whistleblowers, how the fbi destroys their careers, suspends them under false pretenses, takes their security clearances and pay with no true options for real recourse to remedy this is by design. it creates an orwellian atmosphere that silences opposition and discussion. the fbi weaponizes the security clearance processes to facilitate my removal from active duty within one month of my disclosures. in addition to an indefinite unpaid suspension, the fbi initiated a campaign of humiliation and intimidation to punish and pressure me to resign in violation of hip-hop individuals. that the fbi leaked my private medical information to a reporter at the new times that i was retaliated against because i forwarded information in my superiors and others that questioned the official narrative of the events of january six . as a result, i was accused of promoting conspiratorial views and unreliable information. i'm hopeful scrutiny from congress and from the inspector general will deter the fbi from abusing the security clearance process to retaliate against others. the way it's retaliated against

me. >> all right. now, one of the whistleblowers that you just heard from marcus allen, had this to say about the director, the fbi, ray and jan six . >> take a look at this. >> and mr. allen, is it your belief that you were retaliated against because you shared an email that questioned the truthfulness of fbi director christopher wray? >> yes, sir. and you believed that he wasn't truthful based on testimony given to the united states senate? isn't that right? yes, sir. and in that testimony, the senate, you believe that christopher wray indicated that there were no confidential informants and no fbi assets that present at the capitol on january 6th that were part of the violent riot in that right? >> yes, sir. all right. now, marcus, allen's attorney will join us in just a moment. >> but here's the truth. january six , we now know, could have been prevented. according to the federal january 6th, investigators, quote, law enforcement had a very direct role in contributing to this, to the

security failures that led to the violence, quote, investigate has found that the capital was inadequately defended on january 6th, not because of an intelligence failure, but because of the failure to act on the intelligence. let's let's listen to even the mainstream media mobs. >> nbc's lester holt report. >> listen to this. the january six committee's final report was more than 800 pages, but some material did not make the cut, including much of its findings on the failures of federal law enforcement leading up to the attack. >> the chief investigator of the january 6th committee says the government could have prevented it had law enforcement agencies acted on the available intelligence. >> do you believe the attack on the capitol could have been successfully repelled? >> i think it would have been a lot different had law enforcement taken a more assertive protective posture. >> people familiar with the committee's work tell nbc news members downplayed that finding because they wanted to keep the focus on former

president trump. this is why liz cheney should be ashamed of herself. why did christopher wray fail to act? what was going on inside the fbi? what were they doing to protect the capital ? pretty much nothing. capitol police chief's son , he was begging for back up in the days before, and that day alone, he requested national guard assistance not once, but six separate times. he was denied it each and every time. and here's what he said to this show. >> watch. there was a number of requests. i went on january 3rd requesting the national guard from paul irving. that was the first request for the for the national guard. i then went to mike steiner, who was the senate sergeant. that intelligence assessment didn't even indicate the level of threat that we now know existed. the significant threat that was out there, the fact that the fbi was tracking 18 domestic terrorist suspects that were coming to the capitol and my intelligence unit on the fourth, fifth and sixth put out intelligence.

i was saying low probability of civil disobedience. >> now, also, keep in mind that leading up to the 610 president trump and his four witnesses that have already been interviewed by me, that all back up his story, he ordered the national guard to remain available in case something happened. so what was our federal government doing? they knew the building would be packed with lawmakers and the vice president of our great country. they knew a huge emotionally charged crowd would be gathering nearby. they knew based on actionable intelligence that bad actors and agitators would be present . so what on earth was the fbi doing to protect the capital and our elected officials? now, christopher wray gets his way. we will never know. now, this was the complete farce of the joint committee with their predetermined outcome. sadly, nothing has been done to prevent this from ever happening. again. that's not good. we should be protecting our capital or

