loaded up by border patrol and taken on out of here. now, they were mostly adults. some appeared to be saying thank you to the border patrol agents technically this is not a legal point of entry under title 8. migrants still taken to processing centers for assessments and seeking asylum. migrants are also come coming in illegally in record numbers across the entire border. more than 10,000 caught each day, monday, tuesday, and wednesday while title 42 was still in effect. the homeland security secretary released this statement at midnight, quote: starting tonight, people who arrive at the border without using a lawful pathway will be presumed ineligible for asylum. the border is not open. people who do not use available lawful pathways to enter the u.s. now face tougher consequences including a minimum five year ban on reentry and potential criminal prosecution. now, there in brownsville, tackle team members were blocking migrants from crossings border yesterday. those efforts continue today. and in a major development overnight, a federal judge has

temporarily blocked part of the biden administration's plan for releasing some migrants it. would have allowed migrant holding dlearnts were well over capacity to release migrants with no set court date. just an agreement to turn themselves in to an immigration office in 60 days to be screened for asylum. a judge described it this way in his ruling, quote: aliens are being released into the country at an expedited basis without being placed in removal proceedings and with little to know vetting and no monitoring that block on that piece of the biden plan is blocked for 14 days. back to you guys. >> steve: all right, caroline, thank you very much. 7:02 here in new york city. let's bring in soon none bream fox news chief legal correspondent and author of a great mother's day gift "the love stories of the bible speak" shannon, good morning to you. >> good morning, guys. >> steve: so you know what's going on on our southern border we'll know more as sun comes up out there in texas. but essentially for the plan to be we're going to release a bunch of people out on the

streets of texas. no court date. that's the honor system. how does that generally work? >> well, this judge thinks it doesn't work well. and he says listen, this is very similar to another policy that already shut down months ago. this is a situation the judge is saying you can't just unilaterally by executive power make these decisions and allow these folks onto the streets. interestingly any of. as we expected. there are, you know, legal fights from the other side as well. the aclu is out there arguing that some of the newest asylum policies are too tough. they are too cruel. they immediately went to court and filed on those as well. so, what they are saying is so many of the policies that the biden administration is now using, are the same ones that the trump administration was using. they argued against them then. and they are arguing against them now. so this whole thing is going to be tied up with legal fights, left, right, and center. and so far that judge in florida is saying you can't do these mass releases with no court dates. >> brian: thank goodness. florida judge stepped up so we have two weeks to exhale.

meanwhile all hell is breaking loose and biden knows it. this is a quote. biden has had multiple explosions over his staff not doing anything. he said, quote: when biden would have explosions and he did have a bunch of them, he would sawouldsay say dammit you havend me anything different you said last week. anonymity. ten minutes later said i know you are trying. before people's heart goes out to joe biden. he does not return the call to the president of guatemala. he has not sent anyone to pressure mexico with tariffs or these other countries this is not will. joe biden bringing the magic the way he left afghanistan to the border interesting thing we heard that they have great relationship with these

countries including mexico. they talked about the fact that they have had a lot of partnership and working together with the president of mexico people transiting through mexico. overwhelming whether the authorities are doing all they can to stop this or not. it's hard to imagine looking at these folks lined up the way that they are. there are so many different factors that come to this point but, you know, you heard r.f.k. jr. who is challenging the president for the democratic nomination say about a week or so ago you can't create the policies that draw people here and tell them when they get to the border sorry you are out of luck when you are the ones who created these conditions. democrats and republicans alike pointing to this administration and saying we have been begging you for help. this is not a partisan issue when you look at what is happening to the border. you cannot create these magnets and leave this situation in chaos. >> ainsley: the border patrol union says they tweeted this out. they said this is by far the worst sustained disaster that any border patrol agent active or retired has ever seen at the

