>> dana: i'm dana perino and this is "america's newsroom." nowadays it is very hard to hide. you will be found and that's exactly what happened. the arrests are culmination of a four-day manhunt when police say the suspect gunned down five neighbors in response to a noise dispute keeping a baby awake. >> bill: a trip submitted to the f.b.i. hotline led authorities to a house in cleveland, texas where they found the suspect hiding beneath a pile of laundry. >> dana: this man has been deported four times between the years of 2009 and 2016 and accused of murdering five people. one just nine years old. >> bill: one of the many tragedies highlighting the dangers of an unchecked border that continues to this day. jacque heinrich has reaction from the white house and casey stiegel begins our coverage near the scene of the capture in cold spring, texas.

let's start there. good morning. >> good morning to you. authorities telling us in fact not long ago at a press conference that the suspect had at least two cell phones with him. so it is not clear if they were tracing him through that technology and that is what helped lead them to his location, but he was also found not cities, not counties, not states away but rather hiding out in a house right here not terribly far from the actual crime scene. the house where 38-year-old francisco oropesa was captured only miles from where he allegedly gunned down five people friday north of houston. texas dps arrested an acquaintance. this woman, believe to be the alleged gunman's wife. an ice fugitive and numerous runs ins in with her with immigration officials through the years.

on monday cops were hot on the suspect's trail. schools were shut down in montgomery county briefly. authorities say he was indeed in that area at the time but he did get away. >> there was a flurry of activity on highway 105 when we had about 30 vehicles and a helicopter go out there. we did confirm that was him on foot running, but we lost track of him. >> five people were shot and killed in friday night's attack which originated over a noise complaint between neighbors. two of the victims, a mother and her 9-year-old son, were among those killed. now a court hearing is scheduled for later today. that will happen via videoconference, we understand. he won't be physically transported to the courtroom but self-contained here. >> bill: it appears he was getting help on the inside, too. we'll track that down in texas

today. >> dana: suspect casting a spotlight on the nation owes broken immigration system but the white house says it is nothing more than dramatic. jacque heinrich with more at the white house. catch us up. >> dana, the administration sending active duty troops to the southern border, 1500 of them, despite their own claim the president's immigration system is working. >> you said yesterday that when it comes to illegal migration, you've seen it come down by more than 90%. where did that number come from? >> if the dram attics could come down a little bit. the president put in place a parole program to deal with certain countries on ways that we can limit illegal migration and the data has shown it has gone down by more than 90% is what i was speaking to. we're moving, peter. >> the way officials describe it

>> good morning. let me connect a few dots as we can take a look again at that drone. and you have these interior cities like mayor adams and over in chicago mayor lightfoot worrying about the migrants overwhelming their cities but you have to do something with these people. here in the facilities in the rbg sector they're at 140% over capacity. as we look at this levy feet behind me you can see the orderly process that because of the migrant surge and the unprecedented numbers that we have had over the past two years, the border patrol and cbp officials have gotten better at screen, process and transport out these migrants. we get well over 2500 a day here and it is very, very difficult. this is a thought you are looking at right now. look at yesterday afternoon and even a larger group down on the

river in there crossing and they walk down the line, put on buses that arrive constantly behind me. yet the news that 1500 troops were coming down is welcome to the officials here because logistics, as you are seeing on your screen, is such an important part dealing with the surge. texas congressman tony gonzalez says it is more of an indication that the white house admits they've got a crisis even if they won't call it that. listen. >> the positive highlights that the biden administration is waving the white flag and greig the border is no longer safe, humane and orderly process and calling in the troops. >> and governor abbott is weighing in about the 1500 troops saying biden says he will deploy 1500 troops to the border to do paperwork and only for 90 days. it does nothing to stop illegal immigration. i deployed up to 10,000 texas national guard to the border to fill the gaps created by biden's

reckless open border policies. so already we have friction between texas governor and the white house. one thing is for sure, this is the important point i want to leave you with. the officials here are gearing up a week from tomorrow title 42 lifts. for the men and women of the border patrol and texas dps we're headed for something none have seen in their professional adult lives as the numbers continue to grow. >> dana: that's legitimately dramatic and we'll continue watching it. >> bill: josh holmes welcome to our program here. what do you think about what's going on right now? >> look, this is a mess, an absolute mess. i think it starts with the fact that this administration began their administration with a border approach that was reversing something that was working quite well under the trump administration. then we went to entire mid-term

