he has the receipts to show, quote: preferential treatment coming out what would be the federal prosecutor's office in delaware. now, the whistleblower's attorney is already speaking out. >> my client wants to come forward to congress. he is ready to be questioned about what he knows and what he experienced under the proper legal protections. >> attorney mark lytle's client is a supervisory special agent at the irs who is prepared to tell congress the investigation he has been working on has been hampered by what he thinks is special treatment. >> typi typical steps that a law enforcement investigator would take were compromised because of political considerations. >> cbs news has learned the investigation the whistleblower worked on is about hunter biden. >> the things he has been through are very well-documented in emails and other communications with the department of justice. >> brian: okay. the bidens getting special treatment. who would have thought that?

and this whistleblower isn't stopping there. he claims he also has proof that a senior political appointee lied to congress. >> a career law enforcement officer, who knows the right way to do an investigation, when he hears a senior politically appointed official at the department of justice under sworn testimony say something and in his mind it's directly contradictory to what he knows is going on with the investigation. >> bret: and what he can prove with documents recommendation what he can prove with documents, he wants to come forward. >> brian: yeah, he is doing it the right way. right now all fingers to biden's attorney general merrick garland went under oath to say that the department of justice has kept politics out of the hunter biden case. >> he has been advised that he is not to be denied anything that he needs and, if that were to happen, it should ascend through the department's ranks. i have not heard anything from that office to suggest that they are not able to do everything that the u.s. attorney wants to do. >> brian: he is certainly an

inspiring figure. meanwhile to the attorney general just get caught lying under oath? are we heading that direction? it looks like it. but, the white house wasted no time coming out today to clean up the mess. >> is the president confident that his attorney general has upheld all the ethical obligations here when it comes to this investigation? >> again, the president has always been clear during the campaign, during his presidency that the department of justice should have independence. they should not be politicized and they should be able to do their job independently. essentially. >> brian: notice that was not a fox reporter. how can you say this case has not been politicized? everyone is picking up on it. we have been seeing nothing but stonewalling for years now. remember in 2020, 51 intel officers came out to label hunter's laptop before the election by the way as russian disinformation. then, when they were caught lying, they had to backtrack. >> do you regret signing onto the letter. >> oh, absolutely not. because those words are still true. it has all the classic earmarks.

he gave the fbi hunter's laptop backs in 2019. what did they do with it? nothing. we don't even know if they know where it is. we only found out about it a year later. fast forward to october 2020, after the "new york post" got his hands on it. they did the right thing, they published it. then the story was censored. now, thanks to the twitter files, we know the fbi had their fingerprints all over it. but, it doesn't stop there. a former obama-biden white house stenographer, we know about him now mike mccormick is also saying that the v.p., then v.p., joe biden flew to ukraine to push for fracking contracts in 2014 just days after hunter signed on to. [buzzer] marks the gas company. he calls it a kickback scheme and he has proof of it because he was on the plane with all of them. but the fbi and the federal prosecutor in delaware are ignoring it. >> i went to the fbi and filled out their witness tip line. there's a website. you fill out all these tips,

these web directions. and i submitted it. if you lie to the fbi when you are submitting a tip like that, you can go to jail. i'm not lying. i'm telling the truth. joe biden is lying. he is a criminal. and i have got the evidence. if they put me in front of the grand jury that's right now seated in wilmington, with special prosecutor david weiss, my testimony becomes the evidence that will put him in jail or will lead to his impeachment. >> brian: now, we know why the irs whistleblower says the department of justice is giving the biden family preferential treatment, can't say we are surprised. but it does look like the walls may be finally closing in on president biden and his family. it's why hunter's attorneys are now threatening the irs whistleblower, putting out this statement today. get this: quote. it appears that irs agent has committed a crime. it is a felony for an irs agent to improperly disclose information about an ongoing tax

investigation. i thought we celebrated whistleblowers in this country, not put them in jail. buff the one man who is taking these allegations seriously is oversight chairperson, okay, chairman, james comer who promises to get to the bottom of it. >> the reason that nothing has been done to hunter biden is because it's not just about hunter biden. >> right. >> it's about the entire family. it's about the brothers, the sister-in-laws, the sister, the nieces, the nephews, the grandchildren. they were all involved in this. and i think the department of justice and the intelligence community is scratching their head like what a mess. maybe it will just go away. and i got news for the american people it's not going away. it's going to come to light. and i think that a lot of people that were supposed to be checks and balances along the way in the irs and then doj are going to have a lot of explaining to do. >> brian: yeah, they didn't check. they sure do. jonathan turley george washington university law professor and fox news contributor. jonathan, how serious is this

