more fentanyl will kill americans, more americans die, more migrants die, more gang members get in. it's not just immigration issue anymore, it's a national security issue that's about to get a whole lot more. rich: we are going to bring griff jenkins. griff: of course a breaking situation just to set the stage about 8:30 a.m. local here in brownsville we are 4, 5 miles from the border but what happened a vehicle drove up on the sidewalk. struck a group of individuals standing next to a bus stop and resulted in 7 confirmed fatalities as well as multiple injured being sent to a hospital. it is believed by authorities that there are migrants among those both injured and/or killed because across the street from the bus stop is a homeless

shelter that has a lot of migrants right now that is housing it. we have footage, i believe we can show you that is outside the scene. some of the scenes are disturbing to some because it's a vehicle accident but what's unique about this, rich, makes reporting nationally, when we talk to many of the witnesses, many migrants themselves, one woman named rosie who is venezuela migrant with tears running down her eyes as she recounted what happened. she was among the group. she said there were 20 to 30 migrants mostly venezuelans standing outside of that bus stop this morning when she said she saw the vehicle veer off of the busy highway we are standing onto the highway, plow into the group of her fellow venezuelan migrants causing horrific injuries. we are here now with brownsville pd investigator martin sandoval. you have been very busy, what

can you tell us about the situation, is there any new update, can you recap what we know? >> sure at 8:30 we received a call of major accident where a land rover disregarded bus stop across the street from homeless shelter. the homeless shelter is being used to shelter immigrants coming into our country. right now as far as we know, when the officers got here to the location, there were 7 confirmed dead and some 4 to 6 people transported for the hospital from minor to major injuries. the driver was detained at the scene. several witnesses detained the driver. it's unknown whether he tried to leave or still at the scene. officers arrested him and we charged with the most minimal charge which is reckless charges but that's enough to detain him. we are also at the hospital with him and running toxicology report on him to make sure that alcohol was not a fact. if it is a factor, more charges will come. as far as we know, our detectives are working the scene and more than likely more charges coming on later. griff: investigator, walk we

know about the vehicle, rolled over and then the driver got out and you said that the bipartisans detained him? >> yeah, some of t bystanders detained the driver. if he was trying to leave the scene, that's not charge at the driver o. it went up there and hit the couple of people and rolled over. griff: we had very emotional young women here just walking past us, migrant from venezuela, she was telling us that she felt that she was intentional and we don't know the motive yet, that something that you are looking at in. >> that's something we are looking at. we have detectives at the scene and some at the hospital trying to question the driver. if it is intentional there are certain law that is we have to follow and certain rules and more charges will be pending on him. if it is intentional, we will try to see if we can seek help from the federal government if that comes to point.

griff: as we wait for more details, you have to identify there are migrants. we believe there are migrants as victims. >> it is believed that but when we get confirmation that's when we confirm. we need to know who they who we can contact their families. griff: your border communities like yours and brownsville have situations now with so many migrants surging during this period, you have groups whether outside of the shelter, downtown by the bus station, you have larger groups of migrants. something that you're not normally used to which could possibly simply as much increase in danger to just people because of their numbers growing. >> there's large unflux of people in downtown area, on the roads and everything, it's something that we are trying to manage. as far as patrol division, they are still operating normal

procedures, regular hours, nothing has changed from our patrol. what it is we have officers coming on days office. they're out hire trying to maintain the peace as best as we can. griff: from on operational standpoint when you hear of the surge after title 42 could lift, that creates a concern of elevated, you know, pedestrian safety? >> any time we have influx of people or any people is greater concern especially dangers. like i said something that we are planning. we have plans in place. hopefully we do not get the big surge but we do not know until we get to that point. griff: officer sandoval, thank you very much for your time and rich, we will continue developing story here but certainly one that's greatly

