[laughter] happy mother's day. rachel: we're going to be talking about mother's day throughout the show. will: yes, we will. rachel: but we're going to begin this morning with the news. there is a crisis at the southern border. a record number of migrants continue to flood the u.s. border. pete: and now border patrol is warning severe weather in the area is making the dangerous journey to the u.s. even more risky after a deadly tornado yesterday. will: matt finn is live in el paso with more. >> reporter: and part of the immigration crisis is happening right here once again this morning in downtown el paso. there are migrants sleeping on the pavement spread across two or three city blocks here

outside of the shelter. we can't, you know, incompetently con firm the status of every one of these migrants. we saw some walking around with documentation and court dates, but we're also told some of these migrants may have also entered the country illegally. and this morning, two full days after title 42 exe pyre on thursday, the biden administration is still fighting to essentially quickly release as many migrants as possible under its proposed a parole with conditions policy which would allow the federal government to release migrants without a court date. instead, the migrant withs would be required to make an appointment on their own. a federal judge blocked the use of that policy with a 2- week restraining order and ruled that migrants can only be released with a court date. yesterday, the judge denied the biden administration's request to place a hold on his ruling, and the judge questioned why the

administration is pushing to release so many migrants on parole after secretary mayorkas claim to only a small number of migrants would be paroled anyway. quote, dhs' chicken little arguments about the impact of it not being able to misuse parole under either policy as a processing tool for the surge of aliens crossing at the border are hard to square with the recent comments that only a fraction of the people that we encounter would be paroled into the country anyway. and this was the headline yesterday from the washington post, at the border a reset but no surge. even though monday, tuesday and wednesday each saw a record high 10,000 migrants plus each day before that number did drop down on thursday. here in el paso this morning the city is reporting that it has are released more than 4,000 migrants into this city, onto these streets this week alone, and this city reports it has sent more than 10,000 migrants to where you guys are in new

york city so far this year. back to you. rachel: thank you, matt. pete: matt, thank you very much. rachel: by the way, that headline from the washington post said a are reset, no surge. the border patrol union furious about that headline saying this is propaganda, that that they're lying to the american people, that this is a reset and not a surge because if you're down at the border, you see what's coming across. it's a surge. pete: i happened to accidentally see msnbc yesterday, the banner underneath as they were talking about title 42, title 42 expires, no increase in border encounters. they're just flat out lying to you. rachel: yeah. pete: saying what's happening doesn't exist. talk to people down there. will: not sure what that even means, by the way, a reset. i know that means the expiration of title 42, but a reset of what's happening on the ground. check out this tweet from caitlin deese.

quote, speaking to immigrants in brownsville, this man from venezuela was given a candidate to appear in court. you can see the date, if you zoom in, is april 2027. rachel: think about how -- pete: four years from now. rachel: think about how many appointments you don't remember you had even just this month, let alone in 2027. pete: and by the way, as a result, that document that illegal immigrant has, that's their golden ticket. they're here under the guise of legality until april 2027 when they don't show up for their court date. rachel: you think about what dr, there used to be a formal process whether you came through ellis ellis island or recently through the process normal people go through, and it includes a health check. these people are not getting that. there's not enough people to to process that and give them that court date how many years from now. they -- we see an increase in

be welcoming illegal aliens into their homes with open arms. they don't mind dropping them off in your neighborhood ask denying they're even releasing them. rules for thee but not for me, a dose of reality would be good for them. just like in martha's vineyard, these problems should land at the doorstep of those that make the policies that create the problem, ask then we'll fine out if it truly is a problem. pete: they should, but those folks will always build a little taller wall or add another gate to make sure the real world doesn't affect them. rachel: yeah. and they have been dropped off in buses in front of the vice president's residence and an ngo shows up and shuffles them off somewhere. we remember the martha's vineyard incident where the immigrants were left for, i think, 24 hours they had them off the area, and i think they -- pete: they called in the national guard. rachel: yeah.

pete: by the way, we mentioned severe weather down at the southern border, a threat of oheds making this perilous moment even more perilous to. there were tornado warnings across iowa yesterday, and as a result donald trump, who was going to do a rally last night, was not able to. i don't think they've rescheduled it yet, but they will. it was going to be both trump and desantis this iowa yesterday. desantis was able to do his event earlier in the day, and he talked a little bit about -- made some veiled references to donald trump, but talked about 204 and his possible run. -- 2024. >> we've got to demonstrate the courage to lead and the strength to win. if we do that, if we make 2024 election a referendum on joe biden and his failures and if we provide a positive alternative for the future of this country, republicans will win across the board. i used to think our country was

locked and loaded, nothing can go wrong in terms of a free society. but freedom is fragile. with. will: you know, i happen to agree with desantis on this analysis of 2024. at least i think that is the path to victory for republicans in a that 2022 was clearly a referendum on donald trump. i think people voted for or against donald trump. i don't think anybody went into the voting booth and said i can't with wait to the cast my vote for joe biden. but hiding in the basement and having it be a referendum on another personality won't work on 2024 when you have 3-3 and a half years of track record and policies be it, you know, the economy, fentanyl suicide, fentanyl overdoses or poisoning, to the chaos at the southern border. it won't be if he's literally and figuratively hiding from his record. we've had these voter panels on saturday and sunday morning, and i'm really taken aback by those who say they are democrats who

