investigation never should have been launched in the first place. fox news team coverage, andy mccarthy is here in a moment on the fallout for the fbi. david spunt is live at the justice department. >> both the fbi and doj are acutely aware it does not paint either agency in a good light. fbi under the umbrella of doj, but some sources are quick to point out the report focuses on the fbi and doj from 2016 and 2017, and many years later, six years, seven years later and some chances, changes have been made, significant changes have been made since john durham released the 306 page report when he began the report. listen. >> if you are not disturbed by this, you hate trump too much. i don't care what your politics are. >> durham says we conclude the department of justice and fbi failed to uphold the fidelity to

the law in connection with certain events and activities in the report. overarching theme, sandra, durham says the fbi rushed an investigation, code named crossfire hurricane, without the proper legal basis. it's the term used to describe the alleged connections between the trump campaign and russia. durham took two cases to trial, lost them both. a former fbi attorney did plead guilty to a minor charge. and he, john durham and bill barr, the trump attorney general who appointed him were the ones with a political driven agenda, citing a report concluding the fbi investigation was justified, called the horowitz report. fbi says in a statement the conduct in 2016 and 2017 that special counsel durham examined was the current leadership i am implemented dozens of actions, and had it been in place in 2016

the missteps could have been pre prevented. durham, no longer special counsel, he's invited by jim jordan to appear before congress next week, i'm told the conversations are taking place behind the scenes and to stay tuned, sandra. >> sandra: we will for sure. thank you very much on that for us. john. >> john: bring in andy mccarthy, former u.s. assistant attorney and fox news contributor. depending which side of the political aisle you are on, you have a different opinion of what the durham report brings, if you are a republican you think it's a bombshell, if you are a democrat, you think it's a nothing burger. compare to the mueller report which you know, found no evidence of wrongdoing by president trump, yet the mainstream media covered that like there was no other story around. >> yeah, this is -- it's clearly more on the bombshell side of it, john.

i think there are parts of the story that we'll never actually get, my own view of it after watching closely from its inception is that there are aspects that our intelligence world aspects never see the light of day, not in the near term. it was the decision that was made obviously to focus on the fbi. i think a lot of this debate between, you know, what durham found and what the inspector general, michael horowitz found strikes me as like two ships passing in the night. what horowitz focused in on, the technical requirements are in the fbi practice manual in terms of when it's ok for them to open an investigation, and he purposely did not make a judgment about whether it was wise for them to open an investigation, only if it was technically ok, whereas durham did the thing which i think is important here, which is under

all the circumstances, including how disparate the treatment was, kid gloves the treatment was in terms of opening stuff on mrs. clinton, was it appropriate on the basis of the thin information they had to open an investigation, which it clearly wasn't given how much it interfered with american electoral politics. >> john: call four number one and read from the durham report, objective and honest assessment of the strands of information should have caused the fbi to question not only the predication, whether the fbi was manipulated for other purposes. basically saying the fbi should not have taken it in the first place. >> not sure i buy the fbi manipulated, to my mind, no one in america who didn't know that hillary clinton had plan to

smear donald trump as a basically putin's puppet. the fbi clearly knew that. whether they assessed that russian intelligence believed that is beside the point. my view, and supported in the report, the fbi believed hillary clinton was going to be the next president of the united states. if her theory was that trump was a putin puppet, they were going with putin puppet and looks like what they did along the way. >> john: critics of the durham report are saying how much money did he spend to find what he spent? here is how much money over the course of four years, it was maybe a little more than six and a half million dollars, and then mueller, on the other hand, call for number five, put it up, mueller spend $32 million over two years and found essentially no evidence of collusion between trump and russia. so i mean, if you are looking for value for your dollar here,

who has the edge? >> yeah, i also think if you are looking for tone, what i was struck by in reading durham's report, he's very respectful of the work mueller did and respectful of the work the inspector general, michael horowitz did, and what's impressive, it's not argumentative. he essentially allowed the witnesses and the documents to sing for themselves. >> john: andy, we'll see if it goes anywhere. but again, your opinion on what durham found really depends on where you sit as it does with so many things these days. andy, thanks so much. kim strassel made the point where aren't all the reporters angry at their sources for feeding them, lack of a better phrase, b.s. on all of this.

