quickly escalated as the crowd spills out into traffic clashing with police. officers recovering a firebomb at the scene presenting a clear danger to the public. >> molotov cocktail was in a group of protestors. we don't have an arrest attached to that. it was there on the scene in a crowd of protestors. again, something very dangerous that we just really asking our communities, our people who want to come out and elevate their voices, not to engage in that kind of behavior. they can hurt themselves and members of this department and their co-protestors for innocent people. >> dana: laura engel live in the newsroom. hi. >> well, these protestors are vowing they will be back every day until charges are filed against former marine daniel penny. penny has said through his lawyers he never intended to harm neely and could not have foreseen his untimely death.

take a look at this. 11 people were arrested during last night's protest. most accused of disorderly conduct. police say one journalist was cuffed for interfering with three of their arrests. protestors demanding justice both above and below ground at the subway station where jordan neely died last week. you mentioned this. police also found a molotov cocktail in the crowd. no one has been taken into custody in connection to the homemade weapon yet. two people were also arrested. take a listen. >> people have a light to speak up when they believe an injustice occurs. but we cannot have people coming out to protest, what we want to have a peaceful protest bringing out dangerous substances. >> those two people were arrested for jumping on the subway tracks. the weekend protest briefly halted train service.

according to our sources, investigators are looking into what, if any charges filed. a grand jury could be hearing the case this week. one of penny's attorneys told me if the case goes to a grand jury they would be informed at some point in the process to give their client notice to prepare to testify if he chooses to do so. so far they have not received that notice. >> dana: that's an important detail. thank you. >> tomorrow will be a bad day for the white house and it will be interesting to see what joe biden has to say. he lied about the laptop. he lied about his knowledge of his family's shady business dealings. he lied about his involvement in his family's shady business dealings. he lies when he says his son has done nothing wrong. so it will be judgment day tomorrow for the white house. >> james comer head of the oversight committee in the house on earlier today as he finds the

latest findings of the biden family business dealings. he talked about tomorrow a lot. tomorrow is the deadline for the f.b.i. to provide the documents to his committee relating to an alleged bribery scandal involving then vice president biden. david spunt is following that live from the justice department today. hello, good morning. >> good morning to you both. we know that james comer says that deadline is tomorrow for the f.b.i., which is part of the justice department, to turn over the document. that deadline is at 12:00 p.m. eastern time. we'll see if the f.b.i. will make or miss that deadline. comer, along with his colleague in the senate, republican senator chuck grassley, specifically want a form called an fd1023. it is from june 2020 and it lays out allegations from when biden was vice president. sources familiar with the

specific form tell fox news that type of form simply memorializes and interview with a source. it doesn't mean something is correct or incorrect on that document. details of the document are limited. both comer and grassley admit they haven't personally seen the document in question. also tomorrow comer will hold a news conference to lay out the findings on the biden family and their business dealings. in addition to a hunter biden probe on capitol hill, we have to remember that probe that's going on here at the justice department that has been underway specifically with the u.s. attorney in delaware since at least 2018. multiple investigations. late last week the president once again defended his son, hunter. >> president biden: my son has done nothing wrong. i trust him. i have faith in him. enhances my presidency by making me feel proud of him. >> on thursday john bran on will sit for a behind the scenes

>> dana: let's bring in former speaker of the house newt gingrich. president biden's japproval of 36%. i don't think it's an outlier. should republicans take ronna mcdaniels' warning seriously? >> sure. look. first of all, it's a long way to the election. and things can change. second, the democrats have been very, very good at survival. look at the big cities that are disasters but have democratic mayors and it's unlikely you could beat them. the capacity for power is enormous. they desperately want to stay in power and do everything they can to do that. having said that, the american people, if they get mad enough they'll throw people out. jimmy carter learned that, george h.w. bush learned that.

the american people ultimately can hire and fire despite the news media and despite everything else. at least at the presidential level. so i think biden has to be worried and doubly worried because kamala harris is an enormous drag on the ticket. if i were a democrat i would be a little nervous. >> bill: let's talk about balance of power in congress. mitch mcconnell said this. we have the possibility of screwing this up and that gets back to candidatgeorgia, arizona and new hampshire because we didn't have competitive candidates. right now 51 dems, 49 republicans in the u.s. senate. the balance of power. mcconnell thinks they can really go after states like west virginia and ohio, maybe pennsylvania, maybe montana. how do you forecast that as of today? >> well, i think it's very

