i spoke with a source before coming on here. somebody that is retired from the intelligence community. they reminded me of something very important. this isn't just the fbi. this is across our entire intelligence agencies. we seen it with the nsa. in 2017 john solomon and i broke the very first story on the illegal spying from sticky place under the obama administration. in fact, the obama admin surgeon had to admit to the foreign intelligence surveillance court that it expanded its powers and was collecting upstream data on americans which is the backbone of the internet that's emails, all text messages, phone calls and sweeping them in wholeheartedly. the fbi is doing this as well jason. what they're doing, they're doing it through the physis 702. the conservative database which has externally extensions.

they're not just collecting on foreigners. i want everyone to remember those. they're unmasking americans and collecting huge amounts of data. what is more powerful? then money? it's information we are supposed to be interesting our lives. our constitutional rights. our 4th amendment. to the united states government. that there can uphold these bureaucracies. now they're not doing it. the only thing that our government can do now to really show they mean business. oversee the fbi and the department of justice don't care. it's where congress to ensure that they defund some of these agencies and hurt them hurt them so they understand what's going on here. believe me, this collection of data stock order released all a terrorist attack. we have a target we know with a target is. we can collect that data. that is still available with a warrant.

they need a warrant to do it. it's unconstitutional if they don't have it. >> yeah, look, when i was in congress as chairman of the oversight committee we held hearings. the fbi, despite the law was collecting facial recognition for more than half of americans. unbeknownst to those americans. if these violations of the 4th amendment and this particular case, the report that was reviewed today wasn't just about the january 6 people. it was also about people related to george floyd. again, on both sides of the aisle, price is up for reform. greg, in very short order, go down the line. how do we fix the department of justice and specifically the fbi? >> you made several excellent suggestions. first of all, strengthen the inspector general's. especially the one at the department of justice that doesn't even allow the ig to go after crooked lawyers who do bad things.

conservative. try to come up with this new and novel term to essentially categorize them that something that's problematic. that's my seat to the top for our priorities with the national scaredy brush with the fbi or anti-government extremism and racial ethnic extremism which is parenthetically white nationalism. as far as a president is concerned if you go back to speech in independence hall those of the 2 qualities he tried to paint the broad brush of anybody who not just supports president trump but generally replicant in the election. >> my concern is terrorism, foreign terrorism, bio weapons, other types of things, feels like we've taken our eye off the ball that's the concern. real quickly steve, what's the number one thing we could do to help reform the department of justice and specifically the fbi? >> it's not about defunding federal law enforcement. it's about empowering local law enforcement. we should be looking to deputize local detectives and those of the folks that know what's going on. the knocking to be so responsive to what the demands are from k street when you're trying to address these crimes

receiving this? you didn't even want to ask. he whooped it up want to go to the legal department to ask without meant that might apply you what a question that a put it target on your back. it is very obvious that a lot of employees were very disturbed by that. he gave a chilling effect. do not speak up. although they say that spot without was for. that's how many people felt. >> right. i tell you someone that was in congress and being involved in oversight. i've gotta tell you it was outrageous that they do that. my personal opinion, the man but one thing was to intimidate people from hooper think about coming forward and say don't you dare. you will hate it and it will ruin your career. nevertheless, look, used to think it was a couple of people at the top of the food chain that were the problem. it seems more pervasive than that. what's your perspective?how pervasive is this politicalization of the department of justice and specifically the fbi? >> i've always believed it does start at the top in washington

d.c.. starts at the top and starts with executive management those on the seventh floor. then it trickles down. the thing with the fbi is it used to be more of a criminal agency. from the difference of post 9/11 deterrent as marvin intel agency. there's a big drive for intelligence. it seems to be the side of the house that tends to have a lot of the issues and concerns. i think it would be best of the fbi got back to fighting crime. so many amazing agents that are fighting crime. we celebrate national police week this week. my dear friend laura was killed on light duty protecting children from a child predator. that's what the fbi should be doing.she's doing not there's people up in dc that are politicizing the fbi. it's completely disrespectful to her and tarnishes her legacy. it's not okay. >> peter struck is in charge of counterintelligence for the 9 states. he sensed 10,000 text message to somebody who's he's having an affair with. he's honestly not focused on

that they weren't even allowed to get any of the dialogue or any of the discretion of the g7 because they didn't want to show joe biden in action. how do you beat them? >> well, there's a couple of ways to look at this. the tradition in politics with say, look at the approval rating. one of the things obama, trump and biden have in common is that they all had approval ratings at times around the 40s. the difference was that obama had an approval rating among democrats at 80 percent. trump had an approval rating among republicans about 95 percent. biden has an approval rating at about 50 percent to 60 percent among democrats.you will say well, this guy has a lot of problems. in today's presidential election, we look at the national opinion and try to make these suppositions of what's gonna happen. in the battleground states across the country the

republicans and democrats are divided almost evenly at 40 percent a piece. which means only 4 percent of the american public in the states that matter are actually up for grabs. which means, if you look at 2016 and 2020. in those states only bob 100,000 people made the difference in those 2 elections. even less than that in 2016. what does it mean? it means the democrats don't care about candidates. look at federman, look at jobs in arizona. look at biden. but there are going to do is look take $4 billion. there gonna focus on 100,000 to 300,000 swing voters.

