but first this. begin with two cities in crisis, including one that just declared a state of emergency. >> trace: leaders of brownsville, texas are under extreme pressure to house the 15,000 migrants that cross the u.s.-mexico border in the past week. >> sandra: the same problem, trace, crippling a city thousands of miles away. chicago officials say what used to be ten migrant arrivals a day is now close to 100 in that city. and shelters say they cannot keep up with the surge leaving dozens sleeping on the floors at police stations across that city. >> trace: the chicago mayor is calling for the federal government to step up. homeland secretary security mayorkas said this yesterday. >> this is a really tough challenge. we are seeing a level of migration not just at our southern border, but throughout the hemisphere that is unprecedented. >> sandra: right to it with national correspondent griff

jenkins, there in brownsville, texas for us near the border. how are border officials preparing for this surge? >> good afternoon, sandra. they are preparing by surging resources. you can see brownsville city trucks bringing in supplies, stood up camp monument here. we are at ground 0. the last 24 hours, 2,261 migrants encountered here. drone footage shot a few hours ago, you can see the area where they are surging resources, building temporary sites and this group of migrants, more than 150, the majority of which are venezuelans, that's what we are getting here, and that is really why this area is ground 0 for this surge that is coming well ahead of title 42 lifting in ten days. now, fox news got an exclusive look along the river, take a

look at this next piece of video. we can show you, you can see the texas dps troopers along with the national guard, trying to help people out on the river on the other side, the massive migrant camp is sending migrants across all day long, 24 hours a day. that is why there are so many resources sent right here in brownsville where they have declared an emergency. now, over in el paso, that area also bracing for the worst. they say over 1400 migrants in the last 24 hours, you can see video and pictures of the migrants in el paso spilling over. that's why the el paso mayor has declared a state of emergency in his city as well and he's responding to secretary mayorkas. take a listen here. >> i did talk to the federal government the other day, to secretary mayorkas' office and told them we have to change and it's really important we change

says it's working to encounter drug traffickers and human smugglers by communicating what asylum seekers can expect. a roadblock in the senate. >> the only way t secure the southern border, folks, to get the white house back. we are going to pass a meaningful immigration reform and law out of the house, but once it gets to the senate, it's dead, dead on arrival over there. >> while the white house has been facing plenty of pushback from congressional republicans, also human rights groups have been critical saying they are not helping asylum seekers enough. a lot of blame to go around it seems. >> trace: indeed. mark, thank you. sandra. >> we are completely tapped out. we have no more space, no more resources and frankly we are already in a surge. >> sandra: that's the outgoing chicago mayor, lori lightfoot. urging texas governor greg

abbott to stop sending bus loads of migrants to her city, a sanctuary city. families are sleeping inside police stations as the migrant shelters have hit capacity and likely to get worse when the thousands more at the border when title 42 ends. leo terrell, as if it's a major shock that it's happening, they cannot handle it, do not have the resources for them, and it is making matters worse for residents who are already struggling in these big american cities. leo. >> you know, sandra, it's so embarrassing, what lame duck lori lightfoot is stating that it's a problem that greg abbott is creating. all she has to do is look east and pick up the phone and call joe biden, kamala harris, and the most incompetent department of homeland security chief ever, mayorkas, and tell them to enforce the border. mayorkas is unlikeable by his own border people.

>> sandra: a shocking report from the wall street journal is exposing prominent names found on convicted sex offender jeffrey epstein's private calendar, it was after he served time in jail for sex crimes involving a minor. hi, c.b. >> when contacted by the wall street journal, all the people mentioned tried to distance themselves from epstein. some said they thought he had served his time and had been rehabilitated. the new reporting from the journal affirming once again epstein had access to very prominent people. the newspaper says no chance encounters. writing these meetings were

booked into epstein's schedule between 2013 and 2017, years after he registered as a sex offender in 2008. he served about a year in a work release program. the journal admits it can't verify every meeting and does not know the purpose for most of them. a spokesperson for now ci occasion director william burns tells fox epstein offered advice to burns roughly a decade ago when burns was deputy secretary of state and was looking to leave government service. kathryn remler a top lawyer reportedly had dozens of meetings and travel plans with epstein. the journal says see if there is a first class seat. if so, upgrade her. a spokesperson for her current employer, goldman sachs, tells fox she never traveled with him and the meetings were for potential business. she says she regrets knowing

epstein. calendar and other things show the scope of epstein's circle was wider than previous reported, university heads and professors as well as banking executives also listed in the new materials. you'll remember epstein was found dead in 2019 in his new york city jail cell of apparent suicide while awaiting trial on sex trafficking charges. he denied doing anything wrong, sandra. >> sandra: something we will continue to watch. >> trace: investigations into hunter biden are colliding in arkansas and washington. hunter appeared in court over a child support fight over his 4-year-old daughter, but it could have larger implications for him and the president if it sheds light how hunter biden makes money and the biden family business dealings. jonathan turley, professor, great to have you. sound bite from james comer, it

