>> campaign 2024 is heating up with some gop presidential hopefuls coily testing the field as they make rounds to big-name events such as this weekend's nra convention. this as former secretary of state mike pompeo announcing he race. welcome to fox news live i'm alicia acuña. griff: i'm griff jenkins. let's go to alexandria hoff, 170
10:01 am
days for next election but things are sure heating up. alex: who is counting, griff, former secretary pompeo says his decision was not impacted by former president trump's lead in the polls. it's something that he and his wife had to wait for months. >> we care deeply about america and the issues that i have been talking about the last year and a half and decades matter awful lot, this isn't our moment. this isn't time to seek elected office. >> pompeo added that if pompeo winning primary he may not end up endorsing former boss. aisa hutchison joined nikki haley and those announcing a run, senator tim scott introduced his exploratory committee this week with several top gop hopefuls attending nra annual convention yesterday and that included former president trump and former vice president mike pence. they are also going to be in in nashville this weekend for donor retreat as will new hampshire

governor chris sununu which is considering run for the white house. >> i think now more than ever people are realizing that given the former president trump's strong poll numbers they are going to be looking for other candidates to jump in to spur a new message, to bring attitude, new face, new energy to the primary this fall. alex: governor don desantis who has not announced run was speaking in manchester when protestors managed to rush the stage. >> you have to have a little spice in the speech, right? you have to have a little fun. alex: it was a scary moment but he played it off. the women appeared to be yelling jews against desantis. moved on quickly, griff. griff: yeah, crazy scenario there. alexandria hoff live for us in washington. thank you very much. alicia: for more on this and whole bunch

more let's bring in the political panel. with us today vogul group bill mckinley and dnc press secretary jose muñoz. jose, i will start with you democratic congressman ro khana calling on senator dianne feinstein to resign. since fen -- february 16th she missed 16 votes. john fetterman did take time off for treatment for depression. jose, as a democrat, is it time for the senator to move on? >> i disagree. you put the example. it's. >> relatable because we see
10:04 am
fetterman, a man that has missed same amount of votes and no one is calling for resignation at least from our own party. it's sad to see because if she's a woman she had to resign and if it was a man not the same conversation. she's going to continue serving the great people of california. alicia: bill, what's your response to that? >> in a way this is a dilemma of the democrats own making. everybody knew prior to the election last year that said that now senator fetterman was suffering from some health issues and we also had the depression that he sought treatment for and we all wish him speedy recovery and continued recovery on that, however, et demonstrates the fragility of the democratic majority and can block the agenda that they are trying to pursue. there's 14 nominees for the judiciary that have been hold up in the committee and with senator feinstein's absence they haven't been able to proceed on those votes. i mean, as a republican, you
10:05 am
know, senator feinstein should take her time and should recover and then come back when she's ready but from our standpoint we wish her the best of health but it's on judiciary votes. alicia: what about that point, judiciary committee being stuck right now because they are waiting, not advancing nominees or anything like that. is this an issue here? >> well, it is an issue and i totally understand that. look, if there was a moment in time that the senator believes that she cannot come back to the senate at all, then i would be the first, you know, maybe ask her to reflect and say this is the time for her to resign but it does not seem that that's the case. i think she's prepared statement that she will come back and continue to vote for the american people. i think she will back in no time and be able to move forward with the work ahead. alicia: jose, i want to follow up on something that you said, you're talking comparison with
10:06 am
man and woman and there has been talk in background and out front about her advancing age and the impact that that has. could that be more to the point here and some of the concerns and also i want to add on there's conversations regarding the presidential campaign and the president's advancing age. >> sure, look, i think it's going to continue to be a topic of conversation and it should b. i'm not -- i don't think democrats or republicans should -- whether it's senator feinstein or joe biden, their age should be something of concern. that's fine. as long as the public, the american public believes in these people they can serve. clearly they can. we see a president in joe biden that has passed record of legislation and no president no modern history has ever done. i don't think his age is an issue at all. if anything, i will actually say it's an advantage because of the
10:07 am
wisdom that the president brings to the office. alicia: okay, bill, before i get a chance to respond, i want to remind everyone about the moment that he had with al rokir this week, take a listen. >> we are not prepared to announce it yet. >> okay, bill, so that indicate that is there's possibly announcement coming at some point. your response. >> look, i think that they amended the primary schedule for the president of the united states to accommodate president biden in a reelect all indications are that he's going to run for reelection but if you look tat poll numbers including from democrats there are serious about whether democrats want him to run for reelection. president of the united states is the moist demanding job that you could ever hold and we need somebody that can stand up and face all of the challenges that america is facing both domestically and abroad. we have everything from taiwan
10:08 am
and ukraine war and everything from the inflation and the economy here at home and we really need people in those offices that are able to handle the stress and the rigor that requires to get the job done for the american people and i think democrats, independents and republicans have very serious concerns about president biden should seek another term. alicia: bill, republicans have their own fight ahead and candidates getting in the mix, you have a lot of potentialses out there as well, you can't ignore the fact, bill, that former president trump and the first quarter brought in almost $19 million but so much talk has been and so much excitement has been swirling around florida governor desantis.
