after protests and outreach group. let's begin criminal defense attorney mercedes. i want to get to the timing and a moment. but first, from a prosecutor and defense standpoint, what do you make of a defendant giving an interview after being charged but before a potential trial? >> what a great question, arthel thank you so much for having me. it is potentially dangerous for any defendant especially somewhat like a daniel penny it was facing manslaughter charges to speak to the media. but frankly, i think he wanted his narrative out there. obviously he was carefully orchestrated with his defense attorneys. as a defense attorney i tell my clients all the time do not try this case in the media. keep quiet. let the process play itself out. obviously daniel penny felt he needed to sway some of the negative press that is surrounding him to the point he felt that maybe the due process he wants a fair trial might actually not happen for him.

so if i posted to the timing of the charge and the target self. secondary manslaughter appropriate charge? >> early with the loss of life they coated charge with criminal negligent homicide which is a little less but manslaughter seems to be the catchall. especially when the death falls from extreme reckless behavior there has to be some understanding the actions that you did you should have known your actions would lead to the death of an individual. whenever you look at chokehold the description of chokehold talks about the perils of putting somewhat in a chokehold including death. that's what the prosecution is going to really focus in on is the fact that daniel penny, you should have known whether what you found this training during the time you were a veteran or should have known just because all this pretty much know the dangers of a chokehold. all you have to do is look at up edge in the conduct that lead to the death of the individuals. it's going to be a presumption

we have seen desantis he's had a few fumbles over the last couple of months. but, his entrance into this race is going to be very interesting to watch. desantis has recently received a lot of endorsements from a lot of contender legislative folks in iowa, new hampshire. what we are going to see is desantis strategy is really focusing on those early states. he knows those national polls are not showing that he is doing super well. the bucks, their team is really counting on is he is going to be able to rise those polls if he is able to win in iowa and new hampshire. we have obviously seen in some of the previous cycles this is not always been the most consequential way to win. if we remember back in the iowa caucuses back in 2016, ted cruz with the iowa caucus and obviously ted cruz did not win the republican presidential

primary. but, this is a strategy they are looking at and the path. a lot of desantis supporters say the next couple of months and weeks are only going to determine his strength. so if are also some desantis supporters say the troubles of former president trump at your hearing rumblings in the republican party despite the presidents lead in the polls now, his candidacy could be trouble impaired here is bill cassidy republican senator earlier today said he does not think the former president can't win the general election. let's listen. >> the last election cycle we saw in all of the swing states almost all, georgia, pennsylvania, nevada and arizona, that trump -- the candidates for senate that trump endorsed all lost for that means president trump is going to have a hard time in those swing states which means he cannot win a general election.

so potential more indictments and revelations and troubles coming for former president trump. is this a way for desantis to say i have the same policies as a former president but i am not him. >> certainly adeptly could be. republican voters have said somebody that represents their values is something that really care about. in a recent poll it said they cared more about that than actually someone who could beat president joe biden. that certainly is something a lot of voters it's on their minds. we obviously have to remember it is very early in the cycle. we have a lot of people getting into the race. tim scott, obviously somebody who has a lot of gop support here in capitol hill. a lot of allies. we are also talking about pence. he might be getting into this race soon. there is going to be a lot of choices for republican voters. people that represent their values. we are just only the beginning

eric: air quality in denver ranking among the worst in the world because of wildfire smoke from canada. adam: we're seeing a ton of activity across western canada, and there's a couple of areas where air quality alerts are in place in montana, getting into eastern colorado. the wind is funneling it that direction, so we're seeing that very smoky air settling into parts of the mountain west and stretching over towards portions of the great lakes. in the week ahead, it's going to become a little bit more widespread but a little less dense. so a lot of folks might see this, but it won't be as thick as they're currently seeing across portions of colorado. a little bit of rain particularly out west, and in the week ahead there's going to be a lot of rain activity across portions of florida, maybe as much as 8 inches, so we will be watching that, eric, coming up.
