call me. i am waters and this is my wor world. >> good evening and welcome to and welcome to fox news tonight, i'm trey gowdy, thank you for joining us . senator tim scott joins us on his big announcement. >> that's straight ahead. but first, elections have consequence and so do the policies which emanate from those elections. when joe biden took office, he ordered an end to the trump administration's remain in mexico policy. remain in mexico means asylum seekers wait for their claims to be processed on that side of the border. >> rather than wait here in
10:01 pm
the united states . the consequence of that changenc policy, nearly six million migrants cross the southern border, but you should notould b be surprised. >> he said he would do it.3 4 f the idea that a country of three hundred thirty million people cannot absorb peoplet who are in desperate need and who are justifiably fleeingg oppression is absolutely bizarre.sion absolutely bizarre. >> so not only can you cross the border unlawfully, president biden has a list of other crimes. he doesn't has a think are seris enough to warrant deportation and removal. normallyt of oth, migrants are d entering the united states unlawfully. they're processed for deportation. and but if you allege a credible fear of beingcan remr persecuted or tortured, you can remain here in the u.s., those seeking asylum have to showum hs a well-founded fea tr of
10:02 pm
persecution on the basis of their race, religion, nationality, or number of a social or political group. but the hearing is years in the future. sympathy for people seeking a better life, hungering for hope and freedom and opportunity, is embedded in the fabric of this nation. but so too is the rule of law merely reciting words memorized. from a us statute should note wd be enough to jump thoseor those who have waited in line for fo a chance to come to americr a. and economic opportunity is not an asylum claim. ericthe question is , where do you wait your asylum hearing in the u.s. or mexico and how good is the us at detecting fraud in. the asylum process? aand 2008, less than the p five thousand migrantsro claim credible fear 10 years later,n the number increased by nearly two thousand i percent. whatever you think of
10:03 pm
the governments in central america, they have not changedm, two thousand percent in 15 years. >> so what has changed the politics of immigration and border security and migration? democrat party, including presidential aspirants, told migrants all over the world they should come. d they >> and they did. nearly a week after title 40 to expired, as many as thirty five thousand people were reportedly waiting on the mexico side of the border to cross intoaiting o cross into the the u.s.. here in el paso, texas, some migrants have been sleeping on the streets as shelters remain at capacity. city officials fear another surge could be coming. cbp says that in april, when title forty two was still policy, there were more than 200 11000 migrant encounters. border patrol agents arrested 16 people on the fbi's terror watch list who were attempting to enter the u.s. illegally. it's raising concerns among lawmakers about who may have crossed the border undetected.
10:04 pm
it takes years for asylumma hearing hearings to make the court so wonder. the biden policy, they wait here in the u.s.. last summer, republican governors greg abbott of texas o and ron desantis of florida relocated some migrants to sanctuary cities. >> man, after all, democrat politicians who put their money where their mouth is now. is after taking in tens ofafter thousands of migrants, mantay of these democrats, like eric adams of new york , are mia seeking a very different tune.s, >> we have one hundred and eight thousand cities, villages, towns, if everyones. takes a small portion of thatven and if it'e s coordinated at the border to ensure that those who are coming here to thisthis country in a lawful manner is actually moved throughout the entire country, it is not a burden on one city in chicago >> ,migrants have taken overicago,m several police stations. rebecca brannoign is an independent journalist. >> she captured all of this
10:05 pm
she captured this video you are seeing on yo video you are seeing on yourn an screen. >> and she joins us nowd sh with more. thank you for being here. tell us what you look. there's nothing like eye witness testimony.. >> tell us what you captured, what you saw. well there is, chicago is out of tim, money and space. and that actually came frot m top aides to former mayor lori lightfoot last month. and so now we're seeinnow weg at a hundred migrants arrive per day in chicago being droppedg ab ofouf across the city at various police stations.d and yesterday i visited eight ofof those. and what i saw w was not good.d. living conditions are sustainable. living on top of each other, eating and sleeping off the floor.p h other, some are ill, some have lice. some stations are even dealing with bedbugs. and it's now created a unsustainable situation environment for police officers who are now being taken away from their daily duties. policehaving to deal with crime, whatnot, or dealing with ther dl residents who have to come to the stations because they are now having to act as social workers. socia looking after these individuall. . and again, these stations and officers aren't receiving
10:06 pm
