the dirty pavement this morning, spread across about two city blocks here in downtown, el paso. i have now spoken with many of these migrants and they tell me they plan to leave texas for various cities across the country including denver, new york and orlando, florida. and texas governor greg abbott sent another bus load of migrants from this state to the naval observatory in washington, d.c. yesterday. not far from vice president kamala harris' home after title 42 ended last thursday. governor abbott says he will continue sending migrants to cities like d.c., chicago, and new york. and now that a fresh week has begun after title 42 expired. border patrol sources tell fox news migrants encounters over the last few days have drastically fallen. >> the united states border patrol has experienced a 50% drop in the number of encounters versus what we were experiencing earlier in the week before title 42 ended at midnight on thursday. it is still early. we are in day three.

>> and according to multiple cbp sources, last week in calvary. border patrol agents arrested an afghan national on the fbi terror watch list. the afghan national crossed the border with a group of migrants. and when border patrol fingerprinted that man, the fbi confirmed a match on a terrorist screening data base. yesterday, the president was asked about how he feels the border is going overall. >> how do you think things are going at the border, sir? >> much better -- much better than y'all expected. [laughter] >> do you have any plans to visit the border. >> no, i think -- pardon me? >> do you have any plans to visit the border? >> not in the near term, no. just be disruptive, not anything else. >> now, some of thing mys are talking to here on the ground in el paso have showed us some of the release papers. i spoke to a woman yesterday. she has been given a notice to appear in court in 2026.

three years from now. another reporter talked to a migrant who was given a court date in 2027. now, i asked that woman who is here taking shelter in el paso how she plans to get to newark, new jersey where that court date is, and she told me she plans on getting a humanitarian flight and staying in the country for the next three years. back to you in new york. >> ainsley: court date 2027. thank you, matt. we have been hearing court dates up to 10 years. that's fairly good bleeskt. >> will: court date of 2027 says welcome to america. you are never reporting. i don't remember appointments i have end of this week much less four years from now. stunning to see this vehicle tri lap. there is lies, damn lies and statistics. i don't know what statistic to distort saying it's down by 50%, reality is going continue to crude. it already has in the form, i think, what should be the headline of this afghan national on the terror watch list.

arizona. also, keep this in mind. the texas lone star group that has been fathering across the border changed tactics. instead of saying here come with me we are going to apprehend you. they are saying this is razor wire, if i catch you, you are back to mexico not texas. and filling the gaps with our makeshift wall and that deports feel to the port of entry. >> thank goodness the border patrol hatched this afghan national in california to the terrorist watch list. the fingerprint was the much on the terrorist screenings base. the five other immigrants on the fbi terror watch list that were arrested friday near tucson. they were referred to the fbi's joint task force for investigation. the mayor of or the governor of texas, abbott, has said more buses will be coming. you will see buses if you live in new york and philadelphia or thinking or other places around the country because they just can't handle it. i know you reported on it this

legal defense fund for marine veteran daniel penny nearing $2 million now in donations as is he charged with second degree manslaughter in the death of the mentally ill homeless man jordan neely on new york city suspectway. the arrest struck a cord with are supporters worldwide as witnesses say that neely was acting erratically and making threats before penny restrained him. former federal prosecutor nancy hakes joins us now to talk about this. >> hi, ainsley. >> ainsley: what is he up against now? how do you see this playing out in court? >> well, this is such an incredible and interesting case, ainsley. i have a bunch of questions. first, i wonder why alvin bragg chose to take former president trump to the grand jury for weeks and weeks for an investigation of what was effectively misdemeanors but for this case, which is a felony, which involves someone's death, he didn't bother to go to grand jury. he just brought the charges himself. he brought them very quickly

would suggest he was in a hurry might mean is he feeling political pressure from left flank. after the charges we found out another eyewitness has come forward to say that the person who was killed was actually making threats. >> ainsley: do you think that alvin bragg was pressured? there were so many protesters down in the subways preventing all the trains from actually moving on the tracks. i know he had sent it to the grand jury. the grand jury would have decided whether this case moves forward. obviously it's going to now. >> that's right. you have to wonder why he decided to brings the charges there are so many penal in new york who have to deal with these dangerous subways. and you have got homeless people and mentally ill people and violent people constantly preying on people of new york, both in their streets and on public transportation. and you have to wonder whether a grand jury, if they had had a

chance to look at this case would have sympathized, legally speaking with daniel penny. >> who was defending himself and others from someone who was making violent threats. >> ainsley: how does this play out? if it's a jury trial, will the jury side with daniel penny? his attorneys say he didn't mean to kill him. he just was trying to restrain him to prevent him from threatening other people. >> well, it's interesting. he has a very strong legal defense in the state of new york. they have a really interesting justification or sever defense clause in the law. and what the state has to do is prove that daniel penny was not justified in doing what he did. and, ainsley, they use what's is called a reasonable person standard which just means was it reasonable for daniel penny to believe that either he or someone else on that subway were in danger? that is was the victim or the person who died, was he about to commit an unlawful act of force against someone else?

