but it will get around those spending caps on the bill through emergency supplemental bills. that's her concern. so we are hopeful, we are going to try to ask the speaker about that if he can at least response to that, maybe he'll change nancy mace's mind. >> john: she used a very colorful word we had to beep to describe the bill, actually. a quick vote count. 35 republicans against this, seems to me you have more than 180 votes on the republican side, and a lot on the democratic side. i would think it's probably going to pass, what, high threes, i would think? >> i think you are right on the money here. need 218 right, ok, here he comes, they will lose 30 to 40, they expected and obviously gain bunch of democrat votes, see if we can get him for you here. >> i don't know what you are all
11:01 am
going to do by tomorrow. >> speaker mccarthy, live on fox news. quickly, a quick question, how do you feel about -- ok, so he -- he would not take questions, he said he was in a hurry, had to get to the floor to open it, he's on the way to the floor and we'll listen to his remarks. >> sandra: all business. >> john: it's noted. >> almost reached in, but -- >> john: he's got the capitol police around him, be careful how far you reach in. >> exactly, exactly. >> sandra: thank you, aishah, appreciate that. and off he goes. a live look here at the other direction, as john, we anticipated, this would be a quickly moving couple of hours, we hope to know more soon. >> john: yeah, and again, when you take a look at the votes, if you lose 40, don't forget, it's a bipartisan bill and hakeem jeffries is doing everything he can to sell this to his caucus,
11:02 am
kevin mccarthy has promised at least 150 votes, looks like he's north of 180, if you only have 35 defections, i don't know how many are there today, but 222 in the caucus. so you think that you are just north of 180, you add in the democrats, it's pretty easy to get to 218 on this. the question is, for me, when you take a look at what happened with all the machinations, the vast majority of them now saying we don't like the bill and some saying we should invoke the motion to vacate the chair and mccarthy should go, what is this going to portend for the future for kevin mccarthy in close vote and is controversial. >> sandra: and ro khanna just gave an interview a short time ago saying he is a no, a democrat. is a no on the debt limit deal.
11:03 am
but has "full confidence it will pass the house." he explained his stance on the debt deal and weighed in on whether the white house gave away too much, saying i'm a no but i have full confidence, the president did the best he could under a hostage situation, says ro khanna, and he and his team deserve a lot of credit. it could have been a lot worse. they have a deal that's better, frankly he says, than the deal ten years ago. >> john: as they start to open the floor, interesting they describe it as a hostage situation. what did the republicans do? they passed a bill and said we will allow a raise in the debt ceiling but the conditions putting on the debt ceiling. isn't that what members of congress are supposed to do, not just give you a blank check but to say okay, we'll raise the debt ceiling, allow the government to spend more money but we think some reforms need to take place so we don't spend money like water flowing through the colorado river, particularly
11:04 am
after the snow melt. >> sandra: this is really interesting. he went on to say, and added, the point is, that they have increased defense spending because of the republican extremism while cutting aid to the most vulnerable, having student loan recipients not get continued relief, the mountain view fossil fuel pipeline made permanent. not something most of us can get behind. that is a relevant question to our next guest, john. >> john: yeah, and seems to me if you don't increase defense spending, china will eventually eat our lunch. joining us now is louisiana congressman garrett graves. one of the gop negotiators working behind the scenes on this bill. congressman, why don't you start us off by speaking to all of that, the democrats are accusing you of holding the president hostage from our vantage point, seems like what you did, what members of congress are supposed to do, you wrote up and passed a bill and said here is our
11:05 am
position, what's yours? >> yeah, no, that's exactly what happened here. i think a good way of looking at it is maybe a scenario whereby the child comes to you and says mom, dad, i hit my credit card limit and need help paying my bill this month, so you probably help them pay the bill but you say hey, how did we get here, how did we hit our credit card limit, and run out of money, and we need some budgeting or spending reforms. this president is threatening the future of the country, future of the next generation. every child born in america inherits around $4 million of debt over their lifetime because of politicians, we have to stop that. >> sandra: as far as energy reforms, congressman steil joined us and said the bill is not perfect, he's able to walk away and tout the energy reform that is in this bill. that is obviously something very
11:06 am
