>> prosecutor are going to begin begin, working with a judge today to set a sentencing date for army sergeant daniel perry. the jury finding him guilty for the 2020 murder of derek foster. the shooting unfolding during a blm protest in austin, texas. he was saying during the protest foster surrounded his car before raising an ak-47 at him. perry claims he fired his own gun because he feared for his life. texas governor greg abbott now working to pardon perry saying he acted within his legal rights citing the state's stand your ground law. progressive travis county d.a. jose garza calling out it abbott wants in our legal system a jury gets to decide whether a defendant is guilty or innocent. not the governor. the governor's statement that he will intervene in the legal proceedings surrounding the death of garrett foster is troubling. dan patrick is slamming perry's conviction calling this a total breakdown of our system of

people said he was guilty. you talked about this in the first hour, lisa. the lead investigator, the guy by the name of david fugat who has since retired. apparently after this guy army sergeant daniel perry was indicted for murder. the officer said the d.a.'s office forced him to remove exculpatory evidence from his presentation to the grand jury. so they indicted him. but at trial, apparently all because he thought it was self-defense. >> he also accused the district attorney's office of engaging in witness tampering with him because of this act that you just laid out. ultimately, if you look at the facts of this case. what it comes down to progressive d.a.s don't want you to engage in self-defense. supposed to just allow yourself to die? you look at this guy sergeant perry at fort hood trying to make extra money as uber driver. goes downtown to make extra money.

what inevitably happens find yourself surrounded by mob of black lives matter riots. they are lighting things on fire not friendly people, pounding on his car. a guy points an ak-47 at him. so if you are a sergeant perry, what do you think is going to hand? do you not feel that your life is in danger? and you have less than a second to make a decision. is it you or him? decide to save your life or not he decided to save his life. brian? >> brian: he has got the training. anyone looking at this case objectively know this was self-defense. it was the nature of the jury and the evidence that was held back. hopefully some justice will be done. i think that, you know, governor abbott was asked to go on tucker on friday night. tucker is like why are you letting this guy go to jail for murder? next thing you know i think it is related. he is looking at this for a pardon opportunity. did he not go on the show as invited but he is looking to take action this week. i'm sure that will be part of his monologue.

ukraine. china is now assisting russia. you have china continuing to act aggressively toward taiwan. and act illegally in the south china sea seizing and militarizing islands in contravention of international law. you now have iran working to destabilize the middle east through proxies attacking israel. so, really, i wouldn't be surprised to see if russia, china, and iran were working in concert to try and create issues that spread the united states and our allies thin both in the intelligence world, the military world, and diplomatically in trying to figure out who is doing what, where and when. and that's what is causings a lot of the destablization. >> steve: so that point, commander, do we have enough stuff to do that because we are hearing how we are running out of bullets. it's going to take years to resupply. >> that's a good -- steve, you hit the nail on the head. because, in reality, what we have witnessed is a united

states military that took the peace dividend coming out of the collapse of the soviet union in the early 1990s. we began to consolidate our defense industry and what we have today is a united states military that went from being able to fight a two-front major war to one and a half, to one, and it's clear that we couldn't even fight one today because we don't have the depth, we don't have the ability to fight a sustained conflict. we can do the quick hit, hard hit, get in and out and stop. but we don't have the ability to do that sustained effort. and that's what is concerning to the american people and our allies. >> brian: not like we don't put enough money in it. we can always up that not making it quick enough. chinese paid for the stuff that they ordered already. they are waiting three years to get it. it's incredible. and that's one of the problems you have with the biden administration. when we have sold arms to taiwan, give it to them. one of the issues you worry about is how much might get
