regular hosts said scott wouldn't be a republican if he understood race issues. scott says that's one of the reasons i showed up on the show. he'ed to address joy behar directly but, you know what? she wasn't there because she at takes mondays off. rather than actually work on monday she took it off and watched the other host essentially lecture him for awhile. made some very good points. also, apparently in the studio, a number of times the producer came over and said we have got to take a commercial. and he was like why is it every time i'm making a good point we go to a commercial? >> ainsley: i pulled up a chair in my kitchen and i sat and i turned on my tv. i had a little tv in my kitchen. i thought joy behar was going to be there i know she takes mondays off but i thought she would be there because it's tim scott a presidential candidate and i know he wanted to go on and address that comment, some comments she had made in the past. i watched. he was on for three segments. it started at about 20 after the hour. and i said oh my gosh, i hope i didn't miss him. i turned on the tv he was just

coming on. he was on for the first segment and he talked so long that whoopi said y'all they are in my ear we have to take break. second segment he was on the producer walked out on set and whoopi said come on out and tell him is he a talker. is he running for president this is his chance. he came on for a third seeing: he did a great job. we have all interviewed him. is he just a nice person. is he a really strong christian from south carolina. he was strong. he was kind. he came prepared. he had his statistics. he knew the statistics about african-americans and how well they are doing in the workforce. and he really defended the fact that he said we -- y'all keep saying we are the exception and not the rule and he said no. he said we are the rule now. we have had an african-american president. a vice president, two secretary of states. he talked about the number of senators that are black that have served over the last 10 years and it's more than 50% that have ever served. he said, you know, we are in the right direction, headed in the

right direction. >> brian: not perfect but working our way that way. if you have perspective on where we have been from fighting in 1865 for freedom for all, so the big compromise setback in 1875. they gave us separate but equal in jim crow. and the civil rights adjustments in the 1960s that many people look at to be analyzed but the intention might have been great but the results were not. now you have a situation where if there are racists out there? understood. there is unfairness in the world. i get it. what tim scott's message is. overcome it. can you do it. i can do it. so many other people have done it. never say america is perfect. the most successful multi cultural country in the miss visit world. i walked to his house. you walked to his house. instead of fixing it. they wrecked it. his whole neighborhood is really dilapidated where he grew up. he never let it bother him and he overcame it. this is the moment that tim scott needed to establish themself. is he going to oroll out with a whole bunch of marketing and

♪ >> ainsley: welcome back. we are out here on the fox square. we have paris baguette who have set up shop here. it is wonderful. thank you all for being here. we have so much fun. isn't it nice to be here? we have this panel of ladies. the former high school track athletes are continuing to fight for fairness in women's sports in their home state of kentucky. today for the second time a a federal appeals court challenging their case to allow gender identity. we have chelsea mitchell, celina seoul and alanna smith joining us now and senior counsel christiana kiefer. thank you for being here. >> thank you. >> ainsley: chelsea, i will start with you were running track in high school and what

happened? tell us your story. >> i raced against two biological males all four years of high school. i lost medals, podium spots. advancement opportunities and eventually i lost four state championships to these two biological males. >> ainsley: how did you feel about that? >> it was heart-breaking all the work i put in to get to those state championships to be in the running to win and have that taken away from by a male time and time between was devastating and hard to get up after that. >> ainsley: celina, i know you experienced the same thing in connecticut. you are in college now. you were one of the first ones to speak out why? >> it was important for me to voice my opinion and say that women's sports need to be protected because i lost out on countless opportunities, most notably qualifying for the 2019 england championships. i had to go in two other events where i honors and forced under the sideline in my own event. it was a cefs stating experience to have to go through. i wanted to ensure no other girl had to experience the pain and heart break went through what i went through in high school.

>> there was a lot of silence about this and whispers of support. you are encouraging other women to come out and talk about this. it's an issue that is affecting your lives. >> i was really nervous at first once i saw celina doing and it all the news articles and being that she was kind of all alone, i wanted to speak up about it. and i hope speaking out about it will help other female athletes speak up so we don't become sidelined in our own sport. >> ainsley: did you have conversation with the biological men? did you all become friends? i'm they're stronger. >> injuries are a threat in team sports. we all do track and field where there is not that much of a risk. bask, lacrosse, sock ear girl could be severely injured. it's important that women's sports stay womennen sports. because men have many physical advantages over us girls. >> ainsley: i know aible pa of three judges heard this in december. now they are revisiting. this how rare is that? >> that's extremely rare. >> what does that mean for this case. >> i think it means that the

entire second court of appeals is taking a really close look at the panel's decision. they got it wrong. essentially what they said is girls lost opportunities and athletic records didn't matter. we know that's not the case. we are excited to be in court today and to make the case that the hard work celina, kelsey and alanna and so many girls across the state of connecticut put in matters and we want to see their records rightly recognized. >> ainsley: what is the solution. >> we think the clear solution is women and girls should have a protected category because males are bigger and faster and stronger than they are. girls shouldn't have the injustice and egg indignity to compete against biological men. >> ainsley: have you gone around the country and talked about this? obviously you are national television have you met with riley gaines. >> i have gotten to meet with her a couple of times. i'm thankful she saw what i was doing and decided to join the fight. it will be easier to fight this with the more voices that we have. >> ainsley: when do we find out today? >> we won't likely get a decision today. in the weeks and months ahead.
