one. now, i mean, we're beyond a breaking point right here. >> this is a serious situation when you are a female and alone. scary down here. >> i have a gun always and i have dogs with me. if it wasn't for dogs there would be some scary days for us out here. we're on a big place with no help. >> dana: people who live along the southern border all too familiar with the chaos down there. now that title 42 is over and stage set for more chaos they expect things to get a lot worse. unfortunately for them. welcome in a new hour of "america's newsroom." i'm dana perino. >> bill: i'm bill hemmer. good morning. time is up. title 42 is expired. tens of thousands of migrants are massed along the border ready to cross. secretary mayokas saying 24,000 agents are ready to handle it insisting the border is not open. >> smugglers have been long hard at work spreading false information that the border will

be open. they are lying. to people who are thinking of making the journey to our southern border. >> bill: this comes as a federal judge has blocked the mass release of migrants already in custody. "new york post" with a front page on the biden border policy it says surrender. >> dana: matt finn live in el paso with the latest. what is it like there today, matt? >> within the past couple minutes we walked right up to the edge of this border gate or wall and saw a group of a few dozen migrants, as we have seen so often, they are lined up systematically, placed on a bus for processing. the group of migrants we saw this morning appear to be all single adult men. there were no family units or women or children in that group. cbp tells me in the el paso sector it is seeing 2,000 migrants per day crossing into the united states. so far from where we're standing this morning we aren't seeing any major rush or uptick which

might make sense as perhaps migrants try to make it into the u.s. before title 42 expired last night. the el paso sector has historically been extremely active with more than 265,000 migrant encounters so far this fiscal year alone. a spotlight has been on el paso. thousands of migrants have flooded downtown streets and overwhelmed the sacred heart shelter. now what will it look like today and in the coming days since title 42 officially expired last night? a few hours ago the white house released a statement from u.s. homeland security secretary mayokas writing in part, quote, starting tonight people who arrive at the border without using a lawful pathway will be presumed ineligible for asylum. the border is not open. people who don't use available, lawful pathways to enter the u.s. face tougher consequences including a minimum five year ban on reentry and potential

criminal prosecution. in addition to title 42 expires yesterday a federal judge in florida blocked the biden administrations parole without conditions program in which the white house wanted to essentially release migrants without a court date. now that federal judge has ordered migrants cannot be released without a court date, which prohibits any catch and release. border patrol wrote in part this is a harmful ruling that will result in unsafe overcrowding at cbp facilities and undercut our ability to process and remove migrants. creating dangerous conditions for border patrol agents and migrants. as that statement just referenced, in theory the judge's order is going to slow down the processing of migrants all along the southern border. the question is what is going to happen to them? how are federal and state officials hold onto them until they are released with a court date or notice to appear? the biden administration has

said without the ability to quickly release migrants it will have up to 45,000 individuals in custody by the end of this month. dana and bill. >> dana: which is just 15 days away. thank you, matt finn. >> he was in el paso. we try to give our viewers a look of where we are today with the southern border. there are nine sectors, california has 2 1/2, arizona 1 1/2, 3 spit in yuma. el paso as one and texas has four. we'll focus in the brownsville area where bill melugin was last hour. almost 2,000 miles now from the west coast down to the gulf of mexico, 960 to be exact. all these red dots here are points of entry. a couple dozen down there. you see the area i talked about in brownsville. try to give you a better idea here. this is heavily -- the rio grande valley. a lot of apprehensions have happened here and border crossings taken place there. how many ports of entry when you

stack one on top of the other in southeastern texas. now this is brownsville, okay? the rio grande that cuts through and winds its way. matamoros is the area where they have had at least 2,000 apprehensions a day from matamoros into brownsville, texas. that's also an area where governor abbott and the texas national guard went in this week with razor wire along the river and also national guard troops to prevent people from crossing into the brownsville area. that's a hot area along that 1900 mile stretch. what is this? these are the walls that -- the laws expiring this week. one was title 42. this is march of 2020. global pandemic. covid outbreak. trump-era policy now says title 42 is in place which gave the u.s. government vast authority to take a lot of people who had crossed into the u.s. and expel them immediately. fiscal year 2021, more than a

million. 2022 it was more than a million. so far this year in fiscal year 2023 you are almost at half a million. that law was widely used now to kick people out. however, there were no criminal penalties that applied under title 42. title eight, which has been on the books, there was a criminal penalty, still is now. how is that used among apprehensions now over the years? 670,000, look at this. fiscal year 2022 at 1.3 million. so far this year 660,000. so title 42 is gone. title eight is still in effect. if you are apprehended or if you are met at the border by u.s. officials and taken back to mexico or your country of origin, you will now have according to the law a criminal record. if you try to pass yet again, u.s. border patrol will have a record of that.

