[cheers and applause] >> trace: good evening and welcome to america's late news, "fox news @ night." i'm trace gallagher in los angeles. breaking tonight, the durham report is in. so is the analysis and both are a blow to the integrity and structure of the fbi. the report says the investigation into alleged collusion between russia and former president trump during the 2016 election should never have happened. and the fbi lacked actual evidence. the chief correspondent, jonathan hunt, is live with what we are learning about durham's finding clears. >> jonathan: good evening.

the fbi relying on unconfirmed data was susceptible to confirmation bias and ignored evidence that did not fit a preconceived narrative. those were the most damning conclusions of the report, into ties between russia and donald trump's 2016 presidential campaign. special prosecutor writing, quote, the fbi's ability to critically analyze information that ran counter to the narrative of a trump russia collusive relationship exhibited crossfire hurricane is extremely troublesome. the former president for his parts of the report proved that the original fbi probe was a "charade" started by the democrats. and added that there must be a heavy price to pay for putting our country through this. his allies agreed. >> there needs to be prosecutions. there needs to be accountability. and the fbi has got to be

overhauled now top to bottom. it has got to be completely reformed. it cannot go on like this. >> jonathan: but with no new prosecutions announced in the report and many procedural reforms already putting place by the fbi, democrats argued the durham report amounted to much to do about nothing. >> we have spent an awful lot of money as an american government on a report that essentially proves no wrongdoing. >> jonathan: and ultimately, what we have here seems to be another report that like the maulet report before it took years and millions of dollars to complete. and gives democrats and republicans just enough cover to draw entirely opposite conclusions. >> trace: and we are going to talk about those conclusions. with spring and former deputy assistant john you and mike davis. thank you for coming on. john, let's begin with you.

the clinton campaign funded and created this phony dossier and then fed into the fbi and they that, they made hoax, a line, and sinker, quoting, an objective and honest assessment of these strands of information should have because the fbi to question not only the predication for crossfire hurricane but also to reflect on whether the fbi was being benevolent -- manipulated or political or other purposes on unfortunately it did not. your thoughts about this, john. >> 's report is the official confirmation of our worst fears. which is that you had the incumbent party in the white house, their political party, ffed a made up, or manufactured hoax to our law enforcement agencies and used that to cross the red line which has been in place since watergate which is to interfere in a presidential election in a way that almost threw it to the incumbent party. this is a disaster for the fbi and for the justice department.

yoo. this is a hook, line, and sinker for -- >> it showed that if donald trump was right about this the whole time. i admit when i saw this, i was dubious. it showed trump was right. this was a hoax. it was completely manufactured by the hillary clinton campaign and there were people at the highest levels who were out to get him. it was actually all true. the question is, how did we let such a powerful agency power over our life and freedoms to get so biased? there has to be reformed and it has to come at the hands of congress or in the next election. >> trace: and that is a great question for you to end on, and mike davis. how did it get to this point. your final thoughts? >> remember, they interfered in the 2016 election. the fbi also interviewed and the 2020 election by hiding the biden crime family corruption and how you fix this is you bring major reforms to the top leadership of the fbi. you have to gut it and start

to the border patrol agents who, this person coming across the border. there are resources for the border patrol agents who have been stretched very thin and the fact that they caught this person's great. i'm glad they did that there are however, how many people have come across that they did not catch? this is similar to fentanyl. it has been pouring across our borders. we catch some now and then. but we still have many millions of pounds of fentanyl coming across the border so i'm glad they did catch this terrorist but now how many really already gotten across and maybe did not come through a port of entry. this guy did the entry here in san diego county. but it just, you know, the question begs the question, how many others have already made it across in our country with this open border policy and the biden administration keeps allowing it to happen? >> trace: and we made a point made earlier by saying that it appears the encounters in some cities have dropped over the past couple of days.

