felony without a second crime? >> bret: great point, if you listen to legal experts on every ideological spectrum, they have a problem with this, it is not listed in the indictment. the 34 counts to get from misdemeanor to felony, has to be an underlying crime temperature is like choose your own adventure for the jury that you could choose the federal election crime. that is a jump for a local da to make that a federal charge. then he mentioned state election law. and yet running for president is a federal office. and then he talks about avoiding taxes, this was done to help michael cohen on his tax returns and falsifying state law tax records. you are going down in the weeds here. to jump from misdemeanor to felony on 34 counts, that is what he's doing temperature is

statement, i don't think donald trump is fit for office, but i do think this is political. when jeb bush says something similar and you have parts of the party who have a problem with the former president, defending him on this particular charge is a big moment. i also think it moves some people who were not paying attention right now temperature is early. but because they think he is under attack unfairly, they start to say wait a second, we should give him another look. polls are going up and attention is increasing. >> brian: bret, to build on what the opponents, maybe tim scott or mike pence, we don't know, mike pompeo, if you think this case is going to blow over, it may, but what about the georgia case, mar-a-lago? there is another side, when the indictment comes, trump has a

everything in pres precedential past. this is important for everybody to understand. this is a misdemeanor. for almost all charges that alvin bragg is seeing, the majority of them in new york city, he is lowering felonies to misdemeanors to treat actual criminals with more leniency than they deserve. here he is doing the exact opposite, trying to elevate a misdemeanor, which has two year statute of limitation and has played out to five years, that statute of limitation might be in play also, it is more than five years since this happened. this is political and feels like da bragg is the biggest contributor to donald trump's political career in his entire life because bragg may be pushing him right back into the

republican nomination, almost without a challenge and into the white house. one other thing i think is significant here ainsley, bragg in his defense of the charges to me was incredibly weak. i hope trump can rise to the level of not petty grievance and anger and frustration, which characterize a lot of what he said last night and talk about the historical record here and why what is happening to him is an outrageous indictment and attack on free and fair elections in america. if trump can make this and i know this is a challenge, a story about something other than trump, i think he's going to be the next president of the united states. >> ainsley: yeah, it appears the law is being manipulated to go after a political opponent. cnn calling it the super bowl.

haven't heard the epstein case. i'd be more interested to hear about what happened on those islands and in those cases more before i hear about trump and his business dealings. >> steve: frank, the former president does face other legal peril with the georgia case, with the so-called docu-lago stuff, are you worried about that stuff or do you think it will be like this was? >> am i worried about it? no one wants to see crime, do i mind it being investigated? no. but investigate it fairly. president biden has more documents from more years than we can add up all of trump's documents, let's have the appearance that the investigations are nonpartisan.
