he brought out on stage. it was almost an hour of hearing from him. and there were some technical difficulties along the way too. at one point we thought our audio and all technical stuff had gone down in the studio as i was moving from "the faulkner focus" to the "outnumbered"'s couch, a few minutes ago, but it was him. then he tried these different microphones to see if anybody could pick up the sound of his voice. it got very quiet from there in north charleston, south carolina, and then more of his rousing speech. this is "outnumbered," i am harris faulkner here with my cohost emily compagno and kayleigh mcenany, joining us fox news contributor and former state department spokesperson marie harf and fox news contributor and former utah congressman jason chaffetz. kaylee, almost an hour of this, and some stops and starts where he had people coming up with him and he wanted people to see his mother with the long-term family friend to show that the racial divide can be united.

the microphones went out, they came back on. he never lost a beat screaming "let's go." >> kayleigh: what a powerful authentic unifying voice in our country and i say our country, because you don't hear this message on the left. you don't hear this message on the right. it was optimistic. you hear tenors of fate throughout other candidates, but that's a centrality of the message. how beautiful were his words, my father chose patriotism over a pity, i'm showing it's the land of opportunity, not the land of oppression. we need to have compassion for those who disagree with us, can trust with joe biden. the vaccinated have a right to be angry at the unvaccinated. if you oppose voting laws you are segregationist, maga republicans are a clear and present danger, that message beats joe biden, what you just saw beats joe biden every day the week without trying. i believe when he said can somebody say an "amen" there were a lot of people saying

"amen, senator scott." >> harris: you have known tim scott for years, what was going through your mind? i was watching you watch that. >> jason: i'm just so proud of tim scott. i knew him when he got elected to the house of representatives, he ran for the senate breaking all kinds of barriers, he is the real deal. i bet i have been to dinner with him i don't know, a hundred plus times. this is core to who he is. his belief in god, his belief in the bible. his belief in jesus christ, when he starts talking about those things, he is doing that from memory. he does that because he knows it to its core, but he is an inspirational figure. you go back and read his book coming have is history. his accident as a teenager that he had to recover from, i mean, he has sold insurance, he worked at amway, that guy has pulled himself up by the bootstraps and become a 10-year senator. i think that his message resonates. i do think this is one of the biggest threats to the democratic message. i believe that.

and i think that he is a messenger that carries one of hope and vision. >> harris: a redemption story, america, talk about us book. i recently read that and so as he said to the audience, he said, look, a lot of you already know the story. i'm going to tell it again. and he told it like he never told it before and even you are saying i've heard this before, but i don't know. it has a little something on it. but that last part you just said about the democrats being worried, i have to say, i am a little shocked that this was not game-out in terms of the research when they toyed with new hampshire to put south carolina first, not only do you take on two republican declared candidates, but a black man in the south who has a lot of support based on the politically neutral things that he says like loving god, loving country, service, military service, and those things that patriotically unite us all, do

you think there was a mistake? your side is bleeding right now, 90-50 percent in the last news poll. >> i don't think it's whether tim scott can beat joe biden, that was a remarkable speech and remarkable event when he talked about talking to people we disagree with, the question is not whether he can beat joe biden, it's whether he can be donald trump. that is a very different message than to get from the front runner by far. the front runner in the republican party is donald trump in every single pole by double digits, tim scott has a great story, he has been building support quietly especially among his senate and house committee, he does not have a great name recognition, so i think he is going to iowa and new hampshire in trying to build up his ground game in those early states, but the question for me is whether in today's republican party, which i'm certainly not an expert on, jason is much more of an expert than i am, i am doubtful that he can break through in a party that is still feeling like they want the red meat from donald trump and not

this. we will see in the polls that come after this announcement, but i am doubtful about that at this moment in the republican party. >> harris: you want to take a total dodge on the idea that the candidate moved up a primary? and it just got a lot tougher, should this play out? >> marie: i think that this is an inside d.c. game here, and the broader coalition of democratic voters across the country, iowa gave up its ability to be the person in the nation after last time. but i really think that new hampshire is an incredibly important state for democrats. >> harris: they do too, the name is not on the ballot. >> marie: we can't forget about new hampshire. >> harris: before i come to you, emily, i want to go to this, because i can't wait to get your reaction, the senator talked about his family in particular his grandfather and some of the nuggets of wisdom, watch this. >> my grandfather lived long

statistically might brand him a victim, but as he said multiple times, not how he was raised, he was a victor in that household and now standing before us as a senator and a presidential candidate, i am struck as well xs and os underscore in marie said earlier as we understand he has this impressive work, $2200 quietly garnering support center, but naturally polling add about 2 percent is really not a lot of national recognition and a note as someone who has been respecting him and enjoying his presence both in person at events that we have spoken at together and to just an amazing guy he is. what a stand-up conservative, a consistent man of god. my point is that well that message to resignation? the reagan conservatism is the party. will they respond to that versus the populism? and he will not come out swinging. he will come out gently, firmly, strongly representing those ideals spread he says my brand of conservatism, so the question

remains for the primaries the response. but i for one think that that is a breath of fresh air. >> harris: that is so interesting, because there has been criticism that even ronald reagan could not win today and politics. >> jason: to marie's point, i agree with her, there are two races, one is the primary. a donald trump is way, way out in front. feels like he is lapping people at this point. >> harris: he is lapping people. >> jason: but to get to the nomination coming really have to run the gauntlet, it's really tough thing to do. can somebody like tim scott breakthrough who does not have the type of name recognition? i think this is who they want to be, can they actually get there? i think that it's interesting to see if he can get it. >> harris: i don't know if there is a personality that they want? they want to win. >> emily: >> kayleigh: donald trump has 36.5 lead.

