1:09 pm
according to the government, failed to act. that's going to be one of the keys in this case. the government is going to have to show beyond a reasonable doubt that the action or the interactions of officer peterson is the death of the 70 individuals at that school. eric: he said for example that when the shooting started heat rushed to the building. within the prosecutors say instead of trying to confront the suspect with the service revolver, the video shows him going outside and taking cover. next to another building for 48 minutes. apparently they see peterson instant surveillance video they are turning around. that seems to harm the case. what type of standards you have as a police officer to go and when a suspect is shooting?
1:10 pm
>> under the circumstances, if you know where the shooter is you have a duty morally and legally to go in and try to neutralize the shooter. in this case i think you're going to hear testimony from officer peterson as well as other officers on that scene, they did not know where the shooting was coming from. and as a result of that there is a great deal of confusion. deputy peterson's position from what i understand is that he did in fact take cover. but he continued to try to talk on his radio to try to determine the location of the shooter and to provide other officers coming to that seen the locations of the shooter. eric: there seems to be some confusion or there was initially where the shooter was but let's look at the tam line when shooter suspect was pled guilty. enters a building at 2:16 p.m. you see followed through the timeline when the officer meets

at the building. basically six minutes later. and then he arrives the radius say possible shots fired and then he goes to another building for 48 minutes. prosecutors say there's one radio transmission has peterson saying he thanks the shooter is inside it. is that enough? you wait for backup? do it first swat? for the armored swap base to come in that event: by you yourself? >> excellent question. what you are going to have to look at us what with the reasonable officer due under the circumstances question or if you are deputy peterson you don't over the shooter is in your trying to get other police officers some cover to tell them what is going on, you do that with the radio. as you know they charge here him under this stature in florida. they're going to have a heckuva
