be a misdemeanor. it could be a family. we do not know. >> can be election low violation. >> martha: but they passed on that so we'll see if there's any new surprises on that if it is 34 finale counselor than i have a lot of stuff to push back against as we watch this play out throughout the afternoon. take you so much. it was great to see you guys and we will see you later today. >> bill: we have to workable harris faulkner starts right now and we'll see you throughout the day your terrace. >> at the center of it all. he will head to the courthouse in lower manhattan for his arraignment and we will finally lead to exactly what is in the indictment against him. it's been sealed since it was announced last week. except for the fact that one of the big issues is bubbling up to date is grand jury leak remember, that is how we just learned about the 34 felony charges against him. but we do not know all the details but we will get to that today.
8:01 am
there's also the possibility that the judge could put into place a gag order for the former president. you just heard martha and valerie and trey talk about this and will undergo deep down that's what that will really mean for a man who is running for president currently. and, his supporters. people want to hear from him. most specifically they have to get it what words could he not saying that sort of thing. all important. i am harris faulkner and you are in "the faulkner focus." >> harris: no former or current or any president has ever been indicted. here is one of trump's attorneys with his expectations. >> it won't be a long day in court and one thinking and sure of is that he see you here today there'll be no guilty plea in this case is one thing i can guarantee you. i don't think this case is going to see a jury is going to go away on papery and i think there's a li keqiang as i will be made and should be in a successfully. >> harris: the former president not bringing in a high profile white-collar crime expert, a criminal defense

attorney for that type blanche. we are told he would leave the truck legal team. there are multiple reports of the charges against trump. and they will relate to business fraud stemming from hush money payments to adult film workout stormy daniels. the reports cleaning on that grand jury leak i just mentioned. national correspondent frank yanez's drive outside the courthouse with more. so brian, take us to the first steps for the former president as he arrives. >> harris faulkner good morning look i just want to set the picture, there's a couple hundred protesters that are here and some pro and some anti-better back-and-forth. it is peaceful but that this adds to the atmosphere outside of the manhattan criminal court house we expect the former president to arrive here for his arraignment sometime before it back to 15:00 p.m. arraignment inside the courthouse. he is going to travel with his motorcade before myles thompson to the courthouse. he was surrendered to be

processed on the seventh floor. and then at that point, of the seal be escorted to the 15th floor courtroom from his arraignment which should take 15 to 30 minutes. he will not be handcuffed, he will be fingerprinted, but it is unclear if you will get a mug shot. not the judge ruled that video cameras will not be allowed into the courtroom. in trump's legal team had opposed the idea because it will create a circus-like atmosphere. video cameras will be allowed to fill in the hallways of the courthouse to capture trump entering and leaving that courtroom. not this is where trump reportedly will make comment sometime as he is entering or leaving the courtroom. now, we will also be able to get photos from inside the courtroom. still photographers will be allowed inside for several minutes. not the indictment against trump will be unsealed during this arraignment and sources are telling fox news' jump trump will face more than 30 charges related to business fraud in at
8:04 am
least one of those will be a finale charge focused on those hush money payments. now presumably he will plead not guilty and then he will be let go and his own recognizance. it'll be interesting to see how much will be said during this arraignment by his defense attorneys in the cookeville for instance more about their plans to challenge the mingo merits of this case including possible motions like asking to move this case out of manhattan. now former president trump on social just about an hour ago said this saying "very unfair venue with some areas devoted 1% republican, this case should be moved to a nearby stan nominates to be a very secure location for the child. additionally the high polish and judge and his family are well known shrub haters." and that is where this is for the gag order, the former president has talked a lot about him being the judge in the trump pater and will there be a gag order? his lawyers said that i will be insane and unconstitutional. he said to speak tonight at 850
8:05 am
tomorrow harris? >> harris: brian, thank you very much we appreciate the details and let's get into it further. so glad to have you in focus with you nap, but i would like to start with trump's voice in true social that brian branch is reporting on. and his discussion. this is former president trump on his platform saying that it is very unfair with the venue in some areas that ability 1% republican. does he have a point or not about moving in this case to a place where there might be more republicans as constituents in another perhaps a different type of legal treatment? if of? >> yes, harris it is good to be with you here today and i absolutely think the president is right in this point. and that is -- does anyone believe in places like a manhattan washington, d.c., of republican related to trump or trump himself can get a fair
8:06 am
