examine the public corruption aspect and not simply scapegoat hunter biden as an individual? >> i can't comment about the investigation, other than to say all the matters involving hunter biden are under the purview of the u.s. attorney in delaware. it is not restricted in his investigation in any way. >> greg: but the hunter saga does not end there, republican james comer will meet with fbi director christopher wray after the bureau refused to produce documents on biden family income. >> this is one of the most serious charges, accusations, that has ever been made against any public official in the history of the united states, and the fact that the fbi just keeps brushing us off and saying "oh, just trust us," it's not going to cut it. we have had to go to extreme measures. i already subpoenaed director ray for this information, and they turned their nose over there, so now we are going to the next step. >> greg: judge, laid out for us. what does this mean?

where are we going? is this going to explode? is this worse than watergate? >> jeanine: i knew you were going to use watergate. i knew it, i knew it. you know what was worse than watergate? the durham report. that kind of went along its merry way. if anyone thinks it is easy for a whistle-blower, whether the irs or fbi, to come out and subject themselves to this, literally, they could destroy their career, their family, their livelihood, we side with the fbi whistle-blower who was moved out of state, told when getting a new house, you're going on unpaid leave. but it makes sense, because no case should take more than five years in a grand jury. and it's almost going on six years now with hunter biden. the crimes are replete in terms of the evidence that we have, especially as it relates to tax evasion. $2.5 million paid back, as it relates to the pistol permit application. but here's the thing. merrick garland says oh, no, i'm not doing anything.

this is a trump-appointed attorney, united states attorney. but the truth is, before trump, i think it was obama who had him. this guy has been there a long time. i don't know trump even had any idea about any of these attorneys. the thing is there is no consequence. if the party in power is the party against whom the complaints are being made and where the whistle-blowers are all coming out, whether or fbi, irs, or that stenographer who was obama's stenographer commended up complaining about d vice president biden. nothing is going to happen if you don't have a doj, don't have a department of justice, if he can sit there and push back and nothing will happen. that just adds more and more to the belief that there are two systems of justice. >> greg: exactly. harold come in the green room, you said to me, how impressed you were this was on cbs, and that this could be unimaginably worse than anything we have ever

seen, and then you invited me over for dinner this weekend. care to comment on either or both? >> harold: i definitely invited you over for wood dinner this week. the first part, i'm trying to reconstruct my memory about. good to be back. i'd say two things. the judge is right. the whistle-blowers should always be protected. their process they go through the irs and doj that are a little different than perhaps some of the other agencies. if, indeed, what this whistle-blower is alleging is true, and this matter has been slow walked, after today, it won't be slow walked any longer. i do think there is curiosity around, the judge pointed it out, as to why this is taking so long. i am fatigued by this investigation. if there is something there, then hunter has to face, hunter biden come as a defendant would have to face them. not a defendant because he has not been charged with anything, you almost feel like he has and i think the american public feels like he has because of all of the things that have been said, but i think after today, i

have read in some of the articles, i think i have the same background material since judge, that you got this time. the whistle-blower to testify privately with the ways and means committee, the tax committee in congress tomorrow, and i hope democrats participate, and republicans, as well, and if there is something here, if this gentleman is telling the truth, and i agree with you, when you come forward, this is a lot of risk you are taking. they should bring mr. garland back before the committee and ask, how do you counter this? perhaps they do it in private, but this deserves a public answer. >> greg: you are still invited. i agree with you, we should lock up merrick garland. lawrence, there was something here. we were all saying the same thing, five years, what are they going to find something, but apparently they did find stuff, but just chose not to pursue it. to be what i will get to the five years later. first i am going to do with the democrats did when there was a

whistle-blower for donald trump, i found him credible. i found him, as a nonpartisan. he spoke to the issues. i don't know where he stands on the political aisle. that is what they said the last time. now, harold talks about the fatigue. well, we could litigate this before the election, but they realized how it was going to impact the last election, 79% of americans say they would have changed their vote based on the information that we know now. if you look at the headlines from the democratic party, the only thing they are talking about right now is the quote from james comer, saying that joe biden is plummeting in the polling right now. they got all of these intelligence officials to sign onto the letter that they knew was not true, didn't even verify any of the information. to say all of this information was russian disinformation. it benefited their candidate.

