aishah, you would make a great umpire. >> aishah: i was a referee back in the day. i'm in for sandra smith. everyone is talking about in washington today, coming from the white house. >> john: fox news alert to top a brand-new hour, minutes from now the white house will face questions on any number of hot topics, unlike the president himself, seemed to know what the topic was when he faced reporters the first time in more than a month. it happened at this time yesterday during "america reports," president biden in the rose garden caught with a detailed cheat sheet during his news conference. >> aishah: photos reveal he had a note card identifying the l.a. times reporter he called on, complete with her picture along with the very topic she asked about. >> john: critics questioning how the white house staff handles the president and whether they are worried about him answering questions off the cuff. it comes as the 80-year-old president begins his campaign for another term.

lawn as we await the briefing today. peter, any reaction to that gdp report? >> the spin, aishah, about the gdp being 1.1% instead of predicted 2%, today we learned the american economy remains strong as it transitions to steady and stable growth. this past quarter real personal disposable income increased and american consumers continued to spend, even as the overall pace of growth moderated. and the economy is a problem for the president, especially now that he is a candidate. just 21% in the new fox news poll say the economy is excellent or good, 78% say it is only fair or poor. and that as there is new confusion how a very close copy of a question president biden was asked yesterday wound up pasted on president biden's preparation materials beforehand. the l.a. times is telling us

biden administration, i was outraged when i heard about this, and think it makes all of the people who rely on us to be independent arbitors, it erodes our credibility a bit. >> aishah: you cover the media, obviously, a big dinner, the white house correspondents dinner. i want t know how the press corps and the white house should respond to this. if folks are, out of courtesy, sharing with the press secretary staff what they're interested in, what topics they are covering, do you think after this those reporters should get together and say you know what, maybe we don't do that anymore? >> i don't have a great problem with a once a year dinner fest, hype with the pre and post products. >> you love the nerd prom. >> nerd prom indeed. but was the reporter kind of fooled into tipping her hand. press secretaries of previous white houses have told me they are all sniffing around, the

advantage to know the question is coming and also, you know, i think the fact that the presser was held at all shows that maybe some of the criticism of how inaccessible joe biden is to the press corps may have broken through. the last two meetings with foreign leaders he did not hold it, this time he did, and then it blew up into the controversy. >> john: two minds of everything going on here, trying to prepare the president during what is typically, i've never seen it done that way, typically, i've been to a lot of things, typically an ad lib situation, are they trying to arm him against that or is there some horse trading going on, hey, you want to ask a question, let us know and we'll call on you. >> that would be even more serious. but i do think in terms of the advantage to the president and in terms of the way it's perceived by the public, it reinforces the notion that the president's top advisors want to

shield him from unscripted encounters with the press. so, what's more scripted than having a few words so you know where to go. it's like, you know, a ball player, here comes the pitch, you know it's a curveball, and like that. >> john: it did not say here is the topic of the question and what you should say, it was framing out the question, not verbatim. >> of course but when it has the words reshoring semiconductor manufacturing, and if you have an inkling what's coming, it's easier to prepare, the staff briefs you and easier to connect. >> john: usually you get talking points, not a question. that's what's weird about it. >> a lot of weird things about this. >> aishah: dana perino brought up something on this, and she's been on the other side, the

day, that is an increase from even a month ago. >> john: nate foy is live, in brownsville, texas. a couple questions, does border patrol have enough resources to handle the surge and what are you hearing about the plan unveiled on title 42 this morning? >> john, we'll get into the plan in a second. resources here in brownsville are already stretched two weeks before the end of title 42. laredo sector agents are helping the rgv agents process the thousands of migrants arriving in brownsville every single day. take a look at this video. yesterday, almost 2800 migrant encounters. the days before, 262100. but take a look at this next video, not just here in brownsville. el paso, a dire situation, you see migrants outside a shelter. the shelter is already overrun and just across the border,

35,000 migrants wait in mexico. you mention the biden administration laying out the plan for the end of title 42, it involves increasing legal immigration, setting up processing centers throughout latin america, and increasing deportation penalties to include a five-year re-entry ban. here is secretary of state antony blinken talking about it. >> it's an approach focused on making migration more safe, orderly and humane, and on advancing the interests of the american people. >> take a look at the human smuggling chase in laredo, troopers busted the 18-year-old driver after a crash. apprehended four illegal migrants and took another one to the hospital and back out here live, we are already seeing thousands of crossings just here in brownsville. after title 42 ends, border officials are expecting 10,000 illegal crossings every day across the southern border.