trial? i think that's -- if i was a prosecution he seems to me that i would not want this to appear as fair as possible. and i will agree to any reasonable transfer venue that a jury pool could be more fair. because that -- if you think about our whole system, it is going to be under a microscope parents because this process i think half of the country believes it is going to be politically motivated. and they're persecuting donald trump. why not bend over backwards and a try and make it appear fair. at least in some of these situations. because otherwise, i think a lot of people going to be very suspicious of the outcome. >> harris: interest this thing because i did not know how that will affect the manhattan district attorney who has brought this case against president trump. because we do know politically eights and to have a manhattan because this is his own backdrop. moving it out brings about as you put it as fairness to the
8:07 am
defendant what does it do for the prosecution? >> what a prosecution if they are righteous in dave bing in this case. they should be vented to try it anywhere. they think the crimes have been committed and they can prove beyond a reasonable doubt based on the evidence but they shouldn't be afraid to later juries are where they come from quite frankly. they should be willing to reasonably move into a place where he can at least get a get a fair jury pool. >> harris: this is bubbling up and is one of two things today. a new york state statute classifies that grand jury leaks are a class e felony. and here's a bit of it. a person is guilty of unlawful grand jury if -- when being a grand jury when opposing when exposing the grand jury testimony i.d. decision. the result or other matter in a grand jury proceeding which is required by law to be kept secret except in the proper discharge of his official duties or upon written order of the court.
8:08 am
we know about the study for accounts being felonies against the former president because of a grand jury leaks. are we looking after this is over going after the leakers? >> well, they better be at because obviously the challenge here is harris is that if you're going to have a two-tier system of justice is that a lot of people are talking about that today. this is that example. where grand jury's are supposed to be done in secret, in fact until the arraignment unesco's and other charges have been filed. leave no the donald trump was under investigation and we've known then the indictment and how many accounts have been in this afternoon and this data for counts we are going to learn that there is some real leaking from the grand jury. again nobody is above the law but we cannot have it this way were only donald trump it's the back end of the stick on this. >> harris: all right, let's get to this house judiciary chair meant another committee chairs and not demanding that the district attorney alvin
8:09 am
bragg testify about the trump case. here is what jordan said and what happened in when he refused to go before congress. >> everything is on the table maria were going to with the other chair meant in look at the response and we just got his letter back and we redeeming them. but we think that this is -- this is a thing that is the most important, we think it's bigger. it involves all of us and it's going out after anyone who opposes the left's agenda and the establishment's agenda. and that is maybe the most scary thing of all. >> harris: you know you spent two seconds which him and join in the you know he doesn't bluff. so, let this play out? will we see them go to the hill? or could they zoom it? >> yes well, i think to his point if you read the original letter to alvin bragg they laid out legitimate purposes for asking him to come testify. and it's an oversight. and it's a budget and its
8:10 am
personnel and it's all the reason that congress should be able to have some of these questions especially to see if those -- if any resource or going to be used for this. but i think today if we lend the federal election look at the center of this case and elevates it to a felony i think it gives calendar chris mohr because they in charge of writing those laws. if they need to be revised so that they can't be abused away alvin agrees to be abusing them and think it's a legitimate purpose of congress and they should testify. testify. >> harris: went interesting because you talk about the bumping of congress to the class e felonies and the lowest level of families pinot called on the grounds of the conduct was intended to conceal another underlying crime. so what you're saying is it better to do all of that and at the same time which one he all of the communications between any potential federal government emails all of that with alvin bragg's office. really quick with that will as well? >> well, that would show again if there are federal resources and if the law were abused and
8:11 am
in his bid position was using any of those federal resources and personnel reviews. and again it helps inform congress to help write these last of the can't be abused by these local district attorneys. >> harris: brett minnich are always good to have you here. more followed over this by five. new appointing that craft actually did collect admitted to the information while flying all over the united states to space for several days. in fact, some of our facilities reported that they were doing figure eights. they were just going over it so many times. a top senate democrats is that he will hold the president accountable. let's see if that happens. plus, what have hopeful nikki haley coach glaze on her plan to get the southern border disaster under control. in no one -- not want to hold back rather, she accuses the president of dereliction of d duty. >> the problem is we have a president or congress was not making sure that we enforce those laws.