important to you. is it far enough. >> the environmental law we amended in this legislation has not been touched in over four decades. we have seen it grow to this just catch all process that reviews absolutely everything. you could look at the process right now when this law was enacted, it took months or maximum of one year to finish an environmental review. today the average road project takes seven years. to put it in perspective, does not matter environmental restoration, solar energy, road project, this bill helps to deliver those projects, projects are not beneficial to taxpayers until they are finished. this puts timelines and limits scope, raises threshold, it's a huge help, but does not fix everything. we are going to do more work on this after. >> john: we started off the conversation by saying the criticism coming from democrats about the republican position,
11:07 am
but you are getting plenty of criticism from republicans about the republican position. listen to what congresswoman nancy mace of south carolina said about this bill. listen here. >> this is a two-year bill and a hope and a dream and handshake that you are going to commit to those spending caps when you may not be in the majority two years from now. it's [bleep], it's a lie to the american people and it's wrong. >> john: she did not hold back in her criticism. what do you say in response? >> look, that's one thing i respect about congresswoman mace, very, very candid in her conversations. but look, here is the thing, what this does is it does limit, it does tie the hands of congress, it does put hard caps on spending in the future. one thing you have to keep in mind, you can't bind another congress, we can only do it through a law and so if someone wants to do a constitutional amendment to require we balance the budget every year i'll vote yes every day of the week. but otherwise the only tools at
11:08 am
our disposal is passing a law to put in caps. that's when this does and in the past it saves money. >> sandra: for those 35 gop nos out there we know of so far, they are responding to the case mccarthy has made it's a conservative bill. you say it's a step in the right direction, you and your colleagues like congressman steil acknowledging it's not perfect. here goes mccarthy live. see if we can catch anything here. let's listen for a second. ok, did not catch him again. but congressman, to your conservative colleagues' points, are you settling? >> hey, look, not at all. so look, you can have people out there saying hey, look, i want to save $100 trillion in savings and all these other things. but the reality is, you got to look at the options that are actually available to you and the options that are available
11:09 am
are default, the options that are available are doing a clean debt ceiling that gives democrats in the white house unlimited spending opportunity or the options available is the bill that we negotiated that results in the greatest savings in american history, the greatest rescission of federal funds given to agencies in history but not just the greatest, take all the other ones combine them, and this one is even greater than that. it results in the first substantial work requirements on welfare programs in over 20 years, the first substantial changes in environmental laws in over 40 years, rescinds funds for irs agents. you can dream all you can dream, but you have to take the options and choose the best one and this is hands down the most historic reforms, the greatest savings in american history and i'm absolutely going to take it. >> john: no question some members of the caucus wanted you to dream bigger than you did. we played the sound from nancy mace there, but you have got
11:10 am
some members of the house freedom caucus saying well, that one vote threshold to vacate the chair, maybe we should exercise that, dan bishop is one of those people. listen to what he said yesterday. >> you plan on filing a motion to vacate? >> i haven't decided that, subsidiary to the point i just made, in conjunction with others. >> john: a little difficult to hear but basically floating the idea of triggering a motion to vacate the chair and some members of the house freedom caucus saying this is exactly what we were worried about when we elected or allowed speaker mccarthy to become speaker, it's time for him to go. he's only been there a few months. what do you say? >> yeah, john, look, that's -- dan bishop, i totally respect and agree with his objectives of saving as much as we can, changing the paradigm of spending in the united states, count agree are month, i'm supporting the bill. in regard to kevin mccarthy, the most remarkable speaker that we have had in modern history, he is the best strategist,
11:11 am
delivered transformational energy legislation, immigration legislation, parents bill of rights, reversing crime laws in d.c. that tried to undermine or basically diminish punishments for penalties, he was able to shepherd through a law that ended the covid emergency against the objections of the administration and others. this is incredible that you go into the guy that's delivering the greatest conservative wins in modern history and say you are going to sack him. as much as i agree with dan bishop on debt, deficit and spending, this one i don't agree, he's wrong, and not a chance that kevin mccarthy is going anywhere. we are going to continue to take the wins under his leadership, under his strategies, it's what is going to transform america. we are going to build upon the success of the debt ceiling 3wi8 and continue marching forward and bring policies forth that make sense for americans and stop punishing families across the country.
