>> we are out of time. >> good evening welcome to america's late news. volume trace gallagher in los angeles. breaking tonight justice samuel alito thinks he knows who these last years draft of a supreme court ruling that would overturn roe v wade and we will take you inside an unprecedented campus revival involving a giant venue 80,000 people in a very controversial rapper but because the republican plan to secure the

southern border days before title 42 is set to expire. jeff has details of the plan. >> they have had control for four months but republicans say they have a plan for the southern border and they are seeking change at the border but with the man who is in charge of security. >> most americans know this is out of control on the open southern border has to be closed and resolved. it was get back to the legal system that should be working for everybody everybody should know what the rules are. >> he continued to confirm border wall would resume border agents would get a pay bump and those seeking asylum would have to do it at a port of entry and pay $50 fee there's talks of impeaching the homeland security secre some democrats are pushing back already. >> it's a rehash of the same it

doesn't deal with the issue it doesn't deal with the challenge it doesn't deal with the urgency of where we're at right now. >> another devastating aspect the ongoing functional crisis but families of 60 young people who die from overdoses are pointing the finger of blame at snap chat they are suing and accusing the platform of playing a role in drug sales with this disappearing message feature providing cover for the sellers and no paper trail for law enforcement. student there was a colorful drug menu on snapchat. a dealer that failed in their produce he ordered something off of that menu like a pizza and it turned out to be fentanyl and it killed him. >> a spokesperson for snapchat says they remain committed to shutting down drug dealers but
9:03 pm
they feel like this is riddled with false claims. >> let's bring in the congressman from texas. lance goodwin. and former congresswoman took a good swing and your colleagues today listen to her and i will get a response. >> their ideas are too extreme. interesting about this despite the anti-immigrant rhetoric the american people still support immigration we want to see a humane immigration system but republicans don't have real solutions. >> no solutions. your thoughts? screw the pot about americans wanting a humane immigration system is right we can agree on that but i don't agree with the characterization of our plan is inhumane or non-moral or non-christian we are trying to enforce laws that protect
9:04 pm
americans were trying to give legitimate asylum-seekers their place in line and right now that system is being abused everyone is coming across the border claiming asylum they are being shipped out all across united states. catholic charities with money from homeland are making this happen then democrats don't have a plan and they don't want to get on board with securing the border. she might not to mention the fence and all that's killing thousands of americans families of 60 young people as you may have h who died a fentanyl overdose suing snapchat here is one of those moms. >> i had no idea that snapchat's algorithm was pushing drug dealers to my kid. and that he could get drugs through snapchat that they would solicit him and he could get them delivered to the house as easily as he could get a pizza delivered. i had no idea and they were not only drugs they were fentanyl placed drugs and that's what killed him. >> there appears to be absolutely zero desire to close this border so what's the solution for this crisis? screaming there's a lot of solutions declaring fentanyl a
9:05 pm
weapon of mass destruction is one that i asked president biden to do last year the parent you just had on the first word she had on was i had no idea. parents are going to have to wake up and know that their government as long as democrats are controlling the senate white house the government will not take care of them or protect their children until republicans are fully of charge so parents have to be alert they have to wake up and educate children about how serious this is. these are not just the drugs from the 80s and 90s these are serious deadly weapons. spin with the production of america's number one killer fentanyl often begins in china with the creation of the drugs precursor chemicals those chemicals are shipped to mexico where it is manufactured and distributed primarily by the cartels. you think it's actually a decent idea to maybe sue the cartels. sue the chinese. sue the government straight
9:06 pm
>> we need to stop giving them free passes the chinese are absolutely indirectly if not directly involved. as their goal to take our nation down there on their way with the fentanyl trafficking overseas up through mexico and across the southern borders. the cartels should be held liable as well this idea that the nation can't be held liable for killing our united states citizens is crazy and it needs to be changed. >> justice samuel alito says he has a good idea who is responsible for the unprecedented leak of the supreme court's draft decision ahead of the ruling that overturned roe v wade. kevin is in washington with the breaking information. good evening. >> power sources that the supreme court tell fox news 70 individuals at the high court may have had access to the opinion of the dobbs case with tuesday marking the one-year anniversary of the leaked draft
9:07 pm
that signaled the court was ready to overturn the landmark roe v wade abortion case. the offif the opinion says he likely knows who did it. telling the "wall street journal" have a good idea who is responsible but that's different from the level of proof that is needed to name somebody. now alito believes the leak was an effort to intimidate the court and for time created an atmosphere of suspicion and distrust. adding that it was rational for people to believe that they might be able to stop the decision in dobbs by killing one of us. the probe of the leak ended in january with the court's concluding it was unable to identify a person responsible by a preponderance of the evidence. an even lower legal standard compared to reasonable doubt. and on capitol hill the house judiciary committee chairman jim jordan is not satisfied with the lack of answers he is
9:08 pm
getting from government agencies concerning their alleged coordination with big tech companies to censor speech so he is subpoenaed many of the agencies including the department of homeland security and the cdc. >> we want to know the communications that they may have had with big tech companies prayed we know the fbi was involved. >> a spokesperson for dhs said the agency does not engage in censoring speech and does not request the content be taken down despite what we have learned from independent journalists and the so-called twitter files. they have suggested that a much more. >> kevin is in dc. thank you. let's bring in the media research center contributing writer stephanie hamel and it's
9:09 pm
great to see you both. curtis we know the height of the pandemic the cdc was telling big tech who and what to censor. jim jordan subpoena reads the following. it is necessary for congress to gauge the extent to which the cdc coerced, pressured, worked with and relied upon social media and other companies to censor speech. now it's about the extent of the censoring. >> exactly. this is the teeth that conservatives and my colleagues at free speech american my boss have been calling for for years. what did the cdc now and when did they know it? we at news busters documented last year 275 million examples of secondhand censorship many involving the cdc and a lot of the coordination for years. we have documented nearly 5400 examples on our sensor track database of censorship. so americans deserve answers.
9:10 pm
>> yeah they do on the problem here is that maybe you get answers consequences are very difficult to achieve. >> we might get the answers and as you pointed out a lot of people aren't punished for some of the things they have done but as you pointed out the twitter files expose a lot of what many of us knew what was going on but now there's actual evidence to show that the possibility of the government persuading and having big tech sensor conservatives and dissenting voices and so we have jordan who is asking three agencies to be subpoenaed in march they had asked for this information and they decided not to so this is why they're going forward so there are so many things that haven't been answered and we want to make sure this doesn't happen again in the future. >> abc journalist admitting they censored robert f kennedy junior listen to this.
9:11 pm
>> during the conversation kennedy making false claims about the covid19 vaccines and we use our editorial judgment and extended portions of that exchange in our interview. >> we did you a favor. we kind of took this out of there because that can be harmful. it can be triggering. >> that was a stunning disclosure from abc news. they are inviting controversy. you have to appreciate the transparency saying they edited down the interview but that goes with the understanding it's not a live interview some things might be edited down. i disagree with a lot of kennedy's views on a lot of things.vaccines, kind of abhorrent but it doesn't mean the speech be silenced and you can have someone afterword fact check it if you're going to air it so now the cats out of the bag great >> and there's a difference. like curtis points out there's a difference between saying we
9:12 pm
don't agree with this and this is flat wrong and we are taking it out of the script altogether. >> this is an egregious violation of journalism ethics. it's one thing to cut it interview short because there's only a certain amount of time that you have but they didn't want him to speak on covid19 on vaccines and as a presidential candidate he has the right to share his views in those who potentially could be voting for him should know what his views are on this so what we have learned over the pandemic, that a lot of these networks got it wrong when it came to the vaccines and to covid19 so why is that they are the ones in charge of letting us know what's right and wrong even after everything that's happened. stream with the vaccines the mass mandates. the list goes on and on of the things i got wrong and they are deciding we are going to pick and choose what we leave in our editorial take out.curtis and