an noty aid from the city or the government is , in all my conversations, when i spoke to them. >> yeah, you mentioned resources. i mean, obviously, law enforcement, health care, education. don'an, i don't know a single police officer that went through the academy sot they could wait. omega's, but that's what they're being asked to do. >> and i would assume that thaot would be at the exclusion of doing other things which may be desperately needed in chicago, like actually enforcing the law. >> yeah, some of these officers have personally purchased necessity, like baby wipes>> son and food for these individuals.u cedand again, this humanitarian crisis has now fallen on our police officers, our community members and residents who aren'tn on receiving that ad from the city. cities like chicago who have advocated for being a sanctuary city. all right. sa so it's havingnc a n impact on onmpac cities like chicago and new york and others. >> i assume it's also not very pleasant conditions for for vermigrants. me to this
10:07 pm
i mean, i understand people wanting to come to this country. i understand tha countryt even s not warranted, not legal, not justified, i do understand it. >> i assume the conditions are not good for them either. you know, it's a mixed bag in speaking with some of these migrants. they are grateful to be here. bt but in speaking with them, it's very clear they they didn't thleeping on aey d police station floor. have no they have absolutely nowhere to go.wheran and everyone i spoke to didn'to have family here. so i they'reno just waiting.in and officers i spoke to said wed don't know what's goingcers sai to happen. could go onis going for t montd and it's unsustainable. these people have nowhere to g o . >> all right.unsustai we talked about what does we ta , for seeking.ylumlked asylum. i want to play something for for you you , then ask you a questionti. on the other side of thi s clip. >> being in venezuela in the current political position is now did they ever feel thatl they were politically or religiously persecuted, especially when it comespoor ree to them applying for asylumg fo here in america? no, nor, no. what you see clicking
10:08 pm
on hengshui from the lines, i see back to . so they're saying there's definitely financial insecurity. but as farres as religious orsi political persecution, not so much persopolitican. >> i >> and so i blame the united une states for that. i meand , our law does make allowance allowances for people that that are fleein g persecution, but that does not include economic opportunity. that and what i heard there and , you know, credit to them telling the trutforh, they're ny being persecuted for their religion. they're not being persecuted for their political beliefs. not beingit is economic opport and that is not, as is understand, a law, at least a valid asylum claim. >> yeah,a and i don't blame them either. these migrants, again, i do believe our own governmenteve ot and these cities that have and advocated and pushed for being sanctuary cities pushe have now fostered and helped create this humanitarian crisis. helpeand it's now fallen on oun
10:09 pm
police officers, our residents f and community membericers,s who aren't receiving any aid,er again, from the government ors the city. and these migrants are just as confused as you and i. all right. so we we documentednt the increase in those seeking asylum from 2008 and the increase has been exponential. i would assume that there's at least a chance, maybe a reality that after the expiration of the title 42 , those numbers may get even greater and there may be even more of a strainn on on the forces of these municipalities. that already can't afford it.afd >> right. i mean, hundreds are arriving by day in chicago in placesy like new york city. i do know i do knoin chicawgo new york city is constructing right now a place on rikers island to house about seventeene hundred beds there.s an and in chicago, they arethey looking at housing or turningtun a former high school into a place to house migrantse migrs and their community members aret are concerned with what the costs will be for them.
10:10 pm
and ultimately the effects it may have on crime already that they're dealing with . >> well, i guess the good news is new york at least found some use for prisons. rebecca brennan, thank you very much for documenting and coming on and sharing with us tonight.. >> thank you for having me.the s the crisis at the border does not stop at the border. the consequences are felt nationwide. and i'm sure a law enforcement believes it's not the law they're enforcing rather than the politics of the currenw theo administration. nothing quitlie like risking your life or somebody else'sou politics. r life >> jonathan fahy is a former acting director of ice and he joins us now. jonathan , thanks so much for being here.r being politicians in the media cannot stop clamoringe a title 40 to.s >> so, so. so let me ask you this. what is leading to the increase in asylum claims?in i mean, we documentecread froms8 up to two thousand twenty three to two thousand four percent increase. >> what's it? well, i thin a 2k you hi00 it in your intro and just your other point. it's alltro. politics.
10:11 pm
everyone knows these aren't legitimate asylum claims. by and large . has mad but this administration has made it known that if you come to our border, falsely claim b asylum, you are, in effect, an o american citizen, because once they get here, they get everyn benefit of citizenshipamericanhe and oftentimes more than u.s. citizens. and you were talking earlier t moreabout you get a court dat you know, four or five years down the road, be in newark, new jersey at nine , 30 like that, somehow even remotely serious. it's so laughable. and this administration has no intention of changing because, you know, a lot of and you also made this point very good thate the issue doesn't end at the border like we always talk about the border crisis. . but this that's the manifestation of this immigration problem. which you see in new york . ironically, eric adams brought it to the attention, i think unwittingly. but this is a very expensive problem for all americans . and wherever they go, there's lots o.f lost. hi and you hit on those with the education costs, health care costs and those don't go away.