i move so much better because of cosentyx. ask your rheumatologist about cosentyx. working with newday, my va home loan benefit allowed me to keep my money in my pocket. and my service was my down payment. i talked with newday on a thursday, put a contract on this house on saturday. 30 days later, we were moving in. i would tell other vets out there who are dreaming of getting into a home to stop dreaming. pick up the phone. call newday. you served your country. allow newday to serve you.

>> harris: this is dereliction of duty by president biden. shame on you because you're putting every single american at risk, this is the national security threat and you are allowing illegal immigrants to come across the border are putting away another law enforcement and hurting her family are following in our schools and going to hospitals this is your job. the job is to protect the american people and you're not doing it. you do not deserve to be president. she went and hard on biden. their presidential candidate mickey here at the southern putting your city. she joined me on "the focus" hours after our interview where she told her so she would fix the disaster died in his later

in our nation's feet. hailey gave a speech which included the core pillars of our plan. first of all she took aim at those 87,000 irs agency hires, and she wants to take 25,000 of those and put him at the border border patrol agents or at least wiped off the books so she can hire more border patrol agents. and that would more than double what we have there now. she would keep title 42 restriction in place. she will replace president biden's catch and release, and call a catch and deport. his proposal comes at border numbers are alarming to say the least. undocumented tops the 1 million mark for just the first quarter of the fiscal year which began on until the first. that fast they the same time. from the previous two years. look at this compared to 2021, and is more than three times. power panel doug collins form of republican congressman of georgia richard fowler, fox news contributor. jen amended is great to have dan fogler send doug let me start
8:19 am
with you presidential candidate close to the border and lays it all out and hits all the points and you say well? >> i say well, it is not surprising. this is the easiest way for republicans to hit one of the easiest place for the republic if they hit on. the border is a complete disaster and my oco is a complete failure and biden is completely agreed to the problem going on down there. you got a free flow imported which you have the jugs and have the human trafficking you have the national security risk. it was easy pickings for presidential candidates. and it was not surprising that haley meet this month -- i was really surprised to find out this is the first time at the border. but it was an easy thing to do because this is something that everybody in every state especially the culinary states are going to relate to. it every state is becoming a border state because it's an open border. >> harris: with her and others going down there as well, there have been sent by preiser bank overdoses well. but the branding is high for what you get done down there.
8:20 am
she met with judges, she met with local officials. but voters with everybody, so now you have to spend several days down there. richard, does a president need to make sure that the homeland security secretary josh and himself out the door? >> i think it's a car the warehouse to make. but yes. i think he and the president has a right to pick with his staff and -- >> harris: you think marcus is done a good job? >> i think we have a larger problem of how we deal with the border overall, and updating the porter policies we have in place many of them were written years before i was born. so for going to have a conversation about the border would l look at a isolating of e home that security secretary not taking a larger look at some of the problems out like they are. for example -- nikki haley says she wants dickstein tit title 42 beautifully wrapped around a pandemic title 42 goes away because it's a public health issue. so were talking about the border of all we have to larger conversation about legislatively can be done to make sure we keep the american people safe and
8:21 am
with the warehouse were to following the passage of legislation. >> harris: are rights of title viii will get done that too is well. i'm in and we know that the president has pushed back the date for getting rid of the emergency declaration until may. and that is for covid but you can lean hard on title viii which is sometime called title ix but we know the difference. the father for philosophy areas new reports say that the china which crossed america from one side to the next in may january and early february gathered information from several sensitive u.s. military size. reportedly transmitted data to china in real time before a military side of town when you reach the coast. senator jon tester was not happy about and he said in february i didn't biden should have shot down the spy craft over his state of montana when it was first spotted by citizens. a reporter there. it's home to ballistic missile silos in china survey. intestate tweeted this.

