leaks have gone into the media.

border should be top priority for anyone running for president in 2024. cdp reported 1 million migrant encounters at the southern border. >> ashley: and out to a heartbreaking story out of georgia where a 13-year-old boy was in a coma for nearly three weeks back in january after school bullies forced him to smoke a fentanyl laced pen. the doctor say the young teens had a stroke and his mother says he will never be the same. her son, zach, thank you so much for being with us this morning to tell the story. linda, tell us what happen to your son. how did you find him? >> his sister is the one who found him passed out in the recliner. and she thought he was joking around at first because sometimes he will joke around with her. and she will try to wake him up and he won't wake up.

then she tickles him, then he will wake up. he will jump up and scare her. but this time he didn't. and she was in there to play a game and she told me, "he's not waking up." that is when i went in there and i tried to wake him up and i knew something was wrong. i called 911. the ambulance came in to the house to get him. and on the way when they were carrying him out, they dropped him twice going up the stairs. then when we got him in the ambulance, i rode up there with him. when they got him to the hospital, he flatlined. they had to bring him back. we couldn't figure out what happened to him or what was wrong with him. then the doctors started cutting his clothes off. that is when they found the vape inside of his underwear. >> ashley: it wasn't sure if it was fentanyl or something else until the doctor found it,

tested it and did blood work but how did they figure out it was fentanyl? >> they tested it and did blood work. >> ashley: doctors told you what they put him in a coma. he went into a coma. they said he may never come out of it, but he did. what were your feelings and what was going through your head when you got the news that he came out of the coma? >> when he came out of the coma, i was happy, crying at the same time and excited. it was like he was saying his first words again. >> ashley: what were his first words? >> his first words were, "i love you." and then he talked to this nurse and he told the nurse that she was a pretty girl. >> ashley: go on. >> after that, he started

talking, and he was talking at first. then he realized he was paralyzed on his left side. >> ashley: so let's talk about his recovery. linda, let's talk about his recovery. how is that going, how has that changed his everyday life for all of you? >> it has changed a lot. and he is starting to try to walk again. but he still has no movement in his left arm. they don't even think he will get the movement back in his left arm. his left arm is still paralyzed and he has to hold his arm up. but we are still going through therapy and we are hopeful in his arm start moving again. but it will take a lot of therapy. we still have a long road ahead of us. >> ashley: you said he was a straight-a student and obviously this is not something you

thought would happen to your son or family. what warning for other parents watching this right now? >> if your child comes to you and tells you they are being bullied, you need to take it seriously and do something about it. because this bowling has got to stop. i mean, it is going to far in athens ever being done about it. >> ashley: i have a question about that, you said apparently he got the vape at school. you send your kids to school thinking they are going to be safe. do you have any idea who these kids were and where they got it? >> we do know who the kids are and he told me some of the names, but he's trying to remember the rest of the kids were. and i just don't understand it. like i have talked to the school

all the information coming out right now, some things but not as much as like i said earlier with surveillance already gather, what should we be focusing on right now? what is most important? >> well, as we invest in infrastructure in the united states after having not done so for 30 years, we need to think about the infrastructure that supports not only our overall homeland defense, but how do we ensure that our grid doesn't go down? how do we ensure our intelligence doesn't go down? and not just these approaches but the digital things we depend on as a nation. those are also extremely vulnerable as we have seen them being a tech time and time again. if there is a war over taiwan, i think one of the things we will see is chinese attacking the homeland in various ways to go after the infrastructure. >> todd: tomorrow house speaker kevin mccarthy will

meet in california with the taiwanese president. your take on this meeting and do you think china will retaliate? >> oh, they will absolutely retaliate but with that being said, mccarthy needs to meet with the president of taiwan. to think china will do what china is going to do with regard to taiwan appear there is no way to influence them not to attack back. what we can influence is their decision in terms of what they think about the u.s. response to that will be peer that starts now. we can't wait until something happens. i think it is important that mccarthy -- with that being said, that will not dictate whether china invades peer they have already decided they want to do that. it is about when that time happens. >> todd: brigadier general robert spalding, we appreciate your time, thank you very much.