caught your attention today and you can explain exactly why. watch. >> sandra: are you standing by witness -- witness intimidation, the witnesses and the whistleblowers are being intimidated by the president's sons lawyers? you stand by that and you have evidence of that? >> it depends on your definition of intimidation. if you get a call of the lawyers and remind you of your potential liability in some of these business schemes, yes, i would consider that witness intimidation. we are going to ask for immunity for some moving forward. >> trace: you immediately tweeted about that, explain why it caught your eye. >> as you remember, trace, figures like stone, associated with donald trump were investigated for contacting witnesses. this also follows after a very highly publicized meeting in which hunter biden acquired a new team of lawyers and

advisers, and what was interesting is this meeting was leaked to the press, obviously by people in this meeting. and the whole message was that they were going to get more aggressive, that they were going to pursue their critics, and then abby lowell and others have send outleters asking for his critics to be investigated by the irs, and to ask for criminal investigations of those who have been speaking out against him. so, this is part of a very aggressive period for hunter biden. it's not succeeding, but these lawyers have to be very careful. a dangerous line to walk and the question for merrick garland, at what point does this cross the line given what they have done in the past with trump associates. >> trace: it's interesting, when reading your op-ed you believe maybe the best course of action for biden, hunter biden and his attorneys is strike a plea deal, a cap stone plea as you called it. explain that for us.

>> well, you know, the best time to wrap this up would have been before the republicans took control of the house. now republicans have issued subpoenas, generating a lot of new information publicly. that's putting a great deal of pressure on the department of justice. what the biden team would like # is if they are going to be criminally charged, to cap this out at some tax charges, maybe a gun charge, to confine the damage, possibly get a plea bargain that would require very little jail time to be served. the longer it goes, the more difficult that becomes for the justice department. every week we find new evidence where people are asking why does it take so long and what about crimes not mentioned in the leaks, like his being an unregistered foreign agent, another crime. the department of justice used liberally against trump

societies. >> trace: foreign business dealings, hunter biden did something illegal, unethical, and 78% saying he did something illegal or unethical, and when you look at things like influence peddling, the democrats shouldn't be worried about the influence peddling, they should be concerned about the effort to conceal the influence peddling. >> that's right. i mean, there's a maddening mantra you heard in washington from the media, after all is invested in not covering the story at this point, and the argument that well, this may not be a crime, influence peddling is not a crime. that may or may not be true. what you do to conceal influence peddling could be a crime. but it's most certainly corruption, and the department of justice has an obligation to look for crimes but congress has an obligation to look at corruption and whether it affected policies.

second largest bank failure in u.s. history and the third in a matter of weeks, all on the biden administration watch. kelly o'grady is live outside first republic bank in los angeles. are depositors safe, first and foremost? >> yes, they are, sandra. so, whether they have insured or uninsured deposits, everything is safe. it's a little different than silicon valley bank where we saw the government take over, this weekend there was an intense bidding process and j.p. morgan chase has taken over first republic. business as usual, we have seen folks outside coming in and out all day, but j.p. morgan is essentially taking over a majority of first republic assets as well as all of those deposits. i do want to note this, fdic will share in losses on loans, a

very important point for j.p. morgan to limit exposure, but there was a group of banks that funneled $30 billion in deposits to prop them up back in march. j.p. morgan will have to repay all the deposits back to the banks. you mentioned earlier today, the president emphasized he feels the banking system is secure, but emphasized this is not a bailout. >> actions will make sure the banking system is safe and sound while depositors are protected, taxpayers are not the ones on the hook. >> i was on a call with chairman and c.e.o., jamie dimon, says we should expect more consultation in the banking system. and i was struck when i woke up and heard, and 2008, j.p. morgan

took over bear stearns, and the big banks just get bigger. >> sandra: we'll have the panel react to that in a moment. >> trace: crime drags down the president's poll numbers, will have to alleviate concerns over crime. concerns, especially prevalent in democrat-led cities, soft on crime policies have become the new normal. madison, what are you hearing from residents of new york? >> trace, hearing from both residents of new york and chicago, two of those big blue cities that crime and public safety, that is a major issue. when you look across the border, according to the latest fox news polling, 88% of americans are extremely or very concerned about how crime rates, and when you look at those cities, you see just how high those crime

rates have gotten. here in new york city, the problems with crime have continued long after the pandemic. over the last two years, overall crime is up 45%. chicago, total major crimes, rose 45% in one year. so, we took to the streets in both new york and chicago to figure out what people are concerned about when i asked them what are the big issues going into this next election, crime was on everyone's mind. take a listen. >> i think it has improved from a couple years ago but it could be better, absolutely. >> you feel you turn on the wrong street you feel you shouldn't be there. other areas i feel fine. >> stabbings, shootings, i have family members, friends that experienced it out of nowhere. >> stick to the areas i know and feel safe. >> retailers are concerned about crime, it's affecting the ability to do business. >> crime hitting voters personally and financially. the new reporting from the whole foods in downtown san francisco