democrats are tired of this, but the time to have this debate was during the election, where the press could have dug in, where they could have reached out to their sources, where they could have talked to the fbi, the cia. they would have did it if it was donald trump. look, this is the first time i i have seen republicans in a long time fight on an issue. i think comer has something right here, but again, let the process take place. they have only been in there how many months right now? give them their due, at least they are not making allegations that are unfounded. >> greg: that's true. >> harold: they started investigating hunter during trump's time, not just as the this started now. this investigation has been going on for three years, even under president trump. >> jeanine: how about biden, when obama's people said that biden and his son should not be involved in some of the stuff overseas? so it started with obama. >> harold: the investigation didn't start -- >> lawrence: with no subpoena

worse than trump, making him worse than worse than hitler, so as long as we have this brand of demonization by the democrats in the media, you are never going to have a candidate that is trump minus the drama because they are always going to create the drama on top of everybody. "vanity fair" already calls desantis a white supremacist. they tell people hillary says don't go to florida, it is a threat to your personal safety. this is something about governor desantis who really looks like a nerdy version of bradley cooper, let's be honest, he is not a threat, but these networks are now going to be in a quandary, especially cnn, they are already in trouble. if you don't say desantis is as dangerous as trump, that is an endorsement for desantis. if you say he is worse than trump, then you look like a ass because you have been coming out this hysteria that trump was an existential threat and now you find a new existential threat that is worse? people already see through this.

it can't last forever. i don't know. >> jeanine: but, you know, the truth is, harold, the trump hatred has lasted forever, but at the same time, trump still has the highest numbers, the biggest number, and the people who were with trump are dug in with trump. so, is this really about biden, as opposed to running against desantis as opposed to biden running against trump, doesn't come down to whether or not they hate trump more, or is it that desantis has a chance to catch up and be as big a trump against biden? did that make any sense? >> harold: i always understand what you are saying, judge. my take on it is this. desantis, 6-8 weeks ago, with a stronger candidate than desantis is today, largely because of the last eight weeks. donald trump's numbers have grown and his numbers have shrunk. trump remains a formidable front-runner on the republican side. i agree with greg in one regard.

i think a lot of people would never have known he had announced. the vast majority of americans have not been told that he had a glitch with the thing with twitter. that being said, i'm old school. i think when you run for public office, particularly for president, and you are announcing it, visuals are important, particularly for a candidate who many people say might have some difficulty interacting with people. that he may have some views that may not be consistent with sort of a national, mainstream set of views. i think you would have wanted to have a visual and let people like you, let people see that there is something appealing about you. he is a good-looking guy, to even be compared to bradley cooper is a good thing, so to be on television and lay out your views and your path. two, it would give him an opportunity even more so to say so mr. trump, i want to debate you. i have ended my lodge speech saying, mr. president, and understand you don't want to debate me, perhaps you don't because my ideas are superior, i hope you debate me. i think karl rove nailed it in the washington journal. i don't always agree with karl but i read him because i think you're smart. i think we are seeing a big battle set up in the republican

primary between the tim scott brand of politics, which is sunny, kind of positive, can link it to reagan, and those that are not pure i'm not saying donald trump is not sunny, but his approach to campaigning is very different and sometimes can be punishing, so we will see where it goes. >> greg: would you announce on "the five"? >> dana: it would be different, and it is on television. bring your family and make it traditional. >> harold: had a glitch. >> greg: i am the glitch. >> jeanine: you know what, dana, fox news last night, desantis talked about things like policy things, like the border and crime and inflation. how did those points compare to the value pointing of the woke ideology? >> dana: it's a great question. i think one of the things he has demonstrated now that people get to see him a little bit more in that interview that trey did last night as a policy fluidity with complete competence at an example for everything that he is talking about, and he doesn't

hesitate, and he knows his stuff. if that is what you are looking for, that is pretty interesting for people. the launch, maybe it wasn't great, but i am thinking about elon musk. he is willing to have a $2 billion rocket blow up as an experiment just to see, what did we learn here? so i think that one of the things they did last night was find out, okay, twitter spaces needs a little work, okay. now, maybe i'm going to be splitting hairs here but let me do it for the perspective. last night was an announcement that ron desantis is running for president. his campaign office is billing next tuesday in iowa as their campaign kickoff event. and that is where i think, harold, you are going to see more of the tradition that you are mentioning. i think some lodges are memorable. most are not. let me tell you one that is memorable. kamala harris. amazing launch, remember all of the people that were there, even president trump at the time said, wow, she has a good chance, she was the first want to drop out. so the launch doesn't really

matter, it is what matters after that. an opportunity for ron desantis, there is a lot of misconception out there amongst people, i heard somebody today say, well, isn't he advancing racist policies, and isn't he against gay people, and isn't he banning all of the books? and i started to try to explain on their behalf, wait, that is not my job, that is his job, and he has a big one in front of him on that front. >> jeanine: he does have a big job. you know, lawrence, biden's numbers are in the 30s, i mean, and kamala, talk about her falling out, she is even below that. how is it that biden is so strong against some of the republicans? what is that about? >> lawrence: i don't think he is strong, honestly. >> jeanine: that's what the polls are showing. >> lawrence: i think he had his shot, 52% of americans felt like under donald trump that their lives were better, and

