ethics scandals. is this politics? it's tuesday, i'm bill hemmer. good morning. >> dana: it's tuesday and politics. any day is politics. i'm dana perino and this is "america's newsroom." what's going on? the supreme court is facing renewed criticism over reports of justices failing to disclose what democrats say are questionable financial transactions. that includes justice clarence thomas accepting vacations from a wealthy donor and justice neil gore -- >> the democrats see the court needs more oversight. but should not have to answer to congress. >> dana: chief justice roberts submitted a letter saying that the court has reaffirmed a voluntary commitment to keep things above board. >> bill: democrats say it's not enough. republicans maintain sit a power grab designed to rein in a

conservative majority on the court today. >> dana: if you've been following this. the organization the news organization that first put out these reports about clarence tomorrow as. if you want to get the truth about it all there is excellent reporting by the "wall street journal" editorial opinion page editors james toronto on the clarence thomas piece. the "wall street journal" editorial today is the ethics assault on the supreme court. democrats want to gain more political control over the justices and you know how the democrats say they are so worried about the trust in our associations being undermined. the point of today's hearing is to say the justices thomas and gorsuch are undermining the trust in the court because of this. however, i would argue that they're forgetting first of all the court is an equal branch of government and the justice was correct to decline to testify today. >> bill: we did polling recently back in the third week of april asking the american people how

you think of the job performance of the high court. 55% disapprove. keep in mind, too, it's no accident, right? these are not coincidences that judge alito came out over the weekend talking about the leaker. he can't prove it but has a pretty good idea who it was, is today. watch that coming up at 10:00. this now from washington as well. roll it. >> written concerning hunter biden's laptop. they said it was russian disinformation. can you explain what your role was in that and if you incentivized it? >> with regard to that letter, i didn't -- wasn't my idea, didn't ask for it, didn't solicit it and i think the testimony that the former deputy director of the c.i.a. mike morrell put forward confirms that. >> bill: he denied any roll in discrediting the hunter biden

laptop story. meanwhile there could be more trouble for the first son after he appeared in a courtroom yesterday on child support. a top house republican saying that case may help the investigation into hunter biden's foreign business deals. jacque heinrich leads our coverage today with more on that. jacque, hello. >> good morning, bill. on the blinken issue, last month the former deputy c.i.a. director testified that blinken was the impetus behind the letter that dismissed the hunter biden laptop story as disinformation. in his interview he says mike morrell's testimony somehow proves that was not the case. blinken does not explain how he can make that claim saying he doesn't want to get into politics. house oversight republicans are very interested in testimony relating to a number of their probes right now including that one and also including one in

independence county, arkansas where he sought to lower child support payments to lunden roberts. the mother of a 4-year-old girl he fathered. hunter's legal team says biden had a material change in his income and lunden roberts testified before a grand jury in delaware last year as part of a federal probe into the biden family finances. listen to this. >> this has the potential to be very helpful. first of all, what in fact is his income from his artwork? and who the buyers are? that's the most important part. secondly, we want to know if hunter biden has any off shore accounts. we learn more every day about the complex scheme that the biden family had to try to disguise the source of the revenue. >> lunden roberts team argued hunter biden can afford expensive lawyers and shielded view into some of his art transactions, who the buyer is, he doesn't know but they are

arguing someone does and how much was paid for them. and hunter did get a slap on the wrist yet from the judge over his team abusing their ability to redact financial records. >> bill: unless there is a settlement it will go on for some time. thank you for that from the north lawn. jacque heinrich. >> dana: a scary scene north of houston. schools briefly locking down after police thought they spotted the suspect accused of killing five of his neighbors on friday. as the manhunt for the gunman continues there is an $80,000 reward for an arrest. casey stiegel in texas, hi. >> good morning. the scene right back here behind us. we're in a relatively rural community. this is about 60 miles or so to the north of houston and it was about where 10 or 15 people gathered on friday night for a church retreat. eyewitnesses say they heard the

