certain role for the federal government. one of those responsibilities is securing our border. since joe biden has been president, nearly 6,000,000 migrants have crossed into our country. joe biden has failed in that responsibility. so, we in texas are very perplexed that the biden administration is deciding to end title 42. we know that there is going to be a massive surge. >> as border officials brace for the lifting of title 42 in less than two weeks, fox news has an exclusive look at the surge that is already arrived on the bank the of the rio grand in brownsville, texas, across from mexico. across the entire southwest border, the numbers are staggering. agents have encountered more than 22000 migrants in the last 72 hours. leaving three border cities declaring states of emergency,.

>> this is just not fair. since last fall, the state of texas has spent more than $4 billion trying to secure its own border. for the record, it's not a responsibility to do this. but when america's leadership fails, texans always step up. today the white house just announced they will send only 1500 active duty troops to the border. supposedly to prepare for this surge. but these soldiers will only do data entry, warehouse support and administrative tasks, anything but actually secure the border. look, i have been to the border men times, i talked to the agent the on the ground, texas state troopers, border democrats and i learned exactly what they need. here is part what i've seen firsthand. >> we just got out of the chopper. we saw about four different tracks going different directions so we are trying to figure out where exactly they are heading to. these migrants

try to get to a road where a coyote can pick them up. we are trying to find the direction they are heading first. we couldn't get a good view from the chopper, we narrowed it down, now that we narrowed it down we have to follow the tracks. we've had two agents follow border patrol, dps was different, we met up now. we think they are going this way. we'll have to see. after spending some time on the ground trying to track the migrants we went back to the sky in our helicopter to find exactly where the runners were heading. all it took was a few minutes in the air before we spotted them huddled together, dressed in camouflage trying to get relief from the desert heat. >> where did you come from? mexico. they've been traveling about a week but they've run out of food and got lost, because of the chopper we were able to locate them and they are going to surrender themselves. >> but the biden administration denies any of this is happening.

fang.com. what are the different rules they wanted to abide by? >> lawrence, thanks for having me. in the follow -- after the 2008 financial crisis, congress passed a new set of rules to prevent too big to fail banks, risk assessments, you know, the loan portfolio, business decisions of these banks would be reviewed by regulators. that's if you were designated as a too big to fail bank. first republic bank should have been designated as a too big to fail bank but exempted from these rules, supposed to be applied to any bank over $50 billion in assets. now first republic bank like many mid size banks around this threshold lobbied legislators but worked through third party groups, that's what my report looked into. they worked with organizations like

the national asian american coalition, national diversity coalition, these groups went to the fdic and said look, first republic bank should be exempted from these rules, they are spending so much in under served communities, you know, they can't deal with burdensome regulations because they are donating to good causes like us. >> lawrence: who you donate to. >> that's right. after engaging in this lobbying, they were given this exemption and same diversity organization, the leader of this group they started sponsoring their galas, receiving financial donations from the bank. a pretty clear quid pro quo. >> lawrence: do you know what's crazy? look we want the same standards for our black brothers and sisters as our white brothers and sisters and applying for loans or getting money or getting the loan for the house or car to saying, no

break in, i will have you back. we have a fox news alert, authorities in texas have captured the legal immigrant who killed five people including a nine year old child. fox news kevin corke what can you tell us? >> you and i have been talking about this lawrence, we are following the latest information we just received. 38 year old mexican national who has allegedly killed five of his former texas neighbors. he apparently was out shooting a weapon, being very loud and belligerent, apparently drinking, the neighbors went outside and asked him to stop shooting that weapon. he then in turn took his ar-15 and allegedly slaughtered a family of five including a 9-year-old boy. we received word that that man has been a handed according to folks in texas. this is san i jacinto county. i imagine you

are know where the county is, but their da is a gentleman named todd dylan, authorities are awaiting fingerprints to confirm to the person arrested is in fact the 38-year-old oropreta charged with first degree murder and the fbi we are being told is planning a news conference about this case. we are going to make a few calls here lawrence and find out exactly what the timing will be for federal officials to get a chance to go ahead and get in front of cameras. what we know now that francisco orapeca, accused of slaughtering a family of five, including a 9-year-old boy has been caught bylaw enforcement authorities in texas. i should point this out, my friend, yesterday when you and i talked about this we made mention of the fact there were more than 250 law enforcement officials and law enforcement agents who were looking for this man. that is a massive manhunt and when they really get the

can step away from the politics of the border, you can certainly make the argument that this person had no right to be here. he had been deport from our country i believe four, on four separate occasions, he had no right to be living in the state of texas. to kill an innocent family like that, these are the kinds of people, again, allegedly, and if he is convicted, this is the type of case, especially in the state of texas where it would certainly seem that the death penalty would be warranted. >> lawrence: kevin, i'm wondering if homeland is going to release some information so we can understand how this guy was released back into mexico four different times and able to commute back and forth across the border. and i just have to ask this question because normally people and there has been reports about the complaints, the calls, the police, firing shots before. people typically by me being on the crime beat for awhile, they don't just escalate to murder.

their gear, that means they had some type of intelligence that where this guy was, they mobilized and got him, what can you tell us? >> yeah, that's probably true. they had some way of tracking his phone or other known contacts that he has so they can mobilize to capture him. obviously they know what he had done or alleged to have done which is extremely dangerous. what again i think core point which we probably are going to get to, this is something that was entirely preventible. >> lawrence: who is going to have custody of this case, do the feds have this or the state of texas want to try him back at home? >> most likely the state of texas will try on the murder charges and what the federal government should do is put a detainer on him for his federal charges because at least based on what we know from the news reports there is felony charges for immigration violations which again as we all know this person had illegally entered and

reentered the country at least three occasions. so, they do have charges but he should remain my guess would be state custody on murder charges and then with a detainer from the federal government on the immigration violations. >> lawrence: i have only 30 second the. how does someone like this enter and reenter the country four times and we don't do anything about it? i mean this was bound to happen. >> yeah, this is bound to happen. and there is more of these that are going to happen of people that are in the country and this government knows they are in the country, they don't even want to deport aggravated felons in some circumstances. this administration doesn't prosecute people that enter illegally and doesn't deport criminals in many occasions. so, this was predictable and a similar thing or something else horrible that is going to happen that is preventible. >> lawrence: we started this show on immigration, we ended on this tragedy, thank you so much
