we start this hour with a shocking incident at our southern border. look right there in that highlighted area. because a human smuggler is dropping a 4-year-old child over that very tall wall to american soil below. >> pete: this comes nearly two weeks after the expiration of title 42 and highlights the surgent need to stop those cartels and human smugglers. >> we have been watching, do you see the baby actually fall the 4-year-old. right there they say the child is okay. griff jenkins is live at the white house with the latest for us, griff? >> good morning, ainsley, pete and steve, these videos are far too common, yesterday the border patrol chief raúl ortiz tweeting that video out. it's hard to watch. it's heart breaking. you see the smuggler dropping the 4-year-old toddler near san diego. near the san ysidro port of entry. he drops. fortunately he was okay. border patrol agents and emsz quickly responded to begin

rendering care and first aid to the child who fortunately was okay. but, at the same time, that agents are rendering care, they heard gunshots near their position and had to call in gunshots. it's a snapshot, guys of how much control the cartels and smugglers still have. they are not slowing down business as usual. despite the drop in numbers of those migrants we see crossing illegally and turning themselves. in meanwhile, in the big apple, no slowdown in the surge happening there. new york governor kathy hochul, mayor eric adams calling on the biden administration to expedite work authorization and expanded protections for migrants increasingly showing up while also blaming republicans for this crisis on their doorstep. here is mayor adams. listen. >> republicans as we know have blocked all attempts at fixing our broken immigration system. intentionally causing chaos and dysfunction. so we are calling on the white house the united states

that's because of our fifth amendment right and the constitution to remain silent. that includes when you are charged in court; however, i find this very curious. i have seen it before. i have had a defendant do that before. it means absolutely nothing. >> because the constitution, as defined in case law, has the judge enter a not guilty plea for the defendant. the law presumes that is what the defendant wants. but why would he do that? number one, disdain for the judge and the court process. maybe he is a sovereign citizen where he only answers to his own autonomy. you know those people who refuse to acknowledge the irs and they end up sitting in jail because of it. also, he could be laying the groundwork for a mental incompetency defense. in idaho there is no insanity defense but there is mental incompetency. i find it really interesting. what about this? you know, one of the victims and we think it's dylan mortinson at the murder scene that night the