next door neighbor firing his gun in his yard. police say when they asked him to please keep it down, an argument ensued. moments later investigators say the man returned with an assault-style weapon and began firing as he approached the home. when it was all said and done, five people were dead. innocent people, including a 9-year-old boy whose principal spoke about what a good kid he was. >> i would say a model northside student. every picture i saw his smile was contagious and it was ear-to-ear. the students were very interested in making a monument for him in the classroom. wanted to put a soccer ball because of his sport. they all wanted to sign it and put it in place at his desk. >> a few tips have come in but nothing to break the case as the 38-year-old alleged gunman francisco oropesa is still on

when asked about joe biden should he run for president 70% said should he run among all americans, 70% say no. donald trump, should he run for president, all americans 60% say no. is that where we're going, ronna? >> there is a long way to go between now and august. you guys know this better than anyone. so much changes. we haven't made the case. what i will say is it's amazing that joe biden, who holds the reins of power as the president of the united states is so underwater. the american people do not feel like our country is heading in the right direction. we're heading towards default. a broken border, crime rising. fentanyl poisoning our children. the president is failing. i think republicans are in good shape to take back the white house in 2024. >> dana: the democratic nominee preference, this is interesting. primary voters identify as

democrats 62% want joe biden. 19% want robert kennedy junior and marian williamson 9%. then for the gop nominee donald trump hanging really tough at 53%. ron desantis at 21% and then the smattering of others at 6, 4 and 3. as you look ahead to when we host the first republican debate in august, do you expect to see trump, desantis, pence, haley and ramaswamy an scott on the stage, or will it be a smaller stage? >> a lot haven't announced yet. scott has an announcement may 22. i think you'll see all those candidates in. we'll see. i think we'll have a great debate in milwaukee with fox and young america foundation. but what i do know is it's an opportunity not just to be republican against republican. it is not just about the

primary. this is our time to make our case to the american people as to what we'll do against joe biden. why republicans deserve to win the white house. people are really suffering under this administration. so please come to that debate stage. i think it's critical that everybody makes that case in front of the american people. >> bill: looks like about a half dozen on stage today. we'll see whether or not it's higher or lower. u.s. senate this will get a lot of attention as we get close to the 2024, republicans think they have five states in their sights. they include west virginia and montana, maybe ohio, maybe arizona, maybe pennsylvania. how do you see it? >> i would add nevada to that as well where we had three statewide races we won in 2022. some of the biggest gains we've seen for republicans. you just saw in west virginia the governor just announced against joe manchin. he hasn't announced yet. we have great candidates in upon mon. i think ohio is very much in

play and there are eight seats that democrats have up that we can compete for. this is an exceptional senate map for republicans where we can take back the reins of power. >> dana: all these races will be close. maybe not ohio. the rest will be close. republicans came up short in a few of them for reasons that will still be in existence in the next cycle. so, for example, you mentioned yesterday that republicans lost independent voters. what can republicans do to try to win them back? is it going to be mainly the economy or some sort of combination between economy and the social issues of wokeism? >> i think you have to address everything. one of the points i made about 2022 is democrats aren't running on crime, not running on inflation, not running on the border because they can't. they have no record there. they're failing. they're running on social issues. put 360 million ads saying republicans won't give lifesaving care to women in a

miscarriage. those are lies. republicans have to fight back on that and then talk about other issues that americans do care about like inflation, like cost of living, like crime and fentanyl poisoning our children. it can't just be ignore this and we can only talk about this. i will say this. ohio, montana, west virginia there is now only one statewide democrat elected in those three states. that has been a big shift in those states since 2016. all of those are u.s. senators that are up this cycle. in 2020 trump won west virginia by close to 30 points. so i think those dates are very much in play and we can take back the senate as long as people engage early. democrats are investing now. republicans have to do that. i always say text win to 80810 to the rnc. we need people to engage now. >> bill: see you in milwaukee in august and in new york before

>> dana: police say several people are dead after a dust storm caused a multi-car pile-up on i-55 in illinois yesterday afternoon. the national weather service says high winds blew across newly plowed fields that stirred up dirt and reduced visibility. 40 to 60 cars and tractor trailer in the wreckage. more than two dozen people rushed to the hospital for various injuries.