that is the lead, yes, there is no denying that donald trump is a front runner right now. but there are some intangibles here. scott's campaign would tell you we are banking on debate night, 20 million viewers here on the fox news channel, we will likely have -- >> harris: does he show up for that? >> kayleigh: i think he does paired my former boss never spoiled from a fight, but today will make the case about electability, fighting is good, but winning is better. they will make that case on the debate stage. he can win a general election and then finally they will say we are going to win state-by-state. ron desantis is saying i have 37 congressional endorsements in iowa, that's more than ted cruz who had 13, tim scott saying i'm going to pick up south carolina. can you do it? it's a heavy lift against donald trump, these are the arguments. >> harris: well i feel like it has been going for quite some time and it picks up, but potentially ron desantis in the next few days will declare, we don't know exactly, there are others on that list. we will cover at all.

>> harris: the man accused of stabbing and killing those four idaho college students in their home off campus. he appeared in court just moments ago. he has just pleaded not guilty to four counts of first-degree murder and burglary charges. now that he has entered a plea, a 60-day countdown begins for prosecutors to formally file their intent to seek the death penalty in this case. the defense team hired attorney alyssa math a half to their team who is certified in these cases. a criminology and criminal justice graduate student at the nearby washington state university is accused of entering the off campus home near the university of idaho. he is accused of killing and leaving one of the bloodiest scenes behind local police and even national feds had ever

seen. accused of killing kaylee gun call this, madison mogen, zanuck or nodal, and ethan shape it, two other students were also home at the time, but survived. emily. >> emily: of this is what i want viewers to understand, this procedurally means it was a higher standard of evidence that was required to get to this point by the grand jury. so what that means it's rather than having his defense team essentially rebuffed with a lower standard of evidence presented by a law enforcement when they initially arrested and charged him, now this will proceed off the basis of the grand jury indictment. it makes it a little bit more ironclad. >> harris: there was a lot of information at the beginning we were covering and it was all over the place and they were putting together a case in bursar was targeted, then it wasn't, then it wasn't random, at this, lad, the other. we talked about on the couch how you hold, because they had to answer so many questions as investigators to put this case together. what do you anticipate in terms

of what this case will look like when it is laid out? >> you mean whether or not there will be a gag order? i think it depends on the level of transparency that this court wants to share with the rest of the united states. i would not be surprised if a gag order was in fact levied, but also would not be surprised if it was not here in the interest of such national interest and i have to point out as well given the tenant and emphasis on the death penalty eligibility in this moment, remember that if he had allegedly committed these horrific crimes just 8 miles west, then there would not be a death penalty on the table, but because these were committed in the state of idaho and not the state of washington, that makes the death penalty in eligibility and also gives him a leveraged tool, it gives both sides a leverage tool to use that he can say, allegedly all plead guilty, if you take that off the table, so prosecutors can say we don't take it off the table and we are proceeding to trial.

so there is a big impact, big elephant that they have with this. >> harris: and one last one in terms of the indictment today when you mention the gag order, but just take us into this whole process in the next 60 days. >> emily: we will be waiting for the child to be set in any type appearing to emerge out of left field essentially if there is some motion filed, likely by defense at this point it should be roads and the next thing we should hear is again the trial date or some type of pretrial motion hearing date. >> kayleigh: i just want to highlight the addition of the attorney, she apparently is a top criminal defense attorney in ohio idaho. she is very good at what she did, ironically the same school as of four victims but actually overturned a conviction for attempted murder and kidnapping on an individual who was on "america's most wanted." got that overturned. this is a high-powered offense defensive tourney but i have to imagine we only know a sliver of evidence against him that there

>> harris: we had just brought you from idaho the courtroom announcements and results, but let's watch this, this is bryan kohberger accused of murdering those four college students at the idaho university. >> also that team is ingrid beatty, and both from the idaho attorney general's office. if you don't know me, i'm the district judge and i will be presiding over this case. so mr. bryan kohberger, you have already learned a lot of what i am going to tell you that your initial appearance, but i will repeat it to you, because it is important and i want to remind you of these issues.

so i will briefly cover your rights, the charges against you, and the maximum penalties if you are found guilty or if you plead guilty. so we will start with the rights. you have a constitutional right to have an attorney represent you throughout these proceedings, if you cannot afford to hire a lawyer, one could be appointed at the public expense. taylor and her team has been appointed to, but so that is taken care of, you have a right to a public trial for the state required with every element, each charged against you beyond a reasonable doubt. at that trial you would have the right to cross-examine the witness is called against you. that means to see where it is requested, to call witnesses to testify for you. and if you choose to come in to testify in your own defense. you are not required to testify, because you also have the right
