about this suspect? >> john, publicly they are not saying much but some officials familiar with the investigation have talked to the president and they have said they are looking into this theory that the shooter may have been involved with some white and people are coming up at the growing makeshift memorial to drop off teddy bears, and flowers, to pray, you see eight crosses now standing there, one for each of the lives lost on saturday, including a 20-year-old man whose family says he worked here as a security guard and 27-year-old project engineer originally from india. hundreds of shoppers were here at the allen premium outlet mall on saturday when the shooting began. you can imagine the scene turning chaotic as some

eyewitnesss describe a near stampede, people trying to grab their children and flee. listen to this one woman to describe how close she really was. >> when we were running, the shots got closer to us, like really, really close and i thought they were running towards us since we were all running around, and there were more people running around us. >> i felt really scared because many people were running for their lives and some people didn't survive. >> last night a local church holding a memorial service, praying for the three in critical condition at an area hospital. and of course, for the families suffering a loss. and also for the region as a whole as allen here is typically known as a very safe place to live, a safe community with not much crime. now a community that has a lot of healing to do. sandra. john. >> john: all right, casey stegall with the latest, thank you. sandra.

>> sandra: also in texas, we are learning more about the driver accused of killing at least eight migrants and injuring 11 others after plowing his suv into a group of people waiting for a bus outside a shelter facility in texas. it happened yesterday. authorities have now identified the suspect as 34-year-old george alvarez. he tried to flee the scene but was held down by bystanders. he is charged with several charged with manslaughter and assault with a deadly weapon. >> brownsville resident with an extensive rap sheet. charged with eight counts of manslaughter, ten counts of aggravated assault with a deadly weapon. he has received bonds, $3.6 million. >> sandra: they believe he lost control of his car after running a red light. >> john: a live look at the white house as president biden is about to speak on protecting airline customers when there are

flight delays or cancellations, but his light schedule and lack of campaign events may be partly to blame for his new all time low approval rating. a new washington post and abc news poll shows only 36% of americans approve of his job performance. white house correspondent jacqui heinrich is live on the north lawn. how is the white house responding to the new approval ratings? >> they are outright dismissing it. deputy press secretary andrew bates says on twitter the poll is at odds with most polls on approval rating and potus's average approval in polls was lower than it is now when he held the best midterm wins for a democratic administration in 60 years. even the former chair of the dnc is acknowledging that this is as bad as critics say. >> it's sober in a sense, george, the coalition elected joe biden with historic numbers in 2020, that coalition right

now is fragmented. that should concern them. >> people question his fitness for continued office, most democrats did not want him to run, but this poll has to send shock waves. he just announced for presidency. you are supposed to go up when you announce, not down. >> significantly the president saw major drop in support among black voters, dropping 30 points from 82% in 2021 to 52% today. and the white house has not addressed that piece at all but we did see the south carolina democratic party chair on tv touting biden's investments in black communities and colleges signalling that officials in the party are concerned about this. we will see president biden shortly. announcing plans to launch a new rule making process to improve airline customer service, effectively starting the process of starting the process on that. but the last time that air travel woes made big, big headlines was back in january, so it feels a little random to have this announcement coming

today when most people here are thinking about, you know, the congressional leader meeting to address the looming debt ceiling crisis or the end of title 42 happening later this week, and in fact, the only other thing on the president's schedule is a moving screening at the white house celebrating pacific islander native hawaiian and native american heritage month, john. >> john: we'll see what the president has to say. >> for me to see all the bank records and all the deposits from the chinese communist party to the biden family members, it's pretty disgusting and i can't wait until wednesday to present it to the american people. >> sandra: house oversight committee chair james comer saying republicans will reveal more evidence the biden family suspected business schemes and saying that is going to happen on wednesday. this comes as federal prosecutors are closing in on a decision on a potential hunter

biden indictment that may include charges of tax and gun violations. charlie, it's going to be a big week for many, many reasons, but this in particular, james comer has been pressured by republicans saying ok, great, so you say you have the evidence. show the american public the goods. are we going to see that on wednesday? >> it sure sounds like it and we are dealing with -- and this is true of chuck grassley and appears increasingly true about jim comer. these are serious guys. he has not been promising things he has not been able to produce. you know, this is not the same sort of circus that we have seen over the last couple years where everything gets politicized and then you have members of the congress lying about what they are going to produce. we shall see. but particularly interesting that you have jim comer warning doj not to pursue these much smaller charges against hunter biden before wednesday and it