[bleep] [bleep] >> trans rights are human rights! >> sandra: house subcommittee holding a hearing on the violence committed by left wing protestors, former ncaa swimmer and women's rights activist riley gaines has said she's experienced the violence firsthand. she was forced to barricade herself in a room at san francisco state university last month after being ambushed by trans rights protestors. she'll be testifying on capitol hill today. she joins us here first. riley gaines, along with congressman dan bishop, welcome to you both, congressman, i'll ask you about the hearing about to happen on the capitol in a moment.

riley, to you first. what's the message you want to get out today? >> my message is the freedom of speech has to be upheld. it's crucial to a society that's functioning and civil and encourages this open discussion to allow for new perspectives, hate speech is simply not speech that you hate, it's not what hate speech is, but that's the direction we are going and of course, violence is not acceptable in any scenario, that's my message that needs to be sent. >> sandra: and congressman, i know a big point what you want to accomplish is looking into why there's been this failure to adequately prepare for and support local law enforcement organizations in the wake of this violence that in many cases perpetrated by left wing agitators. we put on the wall some examples of the far left violence that we have seen in recent years that has led you to dig deeper into this. what's your goal today? >> you know, riley's first emerged as a symbol of

excellence and integrity in women's sports, but then as the situation has developed she's become a national symbol for courage and refusing to be intimidated in the face of this pattern of left wing violence. now, there's been violence on both sides and all to be condemned but often we don't hear about or people deny or denigrate the notion that left wing violence has affected our civil discourse. riley shouldn't be subject to that, no one in america should be and our hearing will examine the tail and hear from witnesses like riley who have had this experience and know it's the no the right way for the country to go. >> sandra: back to early april when we got to see the video of what happened to you there at san fran state university. i know you said you are going to sue after what has happened there, and they are still saying these were peaceful protests. this is a san francisco state university statement on what happened to you in that picture as we very well see that

situation turning violent on you. the university says that event was deeply traumatic for many in our trans and lgbtq communities, and the speaker's message outraged many members of the s.f. state community. no word on what that meant for you and how that affected you? how did you respond when that was the statement they issued after you were attacked? >> my eyes were opened when this was the message that was sent. they applauded their students for doing this and you guys only saw a snippet, the videos, three hours of being yelled at, of being assaulted, of being called all kinds of names of these violent vengeful hateful things, and their eyes are filled with hit, vengeful and of course they appear soulless which is deeply traumatic and the moments and the hours i was barricaded in

the rooms and i was rushed and ambushed, i truly feared for my life and for the administration to release a statement applauding this behavior is chilling. it's really deeply troubling and that should be everyone regardless of party affiliation should agree on that. >> sandra: congressman, ongoing questions over how so many on the left can characterize such scenes as peaceful. rewind back to the media response to the george floyd protests. just watch some of what we heard then. >> so far this has been very peaceful. organizers told me they want to keep it that way. >> so far peaceful, the rally started off at a park and then to city hall, and they wanted to come up to the i-45 and stop traffic. >> we saw the protests peaceful by day, the pattern that we have been seeing, then the looting beginning. >> sandra: and we know exactly what was happening then, congressman. and back to riley gaines' point, on her situation, she was

barricading herself behind closed doors, had to go into hiding for three hours. they weren't even peaceful in an alternative universe, why is this insistence on the left when things are violent that they are not? >> look, that sort of institutional response is contemptable, everyone should condemn it, it reminds me of what happened at stanford law school when judge kyle duncan attempted to speak there, and an administrator takes the podium and condemned him, not the people, and she was barricaded in a room and it's brazen administrators would respond that way, and of course as you said, they have been backed up in many cases by state-aligned media. that has to change, it's going to require brave, courageous spokesmen like riley gaines and our hearing will get into it today. >> sandra: riley, i have to

leave it there, but real quickly, we'll be watching you in a few moments and listening to your witness testimony. have you ever regretted this journey that you've gone on? i know you said you could be at dentist school, gone on with your career, but i know you said your eyes were opened after this incident at san fran university. any regrets taking this on? >> we were just talking off air about this exact scenario. this is never something i could have foresaw for myself, never something i wanted but i realized it's something i'm passionate about and i will fight 'til the end until every girl and woman is protected in sports and outside of sports, the erasing of women i'm realizing the bigger picture and it's unacceptable and i'm willing to fight for it. >> sandra: well, we have seen you lately on social media calling out so many of those very famous female athletes and putting them on the spot to take a side on this issue. we appreciate you joining us, thank you. thanks to both of you. we'll be watching that hearing happening on capitol hill a short time from now. really, really interesting