possible revelation in future testimony from this irs agent? >> it's extremely serious. there is obviously the allegation of perjury. it's also a crime to interfere with irs investigations. so, these things do bring you into the criminal code. it's also important, as i keep on saying, that there is a secondary question as well. whether or not there is evidence of crime, there is ample evidence of corruption. that's what influence peddling is. there is ample evidence of unless of dollars going to the biden family. congress has an equal interest in that in fact, congress is the primary body to investigate that, since the department of justice investigates crimes. so, there's a lot here that we have to unravel. what was ironic about the attack by hunter biden's council on this whistleblower is that hunter biden just recently called on the irs to investigate his critics.

so, it was a rather odd moment for them to have this pearl clutching scene that they were appalled that a whistleblower went to congress. i have represented whistleblowers. this is how whistleblowers have to proceed. they reach out to these committees in order to afford them the protections of federal law. >> brian: i understand they are looking into him for five years now. must be really difficult case. tax violations, unlawful work as a foreign agent. unlawful foreign transactions, let alone the separate gun charge, which another time with a different whistleblower, perhaps. so, in any of these cases, has the irs agent who is about to come forward, has he violated anything that he -- with his work -- his work employee agreement? >> no. this is what the whistleblower laws are supposed to. >> brian: even as an irs agent? >> yes. i mean, you have an irs agent who is trying to speak to congress about what he believes

is the political influencing of a federal investigation. and so he is acting the way whistleblowers are supposed to act. what's really, i think, important here to note is that many of us have been baffled at how there's been no per acceptperceptiblemovement. in the beginning when the laptop was given to the fbi it seemed to be on its ways to mars. there is no indication they did anything but put it into some file cabinet. >> brian: the other thing is the cover of "the new york post." the same thing that appeared in other papers and then quickly sidelined and told it was russian disinformation. a letter was sent out and signed by 51 intel agents that said this was classic russian disinformation. when pressed they said i didn't say it was i said it looked like it was other than who signed off on this said well, i don't want to comment now. it's proven the "wall street journal" and "the washington

post" and "new york times" say well the laptop is real. so all those 51 were wrong to do it. now we know a little bit behind the scenes. it looks like mike boler was attached by antony blinken this is not real classic russian disinformation can you round up some people and morell does. he rounds them up and said this under oath to the weaponization of government committee headed up by james jordan and, hence, we have a letter and then we have that letter affect the debate which clearly had a role in the election. your final thought, legal or not legal? >> well, it's an inescapable pattern. we saw the same thing with the russian collusion arguments that with the dossier funded by the clinton campaign denied -- which denied that funding for a long time and then fed to the media. this is the same pattern. it was fed to the media. they were more than willing to run with it. >> brian: all right. jonathan turley, thanks so much. we will follow this story, you know we will and you will be on

told us baldwin might walk that looks like that's exactly what is going to happen. alec baldwin who the gun on his hand hanna gutierrez reid will soon no longer face any charges as they were expected to be dropped. that development coming just a day before the filming on the set of the movie rust is to resume in montana. according to the "l.a. times," baldwin's attorney had just submitted new evidence to prosecutors. it claimed the gun's trigger had been replaced before it was used on set. prosecutors in new mexico initially had tried to charge baldwin with a gun enhancement law that was created after the shooting on the set of the movie rust. while no one from the d.a.'s office is commenting, here is how alec baldwin's attorney is reacting saying, quote: we are pleased with the decision to dismiss the case against alec baldwin and we encourage a proper investigation into the facts and circumstances of this tragic accident. now, baldwin has maintained his innocence throughout this entire year and a half ordeal. he said he never pulled the

trigger, brian, despite the fbi investigation releasing a report that the gun could not have been fired any other way. brian? >> brian: all right. that's great news for him and his family. just a tragedy all around. they are going it back to taping soon. thanks so much, jeff. it's important that we teach our children in life how to win or lose. kids are kids. they need responsible adults to teach them about losing gracefully, otherwise, this happens. [shouting] >> brian: he has to be suspended. that was the scene at a high school wrestling match where a loser could not handle defeat, sucker punched the winner in the mouth. the incident looked like a school yard brawl that spilled over into the streets. there is no better example of that than what just took place over the weekend in chicago. a mob, hundreds of teens took to the streets as you see.

