[applause] good evening, welcome to america late news, fox news at night, i am trace gallagher in los angeles. breaking tonight the former president trump has been indicted and arraigned and his poll numbers and donations continue to rise. his odds of becoming president are going up. hours after pleading not guilty to 34 felony counts, he held a rally at mar-a-lago where he told the crowd there is no case and many legal experts say he's right.

we begin with our chief correspondent, jonathan hunt. good evening. >> good evening. the first u.s. president to be indicted on criminal charges. donald trump gathered together his supporters to air grievances. >> i never thought anything like this could happen in america. the only crime that i have committed is to fearlessly defend our nation from those who seek to destroy it. >> now, among the former president's target was alvin bragg, the manhattan district attorney leading the charge to convict trump on hush money payment to porn star stormy daniels. >> the criminal is district attorney because he leaked massive amount of grand jury information. [applause] >> for which he should be

prosecuted or at a minimum, he should resign. >> and the former president hit out of the judge in this case, too. >> i have a trump-hating judge and trump-hating wife and family whose daughter works for kamala harris and now receiving the biden/harris campaign. before he wrapped up, he criticized other cases among him, the classified documents case. to some, the former president seemed a little flat. the crowd appearing less fired up at the end than they were at the beginning. perhaps, a reflection of what an exhausting day for donald trump. and whatever the political divide anyone is on. >> thank you, jonathan.

we are looking at the charges trump is facing. there are 34 of them. many are baffled that da alvin bragg did not disclose the big crime the former president is accused of. >> live with more on what the document say and don't say. good evening. kevin corke. >> in 16 pages, progressive manhattan district attorney alvin bragg lays out the indictment who calls a catch and skill scheme to boot the candidate, trump. at the center, it has been $130,000 so-called hush money payment to stormy daniels. but, da bragg says it is not just about one single payment, but covers -- >> additional statements separate from the charge of

ami documents. it is not just that $130,000 wired payment. >> however, many legal scholars have been quick to point out that while the charges say that the 34 false business records conceal another crime, the indictment never says what that crime is. bragg claims the law does not require him to do so. now, you will remember at one point, bragg did hesitate to prosecute this case but then referred to new details allegedly prompted a push forward. while the judge says he wants to move expeditiously, the next hearing is early december. >> kevin corke live for us in d.c. thank you. let's bring our law officer john yu. john, i want to play some

sound. this is the former president tonight, he made a good point and i will get your take. >> everybody says this is not really an indictment, there is nothing here. there is nothing here. they're not saying what you did. >> he's right, john. they did not disclose the crime. >> not one darn thing. >> sorry, john yu, go ahead. [laughter] >> it is okay. we look alike, too. we are like twins. >> separated at birth. >> the problem of this indictment has a big hole and as what kevin said, it does not describe the crime. without that description of the crime, all you have got are a munch of misdemeanors, the clock ran out over five years ago on charges. they're not even that serious. you don't go to a grand jury. the only way you can get to a felony is the cooking of the books have to be concealed of other crimes.

that crime is never mentioned in the indictment. that's a serious flaw. donald trump may be able to get out of this case because of the failure of this indictment of the timing of the crime. what crime is it and if it is a federal crime, i don't think bragg is able to prosecute the federal crime. this is one of the many legal flaws that are afflicting with this indictment. >> i am not a legal expert but a lot of legal experts agree with you as well. mr. bragg owes the public a better explanation of he is theory of the case. his unclear invasive reply on tuesday does not help. the country does not have to wait four months to find out the answer. bragg at the news conference today did not know how to answer these questions, john. >> or he just did not want to. this indictment is so legally insufficient that apart of me is wondering whether or not alvin bragg

wants it to be dismiss without seeing a jury. this will never -- donald trump will never have a trial on this case because it will be dismissed ahead of time. we should not have to wait for august for a briefing schedule or december, this could be dismissed tomorrow with a properly drafted motion to dismiss. it is that bad. i will venture to say is the big crime not included in here, the little crime is not either. in order to falsify business record, you have to have intend to fraud. who was defrauded? that was the only record mentioned in his 34-count of indictment. >> i want you to listen to jonathan turley and see what he can expand. watch this. >> i know a lot of judges would have been not too pleased to receive an indictment of this. this whats a feeling of a legal slurpee.

it has no nutritional value. there is nothing there. >> is slurpee the proper analogy here? >> i get his point. what he's saying here is if you read the indictment, you can't tell what trump did that was illegal. it is all seems to be coming later. this is a problem constitutionally. the purpose of indictment, the reason and the constitution gives you due process rights that you as a criminal defendant, trump, have the right to know what the government is charging you with. you read this indictment, you can't tell what's illegal and what's a felony. so, i agree. it has no content to it. and it may be constitutional vulnerable on appeal. >> john, we hear this all the time that nobody is above the law. this time the former president is below the law. a normal person would not have been facing these

arrai arraignment. he posted on social. headed to lower manhattan, the courthouse is so surreal, wow, they're going to arrest me. can't believe this is happening in america, make america great again. the judge allowed pictures to be taken at the beginning of the arraignment. trump pleaded not guilty. da bragg upgraded the charges to felony by connecting them to campaign finance laws but did not specify which laws exactly. trump and his lawyer are very critical of. joe tacopina predicted this case will not go to trial, trace. as for how the arraignment played out, former president trump was fingerprinted. he did not wear handcuffs but there was no mug shot which was different than previously reported. and we would hear from former president trump from

other reasons. >> mit romney says this is a political politically-motivated charged. >> look, you know even if the district attorney was politically motivated, the grand jury is not. i know in the green room, you and i were paul bakoing about the grand jury and prosecutors tools, yes, not everyone is indicted. a grand jury has to make that decision. this grand jury did. do i think this is a big problem in this case and do i think we'll see a trial or it may not go away? all of those things are possible. the bigger problem for donald trump are georgia and january 6th. >> the whole concept here is maybe some wants him to win the primary because they think he's a better opponent for joe biden. >> they may think that and that's a bad strategy because they're making a whole lot of enemy.