10:12 pm
once people are here,e they remain. and they these burdens remainam on the american citizen. a and there doesn'nd theret seem e anything that is driving thiss administration to change. they talk about things like comprehensive immigration reform is needed, which inthey d effect, is this amnesty plus codified open borders is what they're really saying is just a euphemism, but they're not t changing. >> all right. heotyou're a really good lawyero i need you to help me with the law. let's say you get a court date and you abscond. you don't come.ab't, and and then eventually they find you and you have your asylum hearing. is there any is there any consequence for not honoring your court date?r r blowing for just blowing it off untily e they come and find you ? is there any evidentiary or presumptions that make it it a negative consequence of a negative consequence of not showing up when you're supposed to show up? >> well, it'ot s even better than that, because if they don't show up, this administration has made tp, the it clear they t even go and look for them. so if you don't show up,, yo you you are almost assured they will not find you unless
10:13 pm
you are convicted of a very unls serious crime. and then it doesn't matter it d' anyway. so, yeah, they're going to even and then when they get their asylum claim, even if they're ordered deported, they're not immediately just whisked ouy art the door. they'll order they'll be they'll have appeale processes and ofteappealn they'l be ordered to self deport. so the consequenceeds ar te relatively minor, if any. and really, they don't want people to come to court. wan they want to stay. and that's this administration's policies. ant them tthey don't deport any. i think they have deported fifty nine or sixty thousand people last year. and okay, we're bringing inle a, three , four million people a year, most of them illegitimately. so, so doing the math, how do you how do you get all of these people out of here and thisnd tt short answer and the longy ar answer is they're not going to do it and they're not even going to try what you just described as a crisis. >> and the only person in america that doesn't call it that is alemi orcas. and the bad newss for us is he's the one in charge of the border. jonathan , you thank you sog us
10:14 pm
much for joining us . thank you . politicians, media, cannot stopy talking about the debt ceiling, but is it reallyp just anotheru manufactured d.c. crisis? manufactured d.c. crisis? more on that next. >> obviously, we got termites. first thing is you got to know'l what they're biting on . i told you to hireall the orkinn i did get a pro orco pn pro . >> i got this. got termites. don't call any pro called the orkan pro or get the best in pests on the left. >> your mouthwash with the burning sensation and on the right close is the alcohol free, gentle mouthwash that works without the burn closes. mouthwash is fresh and breath improved. >> gum, health and strength in t close. this works without the burn. >> says he was only 47 aneurysm . >> did he have life insurance? >> do you know? you've got to get on it.

have you ever wondered how defacing a monument will keep the sea levels from rise. yeah. me, me either. but some little anarchists are convinced there's a correlation and fox news trace gallagher joins us to report on the latest act of climate vandalism. >> hmm. good to see you . these climate activists have yet to explain their reasoning ,as you mentioned, exceptei to say they're against fossil fuels. so the theme now appears to be that the best way to save the world is to destroy some oft the world's artistic treasures. the latest example is the attack on rome's historic trevi fountain, where the group ultimate generation, or last generation, jumped into the trevi fountain and poured buckets filled with liquid charcoal, turning the pristine fountain waters black . the protesters say the reason a defaced the trevi is because of the , quote, increasingly the visible impacts of climate change. and they point to the recent beo

devastatinfg floods in northern italy, where heavy rains followed extreme drought and did significant damage. of course, historians inconveniently remind the protesters that the rain drought pattern in northern italy has been happening for thousands of years, maybe millions. the protest was also linked to the world meteorological organization saying the planeter in the next five years is moreos likely than ever to surpass one point five degrees celsius of warming compared to pre-industrial times. not saying it will surpass that temperature, mind you , but saying it's getting likely. is and it's not just the trevi gfountain being targeted. last month, climate protesters it used paint to vandalized degasrd sculpture at the national gallery of art in washington, d.c.. activist have also thrown mashed potatoes at a monet painting in the barberini museum in potsdam, germany. and , of course, climate protesters glued themselves to john constables, the hey wayne painting at the national gallery in london, though we pat should note, we're told nationa the glue was not made from