it was not the case under title 42. this is what the biden administration right now is trying to hang its hopes on and try to prevent people from coming into that border, a border that is still many would argue wide open now from california down to brownsville, texas. we'll see how it goes. a new chapter and underway right now. dana, back to you. >> dana: thank you so much. newly-released emails indicate divorce lawyers for hunter biden and his ex-wife new about indirect payments from biden and other family members from a wealthy romanian businessman. house republicans continue their investigation into the public family finances. david spunt live in washington with more. >> good morning. house republicans hoping to find a direct link between overseas money and joe biden. they haven't done that quite yet. still they continue to release bank records relating to hunter biden and his finances. newly revealed emails reviewed by fox news digital indicate

that divorce attorneys for both hunter biden and his ex-wife kathleen were aware of payments to hunter which were $120,000 and called the romania deal. hunter's ex-wife said in an interview she wasn't aware of his overseas business dealings. >> i kept my head so deeply buried in the sand. i honestly have nothing to contribute. >> dana, while it is possible she did not know about the romania deal it appears her attorney at least did. sullivan, who represented her during the divorce proceedings wrote in december 2016 to hunter's attorney on the disclosures help me understand why it's taking so long to get this basic information? hunter's office confirmed a deposit of more than $120,000 in hunter's td accounts as funds from the romania deal. house republicans two days ago

alleged the biden family received money indirectly from a romanian businessman. may 2014 vice president biden spoke in romania to members of the government. according to house republicans a company called robinson walker, a business established by an associate of hunter biden, received $3 million from a company connected to that romanian businessman. the republicans claim they have evidence payments were funneled from robinson walker directly to the biden family. we want to point out fox fuss reached out to both divorce attorneys for hunter and ex-wife kathleen including one of hunter's current attorneys but we have yet to hear back. >> dana: thank you. joining us for more on this george washington university law professor and fox news contributor jonathan turley. i want to show everybody all the different family members in the bidens that received money. so here you have it on the screen for you here. you have hunter's ex-wife.

beau biden's widow and hunter's current wife and divorce lawyers new about the payment, does that add anything to the story in your mind? >> it adds a great deal. the only people not on that list are his -- groups like the pets, major is not mentioned. otherwise every generation seemed to get a dividend. what this looks like is a family business. it looks like a family business that is dividing up the proceeds. the difference is that this family business had dozens of llcs and accounts that seemed designed to hide these payments. there is no cognizant reason why you would create this labyrinth of llcs and at unless you were trying to hide the trail. it is not clear what the family business is other than politics. many of us have said for years that the biden family is

notorious for influence peddling and this seems to confirm our expectations. >> bill: the other story is what happened with this letter that was signed by 51 intel agents saying that the laptop was bogus, it came from moscow, russian disinformation? john brennan had a long interview yesterday and jim jordan explained it last night. >> sat for a four-hour interview and confirmed this thing was all political. we expect public servants not to use their title to influence an election. it was so political when all done. >> bill: my guess is we need to see a transcript to find out what the question was and how he answered that. >> yeah, but the thing that people need to remember is when the letter was issued just before the election, many of us had already flagged an interesting aspect of this laptop. it was self-authenticating.

other people who were senders of these emails. not only that, american intelligence said fairly quickly they had no evidence of russian intelligence involvement. and yet this letter was issued. we now know from the person who organized it, that he says that the trigger was now secretary of state blinken who was working for the campaign. we're beginning to see a lot of these pieces fitting now as to how this letter came about. it is not a pretty picture. >> dana: i want to ask you something. i learned that 21 people that the letter instigators reached out to declined to sign it. and yet the letter basically says here is -- based on the collective judgment of these 51 this is russian disinformation without, and yet 21 declined.

they never said that. this is being done at langley? >> yeah. that was one of the more interesting aspects in the last two days of news coming out. there is a reference to a c.i.a. employee who may have played a role as a facilitator of the letter. that is very troubling because it indicates that somebody who has been paid by the american people may have played a role in giving what was called a talking point to then candidate joe biden. when biden used the letter he never mentioned his campaign pushed the letter or was involved. another recent allegation is that the campaign helped determine who in the media would first get the letter. these are all levels of involvement that really we weren't aware of earlier. >> bill: it seems there is a striking lack of curiosity on behalf of most people in the media. >> dana: we have to apologize to