they smashed cop cars. started fires. holding up city buses. we don't know why. and no one seems to want to hold anyone accountable either. instead of punishing them for the mayhem. chicago's politicians making excuses. just listen to what incoming mayor brandon johnson said in defense of the kids. >> demonizing children is wrong. we have to keep them safe as well. have you ever taught middle school? i have. have you ever raised young people? do you understand the risk that young people take just because they're young? do you know that home plate is at the bottom of my stairs? i found out when my son was sliding down those stairs trying to score. they are young. >> sometimes they make silly decisions. they do. and so we have to make sure that we are investing to make sure that young people know they are supported. >> brian: mr. mayor, next time script your speeches because that was totally ridiculous. there is a huge difference between playing ball in the house and trying to rob people

on the streets and maybe kill them. that's what a mob of unruly teens did to this chicago couple over the weekend who were lucky to escape with their lives. we are continuing to see more chaos and we will continue to see more chaos in your streets, in my street and down the block until someone does something to get kids like this in line. simply put: teens need boundaries, they always have. kids naturally act out to gabe attention from adults in some way, shape, or form. when no one will punish their bad behavior guess what they will act out further to get the reaction they are seeking. they need adults to teach them what is right and what is wrong. instead our schools can't even tell our kids what a woman is. >> can you please define for me what is a woman? >> our focus at the department is to provide equal access to students. >> what does hhs say the definition of a woman is? >> i lead the department of education and my job is to make sure that all students have access to public education, which includes co-curricular activities. >> so you are not going to

answer my question. >> brian: so embarrassing. we are failing this generation. they deserve better and we deserve better. governor glerch youngkin joins us now. you went from the business sector to a political sector with a stunning and successful run to get this job. but what i just described with chicago, this is the same challenges you have on your streets in certain cities, correct? what about that mayor's reaction? is that acceptable? it's not acceptable. the left liberal policies that have all of the sudden decided that permitting violent crime and being soft on criminals is a policy that everyone is going to embrace what we know is it doesn't work and what we see is chaos. the words you used, brian, chaos. and so that's when i came into virginia, we had a 20-year high in murder rate. >> brian: yep. >> we went right to work. and we had to backfill law enforcement and so we had a record investment in law

enforcement and raise salaries and we recognize that we have to prosecute criminals and keep them in jail and, finally, we have to increase penalties. and so one of the things we did this past legislative session is if there is a group of people that are collectively robbing a store, they are going to do up to 20 years if they try to profit from it. we have got to increase penalties for crimes. we have got hold people accountable. and this is all about making sure that we are clear. we are a nation of laws. we are a commonwealth of virginia of laws, and we will enforce them. >> brian: i do think it's important for everybody to get into the inner city. find out what the problem is that forces eruptions like this. at the same time, enforcing law and order. because clearly issues that need to be addressed. we can't wait for families to reconvene and come together. on a different note, a lot of people -- go ahead, you want to follow up on that? >> yeah, brian. i was just going to say one of the things that i did early in our administration was i went and visited with the cities that

are having the toughest issues with crime. and these are cities that are run by democrat mayors and the democrat mayors sat down with me and said we need more cops, we need prosecutors that will put people behind bars and we need witness protection because this cashless bail thing is encouraging people to threaten witnesses so they won't testify. and so that's why we launched operation bold blue line. we are going to bring 2,000 more cops into virginia. we are going to continue to invest in training and equipment. >> we are going to continue to raise pay. and we are going to put more cops on the streets. >> brian: i know you have one term and done. just a year in. a lot of people at you as a presidential candidate and off to taiwan to talk about trade and security. there is something within the republican party i wanted to get your take on. i looked at chris sununu, donald trump, chris christie and mike pence. they are all against what governor desantis is doing with disney and the fight with disney. and i would like to see where you stand on that. and i also would like to see for example i know lego land is going into virginia. if they came out against some of

your policies, like the one you just spoke but would you take them on? would you let them know who's boss? >> well, i have been very clear from the beginning about where i stand on all things. i mean, virginians elected a republican governor. they understand that they have hired someone to go to work to cut taxes, to stand up for law enforcement, to put parents back at the chair seat of the table, not to have bureaucrats and politicians telling parents you have no role in your kid's life. people know what they got when they hired me. and we have been delivering. and i just think the key here is that when we, in fact, are fortunate enough to bring in great companies, into virginia, like boeing, like northrup. like lego and see great companies like hilton doubling down again with us. amazon through awf, these companies are coming to virginia because this is where they know they can build a future because we are going to have great