t negotiate at all.gotiat so that is just ridiculous. and two, to speaker mccarthy's credit , we've not in the five v months since january 12th, today, we've not only passed the debt ceiling increase, we passed a bil l to get rid of eighty seven thousand irs agents. we passed a bill to to to pu get in good energy policy. we passed a bill that's enforcing our border immigration enforcement legislation, and we passed a parental bill of rights while pathe senate and the white hous. have done nothing. so i think we're going to get a good agreement in the end because i think the country knows the position.e co speaker mccarthy has takenuntry the house republicans haveen taken is the common sense i position. chairman, i feel a little bit silly having a conversation about about too much spending with jim jordan. you may have been the most fiscally conservative colleague that i had. i mean, anyone who's evetfiscald gift exchange with jim jordanon knows how fiscally conservative you are. knows but much in the time we met invu 1411 a, the debt was 14 trillion and now it's more than doubledoe that. and i do wonder, is there a political appetite foris thera

tackling the drivers of d the debt? >> yeah, rivers o i think there . and i think we're goingt with to start with that with this agreement. speaker mccarthy and house thaa. republicans are committed for the first time that i think in our time in congress. today is the time i've been in congress where we're s actually committed to spending lesspe nex next year than we spt this year. that never happens around this place. it always seems year s to go in justs seems to one direction. if we can if w gee can begi n to reverse that and that's what we're committed to doing, then i think we start to sendnal, w the signal. okaye , now we've made that step. let's look at some of the other drivers of our debt and let's get a handle on that. but let's take that first step, and that is a huge step. if we get it, particularly whene you're thinking about divided government where the democrats control the senateyo and thewe t white house. we just control the house if we're able to actually spend less than we spent in discretionary spending this year compared to last, that is a huge step in the right direction. is a hug>> i you keep saying huge steib. i think it's a minort miracle. i think the fact that you and speaker mccarthy kept all the frogs in the wheelbarrow,
10:25 pm
i mean, you only got, what, fivet a five vote margin? i'm assuming the democratse didn't help you pass the bill.no i think it's a minor miracle that you all were ablee to pass a bill that raised the debt ceiling. what aree debt you asking for in return from the biden administration? >> work requirements for able bodied adults spend less than we spent last year and some permitting reform that ene will help us with our energy bill . that is package. e.rgy. that's where the speaker wants to go. and i would just say this. i would just say the american a people. who do you think's going to gebr a better deal ? joe biden, who hasn't done anything on this issue injoe bi five months, is frankly screwed up. every policy arewha that he's that he's involved with , it got himself involved i with over the lasts two and 2.s a half years, or the guy who went 15 rounds the firsty to week of january to become becom speaker of the house. who do you think is going. to get you a better deal for the for the american people? i would bet on speaker mccarthyl and house republicans. i think we're actually goingd to get a piece of legislationper thatse spends less this year thn it did last year. and if we do, that is a huge win and a huge step in the the right direction for the american people. >> chairman, it seems like
10:26 pm
there are voices on the left, perhaps the far left, that are very unhappy with joe biden for even talking to speakeralking mccarthy. is he facing any pushback from from from the leftist parts of the democrat party? >> no, that's great insidet is trade. i think that's exactly what happened over the weekend whens negotiations kind of brokedown down. i think it was the left, whichis unfortunately now controls the democrat party, the radical left. i think they got to joe bide pan because he was probably,he was l i think, willing to start moving in our direction on worki requirements and on the spending levels. but i think the left got o a ho. of him. but again, i come back to i'llnn put my money on the guy who went 15 rounds the first week othe f january to becomee . speaker of the house. i'll put my money on him.ll put and where house republicans have beemon and how we've been able to come together and pass meaningful legislation outtogeth the house of representatives while the senate and the white house have basically done gislationothing over the laste five months. >> well, i'll put my money a on kevin mccarthy, but i'm alsoe going to put it on one a two time, three time ncaa wrestling champion who actually beat john smith in a wrestling

to just say, hey, look, we have a difference of opinion with you, governor , of this or governor of that or this state legislative body. we just think there's a better way. does it or is politics has been reduced to something as absurd as a travel advisory? >> well, i think politic has been inserted in just about every way of life. and democrats have smartly chosen to do it on race. and they've been winning this war on race for decades. unfortunately, black folks have been paying the price. it doesn't matter what city you are in, whether you be in chicago, baltimore, new york doesn't matter. they're paying the price for these policies that are being pushed out of the democratic party. we see this in the city of chicago where you have numerous failing schools. you see it in baltimore. where's the tribal diversity advisory for those places? why aren't they advocate the democrats? stop that. they stop progressives from pushing these policies that are harming black folks in the city of chicago. for example, 80% of the people