no all along that china's invasion of our airspace was no accident. and i will keep holding the holding the biden administration accountable. senator marco rubio the top republican senator intelligence said that they repeatedly downplay the spying let's watch it together. >> everybody knows that this was done for espionage. nobody believes -- i have never heard from anyone in the intelligence community that this was from benign purposes. if it was for benign purposes then why do we see more than playing around? >> harris: let's hit this quick lease some weathering headlines biden's the laying down in the spy now reach even more. in another, biden's hot air, but the spy balloons. richard, he has a lot to say the american people about this issue have it imagine now that we know that they were able to envelop time, also transmit which is something that previously has been told to list was not occurring. >> i think this is a blunder when it comes to the president should a nom de plume right away
8:23 am
but i think if you zoom out a little bay, the easy thing to do is focus on the spy balloon and not focus and have positive china overall. what you see them doing is scanning across many of the policies created under donald trump. an antigen that we know were not opening up a new fill database in the philippines and will continue to both a military presence in the south china sea. so what you have is a president is taking their policy and extending them and also increasing our military awareness. and this is also happening is is meeting with the taiwanese president. >> harris: what china has done with this need to pete gash is exponentially making it bigger than ours. do not miss a house is about 277,000, but they'd left out in size. they are not catching up with this right away and technology over the other assets and people. so we cannot ignore that and i like how you said let's pull out from the balloon -- because that didn't matter. but you know what else we learned other than the transmissions we learned that they could have any time had it blow itself out.
8:24 am
in fact, we don't know if it was a malfunction that example itself up or if china just chose over at their mercy again showing not to blow it up. >> yes, this was a force they wanted should be in the front page of every paper that the burn administration lied. they couldn't shut it down when it first crescent airspace in alaska and into a new and it took off. they has a problem of a thief or for hair is, why is this just coming up this week with all the trump stuff going on in new york? when it's being buried in the trap issue in the indictment in new york city. to think that you want to do anything to hold the president accountable that's a farce and a joke. he is not going through. then he says he knew it all along was a problem in ways event for the last two months? there are many of us who say this is a problem in a biden blunder and they did not have a foreign policy except weakness around the world and they dropped us in this week. >> this is what i have to degree disagree. and the reason why i'm disagreeing with you because if
8:25 am
you look at his record -- if you look at his record -- >> harris: let them finish. >> you didn't let me finish. you started off the answer saying that biden was basically caring for the trump doctor in charge china. let's at least stop is over i say this is a mistake and it was towed to the american people there was no problem here less light or just float along america. do not try to back out of this this is being dumped in a big "newsweek" when they do not have to do with it. >> this is where the congressman gets it wrong. we were talking about the spy balloon and not having a conversation about new military bases being built in the philippines. i went to taiwan. >> harris: we can talk about that but you better know what you're talking about when it comes to the military. and i've had quite a few people who have actually served -- we are not what we need to be. >> : that's the facts. >> harris: we are not where we need to be in that part of the word for readiness. we are down with the technology but we don't have the people. >> but they has been an expansion in the military
8:26 am
presence and in china since joe biden is thick enough athens including a new military base in the philippines a place where we did not have it previously. >> justin ahrens. >> were giving submarines to the sub -- >> harris: let doug respond. >> someone in the military do not let us spy balloons float across the united states. this was weakness plain and simple, the new basement, as all good and proper. but do not admit the mistake. you just don't want to talk about the mistake. >> et al. called it a blood at the top of the answer. >> harris: it would've been worse had i think been able to blow itself off in china was controlling and command where they wanted to. with the controlled or that's what we found out now. and i don't know, maybe we waited for whether or not they would do that the way they likely waited to see if they were going to poll question the ground in russia. first they wanted to bring about peace but now were waiting for china to call the shots. >> the bid there's a problem.
8:27 am
>> we don't have the kind of time. >> harris: okay we have to go but thank you gentlemen both thank you very much. so, does mayoral election day in chicago and crime is of course essential issue. food is deciding to see if they one another far progressive to a moderate to crisis. plus, some are saying the president president trump's indictment is giving him a huge political boots as he tries to run for president again. >> let's be real, these charges would not of been brought against any of a human being other than trump. almost uniformly, everyone is saying that this could backfire in the democratic party. >> harris: the former commander in chief bringing in big bank after his indictment. we are now waiting for him to head to the courthouse in lower manhattan for his arraignment. marc thiessen in fo on "the foc" up next.
