kill. >> there should be charges put out there and i believe it is because who was killed, that hasn't happened. >> jesse: judge jeanine pirro, you were off yesterday. we missed you. now you have had, what, 48 hours to digest this tragedy. where do you see things moving? >> jeanine: first of all, this is a very sad case. i think that a lot of people are responsible. one of the most significant is the mental health system in new york state. this is a guy who was a schizophrenic, i believe he was probably in the midst of an episode. when you're in the midst of an episode, you can be extremely violent. now, we don't know if that is the case, and i am not suggesting it is the case. we don't know all the facts, so unless and until it is resolved by a grand jury, we can't make a decision. look, this marine is entitled to use whatever force is necessary to prevent an individual from committing or using that force against another person. all these people, these talking heads, they don't know what the hell they are about.

they don't know the law. they make it up as they go among. people actually read saying the other people watching, how is that not a crime, they should be charged with a crime. i mean, we have a law in new york state that is very clear. if a call came in saying he was threatening and harassing passengers, if he was in the midst of a psychotic episode, if indeed this person was reasonable, in his mind, the marine, and the facts make it clear, not just before, but after, where they leave him in a recovery position. they didn't leave him in a position where he was on his back and could have choked. they left him in a recovery position. he didn't move after they let him go. they were saying "where are the police?" he waited for the police. it was not black versus white because it was a black guy holding him down, as well. there are subjective and objective tests that will be used. this is a guy who has been arrested 40-something times. nhe knocked some 67-year-old

woman out. he was a mess. by the way, i'm fed up, i don't mind getting life in prison, i'm ready to die, and you are threatening people, that kind of sends a signal that this guy can be dangerous. so, lets everybody down a little bit and kathleen hogle, the government know my governor, people shouldn't be killed passenger on the subway. 27 people have died in the last two years on the subway. where were you? >> jesse: i think we have some of that hochul sound. let's listen. >> i do want to acknowledge how horrific it was to view a video of jordan neely being killed for being a passenger on our subway trains, and so, our hearts go out to his family's. i am really pleased the district attorney is looking into this matter. as i said, there have to be consequences, and so, we will see how this unfolds. with his deserves justice. >> jesse: that's a pretty reckless thing to say, as, you know, the governor.

>> harold: good to be back. this is a terrible story. i agree with the judge. he was a passenger, but there was something else going on. i want to get all of the facts. i agree with the judge. we do know the new york law is clear around this, any response to a real or perceived threat has to be proportionate to the threat, and if he believed, in his mind, that this threat was of a nature and a level that he needed to respond that way, then the law will be applied appropriately. i think those in the city who believe that crime is going down or that public safety is increasing, this is a prime example that it's not. there is a long list of politicians who have lost office, who told voters that you are richer than you think, you are safer than you think, and the country is more prosperous. if people don't believe that, then they're not going to react accordingly, certainly not a political setting. in this particular matter here, i agree with the judge, we got to wait for the facts. i think mayor adams, his language and his conduct should

be modeled and emulated as we go forward with this process. >> jesse: and so, alvin bragg is going to have this next week what is going to go to a grand jury. do you think he can get a fair shake here in manhattan? >> kennedy: i actually do. harold touch on this a little bit. people don't have a sense of safety when they ride the trains here, and i'm looking at this story and it is tragic. you know, it makes me really sad because aoc is calling this marine a murderer, but it's like, what about drive nyc? what about the billion-dollar mental health initiative at the former mayor's wife was in charge of and that money is gone, it evaporated. why wasn't jordan neely given the help that he needed for the years and years that he was in the system. you know, he was known to authorities, he was known to doctors come he was known to social workers and mental health care workers, and his grandmother said the system failed him. it was not just this one instance. that is tragic. the layers of bureaucracy that zealots of big government actually put people like him at risk, and they don't help him.