>> brian: back with a fox weather alert. storms causing flooding across st. louis yesterday. rest could i crews respond go ahead to numerous reports of trapped drivers. traffic delays across the city. meanwhile in california yosemite national park check in with janice dean for the fox weather forecast. janice? >> janice: good morning. we still have the potential for flash flooding today possibly over the mississippi, ohio and tennessee river valleys. the good news is we don't have a big organized storm system to talk about but we could see the potential of some heavy rainfall with some of these storms as we track them across the country. let's take a look at the maps. i will show you what we are talking about. we could see some showers and thunderstorms for parts of the plain states along the great lakes. or rather the gulf coast,

rather, in towards the ohio and tennessee river valley and then, also across the northwest. here's the rain potential over the next seven days, again, no severe threat. we are not talking about large hail, damaging winds or tornadoes, but we could see the potential for heavy rain that could cause flash flooding really from the colorado rockies down towards the gulf coast and southeast for the next seven days. there is your forecast today. the biggest story we are following is the heat. the extreme heat for parts of the northwest down towards the california valley. so 89 in seattle. typically, this time of year, that's at least 20 degrees above average. 77 here in, no. we were in the 80's yesterday. here in new york city. and then the temperatures are a little cooler this week. look at some of the northwest record heat for seattle and portland and eugene. we broke a record that was set back in 1939 in eugene, oregon on sunday. so that's going to continue to be the biggest story as we go through the next week or so and then the temperatures will come back down on sunday.

chicago. you went from one progressive mayor to an even more progressive mayor. who clearly wants to defund the police. unless he has changed his tune. which we doubt. so, what message are we really sending in looking for more carnage. i have got to tell you, brian, one of the things i have found when you talk about many solve these mayors who will not and do not take on these rogue prosecutors. look at the former new york police officer now turned mayor he goes right up to the point but he won't call bragg. let's talk about what happened recently and it was unfortunate. you talk about a mentally ill man on the train and former marine who goes in and tries to stop a bad event. unfortunately, the young man died. we blamed it on him or should we blame it on a broken system? government system of treating

the mentally ill? and then the outgrowth of that is protest. now, let's change it for a minute. police officer got killed. everybody comes out for the pomp and circumstance. the politicians come out. but where is the angry community when a police officer putting life on the line gets killed? where's that? >> brian: by the way about 1500 down in new york city. maybe some of those men and women might have been on the platform. may have been on the train. we're not doing that. that's why 24-year-old marine had to step in. then we find out, also, that the guy has a history of violent abuse on an actual subway but he is the problem. the problem with this mayor. he came out and said let the process play out. he quickly reversed and brought race into it. mr. mayor, this dates back to the ferguson effects, doesn't it? >> absolutely. everything has a racist next to it. i can remember being asked questions when i was police in

detroit officer involved shooting not first is the officer okay? what's the race of the officer? race of the suspect? what does that matter? was the officer macing an imminent threat to life, his life or someone e else's life? and that decision it had to be made. it's always tragic when an officer has to use deadly force. why does race have to play into it? it's sad. >> brian: you know what it does play into it. the stats, the after path of the stats. most victims of crime are actually minorities. so, when the police pull back, because of the mans portrayed in the minority community they are the ones that pay the biggest price. >> they absolutely do ryan. i will tell you, having worked in many vulnerable communities throughout my career, they want the police. they are excited about the police. they want constitutional policing. these elected leaders, and i shouldn't use the word leaders, but those who sit in these

elected positions, who do they represent? will they don't represent these people in the neighborhoods. i know the people in the neighborhoods. i know what they want. >> brian: chief. they are also the ones voting because maybe they are getting bad information on these extremely left wing leaders and finally, real quick. the president of the united states said the biggest problem in america is white supremacy. do you think that's the biggest problem? >> no. that's not the biggest problem. just like he will sit there and look through -- at us to american people and say, we're too long better with the borders. the borders are not open. come on. we got fentanyl, 200 deaths a day. that's like a jet liner going down every day. fentanyl is coming through those open borders. so, why are we being lied to? >> brian: right. we should be leveled it. mexico is refining it. and the raw materials provided by china. the president should be saying that every day. james craig, thanks some. >> thank you, brian. have a great day.
