"fox & friends" now. ♪ >> brian: we begin with a fox news alert. the suspected gunman who brought atlanta to a stand still for hours yesterday and everyone watching our channel is in custody this morning. >> ainsley: police accuse him of killing at least one person and hurting four other individuals in the medical center's waiting room. >> steve: in atlanta right now, jonathan serrie joins us with all the latest developments in this case. jonathan, good morning. >> yeah. good morning to you, steve, ainsley, and brian. the suspect is identified as 2 #-year-old deion patterson. he is charged with murder and

four counts of aggravated assault. he is now in custody. authorities say he opened fire in a medical office building waiting room here in midtown atlanta. seriously injuring four women and killing 38-year-old amy saint pierre who worked for the centers for disease control and prevention. the agency says cdc is deeply saddened by the unexpected loss of a colleague killed today in the midtown atlanta, shooting. our hearts are with our friends colleagues as they remember her and grieve this tragic loss. police received the car of the after shooter 12:08. the gunman spent only two minutes in the medical building and left in a stolen car. around 7:45 last night police located the suspect near truist park stadium in suburban cobb county. take a listen. >> an undercover officer was the one who originally saw and confronted this individual and was able to have backup from uniformed officers that came in and took him into custody

without incident. it does not work without a cooperative community. a community that backs up the police. that allows the police to take risks and try to take violent people into custody. >> the suspect was discharged from the coast guard in january after serving four and a half years there. patterson's mother who had accompanied her son to the medical building for appointment appeared to blame improper medicine for the outburst. the damn v.a. gave him some messed up medication and all he wanted was an ativan. now the midtown medical building here where the shooting took place is associated with the north side hospital system. hospital says this building in midtown will be closed today. all patient appointments canceled and urges patients to reach out of to their providers to reschedule. back to you guys. >> steve: jonathan, if he went to the hospital with his mother because the v.a. gave him messed

up meds as they said and he became enrained in the waiting room. do we know why he became enraged? >> no, that's something police are still investigating. they have not yet released a motive. the mother at least in her interview with the daily beast seemed to suggest it had something to do with the medication he was receiving for mental health issues. >> brian: what's interesting, jonathan in new york you are don't walk through the hospital without a metal detector. you have to empty your pockets to go through. how did this guy get a gun in? >> yeah. it's a little different here in the metro atlanta area. you can walk into hospitals without going through a massive screening. and this was an outpatient building with multiple private practices so less security you would see at a flab ship hospital than the main campus in atlanta. >> ainsley: jonathan, i know he was in the coast guard and

discharged this past january. do we know why? was it honorable discharge? >> the coast guard didn't release any details about the circumstances behind his discharge. just that it happened in january and he had served with the coast guard for four and a half years. they say they investigative unit with the coast guard is assisting local authorities here in atlanta and the surrounding community as they investigate what happened here yesterday. >> steve: jonathan serrie live in atlanta. jonathan, thanks. >> ainsley: in washington, a whistleblower claims there is a document detailing there was a criminal scheme involving the then vice president joe biden. now republican lawmakers are demanding the fbi turn that information over. >> brian: wow, this is getting interesting. this comes as a decision is reportedly coming soon in the federal criminal investigation of hunter biden four years and counting. >> steve: lucas come lynn son joins us live from the bureau,

two different binders involved in these stories. >> that's right four under investigation. james comer, senator chuck grassley say they have new information from a whistleblower involving then vice president biden in an alleged pay to play scheme. they wrote a letter to biden's attorney general demanding the fbi file that quote describes an alleged criminal scheme involving then vice president biden and foreclosure national real obligor to the exchange of money related to policy decisions. the document includes a precise description of how far the alleged criminal scheme was employed as well as its purpose will afterverify whether or not it's criminal activity but i do have faith in the whistleblowers that bring it to me that this document exists. >> white house defending the president's statement, quote:

for going on five years now, republicans in congress have been lobbing unfounded unproven politically moatgated attacks against biden and his family without evidence of claims or decisions influenced by anything other than u.s. interest. when it comes to president biden's personal finances, anybody can take a look, he has offered unprecedented level of transparency releasing a total of 25 years of tax returns to the american public. grassley and comer have not said when this alleged wrongdoing took place or what country was involved. as you mentioned, steve, the four year investigation into the president's son, hunter, may be coming to a close as prosecutors decide whether or not to charge hunter with tax and gun-related crimes. guys. >> steve: i'm thinking about the last guy, lucas. covered "the new york post." joe, the secret file alleging that then president biden in 2020 took money from a foreign national. >> this is the probably the riskiest of all of the g.o.p.

allegations thus far coming out of congress. this is not about hunter. this is about the former vice president and current president of the united states and claim that can only be backed up by that fbi document that they're requesting. a document that they probably never in a million years will get from the fbi. so, if they can't get it from the fbi, and they subpoenaed it. that's the headline. they have to try to convince the whistleblower to come out of the shadows and testify. >> ainsley: it's bad. they are alleging that he accepted bribes from a foreign national in exchange for a policy decision. they do say it's believed to involve a country other than china. >> brian: right. i don't know why the fbi wouldn't give up the document it's the law. it's speculated in the "new york post" and deals and what it could be around. ukraine we know about that burisma link. mexico carlos slim one of the richest men in the world. went over to mexico he also set up meetings hunter biden with carlos slim and his business

associate jeff cooper. the mayor of moscow, there is a linkage there with the biden family in romania breakfast with dad was one of the things on the daily planners, a romanian businessman. china and cefc and we know about the complication with china and hunter going over there on air force 2 and that possibly linking to the dad. so we'll see if paperwork backs this up. for those people who say this is ongoing accusation from republicans. it's not really. they have only been in power for a month or two. and senator ron johnson was zeroing in on all of this until the georgia election they lostth majority. they lost the majority in the senate and, of course, they lost the white house back in 2020. so we will see if this moves forward and see who this whistleblower is. miranda devine all over, this knew more about all that was going on with the biden family before most of us. she wrote the laptop from hell. talked about this in perspective and thinks it's really getting close to an answer. >> the prey verbal walls are

last night. he looked at all of this. he said what he thought it was was somebody probably called the fbi and said we have evidence about joe biden. to they did an interview. and, of course, as we have learned over the last couple of years when they write down everything they ask him and they ask him every detail and put it in a so-called 302 form. this probably relates to that, according to mr. tolman, which that's a good supposition. so they interviewed somebody. they wrote down everything they said. the question is then did the fbi, the doj, did they deem that person reliable or not reliable? did they follow it up? is the case still open? the house republicans and the senate republicans are making a lot of statements. but we don't have many answers. they just would like that -- they would like to get that document from the fbi. but i bet you a dollar the fbi has a million reasons they will come up with not to release it. >> ainsley: they don't believe this is the same whistleblower that came forward last month with the irs. >> steve: sounds like an fbi

person. >> ainsley: they said the documents subpoenaed by the paneled was created or modified in june of 2020. that was months before the election. it must be supplied at the committee meeting on may 10th. >> brian: keep in mind that stenographer michael mccormick last week said this was a corrupt family i witnessed it up close and personal. i don't know what happened to his testimony but i look forward to him coming forward. i just know the previous administration if there was a rumor of the fbi having documents suddenly they would appear in the "the washington post" and every commentator would have a source from the fbi that reveals something is going on with donald trump and they are doing an investigation like they have never seen before. now with a legitimate subpoena to get paperwork, people worry about them not giving it up. it's bizarre. meanwhile, 11 minutes after the hour, today embattled dhs secretary mayorkas visit the southern border -- by the way it's sealed -- as title 42. >> ainsley: secure. >> brian: texas dps lt. chris olivares is on the lines and he joins us live.