and shame on aoc for representing this part of the country and not standing up to the bureaucracy that got this guy killed. it's like, i ride the train by myself, sometimes at night. we have all seen stuff like this happen. my question is, what are you supposed to do? it's like, i don't feel comfortable carrying a knife because i don't want to be in a situation like this where, god forbid, there is a struggle and someone dies, and then i am liable for it. same thing with my daughters. i don't want them carrying weapons, but how do you defend yourself? and how do you keep other people around you safe? >> jesse: that's a good point. greg? >> greg: the left really appreciates jordan neely now but he is dead. they didn't give 2fs about him when he was alive, so they do not deserve to be listen to peer al sharpton says if you are not at risk, do nothing, then joy reid says if you don't do something, you should be charged. again, they do not deserve to be listened to. hochul said, you know, that could be you. assuming that we, society, what identify with and unhinged, violent felon, threaten people,

with it. there is no want to count for that kind of money. this is just another hunter biden scam that the media is going to say, oh, the guy needs help. where did the diamond go? he pondered it and then did what with that the cash? rated the burisma money go? joe biden himself is worth $8 million. he took out a line of credit on his house for a quarter million last month. where did that money go? we know the sugar brother who paid off the 2 million in back taxes is now hiding hunter's assets. they took the 10% stake in the chinese company and he said that's mine now, so hunter does not have any exposure to it and the woman down in arkansas can't touch it. it's good. i'll give them credit, it's good. >> kennedy: she touched it plenty. judge, let's talk about some of those ethical concerns that jesse raises. there have to be people within the biden administration who are worried about the optics of a legal defense fund. he had been generating money for

a long, long time. >> jeanine: it was during the obama administration that obama's people were worried about the optics of hunter going with his father, where we now know he collected 1.5 billion from the chinese from whatever company he had at that point. considering this legal defense fund, it is so sanctimonious, it is so stunning, this guy who literally has compromised just about every agency and our government, first of all he compromised the intel agencies, we just saw them getting together. he also compromised an election because people say had they known about the laptop they might have voted differently. he compromised the secret service, who found a gun in a garbage can, that gun that he got with a pistol permit application that he lied on. he has compromised the doj, taken five years to figure out whether or not they can indict him on charges, i could sit here during the next 10 minutes and do an indictment myself.

okay, and he has compromised the presidents of the united states, who has made questionable decisions regarding policy from countries where he has got money. this kid is such a dirtbag. he is such an anger, he is such a deadbeat, i'm not just his father, but on the country, and for him to actually have a legal defense fund is just outrageous, it is stunning. we think about it i said to myself, when they had gofundme, on some of the websites for gofundme fundraisers, they were shut down for conservatives, like kyle rittenhouse had one, that was shut down, the freedom convoy, the truckers, there gofundme was shut down, andy n ngo, the independent journalist, that was shut down, anti-backs, that was shut down. this thing will go forever, and you know what? no one is going to question who has given money, how they are siphoning money, whether it is coming from a foreign country or someone who has already maxed out to joe because we still don't know who gave him a half a

for bobby kennedy, maryann williams, or anywhere else, they are not going to set up a primary process for debates for someone to challenge the head of the democratic party. >> jeanine: wow. >> harold: i think the president should spend more time with the media and voters and probably a threshold you have to have for the president to debate in your own party and certainly the debate commission has a threshold you have to meet to be able to get on the debate stage. now, i think the debate commission stress hold was 15%, so it appears that bobby ken kennedy jr., falling somewhere -- he is pulling north of 15%. marianne williamson, i have not seen the numbers where she is above 8% or 9%. i think the troubling thing for the white house and for this president is this: bobby ken kennedy jr. is a serious guy but i do not view him as a serious candidate for the united states. marianne williamson is a serious person, but she is not someone i would consider voting for president. yet a quarter of democratic

voters are siding with them against this president. i think the next 4-8 weeks are critical for president biden and his team, and the way i think you counter this is you have to get out and talk about your record, get a positive message, really go out and talk about it because if you find 4-8 weeks from now, robert f. kennedy jr. and marianne williamson still pulling about 25%, that is when you are going to see gavin newsom, that is when you're going to see gretchen whitmer, i don't mean to leave anybody out, i think you're going to see people say, if they can poll here, if people don't know then that people may not take them as seriously, why don't i get in this race? this is why i think it is critical that president biden and his team get in front of the media, get him in front of voters come and get him out there with his message. >> jeanine: greg, we know they are not going to do that because they cannot trust this man in front of the public without a cue card. all right, so let's talk about, whether 4-6 weeks, it does not matter. the bottom line is, you have a guy who barely announced, who has 18%, 19%. who are they to say, while go,