stephanie thank you. 2 middle school teachers are suing education administrators to deceive parents about their children's gender identity. marianne rafferty is here with this story that's a good one. certificates concerning to all parents. questions on the table does a student's right to privacy in this case talking about 10 to 14-year-olds that way appearance right to now and should teachers be forced to comply if they don't agree with it? two san diego mughal schoolteachers are siding with parents a claim in a lawsuit the escondido school suit policy that prohibits him from telling parents when a student is struggling with gender identity conflicts with their religious beliefs. the school district which impose the rule of february cited state law which protects
9:14 pm
the right of transgender students to keep their transgender status private disclosing it without the students permission may violate the student's right to privacy. those teachers say the parental exclusion policy violates their catholic and christian beliefs about parental rights. big picture and hundreds of districts nationwide these policies are not written down and parents don't know if they are unless they ask. parents need to really watch what's happening in the schools. >> sometimes this stuff kind of slips right by. and in the larger sense the renewed focus on parental rights has revealed some surprising truths about the state of education check out the data from our most recent polling basically half a parent survey view transgender policies and parents not having any say into what's happening in schools as a major problem. watch. >> we should have policies in place that are transparent respect parents and allow them to know what these policies are when the impacts their children.
9:15 pm
>> let's bring in the criminal defense attorney federal litigator. it's great to have you want. i want to read part of the lawsuit. those new policy force teachers and a student for social transition by using any pronouns are gender specific name requested by the student during school wall reverted to biological pronouns and legal names when speaking with parents in order to actively hide information about their child's gender identity from them. can you imagine your child is being given a different name in school addressed a different way and you have no idea about this. stream and let me take all of those words. light of the parents. because a five, six, seven, 89 10-year-old boy or girl says something about how they may feel if it's permanent or temporary but you must lie to the parents for you can't interest raising the children to the parents that's for the
9:16 pm
school to do. it's a frightening thought. >> and we cover this story earlier they were pointing out they have to send permission slips home if you want to give your kid an aspirin if you want to go on a field trip you have to have parents permission but if you are in the process of being a transgender we are going to hide this from the parents. stream of there's no other way to slice it. that's exactly what's happening. drop your kids off and the kids have to be protected from the parenting. that's the bottom line and the federal complaint it's very clear that the district is saying we can't tell the parents because of some harm that may come their way from the parents let's forget about what may happen in society. >> the parents of ethan chapin one of the students murdered in the university of idaho is speaking out. listen to the mom and we will bring the rest of the legal aspects. >> we just walked it out. talk. told stories. cried. one day i was out walking by myself i was crying so hard.
9:17 pm
it shifts whatever.and i happened upon somebody and i thought they were going to call 911 on me but it's okay. i'm just having a moment. >> you imagine the heartache of those parents have we learned that the attorneys want to talk to the surviving roommate bethany funk. is that fine is it not find what are your thoughts on this? >> we talk about the rights of criminally accused and victims as some of the victims family members it's a real balancing act. let's not forget there is a presumption of innocence he has a right to due process so that this individual is a witness in some way shape or for every right to try it but it doesn't mean the witness has to answer less called to testify at trial but you have a right to put on your defense so unfortunately the victims may have to deal with that.
9:18 pm
stream with the teacher that got shot should get no more than a workers comp quoting the virginia school district for a six-year-old student shot his first grade teacher has filed documents asking court to throw out the $40 million lawsuit arguing with her injury she is only entitled to workers compensation. >> workers compensation when did that come about? the 1900s in response to the industrial revolution we don't want small business owners to be put out of business because of injuries on site. it's in the scope of work at that the location of work the argument by the school district may actually hold water and worker's comp. may be the only way they can have recourse very >> it seems if you have a kid that shoots the teacher there would be more than worker's comp. in this thing. >> against that defendant yes but other defendant may be some parenting issues are other influences. it's negligence provided the gun at certain places but worker's comp. sets the bar when it comes to workplace

