communication, also vague communication. they don't know how long this is going to last. the mayor's office says it is a short term solution but there's no end date now, which means pretty much all the extracurricular activities are influx, so they want answers from the mayor's office. send it back to you. >> they deserve them. nate foy, great reporting. that will do it for us. here comes "the five"." >> jeanine: hello, everyone. i'm jeanine peer oh with jesse watters and dana perino and greg gutfield and jessica tarlov. this is "the five." the media melting down after the durham report exposed that the fbi and doj had no jugstive indication to launch the
2:01 pm
russian probe. they said his campaign was colluding with moscow. you would think they would turn in their pulitzer prizes and apologize to the american people. nope. not a chance. >> the former president predicted that durham's probe would uncover, quote, the crime of the century. doesn't look like it actually did that. >> the whole thing is predicated on a rabbit hole conspiracy. >> the conspiracy theory is walking through the fevered swamps of trumpism we well, probably a career ending career reputational damage. >> a whole lot of nothing. >> four years, i don't know how many millions of dollars, how many of his friends he hired in his office to do what? the issue of basically the report. >> durham's report also
2:02 pm
finding the fbi gave markedly different treatment to the clinton and trump campaigns and ignored hillary's plan to tie trump to putin order to distract from her email scandal. the special counsel uncovering that both barack obama and joe biden knew about hillary's dirty deeds. they got briefed on her shady scheme to link trump to russia, but still pushed the collusion hoax anyway. shameful. so now the crooked investigators are running for cover. >> what you have with john durham is look, it is a big fat nothing. >> this is a predictable, sadde ending to an investigation that never should have taken place. >> i disagree with mr. durham's characterizations of what we did in the report and it is very simple. he betrays a deep misunderstanding of not only what we knew at the time but how we make these
2:03 pm
decisions. >> jeanine: okay. so jesse, start with you. so hillary clinton puts together the deal, pays for the dossier. the dossier, she is getting fined, she uses it as a legal expense instead of a campaign contribution. she started this whole thing. and barack obama, joe biden knew about it, and the media on the left is saying that this is all a conspiracy, and it is a waste of money. >> jesse: no wonder you didn't put anybody in prison, you would have to put the entire democratic party in prison for this. i didn't expect prison. i look at this thing and look at who durham didn't interview. he didn't interview mccain, comey, glen simpson, mark elias, peter struck. if you are doing an
2:04 pm
investigation and not subpoena the fbi director, it is a joke. do you realize the fbi lied to the media and then the media reported the fbi lies. then the fbi guys get fired. then they get hired by the media to tell more lies and then the media is just happy no one went to prison for lying. do you actually think any of the people in the montages red that durham report? it doesn't look like they read it at all. i saw the kyron this morning, durham says the fbi treated trump and hillary differently. really? hillary bleached her server and smashed blackberries with hammers, and they tried to put trump in prison for obstruction. think about that. at the end of the day, you have joe biden and hillary clinton coming back from europe, china and the middle east with boat loads full of cash and trump is the bad guy. now, the republicans are out there saying that oh,
2:05 pm
we get in there, we need to get rid of the fbi. that's never going to happen. what they need to do is this. they need to appoint a loyalist as fbi director, the way that jfk appointed his brother to run the justice department. you need a loyalist or some guy you have so much dirt on that he wouldn't try anything. >> the amazing part of it is that there will be no indictments. this is the end of it. they can say look, we tried, there were acquittals, got one low level guy who was a lawyer who pled guilty to altering a document and is practicing law. can american people even have faith in the justice system and the democrats talk about threat to democracy, is the deep state the biggest threat to democracy? >> dana: i might oh jason chavitz an apology for his book, the title i thought
2:06 pm
was overdramatic. you look at this, what's strange to me, strikes me most, all of trump's enemies, alvin bragg, hillary clinton, everything they do is an overreach and it just makes him stronger. now, they had to go through a hell of a lot. you also think about the younger people, the staff or not even necessarily younger, but people that were just kind of on the periphery that had to get lawyers, be subjected to terrible years when they would love to have been serving the country and focused on that, to have to go through that. and the clinton administration, a lot of those went through that because of what clinton did with lewinsky and on and on. you wonder who will want to serve. like pacman. he goes along, eats more fruit, gets stronger. every time they go after the president, he ends up being stronger because he is like i told you so, i
