>> it certainly is and certainly already is happening. now we have got tents of media, reporters and cameras and security extremely tight. just behind me in the last few hours. we have been here since 3:00 in the morning. we have seen another row of barricades put up behind me outside of this courthouse. and to my right there is a line of people who have been camped out since yesterday afternoon. at 8:00 a.m., the first several groups of people will get a ticket to be inside of the courtroom for this historic arraignment of donald j. trump. as you mentioned, we are just hours away and as ainsley mentioned mr. trump arriving at trump tower monday afternoon waving at his supporters. lots of police presence there. we are now expecting to see him arrive at the manhattan criminal court building sometime around 1:00 p.m. this afternoon ahead of his 2:15 arraignment. the court proceedings will not be televised and only still photos will be permitted.

this, after the defense argued it will create a circus like atmosphere at the arraignment, raise unique security concerns and is inconsistent with president trump's presumption of innocence. law enforcement, including the nypd and fbi working to make this process as smooth and safe as possible. the secret service, as we know, will accompany trump at all times and that includes at processing, fingerprinting and if a mugshot happens. he is not expected to be handcuffed. protesters and supporters of trump lining the streets outside of trump tower yesterday where the former president is right now after arriving it from mar-a-lago. more are expected here in manhattan. new york city mayor eric adams urging protesters yesterday to keep it peaceful today. >> new york city is always ready. while there may be some rebel rousers thinking about coming to our city tomorrow, a message is clear and simple. control yourselves. new york city is our home. not a playground for your

misplaced anger. >> now, as we have been reporting, the exact charges are still under seal. trump legal team is already planning to file a motion to dismiss the case. trump will first turn himself in to manhattan district attorney alvin bragg before reportedly facing the more than 30 criminals charges. one expected to be a felony. his attorney re ready to fight. listen. >> there will be a host of motions we will make including right off the bat a motion to dismiss based on selective prosecution. prosecutorial misconduct. there is zero, zero chance where donald trump is pleading to anything here. he commit nod crime. he committed no wrong. not a misdemeanor, not a felony. not a traffic ticket. there is nothing here. i still can't believe this is going to survive our vigorous motions to dismiss. >> and now we have learned that there will be, yet, another attorney involved in his defense. yesterday, we learned that attorney todd blanch, who is a former federal prosecutor and

considered a top white collar attorney will be part of the legal team. so, we are now just counting down the hours, waiting for that motorcade to arrive. >> ainsley: he successfully got paul manafort's case dismissed. many are wondering if that's why trump brought him on the team. >> steve: laura, is he not going to be put in a jail cell and no it handcuffs and no mugshot is there is a possibility that could change? because i read that the judge is going to go through pre-trial stuff first before he decides whether or not to do it or was that already decided by mr. bragg, the d.a.? >> you know, we have been hearing so much back and forth in the last few hours since overnight about the mugshot. about how these proceedings are going go. some of the timelines have changed but we did simply have to wait. we have to wait until everything unfolds and we will be here to watch it all. >> steve: all right. laura, thank you very much. great reporting through the night. >> ainsley: the reason for handcuffs they say is because if the defendant is a flight risk or a threat to the d.a. or

personnel inside the courtroom but neither applies here because the former president is protected at all times by the secret service. >> steve: is he surrounded by a posse. >> ainsley: correct. >> brian: the president right now has raised $8 million since the indictment has been announced. we don't have the details of the 34 counts. it's rumored to be 34 counts. but at the is expected to speak tonight and have almost a jubilant approach to it. >> ainsley: how many people at mar-a-lago. >> brian: i think they are expecting 500. very interesting, too. a motion to dismiss the judge. i'm sure that will be rejected. a motion to dismiss alvin bragg. make sure there is no gag order. that he was going to be interesting. i think there is -- if you say he can't speak about the case in a way, i think on some level his attorneys might be happy about that because they can control the narrative and just focus on what he needs to beat it as opposed to worry about what the president is going to put on put

on truth social or say on the stump. >> steve: joe tacapino says a gag order is not going to happen. that could be just wishful thinking. keep in mind the former president has already bad-mouthed the d.a. and the judge in the case. the judge can do whatever he wants. if there is a gag order it can keep the former president from talking about the case and actually talking about stuff like running for president. cnn across the street did a poll and 76% of americans say that politics did play some sort of a role in the indictment. but, here's what's interesting. while 76% say it was politically based or somehow, 60% of americans approve of the indictment. 62% of independents approve but only 21% of republicans. what's interesting is since the indictment was announced, trafalgar just did a poll and

donald trump's support rocketed up. now it went from 43 to 56%. ron desantis went down 10 points. and liz cheney is suddenly in third place. she was at 5%. now she is at 10%. >> ainsley: what poll is that that central garr. >> steve: travtrafalgar poll. 70% of americans are more likely to vote for donald trump in the primary because of this. >> ainsley: because they think it's politically motivated. the story that broke last night is michael isikoff. he was saying that he has a tip that trump will be placed under arrest today and informed that he has been charged with 34 felony counts. we were thinking one felony count. he is saying all 34 counts will be felonies for falsification of business records. >> steve: right. >> ainsley: the reason bumped up to class e felony lowest level