sort of suggests to me that the concern there is that comer thinks doj might actually go for these lower charges against hunter in order to distract from the much, much bigger charges against the entire biden family that hunter biden, of course, is sort of the ringleader of. but, it's -- you know, even that, it's not about hunter biden, per se, it's about joe biden, it's about the president who was vice president when these, all of these deals took place. >> sandra: so they are basically saying comer and grassley to the fbi, hold off on that, the result of those charges would be simple slap on the wrist. >> comparatively. but also they are not -- you know, they are still serious charges against hunter, should have been -- the incident where hunter biden lied on the gun form, a felony, people go to

jail for that and the reason we have gun forms, it's a federal effort to prevent the wrong people from getting guns. and you had him lie on a federal form to purchase a gun, it should be a serious issue and it's been swept under. secret service intervened on his behalf to keep him from getting charged with this, and then all of a sudden five years later as jim comer is closing in on the biden clan, you have doj making sounds like they are suddenly going to take these irs charges and lying on a gun form charges seriously. it really does kind of stink of like a cover-up. >> sandra: james comer was on over the weekend on fox news, in his own words, warning officials to wait to charge the first son until they hear from congressional leaders. listen. >> my message to the department of justice is very loud and clear. do not indict hunter biden before wednesday. we believe there are a whole lot

of accounts that the irs and the doj don't know about because we don't believe they have done a whole lot of digging in this. >> sandra: you could make the case he's showing a lot of confidence that he's got the evidence that is not only going to be hunter biden, it's multiple biden family members receiving payments from china. i mean, you have to wonder what exactly he's going to reveal on wednesday when you talk about the number of family members that are potentially involved here in the foreign business dealings. >> yeah, and obviously we, you know, we'll see on wednesday what the evidence shows, but it will be -- just disastrously humiliating if they don't have the evidence and of course during the trump investigations over the past six years we saw that repeatedly where they promised things that never got produced because they were looking for short-term political win but i think it ended up destroying their credibility and blew up in their faces every

time. we'll see if jim comer is doing that this time. >> sandra: i wonder how much is the subpoenas issued to the banks to reveal why there was a biden, just with a biden last name as some of the recipients of the wire transfers. they subpoenaed the banks to get more information, perhaps that's what they are revealing. >> yeah. >> sandra: maybe an actual paper trail of that. >> and maybe this is the beginning of the questioning as opposed to the end of the questioning, but nine or a dozen members of the biden family getting payments from the chinese communist party in exchange for something, what, we don't know, that's the beginning of an investigation raises lots of questions, and we should get to the bottom of it. it's not only a corruption issue, it's also a national security issue. >> sandra: and there is great issue from the american public to see where it goes next and to see that actual evidence. and john, we know comer and grassley so far they are saying

the whistleblower claims include a precise description of how the alleged criminal scheme was employed as well as its purpose, comer issued the subpoena after that to obtain the deadline of may 10th and that is wednesday. we await that. >> john: i don't think we should hold our breath expecting the doj is going to turn this over. somebody who has written extensively about this, john n that turley, he'll join us the next hour his thoughts what should happen here. meantime, off duty police officer with a promising future set to graduate in criminology shot and killed over the weekend. >> sandra: is homeland security secretary alejandro knocking a bipartisan plan to help things out at the border? former acting dhs secretary chad

without court hearings after title 42 winds down on thursday. republican senator tom tillis of north and independent senator kirsten sinema who caucus with democrats introduced the bill last week. joining me now is former dhs secretary. you know all this, headed up dhs, what do you think will happen come thursday. >> another surge of migrants to the border. dhs, secretary mayorkas have said they have been planning for this over a year and a half we are going to see. is their planning going to be effective, i don't think it is. but they are not putting in any policies to deter what's going on on the border, so how do we process more individuals quicker into the country so the numbers you see come thursday and over the course of the next several months are going to be high

numbers. 250,000 crossed last month illegally. a quarter of a million between apprehension and got-aways, they are not trying to deter people, lowest number of removals. so a matter of how do you process more and more individuals, it's the wrong way to approach the crisis. >> john: that's what the u.s. military has been sent there for, but some people say don't send the military to do transportation and other functions, send down immigration judges to clear the 2 million case backlog and make sure the people do not stay in the country when they are not supposed so. you mentioned mayorkas saying he has a plan. he reiterated that yesterday morning. >> we are prepared number one. number two, we have a migration information center that is specifically set up to communicate with state and local officials and we have been doing so. we are using our fema regional coordinators as our key points