2:07 pm
told you it was a russia hoax. i would love to see any reporter that had one of these sources, whether adam schiff, maybe not even that high level, someone they could have on the program and say you told me this, this, and this. that all turns out not to be true. explain yourself. that would be great television, good journalism. the other thing is that the report has shifted burden of proof to the fbi, so to your question, can people trust it. is there a different set of rules for people if you are part of the establishment or the government or on the democratic side because not only do you have this situation with the russia hoax, you have the hunter biden investigation going on so long and the security apparatus that tried to bury the laptop and succeeded along with the media, now reports that the irs is reassigning the whistle-blower on the hunter biden thing. you have to wonder if there are two systems. >> what is the realistic
2:08 pm
solution going forward? the american people have lost faith in the criminal justice system. i find it fascinating that the left was saying all this money for the durham report. what about all the money for the mueller report where they hired all their friends and came up with nothing but tried to make it sound like something that we now know from the inspector general and durham was really nothing. >> i think the biggest significance of this is that it is an official acknowledgment after years of probing that donald trump did not collude with russia. there was never any collusion. that's the bottom line. we can't lose sight of that in all of the noise about politics. there was never a golden shar oh with the hooker, the steele dossier was bought and paid for by democrats. and the overarching of it all, not only did it erode faith in government, it was a profound, pointed attack at donald trump and
2:09 pm
almost got him. he was rattled in the early days. this sabotage, early days of his presidency, and william barr coming on as attorney general i think saved the trump presidency, but this was a real vicious, all out, very effective attack on the newly elected president and it almost succeeded. >> jeanine: you think william barr is the hero? >> i do, most honest man in washington. >> jeanine: there's no one could withstand what donald trump did, i don't know that he was rattled. he withstood more than anyone could. wrap it up. >> the american people have been catfished. we had a picture of a beautiful model, supposedly russian interference, turns out it was not. it was a short person that made a lot of money making up lies. that's the bottom line. we can't fix it. all the people that did it have jobs and have the ability to make sure they don't get in trouble and are in the right administration. what the american people have to do, we have to
2:10 pm
remember this come vote time. you need to remember there was a quiet coup on the last administration over two years and they all made millions of dollars. they'll be fine, they have the money, but we can't rely on someone in government to fix our problems. the only ones can fix our problems is us, the american people. vote them out. that's the only way you get rightness back in what was a coup. and that's the most horrible disgusting, but the only evidence that matters is the american people need to vote the right way next time i want to say one other thing, you know they say it is worse than watergate? this truly is worse than watergate. they found something that is. >> pacman eats power pellets, fruit for points. >> jeanine: and coming up, comedy legend dave chappelle telling it like it is, ripping into the liberals in san francisco.

2:13 pm
okay. >> tyrus: and then.
2:14 pm
2:15 pm
chaos has the power to shock anyone that comes to town. dave chappelle gave a surprise performance and taking aim. what the [bleep] happened to this place, before comparing to a zombie movie, telling residents they need batman. they are struggling to deal with 38,000 people living on the streets. the city has a major problem with retail theft.
2:16 pm
the san francisco d.a. will not charge the walgreen security guard accused of shooting a shoplifter saying the guard believed he was in mortal danger and acted in self defense which is pretty refreshing. talk about dave chappelle. tyrus, he picks his moments. he doesn't weigh in on every topic, not always out there, but when he wants to make impact he can in this situation. >> tyrus: that's how you do it. if you have a talking point on everything, nobody listens. i grew up in california. there's this sentiment you can't speak ill of your home state when it is going through problems or whatever. i don't believe in that. i think it should come from californians to talk about the fact that san francisco is now basically a shelf l of what it used to be. can't have a business there, take your family there. what has to happen with this amnesty city, it will be zombie world.