8:33 am
watching for the former presidents arraignment in manhattan criminal court just hours away on the left side of your screen. you can see his home here in manhattan and trump tower. it is just a few minutes to live in my hand rights or to your screen. and when they get started with of course as we kept awake yesterday show you his stepsisters he makes his way there. he is expected to speak before and after his court appearance. informant president trump is using the indictment of fuel mass of fun reading numbers. and it is working. the campaign is claiming his race to $8 million in the last four days. by the waves that number went up for the night. but like a million. a former obama fund-raiser on what it all could mean for 2024. >> i think will play to the narrative that donald trump is seen that they do not liken for what he is fighting for what he stands for. and what his agenda is. and he is fighting for amer
8:34 am
americans. india things try to stop them. and they do not like that is fighting for the everyday american. i think that narrative may be more powerful. >> harris: with a judge in the case could stop the former president of the gag order, that was seriously limit what he saying in a limo choked trial in the white house campaign as of now however for the president is planning to give a speech at mar-a-lago when he gets home tonight. marc thiessen fox news contributor and "washington post" columnist. what would you would you anticipate the president would say? >> were first of all, good luck putting a gag order in donald trump about anything. that's nothing to go very well. especially for whoever wants to shut them up. this is a good day for donald trump. because it makes him -- a pleasant place to do when individual denomination it's a good day for grandma cuts because it puts him closer to winning the g.o.p. nomination. it's just the facts. because the reality is, trump is raising as you say, $8 million
8:35 am
over this. and he said last week he wants perfect photos of the perp walk. there's a reason for that, because even though the majority of republicans want somebody else to be the nominee, the pool say that he has a commanding plurality in the g.o.p. electric but he doesn't have the majority. the majority of republicans do not want him to be the nominee. but even people who do not want them to be the number need to know when a country turn into a banana republic where the justice system is used to go after political opponents. so, a lot of people going to rally around donald trump as a result of this. and it helps them. >> harris: them and put some numbers alongside what you're saying. new polling finds that while the majority of people do support the indictment of trump, 76% said that politics played a role. people are evenly split at 31% of whether or not this strength o weakens our democracy as a whole. and that of course is being the bigger picture and all of this. but it is fascinating because people just want this to shake
8:36 am
out. and voters who have talked with whether they are republicans or people will tell you who they are. i don't know if they volunteer and they say look, i just want this to be fixed so that people can move on move forward and get to the kitchen table issues. and if he's the one to solve the problems, they want him to be able to run and do it effectively. this is like somebody is trying to stop then that's what people have told me. and i've been traveling. so i'm hearing it from different sides of the country. >> i get what you're saying. the reality is, as you said, the majority of republicans just want somebody else to be the nominee but they don't hate donald trump. 70 p7077% approval in the repubn party. most people thought he was a great president i agree. abraham accordance operational groups. taken out so the money. you could go in on the list of the compliments that he had an office. and they -- they just feel that is going to be the most likely person to lose because democrats have now won three election
8:37 am
grinding against trump and the mega movement they won the 2,018th which ended at 2020 election and other midterm midterm. and should be in canada the one the cost of the election where the handpicked candidates of donald trump so they think that their best chances that the democrats do this for him to be the nominee in 2024 and i think a lot of republicans feel that way but there it and move on but they're not ready to banner donald trump to this left-wing judicial establishment with this trying to weaponize our judicial system to go after him and have left always said that trump's chips trying chips trying or institution of our democracy and they're the ones destroying our institution of democracy because we take the justice system and use it as a weapon of politics as destroying our democracy. so there's a rallying effect i understand by people want to rally around trump because it is harmful so our country what they're doing to him. >> harris: i remember how many independents to pull over if, in fact, his face falls apart because nobody talks about all
8:38 am
the things that can happen because he elevated from misdemeanor level to the lowest point. but there are no felonies against them and we don't know all the details because even though there's a grand jury leak, we didn't get to see everything. matt whitaker by the way from enacting a geode that trumps things they need to be an adjudication of the legal system against whoever leaked from a judge and jury. we will see what happens after this is all over. but you know independents do you scoop them up that this case turns out to be nothing? >> may be. but i made it also might not be the only cage. then they bring charges from january 16 other than mar-a-lago documents. so this could be them lee cassell in this judicial work is strong. he probably will have a negative effect on trump in the swing voters so this election will be expected i did buy 200,000 swing voters and swing states. so how this affects them as part to decide if trumps a nominee or whether or not becomes president. and they're going to be exposed
