things i can blame on my dog when i get home. >> thanks. >> that's it. >> thanks, actually. thanks to my guests and our studio audience. fox news @ night with trace gallagher is next. i'm tyrus o behalf of greg gutfield, tom, gene and the wh--jean and the whole staff, we love you, america. >> trace: good evening, welcome to fox news @ night, i'm trace gallagher in los angeles. breaking news into the investigation into hunter biden's taxes. fox news obtained a letter from attorneys from an irs whistle-blower accusing the government of retaliation by removing the whistle-blower and his entire team from the hunter biden probe. the chief correspondent jonathan hunt is live with the breaking information on this. jonathan, good evening. >> reporter: good evening to you, trace. much of the back story on this is still unclear, precisely because this is a whistle-blower

case, but what we know is this, the irs whistle-blower's lawyers have written to members of congress saying that the whistle-blower and his entire team have been "removed from the ongoing and sensitive investigation of the high-profile controversial subject about which our client sought to make whistle-blower disclosures to congress." the whistle-blower previously alleged political interference in the investigation of that high-profile, controversial subject who fox has been told is hunter biden. as for the whistle-blower's removal from the investigation, his legal team says its client, "was informed the change was at the request of the department of justice." the move was condemned as retaliatory action by house speaker kevin mccarthy who said by a twitter that republicans on the house, weighs and means committee, "will expose any possible cover-up at the irs and

republicans will protect the whistle-blowers who shine a light on government misconduct." congressman richard neal, the top democrat on the weighs and means committee said "weighs and means democrats will take whistle-blowers and their protections seriously. more detail is needed here and we call on irs commissioner to provide the necessary context before making any further judgment." now, hunter biden, of course, remains under investigation for alleged tax crimes. he has denied any wrongdoing. president biden has repeatedly said he believes his son has done nothing wrong and that he is, "proud of him." trace? >> trace: still a lot to get to, jonathan. thank you. for more perspective, listen to one of our fox news contributors had to say tonight versus what the commissioner of the irs told a congressional committee last month. watch. >> i think this is worse than retaliation against a whistle-blower. this is obstruction of justice.

this is the department of justice intervening in a very sensitive case. >> can you commit there'll be no retaliation against that whistle-blower? >> i can say without any hesitation that there will be no retaliation for anyone making an allegation or a call to a whistle-blower hotline. >> trace: lessee marshal and jason chaifetz joins me now. the attorneys for the whistle-blower acknowledge that the whistle-blower and his team have been removed from the investigation under hunter biden but tom divine who represented thousands of whistle-blowers said this violates the whistle-blower protection act saying that it resulted in change of doubt cities and working conditions to remove you from a case and if it's because you're whistle belowing, that would make it a violation of the

law. as you look at this, jason, does it appear to be obstruction or some form of obstruction to you? >> well t could potentially be both. it appears as if these people were spending a lot of time, if not years investigating this case. to have them all removed from the case is highly suspicious. it does seem to come in proximity to the whistle-blower complaint. it could be an obstruction of justice. it's also highly unusual that the department of justice would make the claim or make the request of the irs to remove the agents. usually, that's the purview of the irs, not the department of justice, so highly suspicious. we know that there's an investigation because hunter biden has paid $1 million and admitted there's an investigation. so why are the agents suddenly taken off the case? >> trace: yep! that's a very good point. i want to just play this for leslie because here's what the democrats said about whistle-blower protection back in 2019. watch.

>> used to be a bipartisan commitment we protect whistle-blowers because we want them to come forward with the truth of the conduct of our elected officials. >> whistle-blowers play an important role in our government and -- in revealing wrongdoing that they see. it's an important part of writing bills to protect whistle-blowers. >> 2019, whistle-blowers are really important. certainly they're not for democrats. >> i'm a democrat. i think whistle-blowers are important. i haven't heard anyone from my department say otherwise it may be necessary to preserve objectivity of the investigation and the alleged witness, so sometimes you're actually further protecting the whistle-blower or people on that team. you know, look, you want this investigation, whether it's hunter biden or not -- and i know the gop loves to hate on hunter biden -- who regardless of who it is, you want the investigation to be pure. you want the investigation to be seamless, and i think some people could say it could be a

conflict of interest when somebody, you know, puts this information forth and then they're part of the investigation? to me, that is problematic and to me, that wouldn't be a clean investigation. >> trace: but the doj should come out and explain exactly what is happening to the whistle-blower and find out what the status is. so far, that's not happened. i want to move on. here is bill barr talking about the big lie when it comes to this john durham report. listen to this. >> let's not forget what the lie was. the lie was russiagate. the lie was russian collusion. there was nothing to support it. these people were implicated in spreading that lie and benefiting from it personally and hurting the country with their conspiracy mongering. >> trace: you're talking about adam schiff and john brennan. "new york times," cnbc and cnn are out there trying to explain this whole thing away, jason. it was just laughable today when

