great to have you. >> bill: great to be with you. i'll bill melugin. the house oversight committee will hold a hearing on thursday if it votes to hold director wray in contempt the measure goes to the full house where speaker mccarthy has vowed to support it. >> dana: unprecedented move stemming from a fight over a document an unverified tip accusing then vice president biden of accepting a bribe. >> the f.b.i. allowed committee leaders to look at it in a secure room but republicans say that is not good enough. >> dana: jamie raskin suggested the bureau had dismissed the allegations, comer strongly disagreed. >> the investigation is not dead. this is only the beginning. it appears this investigation is part of an ongoing investigation which i assume is in delaware.

so we feel that this accusation is consistent with the pattern we're seeing frankly in other countries. >> i understand the chairman has been saying that this is now part of an ongoing criminal investigation or prosecution. i didn't pick that up. if it's true, all the more reason that specific documents should not be released from the investigation. >> bill: former director of national intelligence john radcliffe is here to react. we'll send it to griff jenkins in washington. >> good morning. this document in question known as a 1023 form dated june of 2020 reportedly alleges that then vice president biden was involved in a bribery scandal. f.b.i. director wray made it available for viewing for the committee chairs but says he can't hand it over without compromising sources. speaker mccarthy isn't buying that. >> this document is not even

classified. what's the first thing that director wray said? he didn't acknowledge whether he had it. he said he wouldn't provide. i explained to him if he doesn't provide it we'll hold him in contempt. now he said yes, we do have the document but only show it to the chairman and ranking member. that's not how the constitution works. >> after committee raskin and comer were able to view the document they walked away with differing views. with raskin claiming the investigation was actually closed. >> what i know is that the f.b.i., department of justice team under barr and brady in the western district of pennsylvania terminated the investigation. they said there were no grounds for further investigative steps so they ended that. >> sources tell fox news that's not accurate. the 1023 in question was flagged and sent to a u.s. attorney in delaware who continues to look into allegations to this day

including the business dealings of hunter biden. the white house has a statement saying another stunt changed by comer to spread innuendo to try to damage the president politically and get himself media attention. as to what's next, mccarthy has made it clear if wray doesn't produce this document in the next 48 hours, they will move forward with a contempt vote on thursday. we'll see what happens. >> bill: interesting how two congressman look at the exact same document but come away with two different conclusions from it. griff jenkins live in d.c. >> dana: john radcliffe joins me now. let's put that document on the board for everyone to see. may three comer issued a subpoena and sets deadline for wray and mccarthy attempted to mediate that dispute. may 30th f.b.i. tells fox news

agency is committed to cooperating and then wray has a phone call with comer to discuss the file and one more step. wray says comer and raskin you can both come and see the document. is wray trying to provide the committee with what it is asking for without overstepping a line that he thinks would protect an investigation or the institution of the f.b.i.? >> well, dana, i think this fd1023 form is an important piece of evidence for two different stories. one obviously to the extent there is any veracity to it and it documents a $5 million bribe to then vice president joe biden, obviously that's a blockbuster. but it is important in evidence how it was treated by the f.b.i. and whether there is another instance of a scandal or abuse by the f.b.i. for political reasons.

remember in 2016 as the durham report and the inspector general report both document, the f.b.i. opened a full field investigation on russian collusion on inverified and unvetted information that literally potentially interfered with the 2016 presidential election. in 2020 f.b.i. agents went to twitter and suppressed the truth about the hunter biden laptop while amplifying a lie it was russian disinformation. if this turns out the fd1023 form from a credible source was somehow buried, i think that's one of the reasons that this contempt proceeding is moving forward regardless of the fact that chairman comer has now seen the document. >> dana: chairman comer, i want to ask you about two people can look at something and come away with different conclusions, we do know that. comer says he believes there is an investigation underway. raskin said he didn't think there was.