of contact. >> the key phrase in there, so we are prepared, number one. there are a lot of people who don't trust mayorkas, he's doing more gaslighting than the entire downtown district of san diego is. what do you say? >> i think you just have to listen to that clip, right. so, if he continues to say the border is secure but you are sending fema and using fema resources, you don't use fema unless you are in a time of crisis. he's not honest with the american people and that's why the majority of folks don't trust him when he talks about this, he's not telling the truth and he's not -- he disagrees with border patrol officials. folks who have been on the ground for 20 or 30 years doing this job, he has disagreed openly in a congressional hearing with them and so i think he's got a real credibility problem and why most americans do not trust him on this issue. >> john: call four number three here, some of the officials he's been disagreeing with include the border patrol chief ortiz

tweeting out what the reality is. past 72 hours, 26,382 apprehensions, 7,399 approximately got-aways, talks about marijuana, meth, cocaine, fentanyl, heroin, the money that's been seized, why is ortiz doing this? >> well, look, i think the chief is a professional and he understands that he's got to maintain some credibility with his workforce. and so he's not going to say the border is not secure -- or it is secure when it is clearly not secure and i think what he's doing with this data, he's throwing it out there for the american people to decide and in the process hopefully gaining a little credibility back with some of the workforce, fed up and frustrated with the administration and the policies and just give information to the american people. >> john: good to see people in the administration are giving us the real deal, when the press secretary says immigration is down more than 90%.

democrats by and large blame trump, they say republicans are racist and -- listen to cuellar and sinema. >> administration needs to go to the center and some of the policies brings them to the center a little bit too late but at least getting policies that will come to the center. >> 1500 troops is not gonna get the job done. it's a reality. >> have you talked to the white house directly about? >> yes, i have. >> what's the response? >> it has not been adequate. >> john: they are in border states, sinema joined with tom tillis and joe manchin to give the administration two years of expulsion authority, the administration says no thanks,

don't want anything to do with that. a huge disconnect between democrats and independents who caucus with democrats. >> that's right. they are looking at what's going on on the ground and in their case -- >> john: red lights blinking. >> when you hear the administration say we want to end title 42 and does not like the bill that gives titl 42-like authority, you have to say why not. it's the only thing that's been working. removing 50,000 folks a month on average under title 42. on thursday, that stops. everyone will be in title 8 removal proceedings, release them into american communities. so the idea they don't like title 42, i cannot understand why. it's the only thing that they have been able to do for the past 27 months and it's about to expire. >> john: and the last week we have seen the pictures from brownsville, texas, look like a port of entry not a pop-up tent

$200 million for each and every african american. >> john: the california reparations task force officially recommending the state hand over $1.2 million to every qualifying black resident. but some activists have been quick to say the proposal falls short, as that man was saying, about $200 million short to be exact. senior national correspondent william is in the los angeles newsroom with more on this. who exactly qualifies for reparations and what would the total bill be? >> let's start with the first question, john, very contentious, people coming from the caribbean are black californians saying we should qualify, too, others say no. if you are a descendant of an

african american living in the u.s. prior to 1900 you qualify, even if the ancestors are not slaved. damages are baked in. how much you get, depends how long you've lived in california. the report goes on to governor newsom and lawmakers, says eligible black californians should receive $13,000 for health discrimination, two grand annually because of overpolicing and mass incarceration and $3,000 a year for housing discrimination. for some, it's over a million bucks. >> reparations is now. pay the debt, cut the check, or no reparations no vote 2024. >> also wants eligible blacks to receive subsidized mortgage payments, free college tuition, guaranteed annual income,

details. in that statement she says mauricio garcia entered the regular army in june 2008. he was terminated three months later without completing initial entry training. he was not awarded a military occupational specialty. he had no deployments or awards. we do not provide characterization of discharge for any soldier and according to an army official, he was separated under the 2005 edition of army regulation 635-200, paragraph 517. other designated physical or mental condition. so reported in various places earlier, this is now official and according to a u.s. army public affairs spokesperson just a few moments ago as we learn more about the shooter that deadly rampage on saturday at a texas outlet mall. we'll have more for you coming up. >> are you prepared to evoke the