workforce. >> brian: governor, i know. if they took you on and called you out about a proposal you might be putting coming down the pike in six weeks, what would do you? >> well, the first thing that i do is i explain why we're doing what we're doing. and what i find over and over again is that common sense prevails. and common sense has been a leading indicator for winning states. and that's why virginia is winning now is because in the last 15 months we have injected common sense back into government and virginia is winning. >> brian: all right. desantis right or is trump, sununu, christie, pence right? >> well, i think each circumstance is going to be different and what i find in my own relationships with companies is that i sit down with senior executives and we talk about what we're trying to get done. and i have yet to find a moment where we can't find a place to find common ground. this is -- brian, the bottom line is we have got to find a

long time. now in a big way this week, right now governor desantis and former president trump are head to head in a race for big endorsements. >> the big ron desantis trip to washington was a big win for donald trump. the florida governor was here yesterday looking to make friends for his likely 2024 presidential run but three florida house republicans announced around that trip their endorsement of trump. one gave her support to desantis. that brings trump's endorsement count to seven of florida's 20 republican house members. just one is for governor desantis so far. >> brian: remember desantis is not in yet. chip roy. other republicans are reluctant to endorse too early in the race. if the governor is going to run, is he going to need a lot of help and all the help he can get are from his home state. byron donalds is one of desantis' great friends and biggest allies when donalds decided to go with trump it's big news. in the future could be more challenging than originally

thought. currently polling shows that desantis has an edge over trump head to head with biden in a general election, which is good news for the florida governor. while at the same time desantis support within the g.o.p. dipping just a little bit from just a few months ago as you see. the new g.o.p. battleground is florida. it's the home state of two frontrunners for the nomination. what will happen in florida will reverberate around the country no doubt. and another up and coming florida star francis suarez making some noise. he might be set to launch his own presidential bid. i spoke to him a few hours ago and he is no fan of his governor. >> he seems to struggle with relationships generally. i look people in the eye when i shake their hands. he has had a real struggle with the florida congressional delegation, most of which are supporting the former president. he wasn't even calling people personally at his fundraiser was the one or i think his pollster was the one that was calling, you know, congressional leaders for support. i think it was veteran buchanon that came out in the "the

washington post" last night. i'm comfortable being a retail politician. i'm comfortable talking to people. >> brian: kind of interesting, right? kellyanne conway is a former counselor to the president and fox news contributor. charlie hurt is a fox news contributor, too. let's start on the right. kellyanne, your thoughts about the florida congress men and women going to the former president more than the governor. >> it's big news and i think mayor suarez and "the washington post" article told you partly why, brian, because donald trump works the phones. nobody is going to outwork him. nobody is going to have more energy. and he has been racking up endorsements and making calls to different people because he wants to show them that i have done the job before. i want to do the job again. also, i think that ron desantis has frittered away so much of the last five and a half months talking about woke this and disney that and not putting out an economic plan not having serious policy people fly to totallahassee education group, ukraine group. crime group. just go to listen to what some

of the experts in your own party have to say. the other ironic thing is that ron desantis has a really good record as florida governor to run on. no question about it. i agree. he is going to be stuck in florida or he's going to be criticized for spending too much time out of florida. just this week some floridians said we were under water here. our entire airport and community was flooded and he was over in ohio raising money or whatnot. last thing, ron desantis made a big mistake by allowing himself to be seen as the alternative to trump rather than as the alternative to biden. and as he said from the get-go i'm not the alternative to trump i'm the alternative to joe biden. he could have supported himself in that man o man race. the threat running hasn't stopped other people. chris christie. francis suarez. asa hutchison, vivek ramaswamy, nikki haley. joe biden 67% among joe biden