i wonder what you think of his point when he said if there is indeed an ongoing investigation, then doesn't that mean this document should not be more widely dispersed? >> so two points on that, dana. first of all, jamie raskin was refuted by director wray himself. so in the meeting that he had with both of them he didn't lead with look, this is a form that came from a highly credible source but in this case there is no merit to it. he didn't say that. in fact, he intimated it was part of some ongoing investigation that was already taking or continuing to take place. the further problem that director wray has on that point about sources and methods is the f.b.i. has been caught using that as both a sword and shield. so director wray with regard to the issue of fisa abuses said

we'll jeopardize sources and methods. people may lose lives but what it revealed is 17 violations of law by the f.b.i. and what resulted in a felony conviction. the contrary with regard to mar-a-lago, within 48 hours f.b.i. agents, the only ones with access to photographs, top secret documents at that time, those were all over the internet and no talk about protecting sources and methods and lives being in danger. it is using a sword and shield as convenient. what speaker mccarthy is focused on here, dana, i think in backing jamie comer in this contempt proceeding is send a message, a couple of them. send a message to the f.b.i. for the next two years we're not going to let you get away with what is perceived to be a two-party system or approach to these investigations where the f.b.i. is being political. i think he is also sending a message to his both republican base and the american public at large that look, we want an

we have to stress what governor newsom said of governor desantis. he called him a small, pathetic man. that's an attack that is extraordinary. but he also said he was guilty of borderline human trafficking. you know, state sanked kidnapping is not a public policy choice. immoral and disgusting. i absolutely believe that. there is now the san antonio district attorney in texas, a state you know well, bill, has decided that it was probably kidnapping when governor desantis sent that first batch of texas migrants to martha's vineyard. what in the world is desantis doing getting involved, chartering private planes to take migrants to these high-profile locations? why? just to make a political point. he is using these human beings as political pawns. i think it really is low down and dirty.

it takes to take former president donald trump head on. this is what we know about tonight's announcement and how things play out later this evening. the former new jersey governor is expected to jump into the race taking the stage during a town hall at the new hampshire institute of politics. it comes as christie is spending more and more time in new hampshire already at his second town hall in the state so far this year. he focused his campaign in 2016 but came in 6th in the primary and dropped out of the race later endorsing former president trump. since then he slammed the former president for a lot of things including january 6th and claiming the election was stolen. the former governor and federal prosecutor wanting the take trump on. he is not a paid assassin he knows trump better than anyone. >> i think chris christie is getting in it to attack trump. i don't think he has any real goals trying to become president. i think it is more of taking someone he doesn't like down.

independent. foreign policy. if you go after president trump who has a solid 33 or 35% in new hampshire, people appreciate what he has done in the past but they don't want to look to the past. they want to look to the future. a lot of the candidates running need to point out some of the things that he did not follow through on. whether it was completing the border wall, not paying for it. sitting next to fauci and giving him awards and obviously pushing for that agenda. a lot of things you can go after the president about. i noted you have chris christie. he is probably one of the only guys that actually has gone up against president trump in real life in debate. the other ones don't that have experience and don't know what it is like. if chris christie will make a difference he has to do what he is starting to do. no better town hall person than chris christie. he has to camp here and live here and do the town halls. that's his brand. people dig it. >> dana: there is rnc debate rules to see if that will

being forced to enable addicts? >> those of us in new york city know we pay such high taxes in the city. so much of our tax money is being mismanaged because they are not treating addiction properly. you know, it is harm reduction is one thing. great in theory, but it is not practical the way they're doing it in places like new york city, l.a. san francisco. needle drops are great. you don't want people dying of opioid overdoses but at the same time, you want to reduce drug use. they are not really tackling that. they have plenty of bureaucracy. they have social workers, you have cops, they could be working together better to identify addicts and get them into treatment. that's the big piece of the puzzle that's missing. you don't want to send people to prison. i agree you don't want to overincarcerate people who are

sick and need treatment. the problem is just giving them free stuff doesn't get them better. that's a massive piece. the humane piece that we are missing from this entire equation. >> dana: what the "new york post" is getting at is you know portland very well. is this the next step to getting to a point where you are helpless and you have a city where you are going to have these addicts and you are giving up? >> it is a way of giving up and ab solving yourself so you don't have to do the hard work which is identifying and treating. we don't have mechanisms to get people into addiction treatment so they can overcome these problems. and you have after the pandemic so many people who are now mentally ill, not getting treatment for it. they find cheap drugs on the street. they steal stuff from stores and drugstores in order to sell it to get more drugs. but we're not arresting serial offenders and we aren't helping