>> john: president biden moments ago stepping up the war on drugs along the u.s.-mexico border. president issuing an executive order and sending it to congress which authorizes the call-up of the ready reserve in the army, navy, air force and the coast guard to go to the border to support homeland security operations to curb the illicit

drug trade, to fight cross border trafficking of drugs, particularly fentanyl, we know in the year 2022, killed more than 100,000 people in this country. so, we'll keep following this and have the latest on it for you coming up just as soon as we can. meantime, a congressional committee examining the threat from the chinese communist party says the fbi is not sharing information about its efforts to stop beijing covert police stations in the u.s.. you may remember two men were arrested for allegedly running one such station in new york city chinatown. one of the suspects got to rub elbows with a leader. and christopher wray is testifying. what has he said about china? >> the fbi director says they need $600 million more this year as they focus china's efforts he

says to lie, cheat, and steal can to surpass the u.s. >> and we have grown the number of investigations into the chinese government and their actors by about 1300% and we have well over 2,000 active investigations into that threat as we speak. >> his testimony comes as the house-led committee on china is demanding the fbi be more transparent about china's ongoing trans national repression efforts in the u.s., to answer basic questions, like how many chinese secret police stations are there in the u.s., when did the fbi first learn about the stations. so far the fbi has not even provided information behind closed doors in a classified session. a bipartisan committee sent a second letter to director wray demanding more transparency by the end of may, writing we are disappointed the briefing failed to provide a response to any of our questions listed in our

initial letter and did not inform select committee members about the significant threat of trans national repression by the ccp. experts say the chinese communist party is operating a sophisticated network of secret police stations, aid centers and nonprofits in the u.s. they say this network harasses, controls and intimidates chinese americans in and is secretly trying to influence u.s. politicians. this month, they arrested two suspected ccp agents in new york city chinatown under the guise it was a chinese cultural non-profit. one of the suspects seen here was photographed rubbing elbows at the event with mayor adams and chuck schumer. records show he and his brother donated $32,000 to new york democratic politicians and john, politicians need to be alert and need the fbi to play ball so they can alert everybody. >> john: yeah, head's up to

what they would refer to as their 9/11, when abu dhabi was hit. does that surprise you? >> disappoints me, i have to say. unfortunately doesn't surprise me. just a couple of things here to point out on this issue with the ucht a.e. potential naval base for the chinese. from a military perspective, it does not cause a problem. they only have the chinese only have one other naval base outside of their territory in the world whereas we have more than 100 naval bases scattered throughout. so, in terms of power we have no problem handling that if we needed to. but the influence is a far bigger issue and very thing you are talking about there, i think we are starting to see on a broader scale and this does pose a problem to the united states and that is we have basically abandoned the diplomatic field across the world and we handed that over to china and they are taking advantage of it in countries all over the world, north and south, asia, europe, the middle east, and this is just another one and if we don't

get back involved in the diplomatic field and don't rely just on military coercion, we are going to find they are losing more than just a few friends. >> i know you are saying the base is not that big of a deal, we have so many more, but why would our friends, allies even consider to allow the chinese to come in? >> well, that's the problem and this is the result of it. china is aggressively and going to countries all over the world, hey, we have a better deal for you than the united states does. if the united states is not even talking to the u.a.e., the chinese are. and look what happened between saudi arabia and iran. they have some -- they have not had -- we have never been able to bring that to bear and no coincidence shortly thereafter, saudi arabia is willing to do some of their energy deals in the chinese money and not just the dollar, and the same thing in brazil, and even some european leaders. we are seeing the areas supposed

to be our strengths, china is making inroads because we are not present on the realm and the administration is just not putting enough emphasis on diplomacy. >> aishah: fair to say xi is trying to play the mediator and fix issues like the ukraine war, and had a visit with macron, all of this while china sends spy balloons over our mainland while the white house says the president still has not even spoken to the chinese president, so is the president, is biden slow rolling their response to china? >> yeah, this is a huge problem. i said on this network in the aftermath of the balloon mess, when blinken canceled the trip he was going to go there because of all the stuff that had happened and he had not been in more than a year prior to that, and look at, if you are not talking to the ccp, if you are not talking from the biden to xi

cornered by police, and did not come out alive. steve is following the wild story for us. >> that's right, the fourth inmate is dead but comes only after a two-hour gun battle with police. one deputy was wounded in the fight and dylan arington, 22 years old, in jail for car theft. the house went up in blazes during the gun fight. >> shortly after i got here gunfire was already being exchanged, even before the swat teams arrived, and other law enforcement agencies arrived. it was clear someone inside of the house was actively shooting at law enforcement. >> those four mississippi inmates escaped through the roof of the prison. one of them, arrington now dead, stole a motorcycle, he crashed it, a good samaritan offered to help him. that was a mississippi pastor