>> dana: marine veteran in a subway choke hold death investigation turned himself into new york city authorities two hours ago. daniel penny is being processed. will take a couple of hours. expected to be arraigned in manhattan criminal court this afternoon on second degree manslaughter charges. the marine veteran faces up to 15 years in prison if convicted in the death of jordan neely that took place last week. it sparked some angry protests on the streets and subways demanding justice for neely.

a homeless man known for his michael jackson impersonations. nypd says neely had 42 prior arrests some involving attacks on subway riders. paul mauro, former nypd inspector was with us and listen to what he said. >> the system in the city caved to political pressure. alvin bragg is the face of this point. he did not act alone. he turned himself into the five precinct, did mr. penny. the police department is making the arrest. we didn't go to grand jury. it was a rush to action for lack of a better term. the police department doesn't take this action unilaterally. absolutely no way. >> dana: there is more to come on that. there was pressure, perhaps, that alvin bragg the d.a. you see right there and the mayor of new york, eric adams, who were perhaps feeling pressure from the protests which were scant and had died down. they decided to take this action before convening a grand jury.

foe the clock is on. >> mayor eric adams, he was a transit cop. that means in new york city you are a police officer for the transit system. you are working in the subways. he said yesterday there was a lot of jordan neely's in new york right now and we've seen it since covid. a lot of homeless who live on the streets and some of them, they may need more than they are getting from society. medical attention, etc. >> dana: he was arrested 42 times. at some point does the system fail him? jordan neely and the rest of us. >> bill: fair question. it will go on for a bit and let you know when we get the latest from new york city. in the meantime a doozy. the feds have arrested an alleged chinese spy in boston, a u.s. citizen accused of coordinating with the chinese government and chinese communist party officials in beijing and sharing information on political dissidents in america since 2018. indicted tuesday charged with plans to act as an agent of a

in new york city a couple weeks ago. they uncovered a building in lower manhattan that was spying on people who live here in new york. chinese americans know when they go back to china mainland or even hong kong, they know the government is watching them and their phones and every movement. >> absolutely they do. they should know when it comes to the united states of america, that shouldn't be allowed. this is just one more signal that the chinese communist party is not afraid of the ramifications for their activities to be found. let's go back to the surveillance balloon and look at the number of what's called 0 day attacks. these are attacks on software and electronic systems that were previously not known. an increase of those coming from the chinese government. this is a sign the chinese government recognizes they are not afraid. they don't care about the consequences and they continue to get aggressive in their goal to surpass the united states of

america as the sole global super power. again, this is serious and something that we need to be building a global coalition in order to counter. we need to be making sure that the public and private sector are working together to insure american dominance and supremacy over technologies like artificial intelligence and quantum computing. what we saw in boston and what has happened in new york and other places is just the tip of the iceberg. >> bill: deep fakes are something that came up. a senator from nebraska talked to fox digital about that. the possibility it could happen. he thinks this is a reminder of the cold war. listen. >> i think there is a big parallel here between what the soviet union did back during the cold war where they outspent us 10 to 1 on this propaganda and what the ccp is doing right now. they are outspending us 10-1 and trying to leverage it with the technology advantage of a.i.

>> bill: you know that all too well in your former life, right? >> absolutely. artificial intelligence is a tool that will allow us to get better medicines and save lives but also a tool that can be used by our adversaries to try to influence us in our trust in our systems. the good thing is when it comes to improved deep fakes there is technology to try to determine deep fakes but yes, the senator is correct. the chinese government will try to use all tools within their toolkits in order to disrupt our operations because their goal is to surpass us as the sole global super power in the world. it requires us to educate our citizens and kids to make sure to understand whether something the fake or not. we have to be curious. we have to be able to discern those things. but also we need to be making sure we use these tools to detect these things out there in the wild.

he was on board that train on the first of may when he encountered a homeless man who has had dozens of dozens of encounters himself with the nypd. >> dana: 42. >> bill: apparently had a warrant out for his arrest, two years old. that was never acted upon. >> dana: penny arrived early this morning at that precinct, fifth precincts as paul mauro told us. he was there for about two hours and there will be, i think, another appearance this afternoon. there were two people who helped him subdue neely and we have not heard their names. we don't know where they are. they might be witnesses but they are not being charged. we also don't have a toxicology report. we also do not yet have a grand jury that might be coming. we'll find that out. alvin bragg the prosecutor in new york now on the record and on the clock. >> bill: the story will go on for some time. another chapter in the story. see where it goes from here.