concerning. they are all saying that it was mostly migrants among this because of the fact that it was right next to the shelter behind me, but no confirmation yet from officials. >> rich: griff, how far are you from the u.s.-mexico border? you hav have been down for a wek now. griff: rich, with every day that we have been here the numbers have increased, the groups since the middle of april in just that area where we have been doing normal live shots in brownsville at camp monomovement that bored patrols are dubbing it. we have seen some 30,000 plus migrants being processed since mid april, just lastly, simple look down the road, we are 4 to 5 miles from that exact crossing location but migrants are routinely brought here to this side of the street. you can't see it now but in the

distance, the building down there beyond that super market sign is a normally homeless shelter but it is overwhelmingly full now with migrants because of the recent surge and then on the other side of the street is the bus stop where the migrants frequent i will go to oftentimes trying to catch a local bus down to the main bus station downtown so they can get the bus into the interior of trust. just a part of complication, border communities dealing with influx of migrants as we are seeing today a tragic, tragic situation here. we will bring you more details as soon as we get them, griff. rich: griff jenkins live in brownsville, texas. thank you. we will bring in tom homan former ice director. tom, you look at this situation and, again, we have to stress that police are still investigating what's behind this accident who was involved, who was killed in this accident but there have been repeated incidents where you have migrants being transported throughout the country where

there have been deadly accidents and incidents. >> look, this is tragic and what's sad you will see more of this because the border communities, they are overcrowded, they are overwhelmed. this administration has no plans and plan to release everybody in the united states but no plan to take care of them and the shelter is overwhelmed asking the. they are turning people away. so when title 42 ends, the situation you saw is going to get worse. el paso's streets are overwhelmed and brownsville's streets are overwhelmed. this is something that no one is talking about. the biden administration keeps attacking the trump administration about how inhumane. since joe biden has been in office, there have been over 1700 migrant -- migrants that died on u.s. soil. that's just the ones we counted.

many one that is have drowned in river are never found, many lost in texas land in arizona desert and never be found but 1700 migrants have died since joe biden has take tennessee white house because you opened the border and the most vulnerable people in the world will come to the greatest nation if you promise that you can get to the country and you'll be release and no consequence. record number of migrants have died under his command by far, historic number have died and historic number of americans have died by fentanyl crisis. there's nothing humane about the policy because it puts vulnerable people at risk. rich: tom, you mentioned that so many agents, border patrol agents are getting drawn off the border because they have to deal with a lot of administrative details of all of this and the administration as a result of that has sent -- is sending 1500 troops to the u.s. border to help with that. how much does that help?

>> well, the military, they are going to take up administrative duties like transport facilities, work but under trump administration we will do the same thing but when we sent the military down, our whole intention military to take on duties to release border patrol agents to get back to the border. this administration again from day one for the last 3 years, their number one plan is to process quickly and release quickly so it doesn't appear to be overcrowded. they are concerned about the optics. they haven't done one dam thing to slow the flow. the military will go down there and what that mean and release some of the agents and those agents will go to processing center because they are overwhelmed and they will need more help processing and releasing. once the border patrol has over 26,000 in custody, they will pull everybody out the line. mark my words. there are parts of the word near the next couple of weeks and no

single border patrol agent in the sector. they did that when there were haitians down the river. rich: if you look at the screen on the right here, that's migrant processing along the border that's not the accident scene that griff jenkins was reporting at. those coming across the bored and they encounter processing and load them onto bus and move them on from there. if the u.s. doesn't have an agreement with the country that they are a citizen of, it's difficult to return them. here is chief ortiz. >> big portion of the population that we are encountering are from countries where we have no repatriation agreements, cuba, venezuela, nicaragua, very difficult to send somebody back to their home country if their country is not willing to