our institutions, our elected officials, just like we should have followed through on the five hundred and seventy four riots in the summer of 2020. >> none of them were ever fully investigated. the people responsible for thousands of injured cops, two dozen dead americans and billions in property damage. are never held accountable. now, of course, on the federal le docrats, they're not interested in holding the fbi accountable after vilifying local law enforcement for years and defund, dismantle no bell, they have now entered into a warm embrace of the fbi. now, this love affair with federal law enforcement will likely continue as long as the washington field office does. the democratic party's bidding, for example, the party that once loved and respected whistleblowers well, now threats. >> they seem to now threaten them. >> take a look. mr. allen, have you ever used twitter, yes or no? >> i have utilized twitter, yes . okay, and is your account at marcus eight nine seven zero

five zero six four five ? that is absolutely not my account. okay, that's not your account. well, on december 5th, 2020 two , an account under the name marcus allen retweeted a tweet that said , that is not my account, ma'am. you haven't let me finish the question, but the football player, you haven't let me finish the question. on this end. the time is mine on december 5th. twenty two , an account under the name of marcus allen retweeted a tweet that said , quote, nancy pelosi staged january six re tweet if you agree and quote, do you agree with that statement? yes or no? that that is . i don't know, ma'am. that's not my account at all. >> i have i'm asking whether you agree with that statement. yes or no. can you please rephrase this to the general? do you think the general idea has expired, staged january 6th? i just want him to answer you answer. yes, sir. i just telling you , your time's up.

do you believe that, nancy? do you agree with the statement that this person tweeted that nancy pelosi staged january 6th? yes or no? no, thank you . >> it's not as a count. anyway, joining us now to respond, the attorney representing both marcus allen and the irs whistleblower in the hunter biden case, tristant levitte, as well as treston. >> thank you . welcome aboard. thank you . pleasure to show you here. >> why do you think that there is a dual justice system? because i don't have any doubt in my mind that we have that. well, that's a complicated question. but clearly, one of the factors has been that those that are in the ruling part of the fbi and in other places have a one party mind, one ideology, one way of looking at things. and those that question and challenge that they're very willing to to attack. >> all right. so you how hard is it for a decorated combat marine like marcus allen to have the fbi questioning his allegiance to his own country, a man that put his life on the line for all of us in iraq?

how does that feel for him? >> it's very disconcerting for him. he's simply all throughout been trying to do what he believes is right. he is a person of faith, someone that is guided by his conscience. and he's just been trying to play this straight. and so for the fbi to treat him the way that it did to begin with and for him to have this kind of treatment subsequently, you see, you saw that that exchange there with rick sanchez and that kind of treatment is precisely why he opted to not be interviewed by the democrats initially. this is how they treated steve friend and george hill in earlier interviews. and he saw that they released a report explicitly going after them, smearing these individuals. so, you know, when when they act that way, it tells you exactly what it is that they're after. but so for him, this has been very disconcerting. so your client now has been suspended. do you believe this is retaliatory? and what recourse what remedy might he have? >> yeah, so we actually empower oversight, which i'm the president of, actually represents both marcus allen and steve friend. but so mr. allen has has had

his clearance suspended. we have filed a complaint with the department of justice office of inspector general. and so they have the jurisdiction. it's a very weak process for investigating retaliation through the means of suspension of security clearance. so it requires that they wait a year after that happens. but he's reached the year. markis, i think is sixteen months without a paycheck since his clearance was suspended. and so we're we're very happy that the doj inspector general is looking at that. he'll be interviewed by him tomorrow and we're confident that they will help, you know, help to write things there because his is a very straightforward case of whistleblower retaliation. >> do you believe that the fbi at the top leadership is now trying to stop whistleblowers like your client from coming forward to silence them? and are they intimidating them and are they harassing them and are they violating whistleblower protection laws? >> yes, to the first three . the fourth one's a little bit tricky. so they're using security