we expect of those will rise again as more of migrants kind of make their way to the border. but i want to show you this picture, supervisor, because this was taken, tony gonzales, congressman, texas, this is the el paso region. every single shelter across the borders. arizona and texas and they are all filled to capacity and they are letting people go by the thousands. what are your thoughts on this? >> well, you look at that is crazy because we can't track people. even the ones that we do, you know, are seeking asylum and allowing into the country, they are getting hearing dates make like three or four years out in the for all the people they are letting in, to me, our whole border system is broken. we need a safe and secure border and we need border policy that the people, you know, the, people in and lets the bad people out and with the onslaught we are getting, we are getting all of them and some -- so many people that are subjected to sex trafficking and

other things, it is a terrible situation. it is our responsibility. it is our border, and we need to keep it secure. from quoting, homeland security patrol, into the u.s. from the southern border on friday. according to a department stores. a day earlier, a judge issued a temporary restraining order against the border patrol' use of catch and release. so the federal government is ignoring a federal judge. >> and that is crazy. i'm really glad that that judge in florida stepped in because basically instead of being screened and being questioned about their asylum status, they were just given a slip of paper and april paper they called it and where the only just had to check in with an immigration center within six months or something. but there was no way to attract people and to know if they actually did that process. so to me, it is crazy, you know, the way it has been handled. it is open border. the biden administration has really let us down and i think,

>> reporter: prosecutors have acknowledged that neely was observed making threats and scaring passengers. penny's lawyer adamantly pushing back against any notion that race played a role in his actions. >> he is the one that put himself in danger to save who? all the people on that train. black people, brown people, white people, it did not matter to danny. danny put his life at risk. it has nothing to do with race. >> reporter: neely's family as well as protesters have called for murder charges. trace? >> trace: thank you. let's bring in trial attorney brian claypool. want to play one more soundbite. it was interesting the conversation he had with judge jeanine. i want to get your take on this. watch. >> mr. neely entering the train and acting in a very violent manner. both physically and with words. the mindset is pretty simple.

he was fearful for the safety of those passengers. so when he acted, his mindset was to keep his fellow passengers safe from attack. >> trace: trying to keep the passengers safe is what this contention is, brian. and doing that, by the way, he was trained as a marine. that is kind of the contention here. what do you believe? >> trace, the daniel penny matter needs to be -- prosecuted based on the facts and the law. kid rock is involved. a lot of republican people are donating and you got aoc on the other side saying, we are not publicly condemning this because he was black and homeless. this needs to be based on the facts. if you look at the facts, we got to get footage. we need to see the footage inside the subway. exactly. you got to find out what happened there 15 minutes leading up to the chokehold.

was nearly actually threatening people? was he brandishing a weapon? did he physically harm anybody? we need context. where is that? does anybody know where the footage is? we should have the footage. >> trace: somebody has the footage. >> so we need answers there. that leads to the next question. for example, if neely had a weapon, maybe the chokehold was warranted. but if he did not have a weapon, if he had not harmed anybody physically and neely is putting on a chokehold that was banned in 1993 by the nypd, then he might have a problem. he might be facing second-degree murder. carmen but you don't need to be punched in the face to feel afraid for their lives. you don't need to be physically assaulted to feel like you are afraid for your life. >> the standard is this. here is the standard for second-degree murder or manslaughter in new york. you have got to create an unjustifiable risk which i think happened here because he was -- chokehold for 15 minutes and then you have to act in

conscious disregard for the welfare of neely. here is the key. the prosecutors would have to show gross deviation from what an average person would do. that is what i'm talking about with the chokehold. do you exercise a chokehold on someone for almost 15 minutes with that person had not physically harmed anybody? and how is that person posing a risk of imminent harm to penny if he is laying on the ground? you have heard that adage, you can't bring a gun to a fist fight. and here, i mean, based on what i'm saying, i mean, the chokehold initially to bring him down but to keep the chokehold going for 15 minutes, i think, is a little severe. >> trace: former nypd lieutenant said the following. jordan neely was a person that should have either been incarcerated or placed in mental health facility. he should not have been on that subway car. as a result, we had mr. penny that i feel took appropriate action and attempted to restrain him because he put those people on that train in fear of harm. i got about 15 seconds. what would you say?

