"fox & friends" starts now. >> steve: this is a fox news alert. and good morning, everybody. it's friday may 12th, 2023. now to the southern border. a wave after wave of migrants are starting to pour into the united states following the midnight expiration of title 42. >> brian: all right. agents were encountering 10,000 every single day. this week before the policy ended. but that's going up. >> ainsley: caroline shively on the ground in el paso with the latest. i was reading 10,000 on monday, tuesday, and wednesday. three d days in a row. >> absolutely. the shelters are absolutely

packed over capacity in many parts of the 2000 thousand mile long border. of course, title 42 has come and gone and migrants keep coming, guys. we got here 1:30 local time and so far two different bus loads at migrants here at gate 42 loaded up and taken to processing centers. we shot video of that if you want to show it for our viewers. they are the folks who have done the paperwork. el paso sector already seen a surge of migrants trying to gets in illegally as well. check out these numbers. in april, el paso sector saw 1400 apprehensions per day. but in the last 48 hours, this sector had 1500 am apprehensions, homeland security secretary released in statement at midnight quote: starting tonight people who arrive at the border without using a lawful pathway will be presumed ineligible for asylum. the border is not open. people who do not use available pathways into the u.s. face tougher consequences including minimum five year ban on reentry and criminal prosecution. now over in brownsville, tackle

team members were clocking migrants from crossing the border yet. some border patrol agents say the entire process is just not enough. >> the only thing we do is fingerprint them, see if they have a criminal record here in the united states. we also to see if they have interpol hit and that's it. we can't check anything that's happening in their countries. if they have a criminal record in their country we are never going to know about it. >> and in a major development overnight, a federal judge is temporarily blocked part of the biden administration's plan for releasing some migrants. now, would have allowed migrant holding centers well over capacity to release migrants with no set court date. just an agreement to turn themselves in to an immigration office in 60 days to be screened for asylum. a judge described it this way in his ruling. quote: aliens were being released into the country on an expedited basis without being placed in removal proceedings and little to no vetting and no monitoring. that block on this part of the program lasts for two weeks while they hash it out in court. back to you guys.

china. many of which turn out to be scientists. they are coming through our border rather than using our immigration system or going to college and refusing to leave. so now we're watching the end of title 42 and brought to wonder what is it going to mean now that title 8 is in place? what do you have to say when you come to the border in order to get in? one thing that will get you in hey, i'm oppressed. i'm gay. i can't stay in my country. that gets you a free pass. in meanwhile the mayors joined bret baier last night in this area. three of them joined. just talked about what is it like on the ground? how bad they need help. they are not talking about democrat or republican. they just need help. watch. >> this is not our problem. it's not a municipal issue. it's federal government issue. we want to see some action. finally some action. >> they tell us they have it under control. i can tell you right now in our sector in uvalde, that probably 75% of our border patrol they're not on the border. they are in these processing

places. the border is wide open. >> our border patrol agents are now inside their processing facility processing the migrants come in the u.s. and that leaves our border wide open. we want to see more support on the border, sir. bottom line. we need support down here. >> steve: yeah. brian, you mentioned all those different countries people are coming in from. el paso is the new ellis island, essentially. you look at those images right there. there's great item in today's "new york post." a fellow by the name of tom bins bensman. he actually earlier this week was on the mexican side of the border. he noticed as you see all these people waiting to come into the united states. he noticed about 100 or 150 people would get up as though in response to a signal and they were pausing. and then follow a little while later by another group. he asked one of the mexican immigration officials what exactly what is going on.

and they said their mexican official superiors were coordinating with u.s. officials on the u.s. side on when to let the migrants cross the river. because the department of homeland security wanted to make sure they were finished processing one batch of migrants before the next batch came across. they want to make the whole process appear less chaotic and news worthy. >> brian: you really can't count on anything coming out of the homeland security secretary's mouth as being factual. the reality is we are getting the real facts from our reporters on the ground and for people on the scene. for example, here's what he said. mayorkas comes out. has a press conference and mayorkas on the press conference said title 8 does not equal removal. it equals this according to the border patrol. they want to straighten out what it really means. they said title 8 does not equal removal. it equals release. example. march, no more than 42% of arrestees held for removal were removed. all those released in april, no

more than 31%. this is what marco rubio said a month ago. even title 42 was only throwing back 30%. the other 70% were getting in here. they just say do the math. the border patrol union hates this guy because he knows he's not telling the truth to the american people. he has made their lives hell. and for joe biden to say i need 87,000 irs agents but not 87,000 border patrol, again, this is joe biden's equivalent of the afghanistan exit. he just says i want my people out of there, embarrass the country forever, and now he says i don't like donald trump's border policies, record levels. we are in the middle of an invasion from thousands, if not millions of people, we know nothing about. and it's only because we have an administration that has no interest in our national security and safety. >> ainsley: the front cover of the "new york post" says surrender and a lot of migrants. biden orders border agents to

let migrants in with no tracking or conditions. that was the parolee program that we were talking about. is that the parolee program that karine jean-pierre was talking about 90% down? what was she saying we released 90%. >> brian: thank goodness that judge said for two weeks you can't do that number one, number two on the parolee program. part of it check n colombia and guatemala check the app. and then we will fly you in if you qualify. they haven't even set up the places yet. and the app. doesn't work. >> then it also says the next asylum court date is 2035. >> brian: do you believe this? the "new york post" has some reporting where yesterday, the migrantst in brownsville apparently they were given court dates for 2032. and then migrants who were heading to florida and chicago were given court dates over 10 years from now. >> ainsley: new york suspect there, too. >> steve: it said florida and chicago. i don't know about new york for sure.