border. and one man is responsible for every single bit of it with the worst still to comement and you can see there, shannon, a picture of joe biden. if you look at the numbers this week, 10,000 have been apprehended on monday. 10,000 tuesday. and the same on wednesday highest daily numbers ever reported for been. what are your thoughts? >> not like we didn't know this was coming. we have been told for months and months and months. things are out of control at the border. a large percentage of them god bless men and women risking their lives trying to save the lives of those showing up here. they have been in large part sent into administrative duty. and when they are forced with, you know, doing paperwork and processing people and trying to treat them as humanely as possible. there are other sections of the border that don't have manpower there to do things like indr. tra district carts and drug smugglers. when he they're pulled away only so much they can do with on the ground enforcement. and so this is not a surprise

everybody knew. we have been warning them for months. erasure of title # 2 was going to be a nightmare. you have a bipartisan measure. democrats and republicans have signed on to in the senate trying to get that passed that would reinstate some of these powers and yet here we are. >> brian: border patrol unit went on to say if anyone is dumb enough to believe the lies about our white house from the border seek help immediately. they are fed up and done. remember the first people that crossed had biden harris t-shirts on when they came in office. they knew with trump gone all hell was going to break lewis and now they are coming in and this is their playground. 6 presidential people peer a fox news alert. this just came across recently marine veteran daniel penny set to surrender to the nypd today and face charges in connection with the chokehold death much jordan neely.

todd piro is outside the fifth precinct with the latest. todd? >> todd: steve, ainsley and brian. mr. penny is expected to turn himself in behind me through those doors at the fifth precinct within the hour. that is what is expected. and while we wait for that, streets blocked off in and around this area. no cars passing. in either way in anticipation of what is to come. d.a. alvin bragg's office confirming the retired marine will face a charge of second degree manslaughter for the killing of neely reportedly reacting moments before the incident in question demanding he face consequences. his press release is not an apology or express of regression. it is character assassination and a clear example of why he believed he was entitled to take jordan's life. in short his actions on the train and now his words show why he needs to be in prison. the penny's attorney says, quote: when mr. penny, a decorated marine veteran stepped in to protect him sanged his fellow new yorkers, his well-being was not assured.

the unfortunate result was the inintended foreseen death of kneely. when all the facts and circumstances surrounding this tragic incident are brought to bare mr. penny will be fully absolved of wrong doing. could receive three and a half to 15 years in prison. protesters took to the street demanding action calling neely's death a murder and more protests are expected today. the entire processing that will take place behind me is expected to last about two hours. back to you all right. todd, thank you very much. bring in shannon bream our chief legal officer here at the jail: after mr. penny cass bedeclared dead or rather mr. penny was released after neely was declared dead. and he was not facing any charges but then there were all these protests and then alvin bragg, who has been in the news a lot. suddenly it's like okay. i'm going to charge the guy. result 34589ly it's going to

come counsel to a jury of his piers to decide whether mr. penny trying to kill him or restrain him. it's all about intent. what was he trying to do? >> it is. second degree manslaughter. let me read you a little bit of this. also known as reckless homicide that would require prosecutors to prove that mr. penny caused mr. neely's death and did so recklessly meaning that he knew the chokehold would kill mr. kelly or excuse me mr. neely and unreasonably chose to oea ply it anyway. so, they are going to have to walk the jury through this. it's interesting that alvin bragg didn't take this to grand jury. he totally owns this decision, this charging decision. you heard from the family. something more stringent. alvin bragg is probably trying to thread the needle here gosh i have to have response to public outcry. i don't think this is murder but i will put this to a jury and let them decide. yyou have a four minute video

other witnesses there and provide more context that. video someway into that altercation that led to the death plaintiff neely. and so was a real threat. somebody was cautioning him at one point saying be careful. you got of a hell of a chokehold there. you don't want a murder charge. other people also restraining mr. neely who weren't mr. penny. and whether any charges come to them. it looks unlikely but the jury is going to have a lot more to work with if they can get more witnesses into this investigation. >> they would have to prove the chokehold was the reach for his death. there wasn't anything in his system or that kind of thing. they will be able to talk about what happened. what mr. neely is accused of doing on the subway before. will they be able -- will this be admissible in court all of his past crimes? i think he has been in trouble a lot. 44 times; is that right? >> brian: yep. >> shannon: i think the defense will have very good arguments to show all of that to show there

