help for my nephew but everything was about insurance. doctors knew his condition. he needed to be treated. he wasn't a bad person. the marine involved was questioned by police and released without charges. the family of jordan neely and the marine have both lawyered up as a manhattan d.a.ens office continues its investigation. protesters are expected to hit the streets of new york city again later today. back to you. >> brian: all right, todd. thanks. this is, to me, absolutely unbelievable. he is on the f train 2:30 in the afternoon. this maniac gets on and starts screaming at people and threatening people saying i don't care if i go to jail. menacing. he is an absolute menace. everyone felt threatened. i was listening to eyewitnesses this morning on the local wnbc affiliate. yeah, everyone felt as though he was in danger. he locked him up in a submission hold. sadly i don't think for a second he would want to hurt the guy. he wanted to calm the guy down. and two other people grabbed his arms because that's how out of control he was. by the time they get to the

stop. he doesn't have a pulse, they were unable to revive him. sadly he passed away. we don't know the toxicity in the blood. we don't know what is going on. we know this guy has been arrested 44 times. the last time he went to jail for punching an older woman in the face causing her severely injuring her while she was sitting -- while she was just sitting down on a bench. so he obviously is a problem. i have seen these lunatics on the tram, on the subway around that time on days when i'm not working late. almost three times a week for the last 15 years. especially through the pandemic. when you get on there, it's like you are in a cylinder. you are stuck there. and you could sit there and watch people get beat up or you watch people get shaken down or this guy says i'm going to lock this guy up. and i'm not going to stab him. i'm not going to shoot him. i'm going to subdue him. so now these protests, i don't know how much they are getting paid in the street wanting justice for a 20-year-old

homeless guy. what about the 27 people killed in subways since 2020? where were the protests for them as two were stabbed to death while they were sleeping? >> rachel: the leaders of this state, including governor kathy hochul are calling for justice for the family. listen. >> i do want to acknowledge how horrific it was to view a video of jordan neely being killed for being a passenger on our subway trains. so our hearts go out to his family. i'm really pleased that the district attorney is looking into this matter. as i said, there have to be consequences. so we'll see how this unfolds. >> lawrence: terrible governor. >> brian: she is the worst. >> lawrence: what a terrible human being. charges? charges against the person that stopped -- if my mom or my sister is on the subway, i want someone to step in. >> rachel: you want a marine in

a car. >> lawrence: this country is in utter chaos. i talked about this last night. a few months ago, i warned the public that this type of stuff was going to start to happen. there is no law enforcement anymore. they can't do their job. they have stepped back. the ones that decided to stay on the job. the d.a.s have allowed the criminals to roam the street. people have been pushed into the subway. month ago reporting on people taking chain links for bikes and wrapping their bodies around poles so they didn't get pushed into the subway. and no one has done anything about it and finally have a marine and two other people, one was a black guy. and there has been absolutely no coverage of it. and so you have the governor trying to tip the scales of the -- justice for what? what happened to the other 40 people that he attacked? 40 crimes that he has against him?

done. i don't care if i die, et cetera. those are signals to people who are trapped in that car. this is going really bad. and that plays into what the defense would be for this marine. his deference is going to be something called justification. and it's pretty simple. it's pretty much what it sounds like. i had to take the actions that i did, however risky, to mitigate a commensurate risk. in other words, what i did was justified because of the risk that this guy posed. >> brian: right. if he wasn't black, and the marine wasn't white, this wouldn't even be an issue. no one would care. now they have these protesters. i wonder how much they are getting paid in the streets and how much they are getting paid tonight. here is what aoc said. you talk about irresponsible and idiotic. jordan neely was murdered because jordan was houseless and crying for food at a time when the city is raising rents and stripping services to militarize itself. that's called giving cops a pay raise. she calls it militarize. while enemy power demonize the

millions on tv outnumbering radio for the very first time. , so much has changed since then and there's a lot of efforts to modernize what this coronation will look like. king charles has opted to ride in a diamond jubilee coach to get to the ceremony. this was built for the queen's 60th anniversary on the throne. it's much more comfortable than the historic golden gate coach does not have shock absorbers more than 200 years. this was that additionally used to transport want monarchs to ceremony. king will pay a special tribute to his wife by including the queen consort on the special honor medal that will be given to the about 440,000 people working on the coronation, those are medics and police officers and emergency workers. making sure that everything this weekend runs smoothly. 2,000 people have been invited to the coronation service itself. and those who will not be in attendance, of course, a lot of eyes on whether harry and meghan would be, prince harry will be

hour. massive protests breaking out in new york city. overnight probably like tonight again over the death of a 30-year-old homeless man on a subway. his name is jordan neely. he reportedly threatened several passengers earlier this week when he was placed in a chokehold by a retired marine at 24 years old and ended up dying. his death was later ruled a homicide. now protesters are demanding the manhattan d.a., you know him, alvin bragg file charges. here to react manhattan district attorney mark better row. great to see you. first off your reaction, how much should this 24-year-old marine be worried being charged? >> i would be worried that he could be charged with manslaughter charges or criminally negligent homicide charges. i think he should be worried. >> brian: why? >> because there is a video of him holding neely, choking him, using what lawyers call deadly physical force. and if he was not authorized to use that force, then he is potentially facing charges one

might assume or believe he wasn't justified because he didn't appreciate the risk that a reasonable person should have by choking someone it's likely to cause their death, particularly a marine who presumably is well-trained in the use of that kind of force. >> if you feel threatened you can't get somebody into submission hold? >> the law requires, before you use deadly physical force, that you believe another person is using or is about to use deadly physical force. >> brian: this could be the case especially when you look at this guy's track record, 44 arrests. one time he spent the last time he spent time in jail was for punching a woman in the face causing severe brain injury. >> the issue is, the marine who just encounters him on the subway is not likely to be aware of that. so, in a legal sense, although that history is relevant to people who want to see the right thing happen here legally with respect to what the marine perceived and what kind of physical force he saw being used i is not going to be aware of
