is hugely popular. he's an accomplished governor from the free state of florida. he won reelection by a million and a half votes, which was a record, taking majorities in both red and blue counties. and as of now, desantis has a lot of ground to make up if he wants to challenge former president donald trump for the nomination. brand new fox poll, the former president is ahead by more than 30 points. the real clear politics average has him up 34, a new quinnipiac poll has a similar result with trump up 31. donald trump is the front runner by a wide margin. it will be a huge challenge for desantis or any candidate to match but the primary really has just begun. and is customary for every republican tmob, the media, the democratic party are waging nothing but a completely dishonest, lying smear bee searchment campaign in this case against desantis seemingly operating in unison.

[cheers and applause] >> sean: so governor, let me start with you tonight. i actually wasn't sure if ron desantis was getting in until the end of april when the legislature made it possible for him to run and keep his seat as governor. he's running now. real clear politics average has trump up by 34. okay. now desantis is averaging about 20% in the polls. how do you see this race playing out? >> it's a long way before anybody even votes in a caucus or primary. so there's a lot of time for things to happen. ron desantis clearly steps into the race in the number two slot but it's a distant number two. and what ron desantis does not have at this point is a fa natically loyal base of people who are as fanatically loyal to

take. how do you see this race playing out? obviously different than 2015/16. >> well, first of all, boy does mike huckabee make an incredible point here, which is that if we create the precedent that the media and the weaponized fbi and doj can take out our candidates then they will do this again and again and again for the rest of our lives. to me that's one of the strongest arguments to rally around president trump is to say to the doj and the fbi and to alvin bragg, and to all of the democrat prosecutors, you do not pick our candidate. we pick our candidate. and i think the strongest argument that president trump can make in the days ahead is, they are all coming after me. they are all trying to stop me. they are all trying to destroy me because they know that i, if given the chance, will destroy their reign over this country. that is what this primary is all

♪ >> sean: breaking news tonight, a new escalation in the fight between congress and the fbi over a document that purportedly now accusing your president, joe biden, of participating in a criminal bribery scheme that he took specific action in exchange for money for his family as vice-president. now, the house oversight committee chairman james comer says he is now prepared to hold the bureau, the fbi bureau, that is, in contempt of congress if they do not return or turn over that document. now, we asked the fbi for their side of the story. they actually responded and they told us that they remain, quote, committed to cooperating with congress's oversight request on the matter. well then hand it over. all right, to that end, fox news has learned tonight that the chairman, chairman comer and fbi director wray, they are set to

committee are prepared now to hold director wray in contempt but now we're hearing you will be meeting with director wray. at issue is this 1023 form that an fbi whistleblower made you aware of that talks about specific actions joe biden may have taken in exchange for money? >> that's exactly right. i sent director wray the letter threatening contempt of congress proceedings if he didn't hand over the document at 3:00, just a few hours prior to coming on your show, sean, i received word that the fbi director is committed to meet with me next week in washington, and we can discuss this. but nothing's going to change with respect to holding him in contempt of congress if he doesn't turn over the document. not only do i expect the document i expect to know exactly what the fbi did to investigate the validity of the claim. because as i said on your show before, this claim is consistent

with activity that we have seen in other countries around the world, and it all stemmed over the course of 2015 and 2016 during the end of the obama administration when joe biden was vice-president and he took it upon himself to travel all over the world to some of our adversaries around the world and talk about foreign policy and foreign aid. >> sean: so but a 1023 is a confidential informant that would give information that they would take it, maybe it's not fully corroborated. now the question is, did they do a full investigation, a. and, b, and secondly, if they feel or fear that this may be made public, i'm sure you would agree to see it in a executive or a private setting. would that be fair? >> that would. fair but it's not classified. their argument that says they don't want to out their informant i agree with that 100%. there's a process in washington

for that that's called redacting the name of the informant. that solves that. if the informant's claim isn't legitimate then again why are they about the informant. we learned something during the second conversation we had with people representing the fbi when they came in on talk to my staff. our specific request, first of all, said, we want any form 1023 dated in august 2020 with the word biden on it. and you know what they came back and said, sean? they said, well, that would just be too many documents. we can't possibly prepare all that. so, you know, what do you mean? how many 1023s are there with the word biden just for one month in 2020? this is what we found with the treasury with the suspicious activity reports. there were hundreds of these indicating potential wrong doing of the bidens with respect to financial transactions. now the way thatity understood

the fbi, there are multiple form 1023s perfect taking to biden. so we had to narrow the focus to say okay, biden and the world $5 million. specific document. >> sean: let me ask you this. do you have evidence that the fbi may have more than one confidential source in the summer of 2020 alleging a biden bribery scheme? and what do you know about hunter biden wooing chinese executives with high level ccp ties while fund raising for a movie venture with bulger's nephew? >> well, with respect to china, more and more comes out every day. we've already had one press conference where we proved that joe biden was not honest with the american people during the presidential campaign when he said his family never took money from china. we've proven that and i believe there are multiple transactions that we'll be able to present to the american people.

with respect to the fbi, they could have had many meetings with this informant, but the way the fbi described it and the way that my staff and i interpreted it was, there were multiple 1023s. so it could have been the same informant that the fbi met with multiple times. >> sean: but do you have multiple sources is what i'm asking you? >> it could be multiple sources or it could be one. you know, again, the name of the informant is confidential, right?. >> sean: okay. anyway, james comer, thanks for the update we appreciate it. keep up the good work >> as the house continues to investigate the biden family business, fox news digital uncovered new e-mails that show hunter tried to set up a movie production deal with his communist chinese business partners and of course that was all happening while daddy, pops as he calls him, was the vice-president in charge of u.s./china policy.

and as the doj's investigation of hunter continues with no end in sight, the boxes hoax appears to be coming to a close, former president trump's attorneys are now requesting a meeting with the attorney general merrick garland to discuss that witch hunt. here with reaction fox news legal analyst gregg jarrett former law professor allen dershowitz. professor all i ever see out of christopher wray is him protectsing the institution rather than returning the institution into what it once was, america and the world's premier law enforcement agency. why? >> well, what we need is an independent investigation admission like 9/11 to look into the fbi to make it a non-partisan issue and return it to the glory days when people like louis freeh respected it. but i suspect this meeting that

is scheduled now between the attorney general's office and trump's lawyers probably means that trump's lawyers have been told that trump is either a subject or a target of a criminal investigation. it makes a big difference. a target means likely to be the indicted, subject means they're still considering the issue and he may or may not be indicted. but normally meetings like this only occur kind of at the last minute in an effort to prevent indictment. so i think we're seeing a winding down of the investigation. which of the charges will be the subject of an indictment, whether it will be the confidential classified material, a coverup of the material, january 6th, perhaps the fulton county. but i think that at this point trump's lawyers have something to worry about an indictment. you can indict a ham sandwich the hard part is whether there

will be a conviction but i doubt it based on the evidence. >> sean: there we go again gregg jarrett. there's the doj, the fbi involved in the next presidential election. >> they tried to interfere in the 2016 election, the 2020 election, they'll do it again in a couple of years next year, 2024. trump is indeed being treated fairly as his lawyers allege, but their complaints, sean, will fall on merrick garland's deaf ears. he is a hyper partisan towards the law to persecute if not prosecute trump, and this mar-a-lago case is a civil dispute over documents. it's governed exclusively by the presidential records act but garland decided to criminalize it to raid trump's residence. and to do it, he had to actually reverse long standing doj policy that a former president can take pretty much everything he wants