activity. >> and then tonight's real news roundup bills would have further restricted abortion in nebraska south carolina failed to pass after coming up one vote short. nebraska prohibits abortion after 20 weeks 22 weeks in south carolina and the third time in less than a year this type of bill has failed in south carolina and a colorado democratic governor jared polis signed a new gun law, a couple of them but require a three day waiting period when buying a gun in the minimum age of 21. they also expand red flag laws that make it easier to sue gun manufacturers in illinois a federal judge issued a temporary injunction meeting for now a ball landing high-capacity magazines and semi- automatic rifles cannot be enforced.the democratic governor signed the law in january but today in his ruling the district judge said the court must be mindful of the rights guaranteed by the constitution.

stole 20 grand from the safe along with the english bulldog puppies and other items worth $10,000 each. >> the common sense department and everyone else realizes the d fund the police movement was a monumental mistake. in almost every major city the number of police officers is down and crime is up but now some areas like los angeles are doubling down on their mistakes instead of hiring more police and deputies they are shifting millions of dollars toward security ambassadors. these are uniform security personnel who are unarmed, untrained and under the impression that by just being visible the bad guys will turn tail and run. in west hollywood a road rage incident broke out two men got out of their cars and proceeded to beat the daylights out of each other. security ambassadors standing

feet away did nothing. common sense understands these ambassadors are not meant to respond to violent situations but security is in the job title and they are taking the place of a deputy or police officer and common sense would like to point out the motto of the security ambassadors is to make people feel safe again. unless of course you are getting pummeled at the intersection of hollywood and vine in which case you are on your own. >> as drugs gain in popularity among a growing number of overweight americans a powerful medication may be poised to blur the line between treatment of type ii diabetes and weight loss let's bring in a board certified medical doctor. it's stunning to me because i want to run this down because it says industry analysts predict that mounjaro could

>> the "wall street journal" said more kids get weight loss surgery to treat obesity more children are getting systemic surgery. the most drastic measures the doctors are recommending to confront relentlessly rising obesity rates. i see them going up but surgery seems like that would not be your first choice. >> i think it should be a last resort for a kid who is so obese and they have such severe disease related that they could die young because of this but you look at children they don't take energy out of the air. someone is giving them that food. this food is being given to them provided by adults.it is the job of the adults to regulate their food what's in it and how much they are consuming so this is a parent and school issue and if they are not providing that why not?
9:32 pm
if we invest in healthy food for kids, inner-city kids who are the ones at greatest risk of obesity we would have to go to the surgeries but doctors are making money off of surgery and not diet and exercise. it's a problem. >> tonight were taking a closer look at the worst-case scenario for artificial intelligence someone to take steps to make sure ai cannot launch nuclear weapons against human creators. here is a congressional correspondent. >> ai is amazing it will help society can also kill us. >> the democrat representative wants to prevent artificial intelligence from launching a nuclear weapon. so he has teamed up with a group of bipartisan lawmakers on a bill that would turn a current pentagon policy into law the defense department mandates humans must be in the loop for any launches by an