you saw this all day. >> you have the durham report and the muller report and the general inspector issuing more than 1,000 pages. there are major systemic problems from the investigation. i don't buy they made the changes. they went after donald trump and went after what they wanted, a media narrative. they went after the guy for years and impressed the election. i believe someone should have been prosecuted but nevertheless they lost to those prosecutions but the one person for forgery didn't even lose his bar assignment. he's still a practicing attorney. it's really quite a -- i think what really gets me, trace, is there's no consequence. if this isn't breaking the law, then what is? >> trace: leslie, last word. >> we have a prosecutor not prosecuting. i can understand why republicans

would be upset because they're waiting for this big moment and for this big reveal. what do we see? it's a lot of the same information we got from the former report when we had the department of justice have their independent investigation. we're not really finding, you know, much that is new, and, again, a prosecutor not prosecuting, you don't have arrests, you don't have indictments, you don't have handcuffs and so there are a lot of people saying this was a lot of wasted time and money. >> trace: i think what they found out is the fbi had no basis for the investigation at all. zero basis for this investigation and yet they went forward with the investigation and that's the big problem. thank you, both, jason and leslie. in the meantime, there appears to be optimism tonight concerning a deal on the debt ceiling. it comes following a white house meeting between the president and top congressional leaders. kevin corke is live in the nation's capital with more on that. good evening. >> reporter: evening, trace. the proverbial clock as you know is ticking in washington. politicos in both ends of pennsylvania avenue are obviously eager to make a deal,

however, the negotiations continue against a backdrop of pending doom, at least if you believe the treasury secretary janet yellen. so just might when we run out of money to meet our obligations reaching the debt limit? janet yellen says the actual date could be a number of days or weeks later than these estimates. her office is still pointing at early june which is why president biden welcomed congressional leaders to the oval today, however, in typical biden fashion, he didn't answer questions leaving that for the leaders from both parties. >> it is possible to get a deal by the end of the week but we have a lot of work to do in a short amount of time. i wish we'd been able to be in this place 100 days ago. >> the idea of having a partisan bill we knew would get us nowhere. everyone freeload mitted that in the room. >> look, it was a good and productive meeting. everyone agreed default would be the worst outcome. >> reporter: little argument there. meanwhile, the president is also deploying two of his very top

advisers to sort of massage this negotiation over a possible debt deal. he's calling on negotiators steve, a long-time adviser. folks here in washington certainly know him and the o&b's director, young. he's asking them to work with republicans. that, trace, could be a sign of a possible advance let's just say maybe a deal in the offing. we'll have to watch together. >> trace: it's a game of inches. kevin corke live for us in d.c., thank you. let's bring in stephanie hamill. stephanie, always great to have you on i was kind of looking at the president after -- well not even the news conference -- after the cameras were in there and the people were getting pushed out and he said, "give me a break." a couple of times he said nothing else again. this is the same president who has held zero solo news conferences this year so far and here i want you to watch this is what we've gotten from the president over the past two months. watch this. >> we'll see new california.

[everyone speaking at once asking questions] >> i'll talk for 10 minutes, take zero questions and cheerfully walk away. >> thank you. thank you. thank you. thank you. thank you. >> thanks so much. >> thank you. thank you, guys. >> thank you so much. >> thank you. thank you. thank you. thank you, guys. >> trace: at some point, stephanie, he's got to talk, right? >> well, we would hope so. and the clips that your team put together is just typical biden. the president is refusing to answer questions from friendly press. i mean, most of the people in that room are not his enemies. in fact, they're probably big supporters of his, and they're asking extremely legitimate questions right now like the last media clip you played in regards to the debt ceiling. according to reuters, 3 in 4 americans are very concerned about what the debt ceiling means for them and they want to see what the president's plan is. and, you know, we've had a really hard week, right?

america is dealing with many crisis. we have a border crisis. we're still dealing with an economy that's difficult for many americans to get by, and we want to hear a plan and leadership from the president yet we don't get that. and whatever happened to the journalists and the watch dogs of america? they're supposed to be asking the tough questions. and they're not doing that right now. i mean, they'll get a few questions. they don't get the answers that they want and then they just kind of move on. >> trace: it's a very good point because we had a lot of big events as you said and it really is a friendly media. jonathan turley said, "today we're seeing much more dangerous phenomenon. the coverage this week has all the markings of a state media. the consistent spin, the almost universal lack of details, the absurd distinctions. it's the blind side of our first amendment which addresses the classic use of state authority to coerce and control the media." you watch what is happening on the newspapers and the networks