have come into the 80% support. >> reporter: 850 school districts nationwide have dropped the fifth day of classroom learning. chris freyler explains they made the switch after losing out on major funding. >> we made the decision to move to a four-day week around retraining and training quality adults to work with our kids. the adults that they are working with in the schools. >> reporter: a recent study looked at six days and found a huge learning loss that "unambiguously hurts student achievement overtime." the former education secretary said recently u.s. students are already hurting. >> the fact that 87 out of 100 students are not considered proficient or don't have a fundamental knowledge of u.s. history is just inexcusable. we spent $750 billion a year on our k-12 education. we are not getting what we are

spending. >> reporter: 40 weeks are popular in the rural west but it is picking up in metro areas, texas and arizona. gillian turner, fox news. >> trace: let's talk about this recent embrace of lower education standards with the coworker of the new book, senior fellow corey deangelis. it is always great to have you on. a look at the whole landscape here, four-day school weeks. getting rid of homework. getting rid of letter grades. it seems like part of the country have just kind of given up on education because they can't find it. >> i mean, look, it seems like the job, the government school system has become more of a jobs program for adults as opposed to an education initiative for kids. they are going from five days to four kids. does that mean they're going to give 20% of the funding back to the parents? they are missing out on one of those days now. 3,000 per student, give it back to the parents and let them find

alternatives. the problem is the school system wants to keep all of that money and provide less time in the classroom, less learning for students. and look, the school system has overplayed its hand here. you would think they would have learned something over the past couple of years. but they have not, which is good news for school choice victories. we are seeing the government school monopoly dominoes fall because parents are clamoring for educational opportunities. >> trace: texas governor derek greg abbott is threatening to veto quoting the latest house version of school choice which came out this week and only applies to about 800,000 students and also provides less funding for special education students in the original house version of the senate bill and denies school choice to low income families that may desperately need expanded education options for their children. is he right, corey? >> yeah, governor abbott is a true education freedom fighter and he is not going to allow

fake republicans in the texas house to send him a bill that is totally watered down and that would just be a huge slap in the face to parents. i mean, the senate passed a bill that was just about all parents eligible over 5 million students would be eligible. they watered it down to 800,000 and average also threatened to call special sessions over this. he is serious. dan patrick is serious as well and they are in lockstep on this to push further education freedom. texans will have school choice this year because of leadership from people like greg abbott and lieutenant governor dan patrick. >> trace: i'm wondering. i know you are for school ch choice. what would you include? what is in every school choice or school choice program need to have? >> yeah, just have eligible. don't pick winners and losers. allow all families regardless of income, regardless of background to be able to take their children's education dollars to

[applause] >> trace: what do you think about that? >> i think a couple of things. just the claim on its face that white supremacy is the most dangerous terrorist threat to american society. you know, there's a point there insofar as there's data to show that over the course of a number of years, hundreds of homicides committed by white supremacists, by neo-nazis, it is a real problem, but it is dwarfed by the gang violence, violence in streets and neighborhoods across

america, inner-city communities and so forth. it is a part of a larger narrative that president biden is putting forward saying that he is against an ascended white supremacy in society perhaps embodied by maga republicans are present from or what have you and the difficulty i have is that i think it paints a picture of where america is at in terms of its race relations. it is not actually borne out by reality. we are not a white supremacist sort of society. but what is truth is that we have this history behind us and it does impact american societies in ways that in our current day lead to a sort of, you kn know, income inequality d all sorts of different things that mitigate the opportunities of african-americans and others. those sorts of issues, poverty and class, is where i would like to see the president focused on. >> trace: you made a good point. "the wall street journal" says, you may have thought he was

addressing a graduating class in alabama. maybe the brave graduates of a black university in south africa in 1980 i mean, your group is about unifying. it doesn't look like that speech was intended as a unifying thing. >> party politics, it is not always about unity. that is the language that we are using. but again, president biden could talk about the real progress that has been made in terms of race relations in america while also pointing at the material deprivation that faced poor people, many of the disproportionately people of color and be honest about wanting to seven people to respond to those problems without re-characterizing everything to seem like we are still in 1960s jim crow. >> trace: i want to put this up on the screen. a good point you said, african-americans are disproportionately poor because of the past racism and bad policies. the problem is a lot of people argue is we still have those bad