receive them. rich: how much of a challenge is that tom? >> it was a challenge in trump administration but we fixed it. guam em three, honduras and honduras they were pushing back return to but president trump told them either you do it or we are going to take your national aid away. he told mexico you are going to put troops in northern and southern border or we will tariff your products. look, the administration needs to get a backbone and hold the other countries accountable. if cuba don't want to take citizens, there's a process to return to country. this is a policy issue. we've already wrote the plan that was -- they gave us the most secure border in my lifetime. all they have to do is take the plan and dust it off. title 42 coming up, everybody is panicking, they can put remain in mexico program back in play, the federal courts have said it's legal. that was a game-changer for the trump administration. they could fix this tomorrow if

the violence that continues to plague our country. back to you, rich. rich: casey stegall live in texas, for more on this, we are joined by retired special agent. the dallas morning says this is the 20th mass murder in the united states this year. this is early may, just this last week we've had cleveland, texas, tulsa, oklahoma, you've had the shooting in atlanta. what, what's left for law enforcement to do here. >> we've had almost 200 mass shoot negotiation the united states just this year alone and the reality is this problem isn't going away. law enforcement is doing everything they can but we need to talk about mental health issues in the country and we can get the help with doctors to look at these problems and

hopefully prevent some of these things from occurring. po.rich: this is a state where u don't need a license to open carry. in a way relying on citizens to carry weapons to stop this kind of thing. it wasn't the case here, but, you know, what do police officers -- what does law enforcement think about -- about citizens out there to defend against situations like this? >> rich, part of the problem is no matter how fast the police respond, there's always going to be somebody injured first. we were fortunate there was a cop on the scene who ran towards the danger and took the shooter out but there's always going to be a delay and tragically we had 8 victims. people need to know how to protect themselves. it's a sorry commentary on our society but that's the reality

during his interview on msnbc. >> the sentiment in this country despite all to have wins -- >> all i've heard is negative news. everything is negative. i'm not being critical. the only way you will get a hit if there's something is negative. >> now to washington post abc poll, biden's job approval has fallen to all-time low of 36%, majority 56% disapprove of the job he's doing and 54 to 36%s of americans say donald trump did a better job handling the economy when he was president and then there's this, rich, the poll show trump beating biden in a head to head rematch 44 to 38%. if florida ron desantis, 42 of the population said they'd vote for him instead of joe biden. then the question of age, 63% say the oldest president in u.s. history does not have the mental

>> at this point it doesn't look like it. when you already go trailing by 35 plus points it's a pretty big hill to climb against a former president. you've never seen that before and he has a passionate base that comes out. they come out to primaries. there's incumbent president here and we don't have incumbent presidents facing significant challenges. does he have a risk of not getting the nomination again and what should his strategy be? he hasn't held many press conferences. is it -- if you look here, joe biden at 62%, robert kenny jr.

at 19 and marianee williamson at 9%. does he need to get out there? >> to answer your first question, is a risk that he won't get the nomination? no. straight forward simple answer, no. he has broad support of the democratic party. two reasons for that, interestingly enough or ironically i guess as president trump stocks rise so do joe biden's, joe biden has beat donald trump in the general election. that's his strongest argument for reelection, i've done it once, i can do it again and secondly he has had the most successful first two years as president and tone more in terms of passing really substantive legislation than any other president before so he's got a strong legislative policy argument to make for reelection which is what democratic base voters care about. we had progress on climate change, gun safety and prescription drug negotiates that medicare is able to negotiate and lower price for seniors.

the president is blaming the media, that's certainly part of it but we need proactive message and telling america voters what you have done and plan to do if reelected. >> you know, mark, i will put this to both of you guys, we are talking about two leaders of parties here who will be in their 80's potentially by another term. and you've had a number of polls saying, they don't want a 2020 -- americans don't want a 2020 rematch in 2024, yet that's what the parties are getting us. what about that? >> well, i think the washington poll is devastating for the president, one thing about being electable is i beat trump, he's losing to trump, only 36% of democrats say they want him to be their nominee. so right now they are looking for other options. they may not get one but they are at least looking. when you look at major issues, donald trump, the trump policies