clearances because that's a method they have available to them. other agencies i've seen do that before. in my career working on capitol hill as an investigator for the fbi right now is particularly aggressively using the suspension of clearances as a way to after whistleblowers. part of the reason that they are able to do this is because the fbi does not have strong whistleblower protections when the modern system of whistleblower protections was passed in 1978, the fbi was given a special exception. it's not that long after j. edgar hoover and they they have had a lot of clout, although obviously their friends and allies have been diminishing as they're there. recent strikes have come to light, but that's allowed them to be able to get away with quite a bit that other agencies wouldn't. >> absolutely chilling. we wish your clients the best. thank you , tristan. we appreciate. all right. joining us now with a full report on the bank records scandal at the fbi, editor in chief, investigative reporter at just the news.com. >> our friend john solomon is back with us. john , good to see you . all right. this scandal is way bigger than

i think people know. and danger is because it violates all civil liberties. and i think that liberals would be as outspoken as we are. but there their silence is deafening. >> forty years ago, they were outraged by abuses by the fbi that mirror what these whistleblowers today allege. >> let's think about one of the things this isn't a dispute between a manager and an employee here. these whistle blowers are raising fundamental constitutional issues. for instance, they one of the whistleblowers revealed that the fbi went about and got people's bank records who were in washington, d.c. on january six . some of them never committed any crimes or not even suspected of committing crimes. they got him without a subpoena, without a court order, without a national security letter. the bank apparently volunteered them. bank of america. that's the allegation. the bank has not responded to it. an fbi official talked to me tonight saying, well, some people would volunteer us . we don't have a problem taking it. that's an end run around the due process. of the fourth amendment. other whistleblowers like mr.

friend that you saw in the clip there, he's alleged that they've excessively used force, meaning they've sent out swat teams to go out and arrest people for misdemeanor crimes because they want to humiliate them as different testified today, they've made the process the punishment. even if you don't commit a crime, they're going to make the process of being investigated by the fbi. so onerous that that becomes the punishment. these are exactly what our founding fathers never intended, a powerful federal agency to have the ability to do. >> the idea that they say we we just ask for it. and they gave it to us anyway. the fact is they know what the legal process is . so it's not just an end around. to my mind, that's an end around the law. isn't it? >> it is us. and we had brant tober, we talked to him today, a great u.s. attorney , a great legal mind, said this is clearly extra constitutional, unconstitutional. the fbi, the justice department, they know it. they don't care anymore because there's no consequence to the bad behavior they've engaged in since at least twenty , fifteen weeks early.

she has any clue what's going on . i honestly don't think she knows that she's been gone for three months, evidenced by the statement she made the other day. i think she was legitimately confused about whether she had been gone. and fetterman, he's just an absolute disgrace at this point. he can't do the job either to be a us senator . that's an important position. you're one of 100 . you have to be able to to interview people. you have to be able to make statements. you have to be able to , you know, to ask questions of witnesses. he can't do any of this. he's completely incapable of doing the job that he's been sent to do. and we're going to get in trouble. you have him. you have feinstein and you have president biden. of course, we have three people that need to have that conversation with their doctors in their families. >> you know, charlie, let me go to you . i would say this if i had a family member, we'll pick joe biden as an example in cognitive decline, like the president. it was two things that i would say to that family member as loving a way as i possibly could. well, first of all, acknowledge your own granddaughter and stop ignoring her. and the second thing i would

say is you are not fit to run for another term. and i would say it strongly. i would say it firmly. i would say it lovingly. joe biden, is there not anybody in this guy's life that pushes him to do the right thing on these issues? apparently not. and it's it's really shocking that joe biden doesn't have anyone in his family that cares enough about him. to sit him down and have exactly that conversation. or john fetterman family or dianne feinstein's family. and i think what's really sort of disturbing to me about it is that it's they're surrounded by , i think, obviously family members that don't seem to care about or be concerned about their well-being. but are also they're also surrounded by colleagues who are so thirsty for power, who will do absolutely anything for power to cling to power. they will prop these people up and push them through the hallways in a wheelchair.