2020 voters so people know he is vulnerable. i think ron desantis has not handled trump well. last point this statistic in new hampshire is devastating. the university of new hampshire poll in january plus 13 desantis over trump, the latest one plus trump 20 over desantis. it's a swing of 33 points in three short months. >> brian: charlie, the thing that the former president is looking at is possibly two more indictments and you have a rape trial in a week. any one of those things in the past for any other candidate. >> not a rape trial. >> brian: it would be over. >> yeah, all of these political persecutions and as kellyanne points out, you know, they are absurd. they're ridiculous. they're his enemies and it reminds everybody just how nasty democrats are willing to weaponize the judicial system in order to go after donald trump. and, you know, obviously we have seen the polling, it helps donald trump in the primary but i would argue that it probably in the end also helps him with

independents and in the general election because what republican voters are seeing right now, these lunatics like alvin bragg in new york and there are other places around the country that what they're doing to donald trump regular independent voters see it, too. so i think it's effective all around. in terms of the florida thing let's also not forget to step back to the 30,000-foot view, florida was still a swing state before 2016. and because of donald trump and because of, more importantly, because of donald trump's policies, florida is no longer a swing state. it is a dyed blood red republican state. it's been salted away because of the policies that donald trump has espoused and obviously donald trump got ron desantis elected. ron desantis' wonderful, his resume is the state of florida. the problem with that is that he's going to have to figure out how to convey that to people who don't live in florida.

and if he's losing 8 to 1 among the congressional -- endorse. s don't matter in the end. if he is losing 8 to 1 among endorsements. >> brian: it's going to push up his timeline, i think, for sure. now let's talk about joe biden. why do you think, kellyanne, he all of a sudden is going to announce tuesday? what happened? i thought we were waiting until october? >> he can't wait because now there is pressure. kennedy, i saw the poll today of the 2020 biden voters gentlemen and biden has 67% of the vote. robert kennedy has 14%. there's nothing that quite screams like future in energy in the democratic party moving on as they like to say as having a biden and a kennedy running for president. you might as throw a couple clintons in there for good measure or a couple carters. but, look, i think joe biden's personal attributes are his real undoing, brian. 67% of the americans say he doesn't have the strength or stamina. they don't think he has a plan. they don't think he cares about people like them.

brian brian all right. welcome back. earlier this week we showed you and told you a story. it's a bombshell report that appeared, of all places the "new york times" exposing the biden administration's white house for ignoring science of exporting trafficking among migrant children. it's happening right now. the "times" says these kids came to america, put to work, spending nights in slaughter houses, replacing roofs, operating machinery to pay off their smuggling debt that got them to this country to begin with. some of these kids are as young as 12 this is child labor. we handled this over 100 years ago. it's illegal in america. somehow these child sponsors are getting away with this putting these children to work. why? we now know it's because the government ignored it. they let it happen. that's not what the white house was delegate us when these reports first came out.

remember there is another factor vetting making sure these kids are going to homes that are safe and review process. certainly why don't want to expedite that to where they would be going to harmful homes. oops, they are. that's exactly what is happening. my next guest linda brand miller helped the "new york times" blow the lid off that story. she personally behind the scenes migrant shelters. she used to work there told the "times" in 2021. suspicious cases to her supervisor. one was man wanted to sponsor two boys construction. sponsor two children half to work off the cost of taking them north. bran miller knew this was not good. she took it up the chain. she emailed president biden's department of health and human services and told them this was urgent. what happened next? well, listen to this. here's the quote. ms. bran miller also emailed the shelter manager. a few days later her building access was revoked during the lunch break.

she said she was never told why but she was fired. let's get this straight. people who are trying to help these kids weren't only ignored but they were let go. something doesn't seem right here and it's happening right now. if these people can't protect the children who can ? linda brand denies miller joins us now. how shocked were to you find out this was happening. >> not as shocked as some might be because i have about 20 years experience working in immigration, working with these children the emergency shelter system by design is going to come up with these problems because it's a stop-gap measure. it's not a good fit. i know that -- you know, the theory is that there were so many kids coming in they didn't know what to do with them. but there is an established shelter system already in place to put these children and that's -- it's not a perfect system, but that's the avenue that should be used instead of

these emergency facilities because there's just not enough time to vet and to oversee. >> brian: linda, how do these people sleep at night snowing some 13-year-old is working 16 hours a day unable to see another human being or own families wondering where school is or future lies what country is this? how hard is it to know that that is going on right now? >> a very painful. and i can't count the number of times that i'm just -- i keep saying but they're children. people correct me and say they're immigrant children. and sometimes we seem to be differentiating in our minds that these children somehow don't deserve maybe what our other children do, but that's not true. no child should be put into those kinds of slave labor conditions. they should all be in school. and you know, unfortunately, they -- many of them do have to work and skip school in order to pay back the debt in order for them to get here. >> brian: hhs secretary according to the story becerra