stuff. i was able to catch up with riley gaines in person a short time ago at the white house correspondence dinner, she's so passionate about this and taken this on and she's out there. and the question at the end whether or not she has any regrets, she's putting herself out there and expose herself to a lot of criticism along the way. >> john: yeah, i caught up with her as well, she was a guest of fox at the dinner. and it was terrific to talk to her. she is, as she said, very passionate about this. but what's extraordinary to me is the way that our institutions of higher education have devolved to the point where people take extreme offense and are backed up by the administration because somebody is expressing a point of view based on their own experience and this is a point of view that for riley gaines says look, it's my opinion having biological males who are almost a foot taller than i and outweigh me by 50 or 60 pounds are allowed to

compete against me in the same category, it's just not fair. and, she also tells the story of when she tied lia thomas at some ncaa competition, that the officials said well, we have to give -- only one trophy, even though the two of you tied, but we want to give it to lia thomas, we want the picture of lia holding the award and not you. i mean, how is that possibly fair? >> sandra: i'll never forget her saying, there was a moment she realized that waking up at 5:00 a.m. every day and practicing 'til she went to sleep at night, there was no amount of practice that she could put in that could put her in position to beat a biological man. >> john: certainly not a biological male like lia thomas. he has quite a physique, no question about that. moving on to the next topic, president biden says his administration is handling the end of title 42 better than anyone expected. but is there a more worrisome

>> sandra, they have. a source tells me that yesterday just under 4,000 illegal crossings. that continues a really big steep drop that we saw from the record highs of last week when there were more than 10,000 a day. now, with that being said, about 4,000 in a day is very significant and we want to show you some new video we have gotten. take a look at the contacts from eagle pass, a large group of migrants travelling on to their private property as a border patrol airboat is in the river. a soldier opens up the gate to let the migrants in. they say that was not a texas soldier. they say that was a soldier from the missouri national guard working under the federal government as part of title 10. texas says it was not their soldier who opens that gate. also want to show you these images out of arizona. ajo, arizona, border patrol

avella. we have migrants staying in public schools in new york city that are in use by students, veterans kicked out of hotel rooms north of new york city because illegal migrants are there to be housed, people are losing rooms for their wedding reservation in the same town. juan, this is having an effect far and wide across our country. >> i don't think there's any question about it, and these situations are anecdotal, john. but i think that they are evidence of the larger impact. it has an impact on our schools, an impact on our healthcare system. these are new people. also some people, i know businesses might argue they can use the workers, but i think that all of us in some ways are being impacted by the crisis at the border. >> john: we have some video of a protest in brooklyn in sunset park being housed in schools, and reading a few articles, that parents of students at p.s. 188 in brooklyn are concerned about

dropping their kids off there. the gym that the migrants, david, are going to be housed in is detached from the school, not a part of the building, but still on the property. a total of seven schools in new york city are housing migrants, and given concerns about school safety, why would the city do this? >> trying to protect their citizens and unintended consequence for the biden administration may be is that he gets a primary challenge out of this. if you are eric adams or one of these big city mayors and you are dealing with the policies of the biden administration, eventually you say i've had enough and you are hearing this out of eric adams, not that he per se is getting ready to challenge biden in the primary but had enough of biden not dealing with the border. some democratic mayor may say they have enough. for goodness sakes, you've got williamson and robert f. kennedy, jr. getting 30% of the primary right now. joe biden's policies only invite some democrat take him on in the

other over the migrant problem and biden is sitting there and watching people come across the border and not doing anything to actually close the border. >> i disagree. it's a national problem. wait a second, we have seen a decrease, not a surge over the last few days, widely predicted. >> john: but a lot of people coming across. >> they are taking steps about having people processed outside of the united states, and it may be having some impact. we can't predict what is to come, john, but you have to say yes, the surge has not happened. the second thing to say -- >> john: however, if i can interject, 60,000 people came across the week prior to title 42 off, 6,000 released to the united states on thursday. >> we all predicted, i think at this very table there was going to be a massive surge after title 42, you know, ended. it hasn't happened yet and i think there is -- you have to give some credit to administration policies. the thing about this is we do have a crisis at the border and we have a broken border.