8:39 am
every day to a reminder of his moral turpitude about the allegation that he had an affair with the adult film star. and then paid hush money for it. it's not going to endear him to swing voters. but the republican voters eric day and then they don't care. >> harris: i tell you what they won't be hearing all the oxygen that is drained out of the room and is trying to convince people that inflation is in high and the cost of food is something we can all live with. he's out there on the second other tour right out. those are the issues that people want to talk about. in the last time that the gas was as cheap as was ten with once-in-a-lifetime this president was in the one. it was the previous one. so is really interesting how one close island no one and we cover all of it. my teeth and is been great to see you think your. >> good to be with you harris. >> harris: people are still grieving and picking up the pieces and now more of it is happening if you seen other states hit by deadly tornadoes
8:40 am
over the last few weeks. communities throughout the south and midwest are struggling. and they agreed things i've mentioned. loss of loved ones. and the red cross is working around-the-clock as you might've imagined to bring relief to those affected and fox corporation is helping in those efforts. donating more than $1 million to the organization. it is also a doubled matching and play competitions. if you would like to donate the long log onto rick ross.org/fast-forward to scan the qr code on your skin right now. that means you have to grab your phone so we want to just pause right now. or if you are watching -- and you have a dvr you can scroll it right back. and take that right off. although i may have given you enough time just to do that. a lot of critics are coming out manhattan district attorney martin bragg they say that he should be paying more attention to what is happening on the streets of a city instead of going after president trump watch this. >> new yorkers are experiencing the first few

months of alvin bragg's tenure. and they are seeing crime and many metrics go up. they had this prosecutor who seems to be more of a defense attorney than a district attorney. >> harris: , some statistics show just how rotten the big apple is when it comes to violent crimes. jason rantz a on "the focus" up next.

>> the reason why we've not been able to get control over the city of chicago is because we are using the same tired tactics. they don't want to talk about public safety, he wants to talk what his obvious statements on defunding the cops. >> harris: their politics are very different. those two men. the one of the left is very far left. and balance on the right, is a moderate. we shall see. chicago's photos are picking a new mayor today, and the city soaring crime rate is such a focus on the race between moderate paul vallas. in the far left progressive brandon johnson. >> harris: of former schools chief who is pro-law enforcement and backed by the cities for the police union. john is in a teacher in a union organizer is supported they defunded a police and was endorsed by the city's powerful

teachers union. tenney's love for us in chicago. the big question is do they want the difference maker away from lori lightfoot? in the disaster that she was or do they want something diff different? >> harris, there is absolutely gonna be a difference because these two candidates are to the right into the left of the lori lightfoot in the top issue is you much of a voters serious crime and public safety. in these two candidates have vastly different approaches on how they plan to make the city safer. brandon johnson wants to increase jackets. they then take that money invested into social services to train and adjust the root causes of crime. dinner dinner at the campaign he has been plagued by his previous support for the d from the police movement. which is now trying to walk b back. >> in 2020 you said defunding the failed system of incarceration of policing was not just admirable, but necessary. >> i am not going to defend the police. >> now you're saying you're not gonna take a penny away.

institution of suppression is going to look at the people who go through it as victims. and thus, you see these criminals were being treated as a victim of war where they have endless chances. the problem is, when you keep giving bad people another chance they start to pick up on it and realize that there is an consequences. and that's where this whole restorative adjusters reproach that is been adopted by so many days of the progressive d.a.'s miserably. and the people who are just trying to live their lives take the kids to a park and walk to work without getting stabbed. or attacked. her hassles. that is the reality for people on the ground. steve monette i mean the buddy system is particularly further this city is about daily. and i don't live here but as i get ready to leave the city, i hear other women on the sidewalk saying i remember we cannot be alone, and is not quite dark out yet. everyone is thinking this, nancy reality no matter how much the city officials including at
