wiping it away in primary numbers. practice dimension present biden's job approval numbers are looking pretty left. the job approval standing at 42%. he's underwater on several key issues. 50% disapproving of the job he's doing. nearly half the people polled say the policies are hurting their families. so if you are when these other ken is not named donald trump or donald trump is clearly leading it all the polls right now. how do you use these negative numbers for biden to start chipping away? you've got to be part of the 10% threshold right now it's only trump and desantis putting up the major numbers. if you are one of these other candidates how do you use these rough numbers are present biden to start moving your way up the polls? >> you have to look at that. if you look at every area that you just name biden is doing absolutely horrible. so as a candidate you take each

of these different subjects, each of these different levels of issues. you try to put your own agenda against these issues to see if you can't get a bump in the p pulp. but that's about all you can do. right now, like you said you only show the poll that shows invited completely negative polls. right now it is tea up for a new change. meaning a republican change. they have had for years under democrat leadership and biden is not cutting it. not only that but a lot of people are not very excited with the sheer fact that with the aesthetics are with biting. a lot of people are saying he is too old, whatever. but look at these settings. see where he stumbles, he asked -- make it not look like a cheerleader. a lot of people are upset with that. there are a lot of plays that

get out. get out. >> instantly to now former employees identified as rachel rogers and jennifer ferguson say they recorded the incident and in the video you can see three masked individuals come into the lululemon store. they appear to take terms grabbing handfuls of clothing while the two women yell at them to get out. the mass could then do eventually even runaways the lululemon employees also exit the store to continue filming. they do not appear to physically stop the individuals. said ferguson and rogers say they called the police because the incident was part of a string of robberies at that particular location. note lululemon denies the two women were fired for calling the police alone. following the suspects may have played a part in their termination. we looked at the lululemon employee handbook and it says the company has a zero tolerance policy for chasing or physically engaging with the suspect or a robbery. a spokesperson for lululemon tells fox news and part of the

statement quote the safety and security of our employees and guests is always lululemon's top priority. protocols in place to uphold a safe environment. one of policies as you mentioned, arthel is to call 911 after the suspects have left the store. employees in this case did do that but unfortunately they are looking for new jobs. arthel: maybe they will reconsider. maybe they will say it listen you have to say safe and here's why the rules are in place. it's a warning don't do it again. i've time telling i have been in a store where that happened came in and started taking stuff. first of all i could not believe my eyes what was happening in my heart was racing. he was very disturbing very scary. it is discussing people are doing that. >> i agree in absolute shocking stuff. arthel: charles watson there in atlanta thank you. shannon: well said right there, arthel for this family is vamp

filing a civil lawsuit against amanda put them in a deadly chokehold on a new york city subway. marine vet daniel penny said he restrained neely to protect himself and his fellow passengers. he's out on bail after discharge with manslaughter. cb cotton is live on the reported lawsuit. what do we know about it so far? >> according to the near post the neely families are the manhattan-based law firm's attorneys about earlier this month to hold daniel penny accountable. now a letter from those attorneys reportedly reads please be advised this office has been retained to pursue a claim for personal injuries and wrongful death. your action resulted in the death of jordan neely. the word of this move comes within two days of a "new york times" report which said daniel penny plan to testify in his own defense before a grand jury next month. i move that could help penny dodge an indictment on second degree manslaughter. penny was arrested and charged a little more than two weeks ago.

for putting jordan neely in the middle chokehold on the subway at the start of the month. in his first interview daniel penny told the "new york post" he left all people and cultures and was not a quote white supremacist. the neely family fired back saying in part that penny's interview was an advertisement to soften the public's view of him. attic they never called him a white supremacist but rather a killer. now neely was almost reportedly threatening other subway writers before being placed in the chokehold. neely had more than 40 prior arrests in active work out for his arrest at the time of his death. mental health advocates and others have called neely's actions dangerous into land she is in. retired law enforcement elected republicans who held a rally this week sent a different message saying penny should be praised. >> he is a hero. he is somebody that was a good samaritan and jumped to the

shannon: welcome back. tomorrow horses were sadly euthanized this week and a churchill downs break that now makes 12 horses put down in recent weeks at the home of the kentucky derby. the famous racetrack on the number of fatalities in the last two months quote highly unusual. they say they are cooperating with investigations requesting a comment on this live on this what have you learned? >> hey bill, as for the two horses that just died there's a ligament rupture to front like on star during the race and lost in limbo suffered a similar injury during friday's race. both cases that you treated them to determine the horses could not recover for churchill downs issued a statement saying that betz made the difficult the most humane decision to euthanize them. their deaths add to the other horse fatalities a churchill

