voices or with weapons. >> harris: the protests are going. last night after a day of it yesterday and shut down a major new york city bridge for more than 20 minutes as the protestors marched to the courthouse. others gathered in the subway station with the 34-year-old jordan neely died on monday. some demanding a criminal prosecution now for the former u.s. marine who put neely in a choke hold after neely reportedly started yelling and threatening passengers. progressive congresswoman alexandria ocasio-cortez getting into the mix early quoting neely's death was a public execution. before that she called it a murder. the death, however, was ruled a homicide by the coroner's office simply meaning the cause was another person. mayor eric adams called
8:02 am
alexandria ocasio-cortez's claims irresponsible. >> those will criticize no matter what's done. i have a responsibility for this entire city. and i have faith in the criminal justice system and i am going to let the process take its place. those who believe that i should do something differently, i respect that. but i have to make the right decision for the city of new york. >> harris: 27 other people have died in our subway system here. they didn't get this kind of response from the far left. the pressure again is on that d.a. alvin bragg. will he call this something that will pitch to the far left and keep them happy? is that the goal for the soft on crime prosecutor? we'll watch. for now fox news senior correspondent laura engel with more. >> the mayor of new york city continues to ask for patience while the investigations play out as the voices demanding justice for jordan neely grow louder with many enraged by what
8:03 am
they have seen so far. this cell phone video we've been watching of the deadly struggle in the subway continues to draw questions about what happened leading up to the moment that a 24-year-old former marine held neely down on the ground in that deadly choke hold? witnesses say neely was screaming and threatening passengers as you mentioned. the former marine has not been charged in the death. fox news has learned he hired criminal defense attorney thomas kenneth a manhattan d.a. alvin bragg's formal rival who ran against him in the race for manhattan d.a. in 2021. a former manhattan assistant d.a. talked about the possible charges the former marine could face. >> involuntary manslaughter. that he was reckless in choking him for an extended period of time and that he was not authorized to use that level of force. >> protestors marched last night from barclay center if brooklyn to lower manhattan shutting down parts of the manhattan bridge.

spray painting the street with justice for jordan and at times clashing with police and chanting we reject eric adams for not calling this death a murder. the mayor applauding the police for getting to the scene so quickly. >> as a former transit cop, i did it as a career. i know what it is to have to respond to a job in the subway system. those officers did a great job. >> still more to go. nypd and manhattan d.a. investigate. they hope more witnesses will come forward. >> harris: thanks for getting us started on the story. free speech on full display. opinion editors are churning out op-eds. this one. what happened to jordan neely is the city's failure to police subways and treat mentally ill. another with jordan neely and george floyd syndrome makes
8:05 am
these three points. one, if reports are accurate, neely's actions arguably justified a defensive response. two, his character and past became irrelevant once he had been restrained. three, vigilante justice only happens when a law enforcement void is created. retired nypd inspector paul mauro with this. >> remember the context. we have had a rash of stuff in the subways with people pushing women in front of trains, doing all kinds of stuff. you heard some of the verbiage from mr. neely from that witness who says things like i'm done. i don't care if i die, etc. those are signals to people trapped in that car. this is going really bad. all the racial arsonists in this town are topping off their gas cans. it is a disgrace to see. >> harris: let's get to in "focus" now steve hilton host of the next revolution.
8:06 am
can we start with what paul mauro said. all the racial arsonists are topping off their gas cans at this point. >> exactly. that is what is so terrible about this story. there is a human tragedy at the heart of it that we shouldn't forget. and we weren't there and don't know exactly what happened. we've seen pictures and video. it will emerge. we can't make a judgment about all the context. what we can see is what the left is doing right now to use this to exploit it for their own political partisan advantage to push their extremism and that is totally reckless and irresponsible. we heard a comment there the argument this wasn't authorized to use force to that extent. it seems to a lot of people the ones who are these days authorized to use whatever force they want are the criminals. that's what has happened in our big cities run by these far left democrats. i have to say eric adams seems to be striking the right tone in his remarks and that's all good.
8:07 am
let's remember what the real story is here. he was elected on the promise to stop the crime and chaos in new york, specifically elected on the promise to stop the crime and chaos on the subway. there is still is. we have to remember there is a political responsibility here to create a situation where a city is safe and orderly and people feel safe and secure going about their daily business. then you won't have incidents like this. >> harris: i was in the elevator moments ago and something caught my ear from laura ingraham on the air at the time a few minutes ago saying there are two options here. treat the mentally ill, those people in trouble or they go to jail. you cannot live in a population, steve, where everybody is on edge based on something they can never predict. >> exactly. again, eric adams made very strong promises. that's why he won and why he actually won in the primary and
8:08 am
general election in new york. he was the one that seemed to recognize the desperate need in new york to deal with these problems and yet maybe he is trying but it is not good enough. the situation still doesn't seem to be improving for too many people. in terms of the mentally ill, it is absolutely right they need proper treatment. now, i don't think i would say that the choices are stark as sending them to jail if they haven't committed a crime. but if they need help they should get the help that they need. that's a long-term process. they go on and on the left about investing in this and investing in that and healthcare and taxes seem to go up and up and up but the services that cities need to look after everyone, including those who are most desperate, never seem to be there. and the actual outcomes seem to be worse. >> harris: the idea that aoc and others on the far left are jumping on this particular situation is really a head scratcher because we've covered it here on the "focus."
8:09 am
27 other people have violently died on the subway system since march of 2020. one op-ed says jordan neely matters but asks where are progressives when those others were killed? look, it is a fair question because we talk about race but many of those victims were black. what is it that aoc, why does she suddenly get involved on this one? i know there is an ethics investigation into the dress she wore to the met a few years ago and how she paid for it or didn't. is she trying to get some spotlight here? what's the political play? >> what it reveals is in many ways the defining characteristic of today's far left extremist democrats. they are not interested in substance, in the actual outcomes of policy and what happens in the real world. the only thing that they care about is sending the right message to their activist base to if you like the term we used
8:10 am
to use was virtue signaling. it is ideology signaling. all they care about. the actual consequences of the policies of the people they support are completely uninteresting to them and especially the consequences. the most shameful thing. for the very people, the aoc and others on the far left say they care about. the poorest, most vulnerable, people in minority communities, they are the ones hurt the most by the far left policy. people on the far left don't care about actual outcomes. they just care about riling up their activists on twitter and social media and sending the right ideological message so they look like a virtuous ones. the exact opposite of virtue and it is really disgraceful. >> harris: she is putting a lot of toxic words and behaviors into an eco system that needs to be calm and that's what the mayor is talking about.
8:11 am