cycle where the answer quite frankly was we don't have a border problem. there is no border crisis. they have got not only have a border crisis, one that even "the new york times" has reported has resulted in children coming across the border being trafficked into sweat shops into the country, a legalized slavery. not only do they have that terrible problem of their own creation, they have a political problem, too. i think this is what you see with the acknowledgement finally and the sending of troops acknowledging they have to political problem because, you know, it's the president up for re-election. sadly, i think that's what it has taken to get his attention on this. >> dana: bill was pointing out to me in the quinnipiac poll they have biden's approval with hispanics at 35%. you cover the races and follow them. looking at a swing state like nevada. what happened in terms of the hispanic vote? if democrats are losing some support are republicans able to

pick it up? >> incremental gain is the short answer. i think there were a lot of people in 2022 looking at the nationwide numbers and predicting this dramatic shift within the latino vote something akin to what we saw in south texas or south florida. nationwide what we saw was a distinct gain. it was about a 5% gain nationwide amongst hispanic support of the republican party. which is nothing to shake a stick at. that's a significant gain. if you consider the 10% gain president trump had in 2020 versus 2016 numbers you are now looking at the beginning of a significant trend that republicans believe can help significantly eat into where democrats have had a stronghold traditionally. >> bill: you think about arizona in that conversation, maybe the suburbs of georgia around atlanta, georgia. i'll play this five years ago here is then senator harris.

>> i believe that it is inappropriate to require the limited resources of the united states military to be used in such a way all because there needed to be some demonstration for the tv cameras based on a political agenda. >> bill: things change, right? reality hits you smack in the face. we'll see how it unfolds. however, you are well tied into what is happening in the senate and aoc came out and suggested dianne feinstein should not come back to work. now you have 1, 2, 3, 4, 5 mostly progressive lawmakers saying she needs to resign. now, chuck schumer apparently had a note card where he said he was going to say but did not speak the word hopeful that she would return next week. what are you hearing on this and how much of a setback is it in the meantime? >> what's really happening behind the scenes here is a battle to fill the seat that will ultimately be vacated by

dianne feinstein at the end of her term if she chooses to serve it. there is a primary well underway and a governor in gavin newsom who said to everybody he will appoint a black woman if there is vacancy. there is one candidate in that primary who fits the description he laid out. she would run as an incumbent. there are a lot of people on the progressive side that want to say this is a good government thing. let's talk about this and democrats need the votes. they also happen to be supporting one candidate in that primary. so there is a lot going on here within the democratic party more than meets the eye. >> dana: do you think there will be an increasing call that grows not just for her but there are many members of congress, talk about age a lot even when we're talking about the president of the united states. he just announced his re-election, too. >> look, i think that's why we have elections in this country. it is an issue and a big issue for president biden. we have seen his team try to

navigate around the fact that most americans, even democrats, believe he is too old to serve a second term. so look, voters are ultimately going to have a say on that kind of thing. i imagine that is going to be an issue that everybody tries to navigate in 2024 for sure. >> bill: thank you for coming on today. breaking news overnight. as you were waking up across the country, russia and vladimir putin is now accusing ukraine of trying to kill him in an attempted drone attack overnight at the kremlin. he has a residence there. russian officials sayings he was not home at the time. what that means we don't know. no immediate comment from ukrainian authorities. however, just crossing right now on reuters out of kiev, ukrainian official says that allegations of the kremlin attack suggest that russia could be getting ready for a large-scale terrorist attack

against ukraine in the coming days. we'll just see how it plays out. keep in mind now as we move further into the spring months now we expect this ukrainian offensive to begin. some suggested that it has begun already but they are more armed than they were just a few months ago. we'll see how the ukrainian military performs if and when that offensive gets underway. >> dana: it is interesting with the drone attack this morning. if you see it, it was small. an attack nonetheless. however, you don't know who actually had that drone and that capacity and that ability to be in moscow. we'll keep an eye on it and talk about it a little later as well. check out this here in the meantime. >> how long would it take me to get crack? >> under a minute. >> heroin? >> same thing. >> fentanyl? >> same. very easy to get. >> dana: laura ingraham shedding light on the san francisco drug crisis. it is forcing a major retailer to pack up and leave the city.

will seek the death penalty against him for the murder of that microsoft executive. >> that is a case to watch coming down the line later in june. meanwhile former new york city cop turned wall green security guard is facing charges for trying to stop a violent shoplifter. check it out. the wild video shows the alleged shoplifter hit the security guard in the head with a jar and in a stunning twist, the guard was thrown into jail on charges of assault. nate foye live near the scene of the crime in new york city. what happened and where are you? >> we're right outside that walgreens right now where all of this happened. that security guard that you mentioned retired nypd officer tells the "new york post" he plans to sue the port authority police department over his arrest that he believes was wrongful. take another look at the video here. you see him wrestling with the man over a bag of allegedly stolen food. there were chips in the bag.