was a pattern and problem. he probably needed help. there is compassion for what he was going through and how his life sort of fell apart when he his mom was murdered when he was 14 years old. that's where the steep decline happened. you can have compassion, of course, for mr. neely and his life and his struggle and the fact that he should have been helped in other ways but also at the same time it can be true that, you know, mr. penny was trying to protect other riders there and himself. >> brian: just imagine how much compassion one of those women evidently still has brain damage when he punched them out in greenwich village. randomly punching women on the subway and in life. a threat to people. and she was according to one eyewitness in the story today. i hope he has a great lawyer because as soon as we got off the subway. i thanked him very much for stepping up. evidently he paused and didn't do anything until this guy started being very aggressive and then he stepped up. and the message around the country is, if you see a problem, don't do anything. you could go to jail for 10 years. so, that's pretty bad. meanwhile, on a happier note on sunday, mother's day.

>> ainsley: we are back a fox weather alert. a series of tornadoes tearing through the grape plains trail of destruction. rook oklahoma city powerful storm system tore apart homes and buildings. in addition to the twisters, a flash flooding threat continues from the plains to texas and the gulf coast into the weekend. let's check in with our senior meteorologist janice dean for fox weather forecast. hey, janice. >> janice: good morning. unfortunately we see the threat for severe storms and flash flooding oklahoma and ghen across the ohio river rally. there are the tornado reports from overnight last night in kansas and oklahoma and then the border of louisiana and texas. and we have flash flood alerts

as well right on the border kansas. heavy rain south texas, central texas. we could see several inches of rain, close to a foot in some of these areas. because it's just going to be relentless through saturday and sunday and even into monday as this area of low pressure just kind of lingers across the region. so that should be a good news story drought in texas and oklahoma. however, too much of a good thing is going to cause flash flooding and, of course, we have got the migrant situation. so that's going to, you know, add another layer to this. severe storm threat from the big bend of texas all the way up towards the midwest and there is your mother's day forecast. it looks like wet weather from the southwest the plain states and ohio valley. here in the northeast, spectacular. all right. ashley, i'm going to hand it over to you. your first mother's day coming up, my friend. >> ashley: oh, thank you, janice. thanks so much. >> janice: you got it. >> ashley: we are going to it turn to a fox news alert.

migrants young and old risking their lives to cross into the u.s. just after title 42 is lifted. the biden administration had planned for a mass release of migrants from overcrowded facilities. but a federal judge in florida stepping in to block that policy. this as at least two buses full of migrants arrives in new york city this morning. the chaos at the border putting a strain on cities and communities across the country. and shocking video shows a fearless father brawling with a burglary suspect in his backyard in los angeles. the dad says the thief had stolen about $25,000 worth of gear from his podcast studio and returned to wipe his fingerprints clean. he joined "fox & friends first" to explain what happened next. >> adrenaline took over. i just -- something inside of me as a father awakened and i said to myself. this is a killer or be killed situation because i don't know if he has a weapon on him or not. this guy has broken in. he has already robbed me. there wasn't much -- i was thinking that's it.

do you think he has a chance of winning despite everything. >> absolutely. if you listen to that town hall. he sounds like the 2016 version of president trump. the best counter puncher in modern politics. you add in the fact that the field now growing to be about the size of the 2016 field by the day all of those advantages for president trump. stays focused on the issues mows press sent to voters. the fact that we have a crime wave. the fact that they have forsaken their number one responsibility to the american people. safety and security of the southern border. i think it would be a winning strategy not just for president trump but for all republicans up and down the ballot come november. >> ainsley: laura, i know when you were a nassau county executive you were a moderate democrat. do you think he has chance of winning. when you look at the polls when you look at people that he possibly could be running against. including desantos, is he up. he gets the most votes 53%. desantis at 21%. >> the usual caveat. anything can happen in 18 months. but, i would love to be a fly on