>> ashley: manhattan district attorney alvin bragg is investigating the death of a homeless man who was placed in a chokehold w by a subway passeng. the man had been acting erratically when a marine veteran put him in a head lock and other passengers stepped in to restrain him. he eventually passed out and e.m.s. workers were unable to revive him. the medical examiner ruled the incident a homicide. marine was taken into custody but later released without charges. protesters marching through new york city yesterday demanding justice for the homeless man. nashville police demanding the release of a manifesto by covenant school shooter audrey hale. due to litigation filed this week, they have been advised by counsel to hold the release of those documents. earlier this week the tennessee

firearms association filed a lawsuit demanding the release of hale's journals which were found by authorities along with a suicide note and several covenant school yearbooks. the shooting in march left six people dead, including three 9-year-old children. overnight elon musk spacex launches dozens into orbit as falcon robert carrying 56 satellites adding to the 4,000 already in service. this was falcon 9th 27th launch and seventh overall flight for this booster. a strategy that helps spacex cut down on the overall costs. and those are some of your headlines, ainsley over to you. >> good deal. thank you so much, ashley. dhs secretary mayorkas is heading to the southern border to speak with local officials and review cbp and ice operations before title 42 expires in one more week. encounters are up 15% this fiscal year compared to the same time last year.

with title 42 ending soon it's bound to get worse. chris olivares from the texas department of public safety joins us now. good morning to you. >> good morning, thanks for having me on. >> thanks for coming on. you see this firsthand. you are down there. do these visits by mayorkas help or hurt? >> they don't help at all whatsoever. when we look all the visits the secretary has done the past two years you showed the numbers on the screen and the numbers continue to get worse every single month, every single year. with all these visits that have been taking place, there hasn't been any significant change as far as to prevent the number of people coming across the border legally to will prevent got-aways. suspected terrorists coming across the border. i don't foresee that this visit is going to change anything. if you actually, you know, keep in mind, right now title 42 is in place. they did have the cbp one app. that's supposed to decrease the number of people coming across the border. but the numbers speak for themselves. the events that are taking place along the border speak for

themselves. nothing has change. the situation has gotten much worse. >> ainsley: we will put up mayorkas' plan he has a post title 42 plan. some of the things he wants to complement. expel through title 8. what are your predictions on ma? >> >> well, you know, right now we are seeing a significant increase along the southwest border with encounters. every single sector has increased the amount of people that have been coming across. also keep in mind, too. the shelters in new mexico right now, there are thousands waiting. you have the central caravans making their way they are all aware may 11 st. a free for all where anyone comes across the border will be released into the country. i say that because i have spoken tom solve the migrants myself. they tell me the reason some of them are coming right now they have family and friends that have been released into the country so that's why they're coming. the cpb 1 app. doesn't work.

if they would return to the policies remain in mexico policy, safe third country agreements and construction of the border wall and apply consequences we would not experience what we are seeing right now. especially going to title 42. they have had two years to put a plan in place in place of title 42. yet, they have not done so. i don't know if that's ignorance or just intentional. the fact of the matter is, they are allowing this to happen. >> ainsley: what do you expect will happen, biden sending the 1500 additional active duty troops down there? we are hearing mainly to do clerical work is that true? >> that's what i understand and, of course, that's not going to solve the problem at all. that's not going to aleve the processing for border patrol. they won't be allowed to process. you are still going to have agents processing and pulled from the field to process the amount of people that are coming across the border. these soldiers will be use ford administrative purposes which is the not role of active duty soldier. if you look at what the national

guard is doing, they are taking enforcement action, some type of deterrence. they have been able to stop 38,000 potential counters between the ports of entry. they have been putting up razor wire fencing. different roles than what the u.s. soldiers are going to be doing. it's not going to solve or prevented anything. so it's just another -- also, if you look back, too, prior to the 2021, there was criticism for the previous administration sending u.s. troops to the border. so, again, just completely undermines their claims that their plan and policies are working and the fact that the border is secured by them sending u.s. troops to the border. >> ainsley: i know dps was involved in that manhunt at the beginning of the week so that i think for your service. and, please, thank all the men and women in your department for that. >> i will. appreciate your support. thank you. >> ainsley: thank you, lieutenant. we have a fox news alert. an hours long manhunt. this one happened in atlanta that brought terror to that area ends with a suspected killer in custody. former fbi special agent and navy seal jonathan gilliam on the quest for answers, next