nonetheless, it's like okay, so those people who came across yesterday were handed a piece of paper. do you think they will still have that paper in 10 years, let alone 10 days? >> brian: in new york it is 10 years. >> ainsley: new york is one of the heist because so many people want to come here and i assume florida, too. a lot of people want to live there to wait 10 years, 12 years before you have a court date? what happens? can you work during those years? can you contribute to society? can you pay taxes here? >> steve: absolutely. because you have got that paper that says you have got a court date. that's why joe biden is i sag do you know what we need? we don't need as many people on our southern border as we need judges. we need migration judges to go ahead and speed this up. and, obviously, it would be great if they could speed it up. then again, it should be happening in two weeks. not 10 years. >> brian: joe manchin says the biden administration has no viable solution to prevent this surgeon. senator kyrsten sinema i think the biden administration does want congress to take action. i appreciate that the house has done its job. but they have been totally

unprepared since it's clear the biden administration had two years to prepare and they failed to do so. so, congress yesterday, the house went ahead and passed the strongest border patrol yet. again, answering the challenge of all those knuckle heads in the administration who first challenged them to come up with a plan on the debt ceiling. they did. then they ignore it. and then they came up and said why don't you come up with legislation? the houses we just passed it. now what? the senate nowhere to be found. a democrat on the border, nowhere to be seen. a policy from this administration? no, fundraisers done by a president that lost his fast ball 12 years ago. we are in a lot of trouble right now. and i think people have to put politics aside, stand up, and start doing something, including getting the wall off the ground and in the ground and stood up that we paid for. >> ainsley: the border patrol union also tweeted this out where are all the environmentalists why aren't they all complaining about joe biden's trashing of our american

meteorologist janice dean for the forecast. make sense of it. >> janice: beautiful day in the northeast. plain states texas through oklahoma dealing with the flash flood risk and more severe storms. take look at it. you can see that area of low pressure across portions of the rockies where we have snow in the higher elevations and then along with the warm front and the cold front, we are seeing the potential for heavy rainfall. look at the future track as we go through today, saturday, sunday, monday, heavy rain in the same areas and that's going to cause a tremendous risk for flash flooding from the big bend of texas all the way up towards oklahoma. so here's the rain still to come with that bulls eye for south and central texas. several inches of rain in a short period of time is going to cause a disaster in some of these areas. and, you know, we are following the migrant story. this is going to add a problem to that story with heavy rainfall in the forecast for the next several days. so here are some of the rainfall

eye is bloody. and that's on body worn camera he was fighting for his life inside of a police car. >> ashley: police say the suspect stole a u-haul truck just before that attack. white house national security adviser jake sullivan meeting with china's top diplomat yesterday in an effort to move pars the chinese spy plane incident from earlier this year. the administration saying hours of talks between sullivan and weijia jiang ye in vienna paved the way. dwight howard is now apologizing, after referring to taiwan as its own country. he instead a video wednesday he had a whole new appreciation for the country after the visit. that stirred anger on chinese social media. howard later told chinese state media he apologizes for any confusion. okay. some country music legend dolly parton and garth brooks.

will have people who don't have guns try to enforce the rules of the road. what could possibly go wrong? >> well, a lot can go wrong. i know in my own personal experience i have will recovered scores of guns from. i tried to stop somebody for going through a stop sign. we had a pursuit. the passenger laid down and firing rounds at me. i don't understand who comes up with these ideas? it's really a subtle form of still defunding the police. what are they going to do unarmed people when somebody pull as gun on them are they going to poke them in the eye with a pen? reckless behavior. even our own chief came out and said he would welcome the idea. i hate to say this on national news. chief moore has 42 years on the police department. showing early signs of dementia this is reckless for him to consider doing. this. >> steve: activists for criminal justice reform traffic stop violence is a symptom of overpolicing and hasn't helped

make the city any safer according to the "l.a. times." so, when i read this proposal, jamie, it sounds like if these unarmed civilians are or maybe members of some department in the city are pulling people over, would they be driving a police car to get them to stop? >> that's interesting. because our laws here in california clearly written saying you have to be a police officer in order to do traffic stops. think about this. just a few weeks ago, we had two officers killed in wisconsin doing a traffic stop. and this is, you know, this week right now is national police week where we are honoring officers killed in the line of duty. and i know several officers who have been killed during traffic stops in los angeles. in fact, we had one officer killed in the early 70s, his name was paul veteranna. he stopped a car, not realizing they were robbery suspects. they shot him, walked up on him and executed him. two young sons grew up and became los angeles police officers who i know. this is something that is very close and dear to us here in los

so i have a group called army of parents we're a 501 c 4. and we advocate for excellence in education, school safety, and parental rights. and for some reason, this has made the activists very angry. so they targeted me in a group -- a facebook group and they said that they wanted to ccurb stomp me. i'm not sure if your audience is aware of the violent nature of curb stomping but what it does entail is grabbing somebody by the back of their head, forcing their mouth open, pushing them down to the ground with their face on the cement, their mouth around the curb and then somebody else stomping on the back of their head. this is murder. it's a felony. and this is what i was threatened with by these activists who are tied to our political candidates.