2:17 pm
there will be no businesses. next two years, there will be no small business in san francisco. and as it continues to move into the gated communities and first worlders and the woke and they can't get to their season ticket games because the parking lot is full of tents, when that happens, everyone starts moving. you see sports franchises leave the city of san francisco, maybe then they'll pay attention. it will basically look like mars. the city is dying. and it is not just san francisco. >> dana: geraldo, he lives in your neck of the woods, went to san francisco to do this. what is it about dave chappelle saying something like this in san francisco that might make a difference whereas if we talk about it, no one in san francisco may care. >> geraldo: we were speaking about it before. he has kind of a teflon that's extraordinary. he and bill maher can say what is really on their mind without fear of being woked, without fear of
2:18 pm
being cancelled. i think it is enormously refreshing. he made one statement about the tenderloin, which was the racy red light district, but it was more than that, color. he said the whole city is now tenderloin in terms of there's no more rules based society any more. it is like anything goes. and it is really so sad. i had dinner last night with some lawyers and journalists, talking about new york. because i am a commuter, now maybe i only see the good, i say how is the city doing? and they, to a person, they said it is now deteriorated. and that's other things that have happened, bail reform, bail reform, it is just that theguys seem to be losing. you have to dig in, need i hope that eric adams is
2:19 pm
the guy. >> dana: talk about san francisco, the d.a. there was brought in after the d.a. was recalled. and she's got her hands full, trying to do the right thing? >> jeanine: i was impressed. she made a decision in the case where a walgreen security guard ended up shooting and killing a shoplifter. she made the decision that she believed that the security guard felt he was in mortal danger because the shoplifter had a knife and was threatening to kill him, was moving toward him with the knife. so the murder was dropped. she said look, there's no way we could disprove that he had to defend himself. which is one of the theories when you have to proffer a defense, so you've got a good d.a. in place, that's the good news. but the truth is that san francisco is the second most hard hit metropolitan area in terms of threats
2:20 pm
in the nation, okay? and the fact it has gotten to that level is the reason it is in this decline. and by the way, nationally we've lost $100 billion to retail theft by these organized criminal groups. and 30% of the homeless live in california. it is like all set up for this. then when you get some municipalities say look, we're going to send out cops to clean up encampments and the judge ends up banning police from enforcing quality of life crimes against the homeless people saying we're not going to let you arrest those people because they're homeless, now you can't arrest people because they're criminals, can't arrest them because they're homeless, then if you have a business that's still a business like a restaurant, dave chappelle was saying he was eating at a restaurant, someone was defecating literally outside the window. so this is a recipe for destruction of one of the
2:21 pm
most beautiful cities in the country. >> dana: jesse, i was thinking with san francisco, one thing it may not ignore is celebrity criticism. they can take everything else, when the celebrities come for them, they might react. >> jesse: they're like the charlie sheen of cities. remember charlie a few years back he went wild and needed a makeover? sometimes you need to take two years off, fire your manager, go to rehab, maybe get the paparazzi to take a picture of you with your children. that's what san francisco needs. they needs to get out of the headlines. every headline you see, flesh eating virus, homeless gets hammered in the head. they need to chill. this experiment with social justice has blown up in their face, has gone too far, too fast, it is starting to kill people and it is killing the city of san francisco. when you have a community that talented ridicule you, ridicule is powerful.
2:22 pm
jon stewart, late night people know it. more powerful than explaining, why explain when you can ridicule. especially if it comes from the left. san francisco doesn't listen to "the five," they listen to dave chappelle. when he is mocking them, that might make them wake up. i don't think he had indian food in the tend tenderloin. there's no good restaurants there. >> dana: do you want to fact check it. furious liberals are second guessing welcoming in thousands of migrants.

2:27 pm
to welcome everybody in. new york city mayor adams was overrun by hundreds of illegal migrants, is now going to court to ask the judge to revisit the law and policy. governor hochul is complaining how out of control it all is. >> they're bursting at the seams, mayor adams is doing the best he can in a difficult situation. if you see people living in tents not just on the border but in the streets of new york, across new york state because we've reached a breaking point. >> jesse: hochul wines about bursting at the seams, they're kicking out homeless vets from hotels to make room for migrants. parents in ritzy new york city neighborhoods are furious over the move to house them in public school gyms. >> i don't feel safe having adults with no health screenings and criminal background checks. this is unfair.
2:28 pm
>> we have parents sleeping overnight in defense of keeping their gym away and not used as a shelter for incoming asylum seekers. >> mayor adams, come see for yourself. i don't think you would put your own child in here, would you? >> jesse: is this the breaking point? >> jeanine: i think it is a breaking point. and the amazing part is this is new york city. how many people live here. 8 million people? we have one of the biggest budgets for a city in the country and we have 61,000 immigrants, illegals, mayor adams is moaning on moaning about the fact that he can't afford it. if you can't afford it, mayor adams, what about the five million that came through and destroyed the southern border and ranches, how dare consider putting people unvetted, you don't know who they are or what their real
2:29 pm
names are, they are just being released in mass into the public and you want them near our kids? are you kidding me? how far is the gym from the school? i tell you what, it is about time new york city and the liberal democrats experience what the rest of the country has been experiencing. we're not just bringing the border to the north now, we're bringing the border into our schools. we are throwing out veterans, throwing out people with wedding plans, throwing kids out of school. it is like what we did with baby formula. we have baby formula on pallets, but for american citizens, you're not at the border illegally, you have an empty shelf. makeup your own formula. if the kid ends up in the hospital, that's on you. i am sick of this. they're hypocrites. now he doesn't want to be a sanctuary city, did you not know what you said when you said we should
