last monday. the the marine's lawyers releasing a statement that reads in part, quote, when mr. neely began threatening the passengers, daniel, with the help of others, acted to protect themselves until help arrived. daniel never intended to the harm mr. neely and could not have pore seen his untimely death. but activist al sharpton is firing people up saying criminal charges must be filed now. >> if you conot prosecute him, in my judgment, you will set a standard of vigilantism that we cannot old rate. the precedent -- tolerate. the precedent alone is a threat to the all of us. we cannot allow this lawlessness to go unchecked. you're not going to choke this young man to death and let us not stand up and raise our voice. >> you know, it's remarkable with al sharpton being around for 20 years, he hasn't saved the world yet, but apparently he

is not. julie, it's kind of amazing, i try to stay off the subway as much as possible. you know, i was looking up the numbers, and since 2019 major crimes on the subway have counseled in the -- doubled in the past, since 2019, including 10 killings last year. though pickpocketing is down. but 10 killings last year. >> yeah. >> you know, what are new yorkers supposed to do? >> yeah. move? because, honestly, the crime rate in new york city has been soaring, obviously, since the pandemic thanks to politicians. and now it's getting even worse. so what do you do if you go on the subway? civilians are given no other choice but to protect themselves because they can't lean on law enforcement because law enforcement doesn't have the backing of the politicians. notice the trickle down, okay? so i talked to the nypd exclusively today, and here's what they had to say to me regarding how, basically, this system failed. jordan neely had 42 prior arrests, and he says to me, and this is nypd, high level, if you

have never been or seen someone cornered on a subway car by a mentally ill person who could possibly kill you or them, then you don't travel on the subway system. if you understand the reality of the situation, then you understand that sometimes average folks need to take action in extraordinary circumstances. whatever led up to the unfortunate death of mr. neely was not a preconceived intent by anyone involved. what initiated this terrible result was erratic and dangerous behavior. good intent by anyone intervening should not imply any intent to harm. mr. neely was let down by the system. neely had 42 the prior arrests. he clearly has mental health issues as well. the system let him down. and now we've got a marine veteran -- desperate -- veteran who stood the up. this guy had pulled out a gun and shot everyone, he would have been hailed a hero, but instead we have protesters decrying him a murderer. >> tom, listen to what mayor adams said here.

it sounds like he's almost leaving open the possibility that they're trying to be open-minded about it, but when you listen to other people, it sounds like they've made up their mind. listen to what mayor adams said. >> i asked to get the body cam, and i realized that they were there in six minutes. and i said, well, where did the 15 minutes come from, you know? someone blurted it out, and all of a sudden it became facts. and so we have to be very careful that facts is based on the actual facts and not what we want to create them to be. i just want to be clear, it did not take police officers 15 minutes to get there. >> before i go to you, or tom, listen to the what kathy hochul says, the mayor -- the governor of new york is one of these politicians who at the exact same time is trying to sort of ramp up the hysteria now. >> i do want to the acknowledge how horrific service the to view a video of jordan neelying being killed -- kneelingly being killed for being a passenger on

our subway trains. our hearts go out to his family. i'm really pleased that the cricket the attorney is looking into this matter. as i said, there have to be the consequences, so we'll see how this unfolds. but this family deserves juses us. >> so which is itsome. >> i mean, she continues to be a horrible person as does al sharpon. i've got to give mayor adams some credit here because at least the he is saying, oh, maybe we should wait until the facts come in. we do have a lot of facts. julie you said, what, 42 the times this guy was arrested? their using words like vigilante. this guy was going about his day. he wasn't on patrol, he wasn't even doing a neighborhood watch. this wasn't the guardian angel. the guy was trying to get from one place to another. so using words like vigilante, yes, of course that is whipping people up. and it's reprehend bl it's terrible that they're doing that. so what do you saw about this -- say about this guy? everyone should cool down, but you can't. i'm expecting mayor adams to