won, they are winning on every issue, immigration, economy, inflation, those are all mishandled by joe biden so i can see why if you're donald trump or any other candidate, you will run bringing candidates back and it's favorable. rich: what about the latest poll, he beat trump, he can do it again. >> there are a lot of things that will happen now and do it again. president trump is under a lot of investigations not to mention he's now -- has been officially indicted. again, as the president -- this is natural any time you head into a presidential primary season, there's voters that are considering their options because we naturally have the process that will play out. biden as he makes his case will consolidate democratic support, the black support will solidify and supporter by young voters will start to solidify and as the president always says, don't compare to almighty, compare me to the alternative and as we see president trump while there may be nostalgic for policy, i would

argue failed policies of the past, there's a lot of baggage around president trump that is unpredictable and you ask any operative that's not what they want heading into the election. rich: i want to get on immigration here and this was an issue that republicans hit hard on the midterms and failed to take over the senate, does it resonate in '24? >> i think what is happening next week it's a tail-tail sign, there's going to be a wave of illegal immigration. joe biden sending 1500 troops down there to do paperwork, greg abbott sent 10,000 national guard men and women down to just do texas, 1500. they are doing secretarial work. we need a deterrent and not people to push paper. look, just because title 42 is going away doesn't mean border is open across the country. we revert for title 8. the biden administration announced a plan year ago to deal with this surge. obviously the proof will be in the pudding, we will see if they can actually control this but this is a political land mine

rich: 8 people are dead and 7 others injured after gunman opened fire at busy texas outlet mall yesterday afternoon. the attack happened in allen, texas about 35 miles north of dallas, the suspected shooter was killed by a police officer who happened to be nearby on an unrelated call arrived on the scene and the spokesman for the local hospitals says the facilities were treating victims between the ages of 5 and 61, texas governor greg abbott calls is shooting an unspeakable tragedy. the police have not released name or any possible motive and we will bring you the latest updates as we get them.

national correspondent griff jenkins brought you story and has updates now. griff: fox news confirming that migrants were among the fatalities, we don't know exactly how many but it is confirmed now with the brownsville police department that migrants were among the deceased, 8:30 this morning a vehicle veered off, 45 miles from the border and struck group of individuals and many believed to be migrants because of eyewitnesses told us and because there's a homeless largely occupied by migrants at this time right in the area. we want to go to brownsville police department investigator martin sandoval. investigator, we have an update, what can you tell us?

>> there are migrants among the deceased, how many, we don't know. identifying them is tricky because we still need to contact with border patrol and it's a very lengthy process and we are taking fingerprints and everything that we can in order to identify them properly and notify next akin but as far as we know there were migrants in that group. griff: for our view irs tuning in the story if you can, recap about the investigation, lone driver and vehicle striking the group? >> right now one driver that was actually driving, he's arrested. that will stem to other different charges. we are doing an investigation in forms of intoxication or it was just a regular accident. it's two different scenes that we are taking care of which means one is an accident scene which accident investigators are trying to determine the cause of the accident and we have investigators trying to determine the criminality of the incidents. griff: to orient our viewers on this side of the street, the

left side here of us is the homeless shelter that's now largely occupied by migrants and then on the right side of the street was a bus station where a group of individuals were believed to be at the time. >> that is correct. on our left side here it is the center, the homeless center, that's where many of the migrants are being sheltered at the time and across the street there's a bus stop where they usually take in order to getgo to gowntown to catch other buses to other cities and mite take them to airports so they can fly to final destinations. >> the grouping of migrants and the influx of migrants, having them in the streets, being pedestrian traffic safety risk, this must be your worst case scenario come real? >> this is definitely one of the worst case scenarios that we've even had here. probably first of this multitude, several individuals deceased for a car accident. we are handling the scene. we are trying to make sure that everybody is safe and as the influx is coming in, we have

