>> this is why liz cheney should not be ashamed of herself. why did christopher wray fail to act? what was going on inside the fbi? what were they doing to protect the capitol? pretty much nothing. the capitol police chief was begging for back up in the days before and that day alone. he requested national guard assistance not once, but six separate times. he was denied it each and every time. here is what he said to this show. watch. >> there was a number of requests. i went on january 3rd requesting the national guard from paul irving. that was the first request for the national guard. then i went to mike stenger the senate sergeant-at-arms. that intelligence assessment did not indicate the level of threat that we not know existed. the significant threat that was out there and the fact that the fbi was tracking 18 domestic terrorist suspects coming to the capitol. my intelligence unit on the fourth, fifth and six put out intelligence that was saying low

probability of civil disobedience. >> keep in mind that leading up to the sixth and president trump with four witnesses that have already been interviewed by me, that all back up his story, he ordered the national guard to remain available in case something happens. what was our federal government doing? they knew the building would be packed with lawmakers and the vice president of our great country. they knew a huge emotionally charged crowd would be gathering nearby. they knew based on actionable intelligence that bad actors and agitators would be present. so what on earth was the fbi doing to protect the capitol and our elected officials? christopher wray gets his way and we will never know. this was the complete farce of the january 6 committee with the predetermined outcome. sadly, nothing has been done to prevent this from ever happening again. that is not good. we should be protecting our capitol, our institutions and

>> it is very disconcerting for him. he is doing what he believes is right. he is a person of faith. he is guided by his conscience. he has just been trying to play this straight. for them to treat him the way they did to begin with and to have this kind of treatment subsequently, you saw that exchange with ms. sanchez and that kind of treatment is precisely why he opted to not be interviewed by the democrats initially. this is how they treated steve friend and george hill. he saw they released a report explicitly going after them and smearing these individuals. when they act that way, it tells you exactly what it is they are after. for him it has been disconcerting. >> your client now has been suspended. do you believe this is retaliatory? what recourse or remedy might he have? >> we actually empower oversight which i am the president that represents marcus allen and steve friend.

mr. allen has had his clearance suspended. we have filed a complaint with the department of justice office of inspector general. they have the jurisdiction which is a weak process for investigating retaliation through the means of suspension of security clearance. it requires that they wait a year after that happens. he has reached the year mark. he is at 16 months without a paycheck since his clearance was suspended. we are very happy that the doj inspector general is looking at that. they will be interviewed tomorrow. we are confident they will help to write things because his is a very straightforward case of whistleblower retaliation. >> do you believe the fbi at the top leadership is now trying to stop whistleblowers like your client from coming forward to silence them and are they intimidating them and harassing them and violating whistleblower protection laws? >> yes to the first three. the fourth one is a little bit tricky. they are using security

clearances because that's a method they have available to them. other agencies have done that before in my career working on capitol hill as an investigator. the fbi is aggressively using the suspension of clearances to go after whistleblowers. part of the reason they do this is because the fbi does not have strong whistleblower protections. when the modern act was passed in 1978 the fbi was given an special exception. not long after j edgar hoover. they have had a lot of clout. obviously the friends and allies have been diminishing as the recent stripes have come to light. that has allowed them to be able to get away with quite a bit that other agencies wouldn't. >> that is chilling. we wish your clients the best. joining us now with a full report on the bank record scandal at the fbi, editor-in-chief investigative reporter, our friend john solomon is back with us. good to see you. >> good to be with you. >> this scandal is way bigger

than i think people know and dangerous because it violates all silver civil liberties. they would be as outspoken as we are, but their silence is deafening. >> 40 years ago they were outraged by abuses by the fbi that mirror what the whistleblowers today allege. let's ink about this. this is not a dispute between a manager and employee. the whistleblowers are raising fundamental constitutional issues. for instance, one of the whistleblowers revealed that the fbi went about and got peoples bank records who were in washington, d.c. on january 6. some never committed any crimes or were suspected of committing crimes. they got them without a subpoena, court order or letter. the bank volunteered them. bank of america has not responded to that allegation. some people volunteered at. we don't have a problem taking it. that is end run around. it's a due process of the fourth amendment. other whistleblowers like mr. friend in the clip, he has

allege they have excessively use force. they have sent out swat teams to go out and arrest people for misdemeanor crimes because they want to humiliate them. as steve friend testified today, they made the process the punishment. even if you don't commit a crime the process of being investigated by the fbi is so onerous that that is the punishment. these are exactly what the founding fathers never intended for a powerful federal agency to have the ability to do. >> we just asked for it and they gave it to us? the fact is they know what the legal process is. it's not just an end around. it's an end around the law, isn't it? >> it is. we talked to brent told her today. he is a great legal mind. this is clearly unconstitutional. the fbi and the justice department know it and they don't care anymore. they have engaged in at least since 2015 which we have chronicled on this great show.

they said the clinton and trump campaigns and the two individuals were treated differently. justice has to be not just blind, but not by his. talking about christopher wray, i served with him in the trump administration. he promised during his confirmation hearing as he faced all the politicization, he promised to be nonpolitical and independent. >> he claims that he implemented all of michael horowitz's suggestions in terms of cleaning up the fbi. here we are in the 2020 election and what happened? they had hunter biden's laptop since december 2019. they verified the reporting of john solomon in the spring of 2020. we had fbi agents that were meeting weekly in the months leading up to the 2020 election pre-bunking the hunter biden laptop story by telling them directly you're likely going to be the victim of a misinformation campaign. it may be about hunter or joe biden. you better be ready.

the non-binary luggage sam brinton has once again been arrested this time as a fugitive from justice. kevin corke has the latest on it. what is he up to this time? >> reporter: very interesting story. it happens over and over. sam brinton is the former senior department department of energy official who you will recall had access to highly sensitive and classified material by virtue of his job. that is sam brinton. he has been arrested. he had been been a fugitive from justice according to maryland police and was finally picked up in rockville which is a suburb of the nation's capitol. the arrest overnight was related to the left, you guessed it, airport luggage. it's the third such criminal case involving brendan burke the latest arrest coming a month after brendan escaped jail time in two separate cases in minnesota and nevada involving luggage staff to. despite facing up to 15 years