the man initially denied having in there. he then swings the bag at the officer's face and he takes it outside and tackles the homeless man to the ground. you see those chips fall out of the bag and the retired nypd officer holds the man until police arrive. he recommended mental health treatment for the man but the port authority police decided to charge both of them with assault and harassment. he says the papd sergeant mentioned the alleged thief's back pain as a reason for the charges. he is calling for his case to be dropped and calling the papd sergeant incompetent. back live that alleged thief is nowhere to be found because he blew off his court date last month. as for the security guard, he has been out of work this entire time because he had to surrender his gun as a result of his arrest. we'll send it back to you. >> bill: wow. what a twist. nate foye thank you on the streets of new york. >> dana: nordstrom will close

both stores in san francisco. they told a local outlet businesses are leaving in droves because of safety concerns. local reports say at least 20 retailers in the area have closed since 2020 and that's a big, important store for an area like that. brings a lot of customers. you go down shopping, grab a bite to eat and have a coffee. all of that commerce ends up stopping as well. >> bill: you wonder how low it will go before they put a stop to it. a great piece in the "wall street journal" about this big skyscraper in san francisco. it had been valued at $3 hundred million listed for 80% of that. wow. talk about -- >> dana: that won't be the only one. >> bill: you are right about that unfortunately. a growing number of lawmakers pressing the pentagon for answers after a national guard airman took part in a 60 second ad promoting tiktok. the d.o.d. signed off on it. mark meredith is live on the hill.

what happened here do we think, mark? good morning. >> tiktok is spending a lot of time and energy trying to convince lawmakers not to ban its app. it launched an ad campaign that features people talking about how tiktok has benefited them. who is featured in one of these ad campaigns that has lawmakers so upset. the ad campaign is called tiktok sparks good. one of the ads features a national guardsman out of new hampshire named john lynch. he tells viewers tiktok lets him reach veterans and others in the military to let them know about things available to them. some think it is outrageous because of the risks tiktok poses to national security. the app is owned by bytedance and many lawmakers warned it can be used to spy on and influence americans. >> here the d.o.d. was potentially involved in some way is unaccountable. we need to figure out why. the bottom line is no government entity ought to be promoting

tiktok. it is a major security threat and privacy threat for every american. >> we are hearing from the guardsman involved saying this video gives no political statement but merely focuses how i use the app to reach military members and say i have no statements or thoughts to be made about the situation of tiktok. the guardsman said he got permission from his bosses to be featured in the ad campaign which has lawmakers scratching their heads. they sent a letter to the national guard demanding to know why it was approved or what else was happening behind the scenes and demanding answers by the end of this month. >> bill: thank you, mark meredith on capitol hill. >> dana reads sports. >> dana: the ratings are in. it turns out this year's super bowl was a really big deal. nielson data shows super bowl lvii was the most watched game in history and you were there. you were there, 115 million viewers tuned in to fox sports to see the kansas city chiefs

>> bill: back to the story in russia. new video you'll see in a moment here which purports to be video of this drone strike on the kremlin overnight. to catch you up to speed now. russia is accusing ukraine of attacking the kremlin with two drones overnight. they believe they were intended to take out vladimir putin. the kremlin says he was not there at the time. moscow says it is a terrorist attack. and that russian military and security forces disabled the drones before they could strike. we were watching this video that our viewers will see momentarily during the break here and one of the drones apparently hit a flagpole. if that's how you disabled them i'm not sure. the video was shot from across the moscow river from the walls of the kremlin. >> dana: no comment yet from the ukrainians. and, of course, we don't know if the ukrainians did send the drone. this is what moscow is saying.

they're also saying that vladimir putin was not in residence there at the time that it happened but nonetheless, the russians are saying this was an assassination attempt against vladimir putin. >> bill: more from this in london with alex hogan who is tracking it from there. hello. >> hi. a lot of reaction just within the last few minutes of what we're seeing coming out of not only russia saying they will reserve the right to retaliate seeing this is an extreme threat. we have heard the first official statements start to come out from ukraine with a senior advisor to ukrainian president zelensky and he said that ukraine had nothing to do with this. and he says it is simply a means for the kremlin to justify a new attack on ukraine. it is worth noting the last week we have seen several changes. i was there in the last month and we really saw a quiet environment in kiev. all of that started to change