11:12 am
>> sandra: it does not appear you are waivering in your yes vote. >> not a chance. >> sandra: reaction to lindsey graham saying why he's going to oppose the deal. he says the defense side is terrible. he said there are some things in the debt deal that are good, acknowledging that. on the defense side it's terrible. some republican leaders say it fully funds defense, that's about as accurate as the border is secure. i'll be opposing it, says lindsey graham. what's your reaction to that? >> look, you know, in this case he's just wrong. the bill increases defense spending, it increases spending for our veterans, and the services that they deserve, where we take the hair cut or where we squeeze spending is the woke spending out of the administration. let me put things in perspective. just on the department of defense, setting aside $886 billion, if you take all of the other nonsecurity funding
11:13 am
programs, 704 billion. robust budget that reflects some increasing security situations around the globe and i'm confident the department of defense can operate under these numbers. >> sandra: do you think it's going to help or hurt the historic inflation americans are living through right now? >> sandra, that's a great question. this is the first step forward, the most historic, the most significant step forward to changing the ways of washington. $2 trillion in savings, this is coming in and putting a handcuff on the administration to where they can't just go wave wands. >> this administration is spending in excess of $10 trillion in the crazy wish list of the inflation reduction act, the infrastructure bill, chips bill, american rescue
11:14 am
plan, reckless irresponsible spending is what caused inflation. incomprehensible energy policy, making us more dependent on china for energy sources, all the policies caused inflation. this begins changing the direction under this speaker we will continue marching the direction that goes toward conservative policies, lowering inflation and creating more opportunity for american families. >> john: we'll see how the markets feel about it tomorrow, at the moment they don't like the process too much, maybe they will buy into the inflation argument. and hakeem jeffries clearly has problems on his left flank as you have problems on the right flank, he said earlier unity is not necessarily uninimty, so maybe will have that in the republican party. >> the white house got schooled in the negotiations, they have to put lipstick on this, a tough time, i get it. >> sandra: jeffries saying biden protected the inflation
11:15 am
reduction, he said biden protected the clean energy tax credits that will be transformational, his word, president biden protected billions of dollars in funding to combat environmental injustice, and biden protected the american people from the types of devastating cuts proposed by right wing extremists. a final reaction to that? >> yeah, absolutely. look, this administration talking about the thing that he's protecting, they are tribal to double and triple down on the energy policies that have caused us to pay higher gasoline prices, higher utility prices, and more dependence on foreign countries for energy. we have come in, repeatedly chipped away at these policies, we are beginning to make changes. we passed hr1, transformational energy policy for the united states, we are pushing the united states senate to act on the bill. we are not letting up on the crazy policies that they are forcing on american families, not yielding any results or outputs beneficial to the country. >> john: we'll be watching the

vote tonight, good of you to spend some time with us. >> thank you. thanks, sandra, john, y'all take care. >> sandra: stunning new report claims tiktok is storing user's personal information on chinese servers. even though tiktok ceo testified before congress two months ago that access to users' data was on an as required basis. and only stored in virginia and singapore. fox business grady is live on capitol hill, meeting the fears of so many right now, grady. they are raising alarm on this, what type of information were the servers actually holding? >> sandra, social security numbers, tax i.d. and other sensitive information needed to pay tiktok influencers and third parties. this is according to the bombshell investigation by forbes. its reporters reviewed a trove of internal documents and what they found is tiktok stored that
11:17 am
info of some of its biggest influencers on servers as you said in china. and employees there had access to it. one who was part of the blitz to woo lawmakers before the ceo testified on capitol hill, he said it came as a surprise to him. and appears to be at odds what the ceo told lawmakers under oath, we should add. >> so you do have access to american data and you have storage of american data. >> american data has always been stored in virginia and singapore, in the past. and access of this is on an as required basis. >> as required of who? >> by engineers for business purposes. it's a private company. >> bytedance? the communist party? >> no, no. >> senator marco rubio says he's going to ask the department of justice to investigate whether tiktok ceo committed perjury in
11:18 am
that exchange at the congressional hearing in march. in a statement, tiktok kept it brief, simply saying we remain confident in the accuracy of his testimony. you'll notice, they don't respond sot allegations in the forbes article but the company has been pushing a plan to oversee u.s. data here in the united states and have a third party company overseeing that data. that's their way to try to appease lawmakers but a lot of them just don't buy that it will stay out of the hands of china. guys. >> sandra: grady, great to see you, live on the hill. thank you. >> john: china's former top doctor breaking with the communist party, he says the wuhan lab leak theory should not be ruled out, even though the chinese government has dismissed that discussion. griff jenkins is live in washington and has the story. what are we learning from the chinese scientist and who exactly is this fella?