10:09 am
10:10 am
i'm going to show you a poll. these are primary voters by age and what they think in terms of approval by age of comparing donald trump to ron desantis. donald trump 76, ron desantis, 44. the former president wins every time. how are republicans going to handle this going forward? >> first of all, it's april of the year before the presidential primary when caucuses begin. anybody who has done this for a number of cycles understand that polls right now are mood rings and not determinative of who is going to be in the lead. president trump is really benefiting from the scandalist indictment that manhattan da alvin bragg handed down where he said he basically allegedly doctored up business records to hide a crime that he wouldn't identify what the crime was. that's being reflected in the polls. the issues that we are facing right now are not going to be the issues that we are facing this summer or this fall or probably in january of next year. i think the race is going to be
10:11 am
pretty fluid and we have to see how the events unfold. alicia: jose, only a few seconds left. >> we are light years away from the presidential election. lucas: president biden spoke about the leak before leaving the island. >> focus to the extent to which it occurred. i don't think it's going to take very long. i think we are getting to the bottom of quicker -- lucas: now more leaks have been discovered. the washington post reporting u.s. intelligent agencies were aware of four additional spy balloons in addition to 4,000 spy craft that made that week long odyssey across the united states being being shot down off the coast of south carolina and early february including over u.s. aircraft likely the nimitz and another crash in south china sea.

reaction to the latest in this leak. >> well, look, we have to investigate how it happened. it may be -- probably too many people access to this information and as we just can't tolerate this. it hurts our credibility not only here at home but around the world and so we need to find out, get to the bottom of it and put a stop to it. >> you're on the homeland security committee, do you anticipate bringing people from the pentagon, others to hearings to sort of try and unpack how this could have happened? >> i think it's probably more a jurisdiction of the armed services committee. so i anticipate that our chair will have some hearings around the world and make sure that our military is kept secret and our adversaries don't have access to that information and the decimation has been widely
10:14 am
distributed around the world. it is very embarrassing to the united states and wasn't helpful to allies around the world. we need to put a stop it to. i'm sure our chair will have hearings on this. griff: you just met with speaker mccarthy in washington post article this morning, we are learning that taiwan is highly vulnerable to chinese air attacks because it's the documents of the leak. what's your reaction with respect to how it pertains to taiwan? >> look, the situation in taiwan is very -- it's very dangerous situation. we have to speed up our weapons system and delivery to the people and taiwan who is as ally to the united states, they produce 80% of the world's chips if communist china does take over taiwan it's not going to be
10:15 am
good for the u.s. economy. we need to step up our efforts. so any information that helps the chinese communist party in their efforts to unify in their words, you know, china and take over taiwan is not god and -- good, and so all of this, we need to tighten information and reduce the number of people that have access to that information to make sure that as far as we can contain any information may be useful to our adversaries. griff: congressman, how concerned are you that taiwan invasion is heading down the path of inevitable? >> i'm very concerned. mostly experts that i have spe--spoken to it's not a questf if but when, a lot of the difference of opinions that are on when it's going to happen. president xi has made no secret that he want to unify to china
10:16 am
and taiwan is, you know, number 1 priority. they are getting emboldened around the world. they are developing relationships around the world, bringing new allies to their cause. what macron said the other day about hey, europe needs to stay away from that conflict and leaf the united states. that's also very troubling and it was troubling to the united states but also a good sign for china and their ambitions to take over taiwan so, yeah, i think -- i'm on the opinion that it's going to happen and i'm of the opinion it's going to happen soon er rather than later. griff: where do you stand where the u.s. defending taiwan? >> we need to do everything in our power to make sure that it doesn't happen. we need to shift the weapon systems as quickly as we can. we need to strengthen alliances with japan, with the philippines
10:17 am