2:30 pm
protect our immigrants, new york city will remain a sanctuary city. english is your first language. you should know what this means. >> geraldo: i just ask people to be -- first of all, there's no sense putting migrant adults, single adult males in gyms attached to schools when you have javits center, the convention center that would be a big covid place, there's no reason. it is almost like you want to irritate and. >> jeanine: endanger children. >> geraldo: not so much endanger, proply debate the fear factor. i want this one thing. well over a million undocumented immigrants in the city, well over a million. 61,000 is the latest. well over a million. every bicycle messenger, delivery boy, baby-sitter, lawn mower, over a
2:31 pm
million. you seldom hear about them in connection with notorious crimes. they are younger than our homeless. they are stronger, more ambitious. they walked through the jungle to get here. i think that things will be fine. it is an emergency right now. the mayor is right to be concerned about the sanctuary city designation. it is being stuck up by various critics, it is unfortunate. but this too shall pass. i promise. this too shall pass. >> jesse: you have been saying that two years, it is temporary, they haven't if i figured it out. i don't care how hard working they are. there's no room left. dana? >> dana: there's a moment, imagine the communications team at the white house taking their ipad and saying mr. president, may we have five minutes, show him actual coverage of things that are happening and understand why mayor adams is saying these
2:32 pm
things. they're so mad at mayor adams because he was mildly critical, asking for help that they booted him off the campaign. this is now also you will see it in colorado, in chicago, you're seeing it in d.c., and philadelphia. pretty soon, i imagine even san francisco will say uncle. we need help. >> dana: there are so many crises brewing. this one they ignore at their peril. this is how you get a historic disapproval rating. this is not how to go into re-election against the republican party, regardless who it is, that will be energized, may pick up some of those independent voters who thought i would never vote for a republican, maybe this time they will change their mind. >> jesse: do you think it can change the political dynamic? >> tyrus: yeah, especially when it is in your front yard. nothing puts a smirk on my face like first worlders
2:33 pm
and unaffected moaning and moaning, can't use the other word, i know what you mean, moaning they're effected by it now. that's why my kids are home schooled. there will be no grown ass men in the gymnasium. i want to point out, cruise ships, there's a ton of them available. i think there's a bunch sailing to honduras. put them on there, sail them out there while we figure out a way to put them in, i don't know, the hamptons, beautiful in the summertime, bring them into the hamptons. put them in places where the uneffected are effected and we'll probably see this cleared up really quick. but cruise ships. sailing out until we figure out a good place for them to be. >> jesse: carnival cruise ships. >> dana: wonder what the carnival pr person would say. >> tyrus: sands is beautiful this time of year. >> jesse: the crews ships

vocal about that. we want to work with the government to prevent that from happening. >> geraldo: putting the guy behind him to sleep. what do you think? i asked my 17-year-old what she thinks of this. she said dad, you can't even open your apple tv. you should be more worried about twitter. do you harness it, go with it, drink it, control it. >> jeanine: people are doing it now, harnessing it, using it. we talked about it during the break, but the problem is that it initially was sold as something that could take whatever is available and summarize it. now -- or create something based on what's available. now we are reading that researchers are seeing signs that ai can use human reasoning that it was not programmed with. and if it can engage in human reasoning, then we are in trouble. that's why they wouldn't be doing this if they

weren't worried about some dereliction, not just in terms of criminal responsibility of someone taking your identity or stealing your voice and all of that, they're worried about something bigger than that, bigger than plagiarism. and the biggest fear of it going wrong, you think about the world players, everyone that's got this, has it available, how can we conquer china, how can they conquer us, scary. >> geraldo: tom hanks fears that his work will live on past the grave. here's tom. >> i could get together and pitch a series of seven movies that would star me in them in which i would be 32 years old. from now until kingdom come. i could be hit by a bus tomorrow and that's it, but my performances can go on and on and on and on

and on. >> geraldo: jesse, could be was tbeyond the grave. >> jesse: 100 years from now i will be sitting here, making the same stupid argument, same bad analogies, glancing sideways at whoever is sitting there. i don't care about this at all. not worried about it. said that about covid. human beings, men, are interested in sex, power, resources. you can't have a machine be interested in those three things. our motivations are completely different. ai is not interested in having sex. there is no status when it comes to robots. and resources, what resources are they going to use? they don't need water, they don't need food. it is a totally different phenomenon. again, you'll see me forever, whether you like it or not, i have a 100 year deal now at fox.
2:42 pm
>> geraldo: but it is inevitable. >> dana: i don't know, made me feel better about things. i am fairly tech no optimist, also a realist. i think the job loss that is to come will be real, it is like taking the industrial revolution and all the decades it took to get to the end of that, we are in the fourth revolution, you're going to see it shrink. there's a lot of disruption. but with disruption comes competition and innovation. i am excited about things that could come. i also don't think that washington, d.c. is going to be able to actually create a new law that will deal with this. i think they should take a look at laws already on the books if they think there are things they can and should do now, they should do that. by the time this congress gets around to regulating ai, we will be onto the fifth industrial revolution. >> jesse: kamala harris was the czar. >> tyrus: listen,