arthel: memorial day is the unofficial kickoff to the su summer. long days in the sun, splashing by the pool or just round the corner. as the weather gets warmer, parents are on high alert to protect their kids against potential risks from the sun, the water, and more. doctor frieda fisher's internal medicine for she joins me now to share some summer safety tips. listen again this weekend and summer time is all about eating on food like hamburgers and hotdogs. but, you have a list immunity boosting foods to toss in. i want to show the list to everyone that will talk about it. got gorgeous, garlic, broccoli,

not let them see you adding the spinach they may not drink the smoothie. making sure kids understand the importance of healthy eating making fun family project. >> is a really good tips and listen you know kids cannot get enough water during the summer. you have any tips for parents on how to keep the kids safe in the pool? >> yes, yes i want kids out having fun for it and want them swimming. but we have to remember that drowning is the number one cause of death in children less than five outside of birth. especially in-home polls. and so children should have formal swimming lessons does help to decrease drowning. also children should be supervised. supervised with attention is not just a bunch of adults around the pool so the kids are supervised with the supervise the children should know how to swim. should not be drinking alcohol. should not be distracted for even if there are lifeguards out there, parents still should have

children they are looking at here because swimming deaths drowning deaths can be quick and silent spray they can happen when no one expects them. arthel: thought about going into the ocean or the local lakes. should kids stay close to the shoreline? always under supervision any tips there? >> there's going to be really bad weather, bad tides lots of ways and it's advised you don't go out, don't go out. but for kids especially in the age of five and 14 there are a lot of drowning deaths for them pretty want to make sure the kids are experienced swimmers. that they are wearing life vests they do not go out further than where they can stand and definitely, definitely you want supervision. there are all kinds of things you want to try to avoid further could be rocks under the water. there could even of course be sharks out yes, stay close to the shoreline and follow all advisors and understand drowning deaths do occur in natural waters as well.

arthel: diverted given to such great voice in the last do you have any other messages or notes for parents and we are still in the middle of this holiday weekend? >> yes, yes, yes were there other things like a bike ride much encourage our kids to go bike riding. make that wear helmets for adolescents and teens also because according to the cdc adolescents and teens had a lot of head injuries with her not helmets read back to the swing pool, if you own a pull up make sure it's covered by a fence on all four sides with a date that is at least 4 feet tall and i cannot stress enough supervisors, no alcohol don't be distracted let's have a fun safe summer emphasizing the word s safe. arthel: those are great tips. by the way doctor frieda fisher your children love you way more and like you way more than the babysitter i'm just saying. thank you. shannon: arthel with pools and beaches all across the country opening up this weekend safety for all swimmers obviously going to be top of mind. but a shortage of lifeguards has some cities and towns taking some dramatic steps to fill the gaps. foxbusiness correspondent lydia hu has more on this. >> this pool and the city of chicago is one of about half that were closed all of last year. and now it is not clear whether this pool be opened as a city with a shortage of lifeguards. our goal is to open all beaches and pools this summer. we are very optimistic about the success of our hiring campaign efforts with this efforts here in chicago include a $600 retention bonus, weight certification being incentives like preevent tickets. the lifeguard shortage felt across the country the american lifeguard association planes a

type tight labor market approximate half of the three to 9000 pools are at risk of either being unable to open port meeting to reduce operating hours. some in the industry say more effort is to be toward recruiting career lifeguards, watch. >> i think having career lifeguards is something we need to take a look at. i think seasonal lifeguards come in from out of school, colleges and high schools just for summer is great. we all seem to offer them a foundation for the future. parts of the cities across the country also boosting recruitment efforts for new york city for example offering $1000 retention bonus to lifeguards, phoenix, arizona offering a 3000-dollar bonus. here in chicago all beaches will be open starting tomorrow for memorial day weekend. the pools however not scheduled to be open until june 23 that is if they have enough lifeguards. we will send it back to you.

what is the idea behind the messages you guys are putting on the signs? what are you looking to get across? >> internet is really funny. after doing this in 2020 have always used writing as a creative outlet to try and communicate my thoughts. and our community has a lot of language in nomenclature that you typically find there. it's really like a wink and a smile when you or someone using it are talking that way. want to try to tap into that and create a healthy online community where people are connected, share a laugh starts there. let's are talking and laughing the talk about real things like resources that are available to them and organizations that are helping to transition beyond the battle. >> on her tongue and cheek a lot