clear. i happen to be at the greenbriar when governor justice announced for the senate. a very formidable candidate. former democrat. the most likely person to be elected to the senate from west virginia, a net one for the republicans. i think that if the biden economy and the biden border issues and the drugs, the report you just had from wash wsh state. devastating. at some point what happens is people say this ain't working. and if they conclude that the biden administration can't succeed, then i think states like ohio, which is very heavily republican now, pennsylvania, a number of places suddenly tilt our way. montana very easily could become republican. i think the mood of a year from now is really, really important. most people now forecast that the economy will get worse, not better. clearly the problems on the

border are astonishing. i watched fox footage of hundreds of young men, almost all of them young males out in the open on a highway in daylight entering the united states illegally. well, all of that weighs on the american people and i think all of it probably is going to make it very hard for them -- for the democrats to win next year. >> dana: quickly this afternoon at 4:00 the white house is inviting republican and democratic leaders to talk about the debt ceiling. biden would like to make this is conversation between him and mcconnell but it is between him and leader mccarthy. speaker mccarthy. how do you think it will go this afternoon? what would you recommend speaker mccarthy do this afternoon? >> well, let me pick up on the point you just made. very historic. mitch mcconnell has been a player in these kind of negotiations for a generation. he concluded apparently -- i

commend him for this. that mccarthy, have passed a debt ceiling bill. mccarthy could say the house republicans have eliminated the danger of default. the question now is whether or not the president is going to recognize that he has got a way to avoid default and going to work it out. i think for mcconnell to have said he will follow mccarthy's lead is truly a historic shift. who is basically going to represent the republican party in these negotiations. >> dana: interesting. we'll be following it at 4:00 today. >> bill: thank you, sir. >> thank you. >> it's hypocritical and maddening to then turn around and do the exact same thing to a county that isn't even a sanctuary county. >> bill: that's a top official in the suburbs of new york city with a message for the mayor, eric adams. don't even think about creating a sanctuary county where he is.

the city of new york telling county officials here in rockland and orange the arrival of 300 plus immigrants, migrants that is imminent. in terms of a specific timeline when to expect them the counties haven't been given any further details other than an imminent arrival. over 100 migrants are expected to arrive here thousands of miles from the border. and when they arrive. they will double the county's current homeless populations that receive services immediately. mayor's office sending migrants here and orange county. that county following rockland's lead and declaring a state of emergency. officials saying the mayor of new york city doesn't have jurisdiction under these counties and towns and questioning the legality. in the town of orange there is a 30-today limit on hotel rent

always. the mayor's office not backing down. his office saying in a statement, quote. we need the federal government to step up. until they do, we need other elected officials around the state and county to do their part and emulate the humane and compassionate approach new york city over the past year. rockland county executive director says his county does not have sanctuary cities and why he plans to stop the transfer. local police are informed to stop any buses attempting to bring migrants into the county. >> we aren't looking to stère a confrontation but avoid a situation where people come up to rockland county, potentially creating issues and dumping on the county of rockland. that's something i will not tolerate. whatever tools i have at my disposal to stop it, i will.

it is. thank you. >> bill: future is bright somewhere. the case of jordan neely's death might nib hands of a grand jury. protestors want the marine vet to face charges. good morning to both of you. we thought that the marine was going to speak this morning. that interview did not happen. we got a statement from the lawyer. when mr. neely began aggressively threatening daniel penny and the other passengers daniel, with the help of others, acted to protect themselves until help arrived. daniel never intended to harm mr. neely. neely's families statement say his actions on the train and words show why he needs to be in prison, end quote. kat, where are you on this right now? >> i don't agree with that. we are talking about somebody who not only has a past history

of criminal behavior but arrested for assaulting people four times. two on the subway. so it is not outside of the realm of possibility and perfectly in line with past behavior that people did feel unsafe. if you are attempting to kill somebody you don't put them in a recovery position that we saw on the video. a sad situation but all logic goes to the fact that really truly believe that this person was a threat to other people on the subway. >> dana: paul mauro said the subway has become a rolling psychiatric ward. i've seen it and a lot of people have to take the subway. if the grand jury decides to prosecute somebody, will fewer people ride the subway or get involved if there is aggression? >> that's the big concern, i do think. i commute every day on the subway both ways. most people who have the choice don't have to don't.

i know you do not do it by hand. new rules now would force manufacturers to limit dishwashers to using 3.2 gallons of water per cycle. far below the current fill limit of five gallons. they did that with toilets a couple of years ago. among the items, regulation nation. the gas furnace, light bulb, washing machine. air conditioners and dishwasher and vending machines. what will you use? >> you will use your dishwasher more. everybody, what do you do when you finish a load of dishes and still food on some of them? you run it again. i did that yesterday. so i also just think, i don't know how you can hear federal dishwasher and it is to me the government is too big in that instance. also all of these things together when you add them up there will be costs associated with this.