guard under operation lone star. those troops are on the border. these troops under this active duty plan from the pentagon would be administrative to free up border patrol agents. meanwhile we heard yesterday from the podium at the white house spokeswoman karine jean-pierre saying that illegal immigration is down 90%. let me go to our drone in the sky right now and show you the images that completely contrast that. nothing could be further from the truth that they are down 90%. you can see the line of migrants here, majority of them venezuelan. we have had them coming here in this sector alone in the last 24 hours more than 2800 migrants. that's why local officials and former congresswoman myra flores is so frustrated with secretary mayokas. >> he claims that we need legislative fix, which we do. the main problem here right now in brownsville is he is not willing to enforce the laws that we already have on the books.

abbott they're going to cities that he believes are, you know, the kind of cities where amnesty is granted illegals where they get to live their lives and dumping them in new york without any coordination. i am opposed to that. if there were coordination or some kind of way to say okay, next thursday you will be get x and so much. >> dana: isn't that the federal government's responsibility? >> as eric adams makes very clear if they will not do the job the city mayors will do it. ad hoc solution. >> bill: we don't know what's happening in these other cities. remember the dark of night flights were going to westchester, new york or into the state of new jersey? when we were coming home from the border two months ago, there were people who were allowed to board the flight with papers before anyone else could get on board. that was just one airline and one flight out of san diego, california. >> to me it shows the failure of

kamala harris, the border czar, to coordinate these various problems. we have a situation on the border that is urgent and critical and a crisis. we have to find ways to get the concentration of the undocumented immigrants out of el paso, which is totally overburdened and out of some of these texas border cities and we have to be humane and pragmatic about it. everything is willy-nilly. no coordination. you suggest that the national guard, active soldiers can now be deployed, 1500 of them to the border. what the hell are they going to do there? you've been to the border. you have 1500 national guardsmen, they need tents, food, sanitation, they need life support on their own. >> dana: they end up having to do the work of administration so that the border patrol can deal with that problem. that is a federal solution. if you are at the white house and, or even mayokas at dhs,

what are they supposed to do? they are supposed to coordinate. what you are talking about is you expect the mayor, not you, there is an expectation mayors should do it on their own. this is -- immigration is a federal government responsibility and the convening power to get them to coordinate is at biden and mayokas's shop. not with the individual mayors, even though the mayors like lori lightfoot, sanctuary city, everybody can come. actually we don't have room for them. what about the small border towns in texas? they don't have room, either. they are running out of the space for them, the shelters. >> i totally agree. i drove to work the other day, spanish drive, a bunch of obvious recent arrivals were on the sidewalk. they were asking and waiting for lunch to be served at this wonderful church across from my hotel. they were from venezuela. they have a huge situation now

where they have -- people are fleeing from venezuela and cuba and nicaragua. you have turmoil and the whole continent in upheaval and on the move. something has to be done. title 42 is going away. we have title eight which allows for expedited removals. i wish -- i would not want to be elected to anything. this is a job that i would relish. coordinate. >> bill: they have dropped the ball on this and sometimes it appears it was done intentionally. >> that's the black mayors feel they are being targeted by, you know, the white governor of texas specifically because they are -- it is a racially motivated. >> why doesn't the white president help the black mayors. why don't they ask him? >> bill: abbott said i adviseed her to call the president to

june 1st. chad pergram live on capitol hill. the president says it's an emergency but he scheduled a meeting with everybody next week. >> good morning. the government is literally running out of cash. the warning by treasury of a june 1st deadline for the debt ceiling rattled washington. there is worry an action could spook the markets but some republicans are skeptical of a june default. >> i think secretary yellen is trying to put pressure on congress. i wouldn't pay too much attention to treasury's statements about the precise time because i think a lot of their statements and the timing are part of this june 1st date, i think it's a political statement, not a statement based on fact. >> the president spoke by phone yesterday with the top four congressional leaders from both chambers. they will meet at the white house may #th. other republicans say it is not soon enough. they demand urgency.