anthony watts, 61 years old. instead, he shot the pastor multiple times and stole his dodge ford truck. left a community of parishioners in grief and mourning. >> when i got ready to leave i told him, i was going to go home, so he turned around, and he hugged me. >> the hunt is on for the other three who apparently have gone their separate ways. some surveillance photos of one of them in houston, he escaped from the same prison just two years ago. this prison has notoriously lax conditions. one judge cited for having cell doors that don't even lock. back to you. >> stunning story, steve, thank you. >> john: and ethics questions growing, scrutiny of the conduct of supreme court justices

intensifies. media reports continue to slam thomas and gorsuch over real estate transactions. >> i believe in the separation of powers but that does not mean anything goes with the supreme court. they have to have a code of ethics. >> after what clarence thomas did, lucrative gifts and travel and perhaps thousands of dollars for purchase of his mother's home, the current system, whatever it is in the supreme court, is inadequate. >> john: let's bring in shannon bream, great to see you. you were up at the zoo with the bears. >> i was, hanging out with some bears. >> were you wearing that with the bears? >> i did not, but i did wear the tony tail with the bears. >> john: chief justice john roberts said he's not going to

testify, but is this a legitimate investigation into ethics complaints of the supreme court justices or like the leak of the dobbs decision about this time last year, an attempt by democrats to intimidate and put more pressure on conservative justices and try to delegitimize the court? >> that's the take mitch mcconnell had on the floor, interesting they always come after these specific justices, always the republican appointees, but the question of ethics, a back and forth and thanks but no thanks, i'm not coming to testify, and they say the last question left us more questions than answers so we need to know how ethics are handled at the court. >> aishah: i want to pull up a tweet here, president of the judicial crisis network, don't know whose turn it will be but name three justices it won't be,

sotomayor, kagan and jackson, it's about intimidation. doesn't this open a dangerous door? >> you heard senator blumenthal who mentioned a subpoena, he is talking about separation of powers and we want to respect that as much as we possibly can but the legislative branch also funds the judicial branch so when they ask for money, it's the one time you will see them come up to the hill to actually have to testify. but interesting that yesterday or a couple days ago the letter from the chief justice had an addition to it, attachment that laid out the ethical things they follow, all nine of the justices signed it. so i think it was a show of unity that they expect that they can handle things internally, they say, and does not seem to split along ideological or partisan lines up there. >> john: we have the organizations from outside the supreme court trying to give us the idea that there's division in the court and between the justices, but almost -- to occasion they always come

forward and say no, we might disagree on matters of the law but all together as colleagues. alexandria ocasio-cortez, her hyperbole is off the charts. barring some dramatic changing, roberts court will be known for rank corruption, erosion of democracy and stripping of human rights. you can have your position on the rulings that come down from the courts, is that what's going on? >> remember just less than a week ago there was a ruling from the supreme court late on friday that kept mifepristone, for medicated abortions, kept it on the market and then they were praising the court, like the court got it right, they know what they are doing so when they make decisions that don't match up with your ideology it's easy to go after the court but interesting how some folks less than a week ago were praising the court for getting it right on that ruling. >> aishah: it's a messaging, we are heading into the election

year and nowhere in the republican controlled house, it could be to shore up the base. >> angus king is independent, but caucuses with the democrats and lisa murkowski said they want the justices to be forced to write to and commit to an ethics code. if it gets through the senate, i'll be surprised. see you on sunday. >> aishah: fox news has exclusively obtained a new photo of convicted killer scott peterson after nearly 20 years in prison. take a look. photo shows the convicted murderer chatting with family from prison almost 20 years later, they still say he is innocent and now he is filing a new appeal. fox senior correspondent laura engel has more on the story. how likely is it that scott peterson might get a new trial? >> we have to wait and see on that one. a couple new pieces of

information, and the new appeal filed last week in california, and the document lays out six claims, some involving what scott peterson and his family call new evidence that they hope will eventually exonerate him. and as we take a look at this new photo we obtained for this report, we also obtained this shot. this is peterson with his family taken during a video call from san quentin state prison last year. peterson is actually sitting in a concrete cell, we see a virtual backdrop behind him showing a simulated window, trees, couch and pillow. no one has ever seen that photo before until we got our hands on it. it has been 20 years since laci, eight months pregnant vanished on christmas eve. overturned on 2020, the death pen penalty and is now in prison