president trump's cnn town hall. it drew strong reaction from both parties and especially the media. joining us now is former republican governor of maryland, larry hogan, you decided not to run so now you get to comment. which in some ways that's a great place to be just to be able to observe. your overall impression of the night? >> you know, i don't think that donald trump or cnn did themselves any favors. you know, i think that some of the stuff that trump said was pretty outrageous and doubling down on failure and doing the same thing he has been doing. but i don't think he alienated the base at all but probably certainly did nothing to win over any swing voters, suburban women or anybody else. it was kind of on him the whole evening. >> dana: what is the category of doubling down on failure? >> he kept repeating the same kind of conspiracy theories. continued to focus over and over and over again about the stolen election in 2020 which most

voters don't want to hear about anymore. he kind of made light of the sexual assaults and then he couldn't decide whether he wanted ukraine or russia to win. all of those were really stupid things to say. >> dana: okay. it is interesting because she really asked him a lot of questions that would be addressed in a general election. not necessarily in a gop primary. somebody who has decided to run against him and declared is vivek ramaswamy. one thing he wants to do is raise the voting age to 25. there needs to be a civic experience. you need to have gone through in order to vote. that experience could be living seven years as an adult and voting at age 25. that experience could be direct service to the country or some first responder service. it got a lot of attention. he is getting a lot of attention. dynamic, energetic and coming up with ideas. your thoughts on either the lowering of the voting age or his prospects? >> well yeah, i haven't put much

thought into his suggestion about raising the voting age. i don't think it will happen. i think people are legal adults they have the right to vote and the way we've been doing it for a long time. to your point focusing in on general election rather than the primary. that's the whole problem. an exact opposite thing you have to do to currently in today's elections to win a primary which is almost the opposite of what you need to be focused on to win a general. that's kind of did dilemma and why we lose year after year. >> dana: we asked shannon bream about the poll that said a lot of people in georgia want biden to have to debate rfk junior. would you recommend he does so? >> i'm all for debates and getting out there and letting the voters see the candidates and hear them answer questions. we have donald trump saying he is refusing to debate the republican candidates and we have joe biden saying he is refusing to debate the democrat candidates. i think both of them are wrong.

date. yeah code breaker bite is a program that is set into place that is a safe place for educators to use in the classroom to introduce a.i. i think it is so important that we guide our students into learning the correct ways and how to use good digital citizenship and that's just a platform we're able to use in order to do that. >> bill: do you worry about cheating? >> i don't. you are building those relationships with your students and talking about integrity and expectations and putting out lessons that students seriously are invested in, they aren't worried about cheating. we've always had cheaters are going to cheat. you know who is struggling and you need to talk to those students personally and try to figure out how to get them invested in the lesson to change the mindset. cheating is a mindset. how we use a.i. is a mindset. it is our responsibility to help students learn how to use it and how to use it correctly and for good with good digital

citizenship. >> bill: that sounds like a fair argument. casey, i don't know how you feel about that. you are cautious but you do train teachers to use technology. what is your view? >> i do. i am definitely not against technology. but we have hit a new leap in what's available and i think it is important that we take a step back and we approach it very cautiously. protecting our students is of the utmost importance. and you mentioned cheating. this is much bigger than cheating. that's not the issue. we have something that we are inviting into our classrooms and we have to think of that as what if we invited a stranger into our classroom and they were having conversations with our students? wouldn't we want to vet that first and want to know who is in control of that and what bias and misinformation they may be spreading? i feel like there is a much bigger picture we need to address before we embrace everything with open arms. >> bill: help me define this.

you told our producers a.i. is a different beast when it comes to education, how so? >> well, like i said we have taken a giant leap forward in a.i. and why it is such a hot topic with their why chatgpt leading the forefront. a.i. is a non-negotiable if you are going to live in this world. if you use technology you are already using a.i. it is not new. has new is the way we interact with it and it is changing so fast we can't keep up with what's out there. and just jumping into the latest and greatest is not necessarily what we want to do because we don't know the terms and conditions and when we talk about k-12 students, i feel like not just 13 and over but what's being put into the classroom is much more important to think about. >> bill: i want to give heather a chance to respond. what do you think of her argument? >> i agree with her. i think that we need to do it
