two elements that must be satisfied. one has to be proof that you killed the individual. and two, you did so recklessly. and there are many sub elements . the reckless part of that one stood out to me. it says is when the risk is of such a nature and degree that disregard that constitutes a gross deviation from the standard of conduct that a reasonable person, reasonable person would observe in that situation. well, there are a lot of witnesses there. so i would think this depends very heavily on witness testimony and what they saw. >> your thoughts? that's exactly right. let me quickly set the stage. man starts basically going berserk on a subway, someone who's had a long and storied history of striking women, breaking people's noses, hitting men , attacking people. he starts screaming and yelling that he's going to kill someone. the witness says that penny stood up and took the man down and held him along with two

others, by the way, right. until they got to the next stop. in order for the police to intervene. >> that's exactly right. you know, those are the facts. and in many ways, it doesn't seem to match the law here. hopefully, he gets a fair jury trial. but i worry because we are in alvin bragg's jurisdiction. let's review alvin bragg and his history guy. alvin bragg is the guy who brought never before brought charges against a former president . fact "new york times" surveyed law experts who strongly suggested state prosecutors have never before filed an election law case for a federal campaign. this is the guy who takes a bodega clerk who lawfully self defended himself and throws him in. rikers had to drop the case under public pressure. i mean, is this politically motivated because it didn't even go to a grand jury here? >> i got to tell you , kelly , when i was u.s. attorney , that's exactly the opposite. we decided cases based on the facts and the law. that's politics and all this

left. and we didn't care if you were. we made the decision based on the facts and the law. the opposite of what bragg's done here. shame on him. and i think a jury is going to look at this, see right through him and get about a 15 minute not guilty verdict. >> wow. 15 minutes. that would be quick. guy lewis, thank you very much. it seems there's a new standard of justice in america. criminals are excused for their crimes and they roam around free. i see him left and right here in new york , honest, law abiding americans who engage in self defense. they are punished. how do we get here? jack carr is a former navy seal. he's also the author of a brand new book, only the dead. you know, jack , as a former navy seal, we know daniel penny. he was a navy veteran. how do you assess his actions? >> well, i think it's indicative of a larger issue, and that's the weaponization of the justice system. and we've seen it at what i would call the strategic level, meaning up here, you've seen it with federal law enforcement. we've seen it recently with the

central intelligence agency with over 50 intelligence officials signing a letter to essentially diffuse a situation that was embarrassing to the establishment candidates campaign. we can go back to the church hearings and the public hearings in the 70s that exposed a serious overreach by the central intelligence agency in particular. but then we go down to the tactical level and we go down to cities like los angeles, san francisco, baltimore, chicago, new york , where you have days that are not prosecuting violent criminals who they go out, commit a violent crime, get arrested and they're back on the street sometimes within hours, sometimes within days. but they're back over and over and over again. and eventually and i'm not saying that's what happened in this case right here, but eventually those repeat criminals are going to terrorize, threaten to assault the wrong person. that's all a person who is very comfortable with violence. >> and it's not going to end well for them. jack , daniel , penny, obviously, he's getting a lot of criticism, is a big case

ahead of him. they say that this individual dropped his coat, yelling wildly that he's not afraid to die. many of the other passengers felt like he was a threat. some passengers even thanked daniel penni after then some additional footage leaks and it shows daniel penny and his fellow passengers tried to prop up mr. neely in a recovery position. is this an appropriate course of action? you've restrained the individual. you're trying to put him in a recovery position. just explain from a tactical standpoint what is going on with that type of language. >> well, first off, you're on a moving train under the ground, trapped in a compartment with someone who is threatening, throwing garbage, threatening to kill people, whatever it might be . and you can sit there as long as you can possibly take it. but it's very hard to retreat in a situation like that. and what it comes down to it, you're defending most precious of gifts, the gift of life and so for someone to take action, if if you were on that train or someone else was

on that train, a loved one is on that train, i would hope there would be somebody there who could help before the situation deteriorates even further. but there were multiple passengers that i saw that also tried to restrain this individual and there was also to say nothing of the 30 plus other people who have been killed on subways recently that we don't hear about for some reason, we are hearing about this one . and that right there is the weaponization of law enforcement, the justice system . and we'll see we'll see how it turns out. but with all those witnesses on there and people coming up to thank him after the act, we'll we'll see how it turns out. but it always comes down to feeling threatened and protecting that gift of life, no doubt about it. >> no doubt about it. and i understand you have a new book coming out. you have a lot of successful books, but you just tell us quickly, only the dead. what's it about? well, it's interesting on this one , considering tonight's topic, that is a novel of truth and consequences, considering that consequences and accountability are absent