and it is really baffling to see they're not covering a lot of this information. >> it's almost like we're living in two separate planets here. a lot of the abc networks aren't covering the issues as they should be. i mean, look, think about the durham report and how that was covered. not a lot of coverage there. huge revelations, huge bombshells. obviously, fox news covered it, but it just shows where we are as a country right now where we have folks in the media who are not doing their jobs and supporting this administration and almost carrying water for them. >> trace: by the way, we should just say breaking right now, i'm being told president biden has announced that sunday in japan at the g7 meetings, he'll hold a news conference if you're ready for that. stephanie hamill, great to have you on as always, thank you. new york city has a new plan to deal with the influx of migrants from the southern border, house them in public school gymnasiums, a move one

parent called "just insane." marianne rafferty is live with the plan and its controversial goals. marianne, good evening. >> reporter: trace, parents will have a problem with this mayor adams facing intense questions tuesday over the city's plan to temporarily house migrants in public school gymnasiums if needed. the mayor repeatedly urged the federal government for help in the influx says 20 stand-alone gymnasiums are in play. >> this is not every school gym in our city. these are self--standing gems that are not inside the school buildings. they're one of the areas that we are looking at. we're not there yet to state that this is going to be happening. we still look at the other 19 other gyms and state if we're going to move them there, but we have to create a list of locations because the flow hasn't stopped and it doesn't look like it's going to stop. >> reporter: according to reports, ps188 in brooklyn is already housing 75 asylum seekers a decision democratic

city councilman justin said is pozling and later tweeted "we can't disrupt school agencies with the same urgency we search for shelter space for asylum seekers. we must move the folks out of the system and out of temporary shelter. endless purgatory is unsustainable for all." some parents are expressing outrage over the plan. >> my concerns are number one for safety, respect and dignity. it's not safe for our children. all the activities we would have had in that gym are off-limits now. >> some cases, there are adult males. i don't feel safe having adult males with no health screenings, no criminal background checks around our children. >> reporter: new york's governor cathy hochul sent a letter to the biden administration requesting to use federal lands to house migrants. the governor said that monday and hasn't heard back. >> the parents made very good comments. >> reporter: they did and you can understand it.

>> trace: you can. marianne, thank you. a follow-up to the story we brought you last night. the new york city's mayor's office pushing back on reports they kicked homeless veterans out of hotel rooms in the city of newberg to make room for migrants. a spokesperson for eric adams says each of the veterans in the hotel finished their reservations when the city began their asylum seeker program. no word on where the homeless vets are staying now though. san francisco district attorney brook jenson -- jenkins, rather, decided not to charge a walgreens security guard in the fatal shooting of a shoplifting suspect. that's now prompting calls for an independent review. >> the video shows walgreens security guard michael anthony asking the suspect, banko brown in the white t-shirt for a receipt. brown refuses. they begin to fight, and brown allegedly threatens to stab the security guard with a knife. >> the only reason why i did that is because i felt like i

was. [indiscernible] if & if i would have let that person go, i would have been harmed. >> on watch closely as the suspect, banko brown, starts to leave. it appears he steps toward the security guard who then fires. critics call it murder. the san francisco d.a., brook jenkins, says the shooting is justified. >> what i will say s no e didn't indicate he saw a knife. what he said was "i saw a movement that led me to believe something dangerous was about to happen to me." the law doesn't require you wait and see is it a gun, is it a knife, is it scissors? the law allows you to have a perception and belief so long as it's reasonable. >> progressives are calling for state and federal investigations. some claim brown was targeted for being a black transgender man. in the meantime, activists want walgreens to pay and banko brown's attorney is planning to sue for damages. >> we should protest about it.

it shouldn't go unnoticed this young person's life was taken what appears to be wrongfully. >> let's bring in the host of "nothing but the truth" podcast, bobby cranky. i want to play one more sound from the d.a. brook jenkins in san francisco and we'll get your take from the other side. watch. >> we have the benefit of hindsight, right? now, we understand that banko brown didn't have a knife, didn't have a weapon, but at that moment in time, it's about what he -- the security guard perceived or believed. and was that reasonable? >> trace: and the security guard says while they were on the floor and kind of wrestling on the floor together that the suspect told him that he was going to stab him, so is that reasonable? what are your thoughts? >> i can't believe this to be honest with you, trace, as a former prosecutor who evaluated many of these cases. this prosecutor who is supposed to be a little bit more of a hard bull prosecutor than the previous one really blew it on this particular case and her explanation of the law is very

much lacking. look. look at the facts of this case. there's a fight. clearly, the security guard was winning that fight. if the security guard was concerned while they were fighting that he had a knife, then why did the security guard let him go which he said he did voluntarily? moreover, he has a shopping bag in his hand. his other hand is visible. that movement that you see where he moves his chest really, not his body towards him, when he points the gun, the security guard, he's moving away. the victim moves away and he fires. you just can't fire because you have a feeling, not a warm and fuzzy feeling, and you think that maybe it could be anything. security guard even said i didn't know what he was going to do. >> trace: let me stop you there, bob, because he did lunge at him. the video shows that. so what happens is is the security guard said he had a gun, he pointed the gun and was holding it on the floor and was waiting as the suspect was going out the door and he said he was waiting to see if he lunged at him with something because he thought he had some kind of

