foreseen his death when he tried to subdue him and he risked him own life in an attempt to protect others. >> is dealing with a sitlation like i said with the -- situation with the sort of integrity and honor of who he is and honorable service in the united states marine corp.. reporter: neily's family acknowledged he struggled with mental illness and had over 40 prior arrest but his family's attorney said no compassion was shown to a man clearly suff suffering. >> no up one on that train asked jordan what's wrong? how can i help you? for everybody saying i've been on the train and i've been afraid before, and i can't tell you what i would have done in that situation, i'm going to tell you, ask how you can help. >> neily's family feels penny should have been charged with murder rather than manslaughter meaning he intended to cause neily's death and his next court date is set for july.

but i saw -- and you can go to my twitter account. i saw another piece of footage where there was an unruly man and african american man and a young woman said take a chill pill, chill out. he said say that again and she said i said take a chill pill and he punched her in the face and men all around her who did nothing. who did nothing after that happened. that and aoc does not have to face those indignities going to work by the way. pete: no, and the person that took that punch could have been jordan neely over 40 priors cold cobbing people on the subway and he got violent often and quickly. when you need them and with choke hold and breathing and released into an arresting position and didn't want to kill them and the passengers around him were thanking him and

pete: what exactly happened and what should we expect going forward and let's go off the wall to learn more. let's start with daniel penny. he's facing second degree manslaughter charges in the subway death. time and time again, 24-year-old marine, he was a 300 series meaning he was a rifleman and infantry man in the marine and got out after four years and e5 sergeant, honorable discharge and as a rifleman, that means he was part of a combat unit. will: second degree charges by the waypoint us toward did he act, did -- would a reasonable person presume he acted recklessly with indifference to jordan neely's life. he lived in queens and from long island. this is a important detail, pete, as we talked about throughout the morning. it probably means like any new

jordan neely's life and began to spin out of control. pete: 14 prior arrests and he was a subway performer and michael jackson impersonator and cycle of violence and mental health problems including cold cobbing and sucker punching people on the subway. two and one month apart breaking one victim's nose in 2019, punching a 64-year-old man in the face. he was charged with attempted kidnapping of a 7-year-old girl, dragerer down the street and oue street and put in jail for a few months and after that punch ago 74-year-old woman in the face and breaking her nose. liz jordan neely's attorneys pointed out there's no way daniel penny would have known his criminal history. he also wouldn't have known he was a michael jackson impersonator or what he looked like when he was 20 years old. what he would have known was the violent potentially volatile man

and choke hold and something known as sleeper hold. that looks like the rear naked choke hold and army combative program and that's the most secure hold on someone and you have them here and have their legs below them, and when he let him go into a recovering position, we're told jordan neely was still breathing. #not trying to -- he's not trying to kill him but subdue him and it'll be in the jury's hands to see if he went too far. will: witnesses say neely was said to be shouting acting erratically and said something to the effect of i'll take a bullet and clearly implicating he's up for a moment of violence. the interaction took place for up to 15 minutes. we don't have a -- we haven't seen the full 15 minute video and two other riders restraining him and witnesses pointing out that they thanked daniel penny for what he did.