>> now we are learning more about that man. the 24-year-old suspect who was discharged from the coast guard in january of this year as his mother speaks out blaming the v.a. for giving him, quote: messed up medication. >> brian: all right, former special agent jonathan gilliam joins us now served with the navy seals knows all about this with law enforcement background. what sticks out. the witness folded catching up to the guyer with did and then having him arrested. from what you know right now, what stands out about this incident? be. >> well, i don't know if this is a premeditated attack but he did have a gun with him when he went in there. so a lot of these hospital attacks and that's what this appears to have been stem from a prior incident or they stem from a domestic incident, possibly he had a relationship with somebody in the hospital. those are typically the two things that these types of attacks happen occur. and then the fact that the

shooter. he was this there for about two minutes. he cold one person and injured others. it sounds like within a few seconds or minutes his emotional outburst had stopped and he fled. and then he went to hide. so he didn't continue a killing. i don't think it was terrorism-related. i think this is going to come down to an issue that occurred not just medication but an issue that occurred and, quite frankly, could have been premeditated when he went in there. >> jonathan, this is what we know about the suspect. he entered the coast guard in 2018 as an electric tricks' mate second class. discharged from active duty this past january. dui charges dropped in 2017. arrested twice for violating probation in 2017. arrested and charged with possession of marijuana. ened in 2015 he is only 24 years old. what is happening when we are seeing all these school shootings or individuals like this who are upset about something and they just plow

down everyone. five women sitting in that waiting room and they all were hit ainsley this is a long conversation but a very simple answer. the fact is our society has broken down, i think it starts starts with the family and school when these people are not taught to control their anger anymore. there is no discipline in schools. enemy cases there is no discipline at home. so we have a generation or a couple generations of young people and middle-aged people who are to the disciplined in controlling their anger. when you throw into that things like gender confusion, drug abuse, and longstanding issues with authority, you're going to have people that do this. and this is something that has grown as social media has grown and has the department of education has completely fallen apart. there is a lack of discipline in this world. and when you add mental

instability which drugs will lead to that and this individual does have a history with drugs and dui. he had substance abuse, this is the type of thing that you will see. in almost every single one these shooters i would have to say all of these types of shooters typically have emotional or rage issues. sometimes brought on by medication but definitely brought on by the fact that the way children are raised right now is just not doing the trick. >> steve: what's unique about this is he actually went to the hospital with his mother and then became enraged in the lobby and we asked jonathan serrie why he got enraged. and the motive has not yet been revealed. maybe later today. jonathan, thank you very much for joining us live. >> ainsley: thank you. >> you got it, thank you. >> brian: still waiting on the manifesto to see what the shooter was thinking in nashville. >> steve: that's not coming out. >> brian: medication involved in this. jonathan saying if you were discipline problem you get detention now you get ritalin. i'm wondering about all these

here's the thing though, brian, just like in 2016 the democratic party is trying to rig the election in favor of joe biden. we saw this before with hillary clinton. we are seeing it now with not even wanting to take on certain primary. "new york times" came out with a post recently talked about the frustration that black voters are file the enthusiasm gap that black voters have he has not kept most of his promises that comes on the heels of the 70% poll that came out with nbc which showed that 51% of democrats didn't want to see him run again. i think if they have a candidate like robert kennedy jr., who is able to get steam and money, that may make a difference. but, of course, you have got democrats who are looking to rig the election in favor of biden. it doesn't look good for joe biden if they're the real candidate that steps in the race. >> brian: laura, the other thing that is real is issues. issue like we have never seen with the border. not control the shots two weeks. remember the haitians under the bridge look like the good old days shortly.
