i am a normal guy. jordan neely's family says daniel penny choked jordan neely to death, we never called him a white supremacist, we called him a killer. we want to know why he didn't let go of the choke hold until he was dead. jordan neely's uncle said, he needs to be prosecuted or he will do this again. he has too much confidence and has to be taught what he did was wrong. as far as daniel penny's, if this case goes to trial, prosecutors could use daniel penny's military experience against him. >> prosecutors could say he chose to disregard it, usual manslaughter two case is somebody waving around a gun or knife, where risk is obvious.

their lives. >> todd: you said this person could have a case. if i'm a business and getting slammed in 2020 with covid restrictions and now inflation, how do i run a business when now i need to anticipate a new area of the law and if i don't do it by the book and letter of the law, i can get sued? >> there is going to have to be decisions made. either decisions are made in the new york legislature, state legislature because one claim is under the state human rights law or the city council because three of the claims are under the city human rights law, or made by a judge. what makes this case a little different, under strict letter of the law it might apair this person has a claim. whether it is $5 million claim, is a question. at a certain point, there will

have to be a judge somewhere, whether in new york city, is a serious question, who will say there is shame issue here, legitimacy issue. not every person who claims to be a woman and wants in the woman's locker room should be allowed to do so, that is an issue. >> ashley: you said lawsuits like this will become more normal. why? >> there is nothing normal going on here. >> ashley: more prevalent, i should say. >> why because as you guys put it, it is a $5 million lawsuit. unless and until lawyers are able to get the message a certain category of lawyers like to bring lawsuits like this, that they're not going to get the money they are looking for. there is no $5 million recovery here, i can assure you.

new york is very comfortable writing large checks for political reasons. this is not going to be one of them, not a $5 million case. unless and until a judge somewhere says this is not what the human rights law was meant to protect and as you point out, this person seems to have a habit of looking for this kind of trouble. >> todd: you would think that having a single gender bathroom would be the end of it. in the allegation in the case, this individual said they were screamed at when using single-sex locker room, if reading that correctly. doesn't single gender bathroom make all lawsuits potentially mute? >> well, there was obviously a reason the people in the locker room were screaming at this individual. some point, there is going to

have to be pushback from women. >> ashley: yep. i've been saying that. what point are the women's outcries going to take precedence, too. this is yes oerr no response, t business is being sued, do the women affected have any legal standpoint? >> that's a great question, if you read the pleadings, you would have the impression the lawsuit is against the women screaming. they are the most offended and naked people, they are the one whose dignity is being impifrjed on, there is no case against them and strictly speaking, if a lawyer like this wanted to bring a claim against those people, it could be brought. two claims are in the nature of aiding and abetting these sort

great to have you both here. norine, why is trump crushing everybody in the rust belt states? >> i don't know if you remember when he was in the white house, let's say our country was a different place to live. the american dream has been lost by sending jobs overseas, inflation numbers and factors that trump brought to light and improved to make this country a place that we actually want to be proud of again and so many reasons why i think we are all yearning for better days and reality is when trump was in charge better days were here. it is no surprise to me that those poll numbers are what they are and i expect regardless of who the candidate ends up being, i expect we will see numbers go through the roof on the republican side.