they chose joe biden strictly because they wanted to bring down the temperature, and that he was supposed to be the elder statesman, and all of that nonsense. that's over. we have seen how he has governed. he didn't unify the country. life is not better under him, and it's easy to vote based on emotion, when life is good for you. now you've got people losing their businesses. you've got egg prices going up. which is why, i think, as i travel the country, the republican base, and i think people discount them so much, but they are not moving. they are not moving. and they want a firebrand, as well. he didn't do that last night, desantis. it was boring. it was stale, and he was reading off a paper. i can tell because his cadence changed when he was with trey. he had a little bit of emotion there. >> greg: 's hair. >> lawrence: maybe got his

attention. if you want to take on the leader of the republican party, someone -- listen, i'll tell you this. there is a reason why -- people aren't afraid of donald trump in washington. they are afraid of his voters in the republican party. they know the way he is able to gravitate them because he is the first one that bypassed the typical washington stuff and listens to them. desantis, as polished as he is, he is still a typical politician, and he showed that last night. and if he wants to take on donald trump, he's going to have to change his strategy. hiring the same consultants -- and i know all of them -- is not going to help you, bud. there were a lot of people that were published in 2016. ted cruz was known as a firebrand of conservatism and could put the policy debate out there. knows the constitution by heart. you got rand paul that was on the stage. jeb bush that inherited a political family that knows all the things to do. and it still did not work.

so, if you're going to run against him, and i know desantis, one of his talking points is now, i am the only one that can win back, i heard that in 2016, as well. you got to make a different debate. >> jeanine: all right vehicle coming up, liberal cities are going to crap, literally. i saw them getting high, openly. cops are around, but they are not supposed to do anything. just supposed to make sure no violence happens. and then, in the middle of the day, i saw when they started to turn into the zombies, literally. i saw people with needles literally hanging out of their arm. and for the life of me, i don't understand how that is compassion. i also saw the people passing out cell phones. i saw them get three meals a day. being delivered. and this has become the new normal. now, we just showed footage of the mayor right there, how she was able to be shielded and brought back into city hall. the people that live there on a day-to-day basis have to walk through there. they don't get shielded. they step over the needles. they step over the human feces. they also have to deal with violent people. i mean, we are talking with people -- look them in the eyes, that's what you do, keep your head down i don't look them

law and order. and until you have law and order, you can't do anything. you can bring people into clean it up, to make it look good for the cameras, but you can never resolve this situation. compassion is killing people. we spend so much money on drug addiction treatment, you know, it's great. it's a disease, it's a horrible thing. but damnit, if you can't get them -- excuse me -- get them in treatment come up with them in jail for six months and let them deal with -- >> dana: a lot of their family members want that. >> jeanine: that is the only answer. people underestimate vehicle they cannot comprehend the importance of law and order and consequences. cleaning up for the cameras is a bunch of nonsense. >> dana: investment in the cities is fleeing. williams-sonoma is now leaving, there is no where to even go down, there is no reason to go there if there is never going to be any shopping.

>> harold: the jobs to be created, you lose your tax base so your schools continue to worsen. whatever we want to call this experiment, and i will go right along, this is a liberal experiment, it has failed, and the political leadership in any city, in this city, has to recognize and accept that and if you can't take icing on the cake or whatever the video was -- i believe that was today -- something is wrong. i think politics at its best, if you have a set of ideas when you are elected, you run on them, you try to implement them, but they don't work, the mature thing to do, the smart thing to do, is to have a surge of maturity saying i'm going to change. not because i'm wrong but my ideas are not working. we need politicians on both sides -- and i would agree, to some extent, judge, this has largely been democrats in san francisco, but the reality as it should just change, and stores are closing from homelessness out of control, crime out of control, you talk about being careful not only for yourself but for your pets, this

we are looking at. she has mental health challenges, also come in to help -- in all seriousness, i hope she gets some of the help. an enduring democracy. i have agreed with things that some have not, not on the show but we have -- we cannot coddle this. if you have students out peacefully projecting a set of views that you disagree with, a professor or a student, you have no right to behave like that, and taint his right, you would fight her from this job at another job at an academic institution, not because of her views but the way she behaved here. i hope she gets the help she needs, and i hope know student has to be around that. >> jeanine: okay, here is the thing. >> harold: i was trying to be civil, judge. >> jeanine: why is it whenever somebody does something that we comprehend we say, oh, they have mental problems. no, maybe they are just mean.