11:19 am
>> yeah, good afternoon, john, great question. he was china's counterpart to our dr. walensky, more importantly, the highest chinese official to float the lab leak theory. chinese government may have taken the lab leak theory more seriously than public statements implied and some kind of formal investigation was conducted at the wuhan institute for virology. now he says this, you can always suspect anything that science don't rule anything out, he adds "the government organized something" but he notes it did not involve his china cdc branch and he heard the lab was cleared of wrongdoing. >> there's a gag order on chinese scientists preventing them from saying or writing anything about covid origin.
11:20 am
so this is tricky and there are very legitimate respectable scientists in china, they cannot speak as freely as they would like because of this intense political control, so it's significant he is saying something like this. >> china is blasting the comments saying in a statement to the bbc, the so-called lab leak is a lie, created by anti-china forces. politically motivated and has no scientific basis. this comes, john, just remember a few months ago after christopher wray told bret baier the agency believes it came from the lab incident in wuhan, about you no evidence of that statement has been released. >> john: just remember how crazy people who said that were taken to be back in the spring of 2020. griff jenkins for us, thank you. >> sandra: former president donald trump is promising to end birthright citizenship for children born in the u.s., sure
11:21 am
to draw a legal challenge from immigration advocates as it would change how the constitution's 14th amendment has long been interpreted. mark meredith is live in washington. is this a sign the former president plans to keep immigration front and center in his campaign? >> sandra, sure looks like it. good afternoon to you. of course, former president trump has made immigration a major issue, and now birthright citizenship on day one. >> the policy is a reward for breaking the laws of united states and obviously a magnet helping draw the flood of illegals across our borders. i will sign an executive order making clear to federal agencies that under the correct interpretation of the law going forward the future children of illegal aliens will not receive automatic u.s. citizenship. >> this is not a new idea for trump, he's floated this a few
11:22 am
times before, including when he was in office. in 2018, president trump admitted it would likely be an issue the courts would have to decide. democrats also think it's a nonstarter. tim kaine tweeting birth right citizenship was added to the constitution in 1868 to overturn the dread scott division, which denies citizenship for african american descent, and he says trump wants to roll the u.s. back, hell no. and ron desantis said trump talked about doing this in 15, 18, 19, and 2020, why didn't he. the former president is going to be in iowa later this afternoon, doing a studio interview for a radio station and it's possible he'll talk about the plans but he has been very active on where else but social media attacking his republican competition, just as he's ready to barnstorm the hawkeye state. sandra. >> sandra: mark, thank you. john. >> john: sandra, dawson's creek star james van der beek is
11:23 am
calling out the dnc for not holding primary debates with president biden, asking how is this a democracy? his challengers are also blasting the dnc for not giving them a chance to face off against the incumbent. bring in juan williams, fox news senior political analyst and mark short, former chief of staff to vice president pence, co-chair for advancing american freedom and executive direct for for the coalition to protect american workers. we are out of time after this -- let me play what james van der beek said about the debates. >> i cannot get over the fact the democratic national committee is saying there will not be a debate to decide the nominee for president. are you [bleep] kidding me? there's no debate? over an 80-year-old man who, if he lives will be the oldest
11:24 am
sitting president in the history of the country? dnc is not with the will of the people, no debate, fo democracy. mr. williams for a response. >> i like debates, all for them. i think fox should host them. my sense is this is a political decision, like moving the first primary away from iowa so south carolina, i think it favors the incumbent strongly in terms of the base that will be voting in skoerl versus in an iowa caucus. but the notion of debates would require there be a substantial major challenger, and at this point there is no substantial major challenger. there is robert f. kennedy, jr. and williamson, and i think kennedy is in about 19%, john, or something like that. >> john: what's desantis at? >> i don't know off the top of my head, but trump is at like 50
11:25 am