several things in place to make sure that everybody is ready. our police department is still functioning at 10% and we have several officers coming in on their own time as far as federal grant to help out with customs and border patrol. griff: we are maintaining distance to give your team the space to do their work but we did just before you and i went on, we saw a hearse. >> they will pick up bodies and take to morgue or center that we have. everything depends there was an autopsy ordered. if there wasn't an autopsy we have to wait for the consulate on what they want us to do with the people that we have identified that are not citizens. >> i know we don't know what's going to happen when title 42 lifts but we are hearing from border patrol officials that the numbers of migrants is going to be even more, possibly double,

april's job report shows unemployment dropping 3.4%. more on the new numbers and latest interest rate hike from the fed, joining us now fox business contributor and founding member to have capitalist pig hedge fund, jonathan hoenig. >> my pleasure. rich: this is a job's report about what was going on in april but it also looks back a couple of months. in february there were 78,000 fewer jobs than forecast and 71 march than first thought. does this begin to show a little bit of weakening on the job front, in other words, fewer jobs created and isn't this what the fed is looking to do, slowing the economy so that we don't have so much inflation? >> indeed, rich, there's many indication that is the economy is slowing. you can't discount, 3.4.

there are jobs out there. a lot of them being createed in the healthcare space at the same time as you said many numbers are being revised downward and if you talk to the majority of americans they say inflation is the number one issue, 7 out of 10 americans say inflation is hurting their bottom line. wages are rising at 4%. inflation is still at 5% and this is why a majority of americans for the better part of a year now say they were already in recession. rich: just want to be clear if you look at those two numbers by the way, there were still jobs created in february, march, just fewer jobs than first thought. >> yeah. rich: inflation is still a problem. have they been going at it the right way or should they be doing something else? >> there's really no right way to fix it. government caused inflation problem. government is tribe to zap it up. in my estimation it's everyday americans that are paying the bill, milton friedman talked about there's no such thing of

free lunch. record number of americans i should say having hardship withdrawals from 401k, credit card debts expanding at the same time interest rates are shooting up higher. the average american isn't feeling it despite happy talk from dc and when you see stocks, for example, like first republic, 3 to 4 biggest bank failures have occurred just this year. every day americans are aware of it. they see stocks $120 a share to zero, still a lot of fear out there despite job's number on friday. rich: how about regional banks, are we going to see regional banks fail? >> you know, the average american family still paying about $400 a year more this year than last year because of inflation but the wide-ranging implications are almost too big to understand and, in fact, inflation killed so many

great concern to both border patrol officials who are seeing the massive increase as well as local officials. now just to recap a little bit shortly around 8:30 this morning longal time here outside of a homeless shelter being overwhelmingly occupied by migrants at a bus stop here out front a car, a single car, a gray vehicle drove up on the curve in front of a bus stop and plowed into a group of individuals. the brownsville pd confirming that there are migrants among and we don't know exactly how many there are but clearly there are migrants among them and that is a concern because there have been a large number of migrants walking around this area. now where we are just orient people, we are about 4, 5 miles from the border where you have seen all week where migrants are streaming across. many of them are released here at the shelter and many walk across the street to both a convenient store as well as a bus stop to get to the bus stop

to the larger downtown bus station to try and go to where they are trying to go further inland to the u.s. now right here i don't want to get out of the way because there's bloody sheets behind me but it's a horrific fatality. the local police telling me this is the among the worst vehicle incidents they have let alone involving migrants and that the fact that you have so many migrants in the streets whether it is at the downtown bussation or here locally, that is increasing just this general safety for pedestrians and traffic as well. and if you look over at my shoulder here just a little bit, we will give you a look, you can see the busy intersection. the fire truck investigators trying to determine exactly how this happened, what we know is that you saw the vehicle go up on the curve and you see the jacket of fbi agent out here. so you have local brownsville police department, fire department and now the fbi here. we learned from officials they are doing a toxicology being