which was forced to close for safety reasons. according to the "new york times," at least 14 people were arrested during the 13 months that whole foods in the downtown area was open, and 568 emergency calls were made from the store in just one year. trace. >> trace: madison, thank you, from new york. >> sandra: california is ditching diesel. the state's regulators approved a plan to ban diesel truck sales by 2036, that's coming up fast, all in the name of climate. some trucking companies are calling the move unrealistic, pointing to the high cost of the electric models and problems that come with charging those vehicles. taylor and brian, co-host of big money show, and an all electric truck fleet. the entire point of the trucks is to load them up for long trips. >> right. and heavy trips.

>> sandra: we know the charging stations and lack thereof of a major problem for everyone drivers. what the heck do they expect truckers to do, taylor? >> interesting, we pulled up a report back in november of 2022, and they talked about three key operational challenges along with some technological challenges and infrastructure challenges as well. so when you think about the weight of the battery that already automatically puts on payload restrictions, because you can't haul super heavy things for long distances when the weight of the battery is already taking up so much, along with fuel cell technology as well, i think pretty heavy, too. then you think about charging the battery, which i think you have to do overnight because if there is a long wait i don't know how you charge it in the middle of a trip. so i think there's -- it's going to happen because it's california and they'll make it happen, but going to be some challenges that come with that. >> sandra: the whole point is to fuel up and go and they keep meticulous records over how long it takes for the trucks to get to their destination and then

turn around and go to the next one. >> this is field of dreams thinking when it comes to our economy. if we build it, if we make them use it, somehow it's all going to work. but if you go through every one of those dimensions, we don't have the answer right now. they are staking the entire economy on a completely unproven technology for any application, but especially for this one, and all the truckers are saying this is not going to work, we can't afford this. we can't even predict how this is going to play out. all of our stuff travels this way. >> sandra: last summer after they are telling residents to go all electric and then struggles with the amount of electricity they have, remember the headlines, told not to charge their e.v.s, the grid struggled with the heat wave, and california asking the electric vehicle owners -- let's mandate it and then tell them to back off. a serious risk if you mandate it for the truck fleet.

american trucker association on the plan, saying that california is setting unrealistic targets and timelines for higher prices for the goods. >> and everyone says e.v.s are green, the end result maybe is e.v. is greener than gas or diesel, but mining the e.v.s. battery does not last longer than ten years, how do you recycle the battery, how does that fit into making the cleaner environment. >> and 2036, they have to start adapting to it now if they are going to do 2036, so the commission in california says we'll revisit in 2025 to see if it's feasible. that doesn't work. they are playing chicken with reality, if the trucking companies will comply, they are

this is happening more and more, russian war planes going after american fighter jets, and you know, our air force top people are saying stay away, steer clear, do not engage. but you think something is going to happen down the road. >> it's very possible something could happen. russians are being reckless, this is dangerous but i think there is something to it. i think they are trying to provoke the united states. they want europe and others to conclude things are out of control with russia in syria and ukraine and elsewhere, put pressure on the ukrainians to end the war or hope europeans do less to support ukraine against russia. >> you don't think it's something bigger, trying to escalate with the united states. >> i think they want the perception, self deterred, not sending enough arms that the ukrainians need and i think it

has an effect on the europeans who want to say we need to get out of this. this is about to get ugly. >> trace: the philippines president, but showed that the forces are doing combat exercises the first time in 30 years. good thing to have? >> good thing to have. an important american objective, set the theater in the pacific so the chinese don't invade taiwan. and you see the philippines south of taiwan and we need to have some sort of presence there because the chinese may be deterred from invading taiwan if they see us located in the philippines, which are nearby. >> trace: talking about invading taiwan. politico writes the relations between the u.s. and china are as poisonous as they have been in decades. but as the white house tries to ease tensions, bureaucratic rivalries in the administration are complicating the effort,

three cabinet secretaries are jockeying to make the trip to china and the white house is weighing its options but has not decided. you can feel the tension with china rising. >> definitely rising, especially since the balloon, they don't want secretary blinken to come in. secretary of the treasury wants to go, typically the most dovish, they want economic relations and john kerry wants to go to talk about climate change and this is the real flaw of their policy on china. we are not really sure if it's confrontation, competition, or cooperation, and i'm not sure you can do all these at the same time. >> trace: it's interesting, we talk about the philippines but if china does invade taiwan, do we go in, and do we have the allies we need to support us. >> we need the japanese in a big way. to at least have the philippines basing options we are getting already. we have to set the theater, so