and i think desantis is 20s, if i'm correct. >> john: high teens in some polls. >> i'm saying, desantis i think is seen as a major challenger to someone who is not the incumbent. and the challenge, if you look back at american history, is that you have someone in the party, it could be ted kennedy against jimmy carter, you know, it could be, you know, a ronald reagan after gerry ford but you have somebody in the party who is of major position holder going against -- this is just is not here in the democratic -- >> john: mark is itching to unload here. >> i don't think democrats want to have joe biden debating other democrats, i think that's pretty clear and evident in all of this. but i can't pile on here. the reality, when you have an incumbent president, he puts his or her person in charge of their party. and so naturally it is somewhat of an incumbent protection party and that's what the democrats are going to do in this. the republicans have a robust series of debates i think we are
11:26 am
all looking forward to. i don't think it's uncommon for the incumbent president not to debate in his own party. >> john: some people say biden should go, over the hill, one of those is pushing j.p. morgan ceo jamie dimon to primary joe biden, a long tweet, potus, joe biden is extremely weak and in cognitive decline, 70% of democrats don't want him to run. it sets up a large opening for a qualified outsider to run as a democrat. he thinks that jamie could beat him in a primary challenge. what do you say? >> i hope he runs his business better than he knows about politics, i don't think jamie dimon would have a shot, period. >> john: we want to jump to the white house, peter doocy is questioning. >> not just about climate, it was about how we foresee the season coming up with
11:27 am
hurricanes, the fires that we have seen across the country, how we are dealing with that in this country in a serious way, protecting lives, protecting communities, thanking the first responders. that's important and americans care about that across the country. we have talked about the bipartisan, part me, budget negotiation, incredibly important, talking about how to deal with the american people in a way that helps all and make sure we do not default. all of those things are important. all of those multiple issues are something that the president has to deal with on a daily basis. >> one more, why hasn't tiktok been banned yet? >> look, as you know there is a review, i'm going to leave it there. it's being reviewed by that committee and so the president thinks it's important issue to deal with, but i just don't have anything else to add beyond that. >> thank you, karine. >> john: so peter doocy getting a couple questions in to karine
11:28 am
jean-pierre, and mark, juan says jamie dimon could not beat biden in the primary and maybe it's true, but the sentiment behind the suggestion from bill ackman, a very deep pocketed guy, and jamie, very deep pocketed guy should run against biden. clearly some big pocketed folks are not happy with him. >> i think we are in a situation that is unprecedented, in his 80s by 2024, high disapproval ratings and leading the front contender on the republican side is a similar scenario. a lot of voters are dissatisfied with options and probably hear more candidates considered to get in. republican field is not full at this point either. the more the merrier, and good for democrats to have a good debate in their party, too. >> john: more the merrier, expecting chris christie to get in next week, who knows who else has yet to jump in, do you
11:29 am
believe that diluting the republican field plays to donald trump strengths? >> no question. look at the math, he has a base, 20, 30% range in terms of republican voters, so it's all to his advantage. now, the problem is for someone like desantis or mike pence is that you get in, and everybody then is looking for the same lane, that lane is i'm not trump, i come with less baggage, more ability, legislative record, whatever, both pence and desantis, former governors. >> john: the hard road and finish off with you, mark, to run here for all the republican candidates. everybody in the republican party liked donald trump's policies, they thought the candidate, the president himself was flawed. so how do you run the same lane as trump in terms of policy but say but i'm not that day. >> i think to juan's point, 25
11:30 am
to 30% base but the market will dictate by the time you get to next january. a lot of time to play out and not all the candidates will be there in january. but i think a lot of us like donald trump's policies when he was president, but he's walked away from the policies. from the guy who, you know, championed the overturning of roe v. wade, he says we need abortion on the negotiating table. he took on russian mercenaries in syria and now welcomes putin in vading ukraine. helped generate economic growth, policies is the same as joe biden. so in essence, trump is not the same person he was as president. >> john: but he did say he could end the ukraine war in an afternoon. >> is that right?