the biden white house said they would be bailed out by a discharge petition. i've talked about house republican leadership aids saying that's not going to happen. and joe biden has had 100 days to negotiate on this, he waited 97 days before he reached out to speak to mccarthy, and the secretary is saying it could default in june while he's overseas. house republicans have a plan passed congress to even, the house at least, to raise the debt limit in a reasonable and responsible way. senate democrat haves come up with nothing, and these are all things the democrats have supported in the past. tightening worker restrictions, those type of things, that they have supported, including joe biden. >> sandra: speaking of which, chad pergram just had this exchange with speaker mccarthy a few moments ago. >> what about the provision here where some of your members have

said hey, we ought to have more time than june 1st, we might have more time -- >> who says that? no, whatever janet yellen says is the date. i'm not going to argue about that. >> sandra: no, whatever janet yellen says is the date, i'm not going to argue about that. a couple of dates, the treasury was saying it was going to happen in august but here we are, sooner than predicted. >> whatever is coming out of janet yellen's mouth is coordinated with the white house, she works for joe biden, she doesn't work for the american people, period. the democrats got caught flatfooted, starting with joe biden, our commander in chaos, because they all along demanded a clean debt ceiling hike, thought they would divide kevin mccarthy and mitch mcconnell and mitch mcconnell would ride to the rescue like he did back in 2011, punchbowl news has reported this, among others. that didn't happen. mccarthy managed to push this through with a 2017, 2015 debt

ceiling increase out of the house and then mitch mcconnell signed on to that letter that was written by senator mike lee and others, i think there were 44 republican senators that all signed on to it backing the republican bill that came out of the house. very few republican senators who did not sign on to it, notably mitt romney did not, so they locked arms and said essentially all in this together, filibuster proof and now it's all at the feet of the democrats, and i'll note that from karine jean-pierre, all she can do is just try to lay at the feet of republicans blamed for the recession that's coming, the recession that's coming that is caused by the reckless spending out of the democrats and the interest rate increases from the federal reserve to fight that

inflation. >> sandra: are they laying the ground work fo blame republicans for the mess caused by the economic policies under this administration, it's a fair question to ask. you mentioned janet yellen, here she is on the warning if they don't cut a deal. listen. >> in my assessment, and that of the economists across the board, a u.s. default would generate an economic and financial catastrophe. if congress does not address the debt limit, there are no good options the treasury or the government can use to save us from catastrophe. >> sandra: ok, so it's urgent. why did the president wait so long to meet on this? >> i think what dagen pointed out is right. they thought they would divide republicans. house republicans are the only ones that have a plan that is passed and now gone over to the senate. if they would take it up, they won't. chuck schumer has put up no plan, joe biden has no plan, and again, the debt ceiling negotiations, 13 times since

it was pushed back about 15 minutes. so we'll be listening for reaction from here. meantime, fox obtaining the irs whistleblower letter accusing the department of justice of retaliation in the hunter biden probe. ok, so obtained the letter sent by lawyers representing the irs whistleblower, sent to the house and senate judiciary committees, ok. retaliation that, is illegal, that is a big deal. what is your big deal to that? >> latest politization of the biden administration whether they are political opponents, trying to protect hunter biden. james comer has had a number of interesting investigative pieces that have shown the connections the bidens have had to the chinese government, this is the latest retaliation, it's very concerning and chilling here and i would hope that senate democrats, house democrats would also condemn this type of action. >> sandra: dagen. >> there needs to be a separate counsel, a special counsel overseeing the hunter biden

penalties for crimes. what are we learning from her on capitol hill today? >> that's exactly the point, john, good afternoon. we are learning mayor bowser is among the most angered at what's happening in the city and she laid that out right at the get-go in her opening statement. take a listen here. >> we see more illegal guns on our streets and more repeat violent offenders using them. those guns are being used in violent crimes like homicides and carjackings. and we have also seen an increase in car theft. for me, these trends are unacceptable. >> and bowser also announced legislative reform she's introducing to the city council, including support for the police force and enhanced penalties for violent crimes which are on the rise. take a look at the numbers. overall violent crime up 13% this year, robberies 18%, motor vehicle theft, 113%. and with 80 homicides so far this year, homicides are up 7%.