have vote for joe biden and said, well, next time i will be willing to vote for donald trump instead the of joe biden. and when pressed, you say -- because you think how many conversions are left to take place. rachel: right. will: so when pressed, the answer is i just will not and cannot vote it for joe biden. rachel: you know, it's funny, because when i saw that,ting i heard he was having a rally, i couldn't help but go -- i appreciate that you went into the with substance of it, because i think that's really the point of it. but it just didn't feel like a rally the way a trump rally would. it felt more like a speech. and i think that's going to become the issue, right? when and if ron desantis, and we expect him to announce, that comparison to donald trump who basically brings the party to the rally and has that energy. pete: yeah. i mean, setting aside the great things ron desantis has done as governor -- rachel: yeah, can't deny that.

pete: it's true, unbelievably underwhelming. the first moment i saw him speaking was in the elevator here at fox. okay, i put on my blue country shirt to go to iowa. very little energy. not as dynamic or engaging as alling have thought basedded on his reputation. the event ends and it's like thank you, thank you, thank you. it's just is not there. there's a lot more sizzle than there is steak when it comes -- that's why i think his numbers have dwindled as he's gotten closer to announcing. i don't think an event like this, an appearance like this makes people say that's the guy that's going to take trump. i just -- and i don't want to say that. just look at the optics -- will: i disagree agree in this are respect, i think in any other year -- he gave two speeches yesterday. that was yesterday afternoon, he gave one as well last night.

it would have been a good political speech. it would have been enough to beat mitt omni, john mccain -- mitt romney. i think your standards have changed when it comes to the style -- pete: you're right. will: and the it's the steak versus the the sizzle. he does have the track record, the policy, the things that everyone should be excited to see play out on the national stage. but donald trump is blockbuster. donald trump is a rock star, and he changed your estimation of what an exciting political speech is, and now that isn't good enough when next to donald trump. rachel: and production matters. i mean, look, the donald trump team has perfected the rally, the music, the energy, but you can't take away from the fact that the guy, as you said, he's kind of a rock star. lawrence jones was in iowa, and he spoke with some iowa voters. here's what they had to say. >> who do you feel has the best shot to beat joe biden?

rachel: president biden's department of homeland security keeping a close eye on middle-aged, pro-life moms, labeling them as potential radicalization suspects in newly revealed dhs training guides obtained by america first legal foundation. here's one example profile. this is ann, a resident in rural america. ann has always been religious,

means? what does this mean in practicality at the d.? this is what they came back with, training materials, videos, things that were being created to help train dhs employees, other law enforcement agencies to spot things they thought, they perceived as people being at racesque of domestic violent extremism. and -- risk. the example you point out is something that they're preoccupied with which is, oh, my gosh, there's a pro-life mom, she must be a risk of being radicalized and turned to d. rachel: right. >> this is something that we actually need to think about. rachel: i read this and was like, wow, she sounds like me. [laughter] i might be on some list with whatever federal law enforcement agency. so they have a hundred known terrorists who have come across the southern border, we have over a thousand percent increase in chinese nationals coming across as well. they have to have some sort of prioritieses. what are they not doing because they're focusing on, you know,

pro-lifers? >> well, they're not doing their job, clearly, at the border -- rachel: right. >> -- as the segment before you all clearly pointed out. there are some major issues. the department of homeland security is supposed to take care of actual terrorism, supporting our borders, and every minute and dollar they spend that they're not focused on their critical, core missions, is a dollar that's not being spent on the things they're supposed to be doing. this is consistent with joe biden's agenda. it was just yesterday he was speaking at howard university where he told this class of graduating students that the greatest threat, the greatest domestic terrorism threat in america came from white nationalists. i mean, they're completely dislodged from reality, but this is what they do. this is who they're looking at. if you are a conservative especially, if you are someone who has traditional values, you better watch out because uncle joe is watching.

when he died, a warrant was out for husband arrest, in fact. his criminal record reveals multiple serious charges. in 2015 he was arrested for kidnapping after drag a 7-year-old girl down the street. in 2019 he was arrested for punching a 64-year-old man and then again in 2021 he was arrested for punching a 67-year-old woman in the face. he's allegedly punched multiple people on subway platforms between 2019 and 20 the 21, and now daniel penny is out on bail with after being charged in the his death. joining us now, former n yucks pd lieutenant and u.s. army veteran dr. darren porcher. great to to see you. >> thanks for having me on, will. will: mission to his criminal record, jordan neely was apparently also on a top 50 list put out by new york city when it comes to homeless on the streets that represent a high level of

either danger to themselves or to others. what does all this tell you about this incident, or how does it inform you on this incident between daniel pen think and jordan neely? the. >> this is a testament to the city of new york's failure to afford the services to us as common citizens and keeping people of this magnitude off the street. jordan neely was a person that should have east been incarcerate or placed in a mental health facility. he should not have been on that subway car. as a result, we had mr. penny that i feel took appropriate action and attempted to restrain him because he put those people that were on that train in fare of harm. in fear of harm. we also had other subway riders that conjoined to restrain him while awaiting police. this is something that we hear the loud left crying that this was up necessary, and -- unnecessary, and i genuinely don't believe that mr. penny was attempting to take this individual's life. but at the same token, what are