doctor siegel, how do you do these assessments and what should be the consequence of this? maybe that's just a big broad policy question but, what do you think should be the role of a doctor who's actually seeing these as patients and these people are in positions of power making decisions. >> jason, i don't think it's a function of age so much even though diane feinstein is 89. in center federman is in his 50s but is have a severe stroke. he was hospitalized for depression for many weeks. as you say, people seem to be writing his lines. i think it's more of an assessment of fitness. which i been saying for a long, long time. as you know, having been in congress, they are atrocious when it comes to this. congress or the senate has never removed anyone. carl monk in 1969 had a stroke and didn't serve for 3 years.

edition of hannity. gop primary field continues to grow. south carolina senator, tim scott has filed with the federal election commission to run for president. this is florida governor, ron desantis, long awaited campaign announcement is expected to come next week. despite the crowded primary race, a new poll still shows trumpet with a commanding lead. desantis 43 points behind. another poll out today asked voters about potential 2024 matchups and showed trump that 7 point lead over biden. when voters were asked about a desantis /biden matchup the 2 tied at 42 percent. here now with reaction pollsters, mark penn, lee carter along with fox news contributor, leo terrel.thank you for joining us tonight.

mark, i want to start with you. at some point, it's early, at some point can't you just get so far out ahead that you can walk at home? >> well, primaries are bedeviling things. we've seen a lot of instances where the front runners, no matter how far out can fall to the challenger candidates who aren't really well-known. who haven't really engaged. no question, trent trump has strengthened as he took on cnn here and ellen bragg. those have strength in him. his primary is not over. it's just beginning. >> lee, how do you see the race right now happening today? i saw the rise and trump coming when he went and visited east palestinian and joe biden didn't. he showed leadership. it reminded everybody that the president was a leader and he showed compassion and it plays well when he does that. >> yeah, i think there's a few things that came together at the same time. i think the visit was very, very well done.

i think was a time for people needed to hear from leadership. then he remembered what he was all about. he went out and visited. he had mcdonald's i think if i remember correctly when he was out the way. people were starting to look at him differently. the other thing that happened is the indictment. you think the indictment work against him. it rallied a lot of people to say they treat president trump unfairly. they gave him another chance. all of these things boosted donald trump. the same time ron desantis makes a big strategic mistakes. instead of running on a florida blueprint and all he had done in florida. he started taking on disney and a lot of these local wars. i told dick that served him well. i think trump's lead is secure at the moment. let's not forget on june 15 in 2015, there was an article in the "washington post" that said here's a 5 reasons why jeb bush will be the next president of the united states.

he didn't even get anywhere close to it. anything and everything can happen. we are a long way away. we know trump is unpredictable. >> yeah, that's a safe bet. he's eating mcdonald's and is unpredictable. i think that's going on on the field. leo, donald trump is showing why people to like him. the lead is massive but, there is the primary and getting the nomination and then there's the general election. what do you think those issues and how are the voters of the republican party going to look at the 2? >> i will tell you right now. first of all, donald trump and jeb bush, not even close. donald trump jason, resonates with the american people. most of these candidates are inside the beltway. donald trump is a guy that could rally a group 40 to 50,000 people on the weekend. donald trump accomplished more jason, and 4 years then some president. biden and obama in 8 years. the sky resonates with american people. they believe he's real.

he's a first republican i ever voted for. why? he puts country first. i will submit to you, i'm looking at these candidates that are running against him. i would love to ask pollsters work at they beat trump in their own state? ãscott is running. he's gonna be trump in south carolina? i like donald trump's chances of south carolina. i like donald trump chances in ¦ i don't see it. >> mark, good question. what is the answer to that? >> i think we are going to have to see what happens in iowa and new hampshire and south carolina. look, these states are gonna shape whether or not these other candidates can get off the ground. tim scott is not known much outside of south carolina. he has a lot of potential. i think he will play well. desantis, obviously has had trouble. he's gotta reset his campaign. trump is writing high. he has certainly been challenged by another republican in the ring.

as i said before, clearly, trump has a lot of weaknesses. can he really went? he could win a republican primary. he's been losing in the republican party has been losing since they have been with trump they want to be winners again. i think were going to have a bill primary care. a real match. a real slugfest. we will see who wins. i don't think it's as projectable as a team spirit. >> lee, it's one thing to get the nomination. to win the general election. the case that desantis is making his look, donald trump comes with trauma. problem trump it will have a hard time with independence and people in the democratic party. the numbers. i did are so weak within the democratic party. there's a huge opening to go grab those people. they will show them there's a reason to believe in them.

how do they play that when they've got to go to the right in order to win the nomination. >> i think it's good to be tough. i don't think ron desantis has an answer that will be satisfactory to the people that will make the decision. right now, the biggest problem the republican party has is with women. 7/10 independents say one of the primary reasons the gonna go and focus for women's rights and abortion. i netted 10 democrats 8 that's what will drive them to the vote. even though the economy is a number one issue that impacts our daily lives. if republicans don't come up with an answer that puts women in the center of the conversation, they will have a big issue. as we know, this election is going to come down, we are neck and neck. where country divided 48 ã48. it will come down to a few points. republicans are going to have a tough fight to slug it out. >> well, it's going to be a fascinating race. i appreciate all 3 of you joining us tonight. where the special edition of hannity coming up right after the tebreak. stay with us. astepro starts working in 30 minutes. so you can
