so if i posted to the timing of the charge and the target self. secondary manslaughter appropriate charge? >> early with the loss of life they coated charge with criminal negligent homicide which is a little less but manslaughter seems to be the catchall. especially when the death falls from extreme reckless behavior there has to be some understanding the actions that you did you should have known your actions would lead to the death of an individual. whenever you look at chokehold the description of chokehold talks about the perils of putting somewhat in a chokehold including death. that's what the prosecution is going to really focus in on is the fact that daniel penny, you should have known whether what you found this training during the time you were a veteran or should have known just because all this pretty much know the dangers of a chokehold. all you have to do is look at up edge in the conduct that lead to the death of the individuals. it's going to be a presumption

from the prosecutor's side that chokehold could have led to jordan neely's death. arthel: want to show on the screen a partial statement from former nypd commissioner telling to the "new york times" is whether the public outrage factors into charging decisions, here is it says it should not be the sole determinant of what you are going to do. is that a factor? definitely for you have a responsibility as the district attorney, mayor, and the police to keep the public safe. public safety has to be the ultimate concern, your reaction? what is interesting for their two sides in this for those who are support of daniel penny say of course now we feel we may be cases we are in these dangerous situation who's going to step in to be the good samaritan? who is going to be the hero in all of this and help those when there is a legitimate concern

for the safety of themselves or others? the opposite view is, we do not want vigilantes. we do not want individuals out there thinking they can take the law into their hands if jordan neely post that danger, call authorities do not take extreme position by putting him in a chokehold. this really two sides of this informer commissioner is probably looking at the fact it might be someone saying we really do not want vigilantes for that is a very significant public safety concern. arthel: i'm want to switch of the other side what is the potential legal recourse compensatory damages and claims of civil rights violations for that family of jordan neely. >> great question for they could bring wrongful death action that's a civil proceeding against daniel penny and said he cause the death obvious of that's going to be a could work itself out maybe he will be

eric: air quality in denver ranking among the worst in the world because of wildfire smoke from canada. adam: we're seeing a ton of activity across western canada, and there's a couple of areas where air quality alerts are in place in montana, getting into eastern colorado. the wind is funneling it that direction, so we're seeing that very smoky air settling into parts of the mountain west and stretching over towards portions of the great lakes. in the week ahead, it's going to become a little bit more widespread but a little less dense. so a lot of folks might see this, but it won't be as thick as they're currently seeing across portions of colorado. a little bit of rain particularly out west, and in the week ahead there's going to be a lot of rain activity across portions of florida, maybe as much as 8 inches, so we will be watching that, eric, coming up.