14th amendment and blow through the debt ceiling? >> we should not get to the point where the president can go on issuing debt, this would be a constitutional crisis. this would be really the first time in the history of america that we would fail to make payments that are due. it's widely agreed that financially and economic chaos would ensue. l>> sandra: that was yellen warning of economic chaos if we do indeed allow ourselves to default on our debts. president biden is not ruling out invoking the 14th amendment to get around the debt ceiling and borrow money to pay the nation's bills. all of this as he will meet with the congressional leaders at the white house with time running out to make a deal. art laffer, do you agree with that, art, the warning about economic chaos that would ensue if we allow ourselves to default

on our debt? >> well, we are not going to allow ourselves to default on the debt, it's not going to happen and if it does, it's for four minutes and 33 seconds. this type of scare talk is very detrimental. it's this talk that causes all the problems in the marketplace and the country. we are not going to default on the debt, it's never been done, we have had debt ceilings and political discussions, both biden and mccarthy have ways of eliminating the problem instantaneously. biden can just agree to mccarthy's bill and that would be done. mccarthy can just pull the bill and say we'll give it clean and free debt ceiling, that will get it done. no one is going to let it go over the hill, sandra, and frankly, it's just really scare talk and i'm surprised janet yellen for doing that. it's not right of her doing that. she's a professional economist. she knows well it has not happened before and not now and she can control it as well. just scaring people is terrible

to do. >> and she was part of the crowd inflation is transitory and ignoring it and saying it's not going to be the great problem it is today but this is her warning and those keeping track of it say regardless where you stand, it could be happening sooner than the treasury was predicting, the penn wharton model, receipts are running $150 billion below government projections, due to a decline in capital gains income and weakening corporate profits. >> yeah, let me say janet yellen is a good economist, i'm not saying she isn't but she's indulging herself in scare tactics. yes, we are getting less revenue we have a bad economy, and it does push the debt ceiling

closer but means we will solve the problem sooner. i'm really -- i don't know why these people love this brinkmanship but i think they think it's political gains, biden will hold true -- that's just not good stuff when you scare the american people for political advantage. purely political advantage, sandra. they know how to raise the debt ceiling and in minutes. >> sandra: the argument from the left and from president biden, kevin mccarthy's plan, to be clear, does not allow us to default on our debt. i want to play this out, this is the house budget chairman, on no blank checks for politicians, art. listen. >> we'll pay our bills and protect the good faith and credit of the united states but we are not going to give any politician, including the president, a blank check to continue to bankrupt the country. >> sandra: what do you think of that statement? >> he's so right.

i think he's so right. yeah, no, that would be a blank check. all the bills passed that did the spending were all passed by a majority, by total democrats, no republicans. all the spending is done on their part and i don't want to be partisan on this, it's been done now they want the republicans to sign the check because they passed the spending. and they think it's now coming due. it's just wrong, sandra, it's just plain wrong and they should stop playing politics with this right now, sit down, come to an agreement. i would love to see them get rid of the 87,000 irs agents. just to get rid of them. >> sandra: you say don't play politics but politics is playing out as we get closer to the 2024 election. biden versus trump on economic polling, new abc washington post polling. who do you think did a better job handling the economy, donald trump when he was president or

basically says for the time being, until you get better you can't own a weapon. he was discharged from the military for mental health reasons, that should have started the process then. it wouldn't necessarily have to be a police officer, it could be a jag officer, it could be a family member and i don't think it stigmatizes somebody. it's something we have to push as a federal law, not a state law, there are 50 different laws out there. >> john: according to the military he did not make it through basic training before he was terminated from the military and we don't know whether the military reported this, but remember back five years to 2017 when devon kelly killed 26 people at the sutherland springs church in texas, he had a problem in the air force where he was convicted of domestic violence and shouldn't have owned a weapon and yet the air force failed to report that and so he was able to get his hands on a weapon.

now, again, we don't know in this case whether or not this was reported by the pentagon or not, but should there be mandatory reporting if our military comes across a problem that means a person is unfit to serve, they shouldn't be allowed to own a handgun or a long gun as well. >> absolutely 100% they should be required and i think they are. army cid is required, air force osi, ncis, they dropped the ball. and the national instant check system which is based on these dispositions, arrest and dispositions of the case that should be sent to the fbi identification division and included in that database. what we find, that system is deeply, deeply flawed. a lot of departments don't send the cards in, the information in, don't update it with a disposition, and then researched to see if they were con --