cave on this because that's the way it goes. the reason these protesters are out will the is they want action now. this is like no justice, no peace. so like most democrats, i expec, i do expect him to cave because that's the way these things go. >> well, it is kind of amazing when you look at somebody like al sharpon the, where were these people when george can neely could have maybe used their help when he was still alive? the way this always seems to work in our politics is the last person who has an interaction with somebody whether it's george floyd or in this case jordan neely, it's only last person in the line who winds up getting punished for this sufficient. >> well, hochul's a liar. he wasn't killed simply for being a passenger, he allegedly took his jacket out, threw the it on the ground, said something like i don't mind going to jail, getting life many in prison, i'm ready to die. when someone says that on the subway, what do you think is going to happen next if you're danielle penny? he obviously -- daniel penny?

he obviously seemed to think his life was in danger. jordan neely punched a 67-year-old woman in 2001 allegedly as well, so who knows what the man would have done. and i'm sick and ire thed of the racial exploitation -- tired. the intentional racial divisions. al sharpton wouldn't care if the victim was white. where is he when there's black on black crime? it's only when a black man dies at the hands of white people that the media seems to care or the left when they can the racially drive divisions in this country, and i'm sick of it. at least be honest about the facts of the case. you know, it seems like basically what they want to the happen is they're going to let the criminals roam the streets, and you just have to allow yourself to die, get pushed in front of a train or god knows what else. you can't defend yourself. >> none of these people want to help or have anything to contribute to any of this unless there's, like in the case of al sharpton, it's a situation where he can exploit it and use it to his own personal advantage. >> you know, what happened to george can neely, let's be

his presidency. it shows about 60% of the coverage of biden was actually positive compared to president trump's first 100 days which was 90% negative. [laughter] i'm not quite sure how he could possibly be complaining about the press when, truly, it is mostly positive which then i have to thank you, mr. president, for giving us so much credit since we're about the only opposition that's actually telling the truth which he sees as being negative. so i guess we're the only news in own theful thank you. >> yeah. the rest of it's just a propaganda machine. they talk about what his favorite ice cream is, things like that, right in. [laughter] but i do, i worry about underestimating joe biden and democrats' chances for 2024 because we're living in a corrupt country, you know? what have we learned recently? we learned that those 51 former intel officials colluded with the biden administration to conning connect this lie that hunter biden's laptop was russian disinformation. these are people at the helm of great power in the country who

intentionally lied to us as american citizens, worked with the democrat campaign before an election. and then you've got the secretary of state, blinken, also lying about his relationship with hunter biden and the fact that they had e-mailed, previously lied to congress in that regard. there's no telling what these people willing to do to try to win and rig an election. so i just worry about underestimating democrats heading into 2024 even though biden's a hot mess. >> here's what, speaking of hot mess, president biden says about hunter and how hunter has impacted his presidency by making him feel proud. >> my son has done nothing wrong. i trust him. i have faith in him. and it impacts my presidency by making me feel proud of him. >> okay. i'm a parent, so i know what it feels like to feel proud. i also know what it feels like to curse out my children -- >> although i don't think -- >> i don't let my children get away with the following: fox news first reported in december of 2020 hunter biden was the target of a grand jury investigation prompted in part by suspicious activity reports

administration is a figment of the press' imagination, and just this weekend or last weekend, whatever it was that the white house clown show, "the washington post" was given an award by a reporter for capturing biden's spirit. we're back to the fox news alert. allen texas investigating a shooting at it out on allen, texas. cb cotton is monitoring the breaking news and developments from the newsroom. cb, what is happening right now? i know there is an active shooter in the mall what's the latest? what's upsetting news coming out of texas this evening. fox news has been there are some victims. we do not know the extent of their injuries at this time. reportedly the shooting happened at about 3:30 p.m. this afternoon and summer outlet mall some 30 miles north of dallas. at this point you not know much beyond the initial reports. the allen space bar did take discussion of maybe 40 5:30 this afternoon just to stay away from this area.