we doing? we don't have the police that are affording us the necessary protection on subway, and this is a a classic example of citizens that did what i believe was right to restrain an individual pending the arrival of police. will: i lived in new york for 15 years. i didn't know there was a list like this, 50 -- new york's top 50 list of homeless people at risk. what does that mean? what is this list designed to do for the homeless here in new york? >> when we have a top 50, these are individuals that present a danger to us as common citizens. we have people that suffer from mental health issues that need to be placed in mental health facilities. so it's the incumbent upon the city of new york the take these individuals and place them in the appropriate treatment. however, it's unfortunate when we look at the migrant issue that's plaguing the city of new york, money is going in one direction and not going in the direction of providing care to these individuals on this top 50

list. will: that's a great point. there's only so many resources, on the so much money. the more we have to deal with the illegal immigration crisis, the less we have to the give to people on this top 50 list. it's a difficult situation because with we can't involuntarily commit people, take away their constitutional rights, and at the same time we can't have this problem on our streets. but one thing we've learned, i hope, from this incident -- or we will learn -- is that we can't also then in turn punish those when attempt to protect themselves or others from these high risk situations. in this case, daniel penny and jordan neely. dr. porcher, it's great to have you with us, thank you for giving us some insight. >> thanks, will. will: by the way, tomorrow judge jeanine on "the five" will have an exclusive interview with daniel penny's attorney, don't want to miss that. 5 p.m. eastern time right here on if -- the fox news channel. at least one person is dead after violent tornadoes touch down in texas, and more severe

after a tornado -- are hurt in south texas after a tornado touched down yesterday. several tornadoes were also reported across iowa throughout the day yesterday. and the severe weather isn't let ring up. warnings are already out today for across illinois and the tennessee valley. let's check in with meteorologist adam klotz for our fox weather forecast. adam: good morning, pete. a lot of active weather across the middle of the country. still there as we currently speak and kind of some showers stretched across from texas, running up into the northern plains, yes, the midwest also. those are some of the same problem areas again today with the worst of it we're highlighting an area from st. louis stretching off towards the south and east, getting into tennessee, the very tip of southern indiana. again, areas we've seen over the last several days where you could see big, severe thunderstorms with strong winds, heavy rain, isolated tornadoes

us. >> good to be here. will: fascinating report of yours referenced right here yesterday on "fox & friends" weekend by sara carter, it caught all of our attention, and it's something we wanted to follow up on this morning with the source, you. tell us about what you witnessed here with the biden administration helping mexican officials and, i guess, coyotes a facilitate illegal immigrants into the united states. >> that's right. so i was in mat morass the -- matamoros for most of last week. i'm now in mcallen on the other side in texas, and i witnessed just crowd after crowd after crowd pour into the river and up the texas river bank all day and all night. and after a while i noticed a pattern to it that mexican immigration officers on the hex can side would hold -- mexican side would hold back thousands of people, hold them, control the crowd until an appointed moment, and then they would signal, and 200 people would

rush for the border, and then the they would cut them off again and get them back up the river bank. and those 200 or 300 would go on up the river bank. so when i asked the mexican officials what was going on, they told me that they were in communication with the american cbp, the border patrol, intelligence officers on the american side who were telling them when to release them so that they could control it better on the american side and ostensibly that fewer people would get hurt but definitely acquiescing and is accommodating the flow of illegal immigration in a kind of illegal way over the border. [audio difficulty] and this was ultimately confirmed by five different immigration officials on the mexican side who said that they were working with the americans on whatsapp, encryptedded

whatsapp channel. i don't know about the coyotes, but definitely with the mexican government. and this is extraordinary because almost every executive branch in the history of, modern history of u.s. presidencies stop, block, deport, detain, coeverything they can to stop illegal immigration, not to conduct an orchestration of it which was the case here. rachel: right. and collude, essentially, with this -- >> collusion. rachel: you know, it's interesting to to me that you got the information from mexican officials. i went to the border, and i couldn't get our border patrol to talk to us. they wouldn't tell us what was going on at all. and so it's fascinating to me that you're getting your information from the mexican officials. >> it's not that i didn't try. i mailed and telephoned cbp

officials and it's been five days and i still haven't heard back. i don't think i'll ever hear back on that. one big issue there in addition to the morality of an executive branch facilitating, directly facilitating illegal swimming over thely go grand is, you know, what happens -- the rio grande, what happens if a child drowns, somebody gets hurt? as far as i know people might very well have been hurt doing that. the u.s. government is opening itself to tremendous liability here. they're going to get people hurt. pete: no doubt. and, todd, how much of it in your estimation is avoiding the imagery of tens of thousands standing together on the u.s. side? >> oh, well, you got it. i mean, that is absolutely it. you know, i have a book out fresh, you know, on the stands called "overrun: how joe biden unleashed the the great border crisis many in u.s. history,"