within the last ten days with russia launching more attacks on the capital of kiev, even just in the last couple days we've seen new attacks on civilian infrastructure, notably one outside where 40 people were injured. look at the video. this is the video that's likely linging to create a lot of turmoil and what we might see in the coming days especially with the counter offensive. what are being known as unmanned aerial devices, drones, of course. still no word from ukrainian government on who could be behind this. the kremlin says they're pointing all of this at ukrainian forces. but the question is, how would a drone even get there given that distance? there are so many concerns around this. also worth noting just how crucial of a role drones are playing in this war right now. ukraine in the last month or two has really ramped up the amount of drones they're using. when we talk about this war, of

course, trench warfare is one of the main things we're seeing. when i talk to ukrainian forces on the front lines, a lot of their training goes into manning those trenches, but more than that right now they're learning to use drone technology. it is not always really advanced systems of drones. they are even using commercial drones that you and i can buy at any kind of store and using it for technology to survey the land on the front lines. this video, of course, is likely what we will see more and more statements come out from both sides of the government from kiev and from moscow about what this means going forward. for months we have talked about the expected counter offensive, ukrainian officials have touted things will really start to change come the end of spring as we move into the summer months, which of course is right now. even though the ukrainian government says that this was not them, russia is saying they

will be able to retaliate and should be able to retaliate for what they are calling an attempted assassination on russian president vladimir putin. so still a lot of questions around this. when we're talking about the counter offensive, something that we have been looking to for months now in terms of what that means, of course, ukrainian forces say that things will change once they have a lot of the western aid, talking about tanks coming from different countries, ammunition, all the new security measures put in place to reinforce the front line. this, of course, is not that. we aren't talking about giving drones that would be pushing towards russian soil and creating new attacks. but at least from the ukrainian perspective every time we have seen attacks, be it on russian soil or even in crimea, they quickly say it was not them but that russian forces should probably take more care and more precautions. we'll have to see what statements come out of this as

we move forward in the coming days. >> bill: alex, thank you for that. looking at the map here in terms of geography, none of this is verified. if you were to launch a drone from inside ukrainian territory, you would have to fly some 500 miles to reach moscow. a drone of that size that we're watching. we don't have dimensions just yet. that's a pretty long way to go. >> dana: it was only a couple months ago that you had a pro-war military blogger who was targeted by assassination with a bomb at a cafe in st. petersburg, i believe. there could be things happening inside the countryment possibly internally in the country. we don't know. we'll keep an eye on it. i am now joined by two senators chris murphy and katie britt. quickly before we talk about the important bipartisan bill you have introduced. senator murphy, this is a classic situation where you have the possibility of a terrible

situation ramping up at a point when both sides are under a lot of pressure. >> well, we don't have any information to understand what the nature of this attack is. it could be a russian citizen, a false flag operation to the extent that putin is complaining about ukrainian -- potentially ukrainian attacks inside russia. that's pretty fantastic given the fact that russia is killing civilians inside ukraine's capital every day. so obviously neither of us have been briefed on this. >> dana: but you will be. we wanted to get your reaction. let's go to this. senator britt, you have teamed up with senator murphy. you believe america's children and parents of those children need to figure out a way to deal with social media in a better way. tell us about the legislation you introduced with the senator. >> absolutely. we came to the table not as a democrat or republican, not as someone who sits on the left or right side of the aisle. we came to the table as

concerned parents. as we look at what's happening across our country, you can look at the data and it speaks for itself from 2011 to 2019, depression more than doubled in our teenagers in this nation. we look at suicide and look at the increase there and we know the negative effects of social media on our kids. this is to protect our children. this is to put parents back in the driver's seat. >> dana: senator murphy i will show a graph. call for number 2 and 3. social media usage for that age group 13 to 17 has risen so dramatically over the last several years, right? you can see there are all different kinds. that's a question i wanted to ask you goes from youtube to twitter and who knows what is in the hopper now being created. would your bill not allow children under 13 to be on social media at all? and then to get parental permission ages 13 to 17? >> is social media companies

themselves say that they don't allow kids under 13 to be on these sites. as every parent knows, it is very easy for kids to get around that prohibition. it is name only. our bill says that these sites have to engage in some kind of age verification. we do age verification all the time for other things in our society. and then it gives parents the ability to have a say as to whether their 13 to 17-year-old is on social media and it requires parental consent. we've looked at the data and not coincidental during this period of time which more and more kids are on social media spending 6, 7, 8 hours a day on these sites that we've seen a dramatic increase in the number of kids reporting intense feelings of loneliness and engaging in self-harm. it is time for us to give parents and kids some tools to deal with up uptick in social media usage.