for chinese consumers that's fine. when you take jobs and import the car back to america that's not something anybody wants to see. >> dana: the other thing that we were talking about in the break. the creeping concern about commercial real estate and if you live in a city and seen it. a lot of people haven't come back to the office or not here five days a week. all these places are empty. small businesses surrounding them have a problem. a lot of real estate isn't so good anymore. we have a lot of troubled office buildings and shopping centers, a lot of troubled other properties. a lot of agony out there. >> that's a great word for it. this first red flag came up with silicon valley bank. they have a lot of property in san francisco and one of the hardest hit they got 29% occupancy problems, right? there is a great chart out. i don't know if you've seen it on cell phone use in downtown

areas. so cell phone use right now versus 2019. new york is at 74% of what it used to be. boston is at 54%. san francisco 31%. >> dana: of what it was before the pandemic. >> this is cell phone use. no one is downtown. no one is downtown. >> bill: new york is off 25%. san francisco 70%. >> 70%. this is scary stuff. you got -- >> bill: how does this -- munger is talking about it, right? musk was talking about it two weeks ago. how does this unwind or play out? >> it is so interesting because in 2009, you know, we had the great financial crisis and then everyone kept saying commercial real estate is the next shoe to drop and wall street was like it didn't happen that way.

now there are eight types of commercial real estate. some of this is okay. office is in trouble. retail has had problems. maybe industrial. hotels not doing too bad and some other things. there will be some bust out there. a lot of banks will go bust. there is an office building in san francisco they were trying to sell for $3 hundred million. it will go for 80% less. building sold in chicago for 25% less. there is still, j.p. morgan picking up first republic the fdic took the hit on commercial real estate. it wouldn't have happened if j.p. morgan had to take that hit. the lingering thing. we don't know how bad it will get but it won't go away. it is really ugly for these large metropolitan cities. here is a problem, too, in smaller towns. the small banks make almost 70% of the commercial loans, it is another big risk for them. >> dana: i'm waiting for congress to say we'll come in

guys are like that's the bottom. we're going above that. i think we have a ways to go before we go to the strike. you have the whole mediation board that steps in if there was a strike. i think the pilots are trying to get their forces in a row to go into negotiations. >> dana: 96% of american airlines cast vote. 99% voted in favor of a strike. they are at least speaking with one voice at the moment. when they say they want stability in their schedules, so do the rest of us. it has been hard out there in the last six most. i don't know if summer looks any better. >> this is going to be a tough summer for the consumer. if you look at just the new york airspace alone, you have a severe controller shortage up there. the figure i saw was 54% of air traffic controllers staffing in the new york airspace. a lot of folks may not care about that airspace but you have to realize that 47% of all

flights originate in the new york airspace. if you have a hiccup in new york it will cascade across the country. >> dana: so there is a possibility of a new ffa administrator, might whitaker who had been there before. will he be able to get a handle on any of this? it's not the weather necessarily that is causing all the problems. there are shortages, weather adds to it. but you have consumers super frustrated. >> when you have the faa asking carriers to reduce their capacity by 10% in the new york area, that again is going to have an effect. you don't have enough pilots, you don't have enough mechanics. you don't have enough flight attendants. it is focusing in on frustrating times for the consumer. >> dana: what's being done by the airlines to try to ramp up -- we spoke to josh earnest over at united airlines and they have

a long-range plan to figure out how to get more pilots in. even support staff on the ground and mechanics. we want qualified mechanics to be working on these planes. >> ten years ago congress passed legislation that required pilots to have 1500 hours of training. that really has created a bottleneck where it's hard to get that training. it is very expensive and there is a lot of debate whether it's worth it. wouldn't you rather have a pilot with a ton of experience actually flying planes rather than somebody what we call punching holes in the sky and going out there flying in his little cessna for a couple hundred hours? you have the bottleneck of the shortage of pilots and why the pilots are in a good position to get a huge pay raise. the rest of us are out there waiting for our flights. >> dana: we can all hope for smoother flights this summer because people really want to get out and see their loved ones. great to see you. thank you for being here today.