of felony in new york. >> steve: still a felony. >> ainsley: bragg says trump was attempting to conceal another underlying crime. a class e felony can result in prison terms of up to four years. >> brian: right. here's the crazy thing. how do you do a poll on what do you think about the indictment whether you don't know what's in the indictment and have you an opinion on it is bizarre. >> ainsley: we don't know what's in it. >> brian: fossa phiing criminal records is crazy. no plaintiff. no bank that said he screwed me. there is no building that's not built. nobody is complaining excepted for an attorney general and a district attorney that said i'm going to run on convicting donald trump on something. and they just want to poor over his records tax returns and fine him in a million dollars in a case he lost in civil court. they say criminal court always has precedence over civil court. they try him in civil court. get some information and reportedly about to enhance a

the streets in the first place. so i really believe that paul will bring in, you know, myself, the state attorney to the table to talk about how we address it and uncuff our police officers to do their job. at the same time provide mental health. because we know there is a crisis out there in all communities. we have to know how to address. paul does have a plan in bringing all of those folks together so we can start addressing the true problem here in chicago. >> ainsley: i didn't realize chicago a third of your population is latino community and vallas was endorsed by the illinois hispanic claim berl of commerce. he did win by 32.9% compared to brandon's 21.6. but i know in the polls, depending on which one you read they are neck and neck. thank you so much for coming on. i'm sorry about your loss. that's devastating. >> thank you so much. >> ainsley: everyone say prayers for those five children.

steve welcome back. more on top story. we are hours away from former president trump's arraignment here in new york as he is arrested this afternoon.

>> ainsley: it is the first time in america's history a former president faces criminal charges in a case that our next guest warns will bring down our justice system. >> brian: it would have been different if he had won the governor's race. former g.o.p. congressman lee zeldin joins us now. we know we are in unprecedented areas but around the country they don't understand the politics of new york. could you explain what's facing donald trump besides the politics behind the justice? >> this is all politics. alvin bragg ran and even pledged before taking the oath that he was going to be personally supervising this case. he did not know what the charges were that he was going to bring against donald trump. he didn't know what the facts were going to be that he was going to use but he was personally going to supervise this case. takes the oath, issues a day one memo where he says across the board that all different kinds of charges he was not going to allow his prosecutors to go after. all sorts of other offenses he

said across the board would be down graded to lesser offenses. so, now new yorkers experienced the first few months of alvin bragg's tenure and seeing crime in many metrics go up. individual cases like the jose alva case where this bodega workers gets attacked he has to defend himself. he has an open stab wound. alvin bragg throws him in rikers island and asks for hundreds of thousands of dollars in bail and the person who stabbed him getting charged with nothing. individual case after case is have new yorkers really upset that they have this prosecutor who seems to be more of a defense attorney than a district attorney, so not having a consistent law and order prosecutor here when you fast forward to the facts of this particular case makes a lot of people in doing that basic smell test realize that this is a political prosecution. >> ainsley: will we see the same treatment for democrats? because this happens all the time. when have you successful,

powerful people, they're accused of different things and sometimes they pay people off so that they don't talk about it. it's not illegal to do it. and they sign nondisclosure agreements. will we look into all the democrats that have done this as well? >> no. alvin bragg won't. and that's part of the problem. we're crossing into a new rubicon here where some republican district attorney somewhere in america could in theory be bringing charges against a democratic former president or vice president. so this is a really slippery slope. i'm more of a student of history and in other countries brian is more of a professor of history. in other countries you have the dictatorial powers trying to can manufacture charges to take out political opponents. this isn't something that we ever want to see here in our country but today we will. >> steve: today we will. and reportedly 34 felony counts. we'll find out what they are in about six hours.

meanwhile, we wanted, lee, to pick your brain about a quote from aoc responding to potentially running for u.s. senate challenging senator gillibrand. she said don't ask me that question. print that. okay. we did. there's a word where i'm -- there is a world, that is to say, where i'm here for a along time in the seat in this position. there is a world where i'm not an elected official anymore. there is a world where i may be in higher office. so, you know what? i'm sure she is ambitious. the big question is could she win at a statewide level? >> i think that she can win a democratic primary. i think that she would have a strong ground game. she would be able to raise a lot of money. a lot of the democratic party primary base is in new york city where aoc's district is located. kirsten gillibrand is not from new york city. the democratic party not just has that far left base.

they have certain minority constituencies that aoc might do a better job penetrating in a democratic party primary. she decides to pull the trigger on a race like this, i think she would be a very strong candidate against senator kirsten gillibrand. >> brian: who doesn't do anything just is invisible. how will that affect whether you decide to run or not and are you considering it? >> no, kirsten gillibrand has been wishing this into existence. mentioning my name in media interviews and fundraising introduce. it was not anything that i was thinking about. the more she keeps mentioning my name and i have to answer questions about it. you know, i'm wondering maybe as we go forward, listen, if aoc gets into this race, while i say she will be a more competitive democratic party primary candidate, if she was to win a primary, she is a more deeply flawed general election opponent. so the race will be shifting in

tornadoes. over the weekend a powerful system swept through arkansas and several other states killing at least 33. late season snow storm set to blanket states by wyoming, utah, colorado and both dakotas. the snow could break snowfall records for the month of april. let's check in senior meteorologist janice dean to put it in perspective. >> janice: yeah. >> this is a big deal. i know we have news to cover but the weather is going to be particularly dangerous if not deadly for some of these states. chicago, we have an election happening today. we could see some severe storms moving through that region. here's the threat from texas all the way up towards the great lakes. again, we have a significant risk for hail, damaging winds and tornadoes. glinchts flash flooding for some of these southern states all the way up toward the tennessee river valley. flash flooding is going to be a huge concern. and then the snow part of this storm, a feet of snow and blizzard conditions with winds in excess of 30, 40, 50 miles per hour. in some of these regions it will