and australia. i think that's going to be critical to deterring china from their ambitions in taiwan. hopefully it won't get done. that's our prime objective is to deterring the conflict but if we continue moving in this direction and showing weakness then we are just inviting trouble and it's something that we can't -- that's something that i will certainly not support and can't have in the united states. again, the best deterrence to chinese aggression is strength and strengthening taiwan's ability to defend itself along with some of our neighbors in the area. griff: great insight, thank you, congressman carlos giménez taking time on saturday. have a good weekend, sir. >> you too. alicia: griff, a new case coming up in front of the supreme court tuesday pits one man's liberty rights against work requirements

days off for religious reasons. senior counsel jeremy involved in this case. jeremy, thank you for taking time. we did invite the u.s. postal service to come on, no one was available. we want to get right into what is the fundamental bedrock of this case, why is this case now making it to the supreme court and what is your strongest argument? >> well, it's taking a long time for us to get here but the fundamental point no employee should have to choose between work and faith. he started working for the postal service as a career because it allowed him to have sunday off. the already's day as he refers to it. they weren't delivering unless amazon bought a contract and started them delivering on sundays. initially they were able to accommodate him giving sunday off to engage in fourth
10:23 am
commandment responsibilities and that was no problem until it was a problem. and so ultimately they treated him rather poorly for about two years, subjected him to 8 rounds of discipline, two letters of warning, two suspensions letter of warning and ultimately quit or be fired and so this is why we are here. look, no -- no employee should be having to choose between their faith and their livelihood in order to work in this country and in this country we ought to return the cooperative spirit that allows us to work together to find a way to accommodate one another including religious beliefs at work. griff: i want to show viewers, usps on behalf post masters, despite good efforts to find volunteers to cover petitioners sundays shifts each time he was scheduled to work, petitioner ultimately missed 24 shifts that were not filled. the filing continues with shifts
10:24 am
swaps. in response, usps took disciplinary measures including imposing paper suspensions that did not result in loss of work or pay. it sort of beg it is larger question, jeremy, why should an employer bear the burden of someone's religious beliefs? >> because that's exactly what congress intended when they amended to title 7 to require employers to accommodate person's religious needs unless doing so would present an undue hardship, over the last 4 years or so, courts have watered down that standard that now they just need to present a de minimis burden. we forget that gerald groff worked every sad and holiday that he could and worked overtime to make sure those who could not work on sundays, well, they were able to spend time with their families. the postal service had no problem accommodating him initially and they decide to
10:25 am
make an example out of gerald that they had to punish him abiding by convictions. i want to understand something really important, all gerald had to do violate his conscious 3 or 4 times at the most, go work on a sunday and he would have the seniority enough to be able to schedule him off on a sunday but he couldn't violate his conscious before god and the united states postal service refuse today do what the law allowed. now the supreme court has the opportunity to rethose important protections to the employment context, protecting every person of faith within the employment context. griff: and just to point out as you alluded to earlier, groff didn't get fired, he quit, he resigned, so would it have been different had he stayed and fought as opposed to resigning and now bringing this case? >> we would have only had one more disciplinary interview, the ninth disciplinary interview perhaps one more suspension and he would have been fired anyway.
10:26 am
the hostile work environment that had been created by the united states postal service refusing to honor his religious beliefs had been so large that he just simply had to pull out. look, an employer the size of the united states postal service, i find it hard to believe that they couldn't work together to find a way to accommodate gerald's beliefs as they should for everybody. look, we have a workable standard under the law, we know by the american disabilities act we accommodate people with disabilities in the workplace unless it's undue hardship to the employer's business. that's the same standard of congress for religious purposes as well. we need to return to that standard. i'm remind what had thurgood marshal said. this is back in 1979. he said that our nation is our little poorer today because of this decision and they undermine that promise from congress and until we restore the religious liberty to the workplace we will find more and more employees facing the very same problem.
