migrant crisis as concerns grow over terror suspects making their way across the southern border undetected. hello, john roberts in washington. trap in, sandra. another week. >> sandra: a lot of concerns about all of that. sandra smith in new york. this is "america reports." president biden says the situation is going better than anyone expected with title 42 expiring despite tens of thousands of migrants being detained just last week, including an afghan national on the fbi terror watch list. >> john: this as we are getting an inside look at some of the holding facilities that are stretched way beyond capacity. >> sandra: a look at these images here, complete coverage now. mike waltz is standing by. but bill melugin is live at the southern border. excellent reporting all weekend on this. what are we learning now about the arrest of the afghan national? >> bill: sandra, what i'm told by multiple sources is this happened last week on wednesday

in border patrol san diego sector, arrested an afghan national, and on the terror watch list. this happened in otay mesa, san diego, inland san diego county. he crossed illegally with a group of migrants, apprehended by border patrol, taken to the station, fingerprints were run and that is when he was found to be a match on the terror watch list. i'm told the fbi later confirmed that match and the fbi is leading the investigation. california congressman darrell issa represents that area. what he is telling fox news, is it any surprise among the 5 million illegals biden has permitted to violate our border some of the world's most dangerous terrorists have also taken advantage of the presidential chaos to enter our homeland. the president and his border czar, v.p. harris, owe the nation the truth and also a course correction from this

disaster. and this remarkable video courtesy of tony gonzalez, congressman, border patrol facility in el paso, showing severe overcrowding. capacity of 120 people, instead 750 adult men crammed in there. the facility as a whole, capacity for 1,000, he says on that day on friday when he shot the video there were 3,000 people. so a snapshot what the situation was like on friday in el paso. and lastly, mass migrant releases, some of these court dates, on one, courtesy of the washington examiner, a venezuelan man in brownsville, court date in 2027, and then another one, our colleague matt in el paso talked to a colombian man released with a court date of 2026 in newark, new jersey. and that is a pull factor.
10:05 am
the migrants know if they can get here, cross illegally and step foot into the u.s., they have a good chance of being released into the country and they are going to be good to go for several years in some cases because of how backlogged our court system is with immigration cases. back to you. >> sandra: bill, thank you. john. >> john: bring in florida republican congressman michael waltz, on the house intelligence committee and former green beret commander. the biden administration taking a victory lap over the sharp decline, but also this afghan national apprehended and hundreds of thousands of got-aways since biden took office, don't know who they are, where they are or what their intentions are. congressman, is that a problem for you? >> yeah, it's a huge problem, john. it's a problem for every american. we know that people from over 170 countries are now coming

across our border. the word has gone out that it's wide open, and if you can just get there and step foot across our border then you can enter into our asylum system, get a workplace, or get a workforce visa and wait 5 to 7 years to maybe show up for court. and look, john, we have to remember, going back to afghanistan, there were thousands and thousands of the most hardened isis, al-qaeda, and taliban fighters released from the prison that was at bagram, one of them was the suicide bomber that killed our 13 americans at abbey gate. where have they gone, we have lost track of them, and i'm hearing from afghans still there, still in hiding from the taliban that the taliban are issuing visas and passports to terrorists who can leave legally

10:09 am
the next few weeks. there is a sense what's been happening is ukraine has been trying to exhaust russian forces and wagner mercenaries in the battle for bakhmut and attack them somewhere else. what do you see happening in the weeks ahead? >> well, part of this has been getting the armor in place, both the german tanks and now we are seeing some of our american tanks get into place. you need the conditions on the ground to actually support those tanks. we are talking 60, 70 tons apiece, and then number two, the logistics to support them and three, the munitions. both sides have completely exhausted their ammunition and getting the ammunition in place. and remember, john, a basic military doctrine, you need a 3-1 advantage offense to defense and what we are seeing from the ukrainians is building that up, and you are right, wearing them down and keeping them guessing where the offensive is going to go. from my trips out there, i think
10:10 am
at the end of the day zelenskyy has to have more access to the black sea and you are going to see the main trust in that direction. he also needs to get that nuclear plant back, that's responsible for about 40% of ukraine's power. those two objectives, and he's in position of strength if we go to the negotiating table. >> john: we'll see how it all unfolds. apologies, there is a k missing from the locator there on the right-hand side of the screen but we all know it's bakhmut. congressman, good to be with you. thanks for kicking us off, appreciate it. >> sandra: president biden expected to meet with the congressional big four, that meeting expected tomorrow. senior correspondent chad pergram has the latest as we anticipate that moment, chad. are they getting anywhere with these talks? >> hard to say, kevin mccarthy signals they are far apart and
10:11 am
doubts the white house is making serious offers. president biden is cautious. >> it's not good to characterize in the middle of the -- i'm an optimist, a desire on their part as ours to this agreement. i think we'll be able to do it. >> mccarthy says he believes the administration wants a default, the sides are focussing on lowering spending to last year's levels and blocking forgiveness of student loans, another big request from the gop clawing back money left over from the pandemic. >> the unspent covid funds should be a no brainer. one of the things i would have hoped on the table, unspent and unallocated debt relief funds, if you will, the student loan debt relief that biden has provided that i think is most unconstitutional, most americans think is totally inappropriate.
10:12 am
>> debt ceiling talks in 2011 went on for three months. tom khan was part of the negotiations, here they only have two weeks. >> it's a grave situation. the factors that would lead to an agreement are so high, the obstacles are so great. i'm convinced that this country is the closest danger of default we have ever been. >> never before has congress tried to hike the debt ceiling with margins this slim in the house and senate, and so little time to act. sandra. >> sandra: chad is on that for us as we walk closer and closer to that actual meeting happening, chad. thank you so much. and john, as we do that, and begin a brand-new week, pop up the dow board, the markets have been watching closely, uncertainty is something for the investment community and traders
10:13 am
to really sort of take in. some unusual trading, started off far down to start the week and since moved up into the green. but there's a lot of uncertainty out there and markets are certainly watching this. >> john: i would think that based on history that neither side is going to allow this to happen, but sometimes brinksmanship can go to crisis and hope we don't get to that point and cooler heads prevail and hammer something out. >> sandra: that will happen sooner rather than later. >> john: we will keep an eye on it. once upon a time, gavin newsom was looking to hand out reparations to black californians. but there could be a change of hard. james gallagher and leo terrell have some thoughts on that. >> sandra: taylor swift smashing records with her hit summer tour. wait until you hear how much some swifties are dropping to