weapon he was going to use against him and you can see he lunges forward. now, he lunged forward to spit, not to stab him, but how do you know that at that very time? >> he's got a bag in one hand and an empty other hand and that lunge respectfully i believe was more of his body moving forward but it's clear when the weapon is pulled out, he's moving away from the security guard. it's -- by the way, the law isn't just that you feel that you're in reasonable likelihood of death or serious bodily injury, it has to not only be subjective but also objective. a reasonable juror has to look at that and say it was objectably reasonable to believe when a guy has a shopping bag that his hand and the other bag is empty he could cause serious bodily injury or death to the security guard? this was a bad shoot, plain and simple and it at least should have been presented to the grand jury and allow them to make the decision as to whether or not it was reasonable. >> trace: i gotta go. you said this is a bad shoot.

what about in new york, the daniel penny case, the killing there of jordan neale. was that self-defense? i have 10 seconds. >> trace, that's a completely different kind of case. the question in that case becomes is it reasonable to keep someone in a chokehold for many, many, many minutes when the person was no longer moving. >> trace: remember, it was less than six minutes. >> i didn't say 15. i said many, many minutes. >> trace: ok. just checking. you think both of these things aren't self-defense. bobby cranky -- >> no. no. >> trace: go ahead. five seconds. ok. >> i think they're completely different cases to compare. >> trace: bob, thank you so much. and how about this for a california trifecta? the mayor of san francisco who long defended the city's crime crisis is now a victim. san diego is suing shamu. turns out the whale might be squatting. later, americans are obsessed with their snacks. last year, snack sales jumped 11% to $180 billion.

farmer's markets are out." and this "one industry is still booming in san francisco, fentanyl." at the bottom of each billboard has a statement that reads -- the group behind the billboards say sometimes you need to shop people into being awake and taking action. i guess the new campaign is better than the old campaign which was to shut up and say nothing about open borders, free reign among cartels and watching young people die by the thousands. for the record, mothers against drug addiction and deaths and parents who lost children to fentanyl are mortified by the new campaign. and they're supportive. commonsense thinks maybe it's all a bit too late because we should have been offended a long, long time ago. san francisco mayor london reid trying to defend her management of the city's homelessness and drug crisis. recently revealed she, herself, was a victim of the city's crime

crisis having her own car broken into. that's a pretty good place to start with reformed california chairman carl demaio. carl, great to have you on. i want to play this for you. >> i mean, my car got broken into right in front of my home. there was nothing in it. that makes worse. i don't have anything to steal because i know better, right? but it's a tough thing. we're going to keep working on that to combat it. we're not throwing up our hands. we're going to keep fighting to get this community to a place where these kids who are growing up there could go outside and play without fear. >> trace: you talk to long-time journalists in san francisco who's been there for years working for liberal stations and they think the city is a mess. >> couple things on this. this interview was recorded in december. it just came out. just last month, london was blaming conservative media for lying about the property crime and the violent crime in san

francisco. there is no lying about the statistics. homicides, violent crime up 20% since the beginning of the year. property crimes up 15% but, trace we know that stores and individuals are not reporting property crimes anymore because they realize what good does it do you? no one is going to actually enforce the law. >> trace: yeah, it is crazy. in the meantime, gavin newsom, governor of california, was reticent about being food stamps to illegal immigrants but now it turns out he's changed his mind and he's warming up to the idea. there's also talk about maybe unemployment benefits and expanding healthcare for illegal immigrants. this is for a state that's $31 billion in debt. >> they already have the health care them free taxpayer funded healthcare. $3 billion for free healthcare for illegal immigrants. on top of that, they want the food stamps. we already give them the education. yes a lot of the illegal immigrants are homeless

individuals we're providing shelter to. we're talking about billions, tens of billions of dollars easily by conservative estimates. the state just came out last week announcing a $33 billion budget shortfall and it's going to get worse. >> trace: it's everything. it's just schools and you can go down the list and there is a price tag on all of these things for illegal immigrants and the fact that california say sanctuary state, it is a very expensive proposition. >> it's not only expensive to taxpayers but we're drawing people into the state of california, illegal immigrants into the state. it used to be they were coming for a job. now a lot of them are coming for the extra welfare. >> trace: here's the capper, san diego is suing sea world for $10 million. apparently shamu might be a squatter. sea world says we've partnered with the city for nearly 60 years, conducted thousands of animal rescues, numerous recycling drives and many other events. we also paid more than $146 million in lease payments to the city of san diego since 2010 and they're suing 'em.
